which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to make permanent certain telehealth flexibilities under the Medicare program.</official-title></form><legis-body id="H68DCA977B1E34EE6A40088023D89611F" style="OLC"><section id="H1EAFFF49607544D9B12FE960BB02757A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Telehealth Modernization Act of 2024</short-title></quote>.</text></section><section id="H3904135706694EE1BC6E4D422778D356"><enum>2.</enum><header>Extending Medicare telehealth flexibilities</header><subsection id="H24AAFB79126E463287C432FD85164EA6"><enum>(a)</enum><header>Expanding access to telehealth services</header><paragraph id="H48E0D8C1519747B881253EDF370C433F"><enum>(1)</enum><header>In general</header><text>Section 1834(m)(4)(C)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(C)(iii)</external-xref>) is amended by striking <quote>In the case that</quote> and all that follows through <quote>2024,</quote> and inserting <quote>Beginning on the date of the enactment of the Telehealth Modernization Act,</quote>. </text></paragraph><paragraph id="H5C50A4DD6F8B4031B7DE70F28F7222C1"><enum>(2)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><subparagraph id="H32FEB2686BF545CBA2C9DF381CEECABB"><enum>(A)</enum><text>in paragraph (2)(B)(iii), by striking <quote>In the case that</quote> and all that follows through <quote>ending December 31, 2024,</quote> and inserting <quote>With respect to telehealth services furnished on or after the date of the enactment of the Telehealth Modernization Act,</quote>; </text></subparagraph><subparagraph id="H96FBB4569E0041AE983F5877D38CD3CE"><enum>(B)</enum><text>in paragraph (4)(C)(ii)(X), by striking <quote>, but only for purposes of section 1881(b)(3)(B) or telehealth services described in paragraph (7)</quote>; </text></subparagraph><subparagraph id="H9318CAB2210D42639E2EF1CF1D8F2CDC"><enum>(C)</enum><text>in paragraph (5), by inserting <quote>and prior to the date of the enactment of the Telehealth Modernization Act,</quote> after <quote>January 1, 2019,</quote>;</text></subparagraph><subparagraph id="H29ECF755A9804A8BB6C92CF5C3F88175"><enum>(D)</enum><text>in paragraph (6)(A), by inserting <quote>and prior to the date of the enactment of the Telehealth Modernization Act,</quote> after <quote>January 1, 2019,</quote>; and</text></subparagraph><subparagraph id="H549B4DB5AC874238BF46286D976E0A5F"><enum>(E)</enum><text>in paragraph (7), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HFA77BD9F8E4E434289F4F4C9DBE341A8" display-inline="no-display-inline"><subparagraph id="HEA302B7B5F8F4C6D9573555AEC027079"><enum>(C)</enum><header>Sunset</header><text display-inline="yes-display-inline">The provisions of this paragraph shall not apply with respect to services furnished on or after the date of the enactment of this subparagraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H4EAFBC8844EA46CAAB8FB8643BFFC7F0"><enum>(b)</enum><header>Expanding practitioners eligible To furnish telehealth services</header><text>Section 1834(m) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)</external-xref>) is amended—</text><paragraph id="H5674AD7B35C84F73B6960E65CCF65755"><enum>(1)</enum><text>in paragraph (1), by striking <quote>(described in section 1842(b)(18)(C))</quote> and inserting <quote>(defined in paragraph (4)(E))</quote>; and</text></paragraph><paragraph id="HA9791218EAF74F16B537AE107E3040A4"><enum>(2)</enum><text>in paragraph (4)(E)—</text><subparagraph id="H4FA86523FC77488E97600B3FD43ABE97"><enum>(A)</enum><text>by striking <quote><header-in-text style="OLC" level="subparagraph">practitioner</header-in-text>.—The term</quote> and inserting “<header-in-text level="subsection" style="OLC">practitioner</header-in-text>.—</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9ECA32CAF6F04D66B6AFBE98FE153230"><subparagraph id="HAA52D0FD06424902B4C098689BEBB26D"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term</text></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="H93F206318FF442879811D674305E1760"><enum>(B)</enum><text>in subparagraph (A), as so inserted, by striking <quote>, in the case that the emergency period described in section 1135(g)(1)(B) ends before December 31, 2024, for the period beginning on the first day after the end of such emergency period and ending on December 31, 2024,</quote>; and </text></subparagraph><subparagraph id="H290EE37DD1BC4B9AAF26B4C12FA6E193"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H44BCC5491C734D43B19AD20EE85C6416"><subparagraph id="H99409AE0862E4BBB9EA40C699AEFAD7D"><enum>(B)</enum><header>Expansion</header><text>The Secretary, after consulting with stakeholders regarding services that are clinically appropriate, may expand the types of practitioners who may furnish telehealth services to include any health care professional that is eligible to bill the program under this title for their professional services.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HEA704D4160774477B7E0AB291E33E7DD"><enum>(c)</enum><header>Retention of additional services and subregulatory process for modifications following emergency period</header><text>Section 1834(m)(4)(F) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(4)(F)</external-xref>) is amended—</text><paragraph id="H8BDC497D20F1461387458E30F8799144"><enum>(1)</enum><text>in clause (i), by inserting <quote>and clause (iii)</quote> after <quote>paragraph (8)</quote>;</text></paragraph><paragraph id="H0040FFC49A2549A6A797500DB0C4B1D2"><enum>(2)</enum><text>in clause (ii), by striking <quote>The Secretary</quote> and inserting <quote>Subject to clause (iii), the Secretary</quote>; and</text></paragraph><paragraph id="HAB533BC727894264AE5BDA314E8C75FC"><enum>(3)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6A639933BA3C4EAD82B2F9B7932A4A35"><clause id="H6C6A46D7088E4E5289079A9026C71D4A"><enum>(iii)</enum><header>Retention of additional services and subregulatory process for modifications following emergency period</header><text>With respect to telehealth services furnished on or after the date of the enactment of this clause, the Secretary may—</text><subclause id="H70389711EED248A2BD5C44290A56742E"><enum>(I)</enum><text>retain as appropriate the expanded list of telehealth services specified in clause (i) pursuant to the waiver authority under section 1135(b)(8) during the emergency period described in section 1135(g)(1)(B); and</text></subclause><subclause id="H6D85D0F095CE4E7AAC0FD391942AB221"><enum>(II)</enum><text>retain the subregulatory process used to modify the services included on the list of such telehealth services pursuant to clause (ii) during such emergency period.