which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Transportation to issue a notice of proposed rulemaking with respect to categorical exclusions of the Maritime Administration, and for other purposes.</official-title></form><legis-body id="H70D8F14E29EE4EECA07445EF40275A58" style="OLC"><section id="H96476EFCA5574887BD9F3C9F35889EF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Port Optimization for Responsible Transportation Act</short-title></quote>.</text></section><section id="H8683ACE13A3C4B3D80687A4512D656EB" section-type="subsequent-section"><enum>2.</enum><header>Maritime administration</header><subsection id="H01C5A7CD7D064B4E842D51157E65CE81"><enum>(a)</enum><header>Categorical exclusions</header><paragraph id="H2E08B6C306324CD9A476EBFF4B82CF8E"><enum>(1)</enum><header>Reciprocal use of categorical exclusions</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Secretary of Transportation shall issue a notice of proposed rulemaking to establish that the Maritime Administrator shall approve any action qualifying as a categorical exclusion established by the Federal Highway Administration, the Federal Transit Administration, or the Federal Railroad Administration, as outlined in part 771 of title 23, Code of Federal Regulations, when the applicable requirements of that categorical exclusion have been met.</text></paragraph><paragraph id="H11D9080C41FE46CF914CA24DA01C2FAD"><enum>(2)</enum><header>New categorical exclusions</header><subparagraph id="H3F4432BABD844079A1391D3AAA425983"><enum>(A)</enum><header>In general</header><text>Not later than 6 months after the date of enactment of this Act, the Secretary shall publish a notice of proposed rulemaking to propose new Maritime Administration categorical exclusions for port authority projects that require the approval of the Secretary under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph><subparagraph id="H97D386FBFB234FB2935310BE9824904B"><enum>(B)</enum><header>Expanding list</header><text>The Maritime Administration's list of categorical exclusions shall be expanded with the goal of having a list that allows the Maritime Administration to issue categorical exclusions that maritime port authorities would typically use, independently of the lists of other Department of Transportation modal agencies, including categorical exclusions—</text><clause id="H69B11C5FC299420487DE78BBA9CC8E89"><enum>(i)</enum><text display-inline="yes-display-inline">corresponding to project types that have typically been granted a Finding of No Significant Impact in past Maritime Administration-granted projects and could feasibly be categorical exclusions; and</text></clause><clause id="H7F8484DE979B4136BDFA9534F56B1186"><enum>(ii)</enum><text>that the Secretary determines would be useful to maritime port authorities in the course of Federal grant-funded projects.</text></clause></subparagraph></paragraph><paragraph id="H1798302C3ECA45D399A1936C2AFCD888"><enum>(3)</enum><header>Process for regular updates</header><text display-inline="yes-display-inline">The Secretary shall include in the rule required by paragraph (2) a process by which the Maritime Administration will update the list of categorical exclusions every 4 years to reflect lessons learned in grant administration and project construction that lead to new efficiencies in the requirements of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>). </text></paragraph></subsection><subsection id="H963369DF8B304A38A05F0E1F1FDC112B"><enum>(b)</enum><header>Application timelines</header><text display-inline="yes-display-inline">Section 54301(a)(5) of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H1FCC1629B6804BC2BE4B768782772E2E" display-inline="no-display-inline"><subparagraph id="HA6F67A667DE348C8AF459E172FF3A062"><enum>(C)</enum><header>Delayed notice of funding opportunity</header><text display-inline="yes-display-inline">If an amendment is made to a published solicitation for grant applications such that an applicant would need the information contained in the amendment to draft an application, other than an amendment of the amount of grant funding available, the Secretary shall extend the application deadline by the number of days between the initial solicitation and the amendment.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H28B11ACCCFD94B9F9D04E4F78F0C3F1B"><enum>(c)</enum><header>Project budget reviews</header><text display-inline="yes-display-inline">Section 54301(a)(9) of title 46, United States Code, is amended—</text><paragraph id="HAC2E98376D5C4D9D895E04606441BC5F"><enum>(1)</enum><text>in subparagraph (B) by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H6BAB57646E9349EFA13953449AC206CA"><enum>(2)</enum><text>in subparagraph (C) by striking the period at the end and inserting <quote>; and</quote>; and </text></paragraph><paragraph id="H689F5EB8E96148EF899063E1BCE2270E"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HA66AA1D4EEB1412380F095FE782FCA67" display-inline="no-display-inline"><subparagraph id="HACC746DC5E3D4DA2A39F40FF62A17B9D"><enum>(D)</enum><text display-inline="yes-display-inline">grant contracts are approved efficiently by the Secretary, minimizing delays for minor adjustments to project scopes and budgets due to inflationary effects on projects. </text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H0DB7BB0D46AC4CC6A83D8B3DF30EF3A2"><enum>(d)</enum><header>Staffing and grant timelines</header><text display-inline="yes-display-inline">Section 54301(a)(11) of title 46, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H83196A9F8BBC4CB884DF0413C23A21B5" display-inline="no-display-inline"><subparagraph id="H548B9AA307B94F768384100167713D8C"><enum>(C)</enum><header>Administrative and oversight report</header><text display-inline="yes-display-inline">Not later than 365 days after the date of the enactment of this subparagraph, and each year thereafter, the Secretary shall submit to Congress a report on the average length of grant obligation timelines and the nature of any staffing shortages relevant to administering this program.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H8264DCE172824313A1082C13D640841C"><enum>3.</enum><header>Federal permitting improvement steering council</header><text display-inline="no-display-inline">Section 41001(6)(A)(i)(II) of the FAST Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m(6)(A)(i)(II)</external-xref>) is amended by inserting <quote>, except for projects sponsored by a port authority</quote> after <quote>$200,000,000</quote>. </text></section><section id="H6B31B2EF66BC47D7B46E8320391A7E60"><enum>4.</enum><header>Build America Buy America</header><subsection id="H727D51E7107C444DB80961399D22277C"><enum>(a)</enum><header>Limited waivers</header><text display-inline="yes-display-inline">Section 54301(a)(11) of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HE09FDE1A05F24F4E9A98B7779EEB7190" display-inline="no-display-inline"><subparagraph id="H2BBE08A6A5B84E52AFF9B88ED079E7D0"><enum>(C)</enum><header>Certification of domestic supply</header><text display-inline="yes-display-inline">If the Secretary denies an application for a waiver under the procedures outlined in section 8301 of title 41, the Secretary shall provide to the applicant a written certification that—</text><clause id="HDDEF3DC01E904767951B006B830B0E21"><enum>(i)</enum><text>the steel, iron, or manufactured goods, as applicable (referred to in this subparagraph as the <quote>item</quote>), is produced in the United States in a sufficient and reasonably available amount;</text></clause><clause id="H260D1F394C794CAF8597EB9E5E4E0880"><enum>(ii)</enum><text>the item produced in the United States is of a satisfactory quality; and</text></clause><clause id="H564BC6829F7C4E82BA2AA89A8729EEEE"><enum>(iii)</enum><text>includes a list of known manufacturers in the United States from which the item can be obtained.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC1859DE6BFCA4C0599DCB794C0DAE84A"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that, to build the necessary domestic manufacturing capabilities, port authorities should be permitted to make group or pooled purchases of equipment, also known as <quote>piggybacking</quote>, in which the post-award use of a contractual document allows multiple port authorities to purchase the same supplies or equipment through the original contractual document.</text></subsection></section></legis-body></bill>
