Short title

This Act may be cited as the Presidential Budget Accountability Act.

Prohibition on pay for President and senior Executive branch officials if President’s budget not submitted on time

(a)

Prohibition

Notwithstanding any other provision of law, if the President does not submit to Congress the budget for any fiscal year on or before the first Monday in February of any calendar year as required under section 1105(a) of title 31, United States Code, during the period described in subsection (b)(2) the President and any senior official may not receive any pay. In this subsection, the term senior official means any member of the President’s cabinet.(b)

Escrow for Presidential pay

(1)

In general

In order to ensure that this section is carried out in a manner that shall not vary the compensation of the President in violation of clause 7 of section 1 of article II of the Constitution of the United States, if by the first Monday in February of any calendar year the President has not submitted the annual budget for the fiscal year beginning on October 1 of that year as required under such section 1105(a), during the period described in paragraph (2) the appropriate payroll administrator shall deposit in an escrow account all payments otherwise required to be made during such period for the compensation of the President, and shall release such payments to the President upon the expiration of such period.(2)

Period described

The period described in this paragraph is the period which begins on February 6 of such calendar year and ending on May 6 of such calendar year.(c)

Application

This Act shall apply with respect to the President’s annual budget submission under such section 1105(a) for fiscal year 2025 and each fiscal year thereafter.