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE4B5603BE78948389F84B84E74079E7F"><enum>(d)</enum><header>Enhancing telehealth services for federally qualified health centers and rural health clinics</header><text>Section 1834(m)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(8)</external-xref>) is amended—</text><paragraph id="HC045BD81F4EA4AC9A130A6DC9BEC8E08"><enum>(1)</enum><text>in subparagraph (A), in the matter preceding clause (i), by striking <quote>and, in the case</quote> and all that follows through <quote>2024—</quote> and inserting <quote>and after such period—</quote>; </text></paragraph><paragraph id="HBA83576AB7FC4C15B7F1A1C9339E2188"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="HB21020541C4E43E8AC86B23C32CF5696"><enum>(A)</enum><text>in the header, by inserting <quote><header-in-text level="subparagraph" style="OLC">before 2025</header-in-text></quote> after <quote><header-in-text level="subparagraph" style="OLC">rule</header-in-text></quote>; and</text></subparagraph><subparagraph id="HEF22797D8FE747D49EA92FAD8C5A9C52"><enum>(B)</enum><text>in clause (i), by striking <quote>during the periods for which subparagraph (A) applies</quote> and inserting <quote>before January 1, 2025</quote>; and</text></subparagraph></paragraph><paragraph id="H3D35A528E7C84C5F9C686AF58A41CCC8"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H1E2DBEE64ECF4F8483444E1D3AC2FC82" display-inline="no-display-inline"><subparagraph id="HDFA85A2EA7884440B4C61866E5A14380"><enum>(C)</enum><header>Payment rule for 2025 and subsequent years</header><clause id="H63C643571553441E86FA3617583FEE35"><enum>(i)</enum><header>In general</header><text>A telehealth service furnished to an eligible telehealth individual by a Federally qualified health center or rural health clinic on or after January 1, 2025, shall be deemed to be so furnished to such individual as an outpatient of such center or clinic (as applicable) for purposes of paragraphs (1) and (3), respectively, of section 1861(aa), and payable as a Federally qualified health center service or rural health clinic service (as applicable) under the prospective payment system established under section 1834(o) or the payment methodology established under section 1833(a)(3), respectively.</text></clause><clause id="HEF76431EFB4D4D6880C237F704548B96"><enum>(ii)</enum><header>Treatment of costs</header><text display-inline="yes-display-inline">Costs associated with the delivery of telehealth services by a Federally qualified health center or rural health clinic on or after January 1, 2025, shall be considered allowable costs for purposes of the prospective payment system established under section 1834(o) and any payment methodologies developed under section 1833(a)(3), as applicable.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H16F6D27F5C0142459AD90962B3EF46C7"><enum>(e)</enum><header>Use of telehealth, as clinically appropriate, To conduct face-to-Face encounter for hospice care</header><text>Section 1814(a)(7)(D)(i)(II) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395f">42 U.S.C. 1395f(a)(7)(D)(i)(II)</external-xref>) is amended by striking <quote>, and, in the case</quote> and all that follows through <quote>ending on December 31, 2024,</quote> and inserting <quote>and after such period, as clinically appropriate,</quote>. </text></subsection><subsection id="H9C9E43B6D44C4AB5941C481F704F8244"><enum>(f)</enum><header>Use of telehealth, as clinically appropriate, To conduct face-to-Face clinical assessments for home dialysis</header><text>Clause (iii) of section 1881(b)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395rr">42 U.S.C. 1395rr(b)(3)(B)</external-xref>) is amended—</text><paragraph id="H9B373652D26D46E18BC776FA3C53A308"><enum>(1)</enum><text>by moving such clause 4 ems to the left; and</text></paragraph><paragraph id="HAF2E96E0F40244FFAB339FD7CA7F22BA"><enum>(2)</enum><text>by inserting <quote>and after such emergency period as clinically appropriate</quote> before the period.</text></paragraph></subsection><subsection id="HDA1B3DACBCE34503A787EE293E855D21"><enum>(g)</enum><header>Allowing for the use of audio-Only telecommunications technology</header><text>Section 1834(m)(9) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(9)</external-xref>) is amended—</text><paragraph id="H6CD1A329A1524C92AF330250A52ABA4D"><enum>(1)</enum><text>by striking the first sentence and inserting the following: <quote>The Secretary shall provide coverage and payment under this part for telehealth services identified in paragraph (4)(F)(i) as of the date of the enactment of this paragraph that are furnished via an audio-only communications system.</quote>; and</text></paragraph><paragraph id="H286A06CBF0D840448931EEC46E748F68"><enum>(2)</enum><text>in the second sentence, by striking <quote>during such emergency period</quote> and inserting <quote>during the emergency period described in section 1135(g)(1)(B)</quote>. </text></paragraph></subsection><subsection id="HE085229E94094F08BC834D1204D49582"><enum>(h)</enum><header>Implementation</header><text>Notwithstanding any provision of law, the Secretary may implement the provisions of, and amendments made by, this section by interim final rule, program instruction, or otherwise. </text></subsection></section></legis-body></bill>
