Review of discharge or dismissal.</toc-entry></toc></subsection></section><section id="H9C3EF4F7AFD1421B9039C7D98F1CD753" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HF1BB81BFF6E24233BF8D8A462ECE3767"><enum>(1)</enum><text>In 2014, the Coast Guard initiated Operation Fouled Anchor, an investigation that revealed reports of rapes, sexual assaults, and other forms of harassment at the Coast Guard Academy from the 1990s until 2006.</text></paragraph><paragraph id="HE1CC5E1B7DFF4829A0816933A5A8D581"><enum>(2)</enum><text>During the period investigated, and partly driven by efforts to protect the reputation of the Coast Guard, the Coast Guard repeatedly mishandled cases of sexual assault, failed to protect victims, and did not hold perpetrators properly accountable.</text></paragraph><paragraph id="HBD78DDA963354B4C9FCAC159850F4315"><enum>(3)</enum><text>Furthermore, until prompted by a news report published in 2023, the Coast Guard buried the findings of Operation Fouled Anchor by failing to share the findings with Congress and the public, and neglected to make needed reforms and cultural changes within the service.</text></paragraph><paragraph id="H088980F131BB4427B78C1D9785CBD084"><enum>(4)</enum><text display-inline="yes-display-inline">In November 2023, the Coast Guard published an Accountability and Transparency Review. As a result of the review, the Commandant of the Coast Guard directed the implementation of actions in support of the Accountability and Transparency Review. The directed actions include structural changes, training improvements, and greater support and guidance for members of the Coast Guard who are victims of sexual assault and harassment.</text></paragraph><paragraph id="H29DB617734924951B5DD21D8ABD3EB99"><enum>(5)</enum><text>To ensure public confidence in the service, the Coast Guard requires additional oversight and accountability to affect the improvements and protections deserved by service members of the Coast Guard.</text></paragraph></section><section id="H7602C05E92C6459DB0A7332081F7E6F4"><enum>3.</enum><header>Implementation status of directed actions</header><subsection id="HE6BEDF78CEA14B52A0FFD7048C0D40A6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/51">Chapter 51</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H257524D61EF0447F962560C918CEE55A" display-inline="no-display-inline"><section id="H712DAD5AC7EB44D7B9584DECD3FD9E86"><enum>5116.</enum><header>Implementation status of directed actions</header><subsection id="H6C4A3BD936F74D47AFEF39D8EADE09AD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than March 1, 2025, and not later than March 1 of each of the 3 subsequent years thereafter, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report on the status of the implementation of each directed action outlined in enclosure 1 of the memorandum of the Commandant titled <quote>Commandant’s Directed Actions—Accountability and Transparency</quote>, dated November 27, 2023.</text></subsection><subsection id="HFB1D8E07186F4342A27DA251507821B3"><enum>(b)</enum><header>Contents</header><text>The report required under section (a) shall contain the following:</text><paragraph id="H8643ECC435AF43BBB1ACB788F7D32F2F"><enum>(1)</enum><text display-inline="yes-display-inline">The status of the implementation of each directed action from enclosure 1 of the memorandum titled <quote>Commandant's Directed Actions—Accountability and Transparency</quote> dated November 27, 2023.</text></paragraph><paragraph id="HD2C9CA1EAFA944318B1E1D258F73E7A5"><enum>(2)</enum><text display-inline="yes-display-inline">A plan and timeline for the next steps to be taken to complete outstanding directed actions in enclosure 1 of the memorandum titled <quote>Commandant's Directed Actions—Accountability and Transparency</quote> dated November 27, 2023, including identifying the individual the Commandant has selected to ensure the successful completion of each directed action.</text></paragraph><paragraph id="HFF914286E26B49F09588FC226C37F2E8"><enum>(3)</enum><text display-inline="yes-display-inline">Metrics to determine the effectiveness of each directed action in such enclosure.</text></paragraph><paragraph id="H8FC9CDF0334F40ED8FDF485CABE63FB4"><enum>(4)</enum><text>Any additional actions the Commandant is taking to mitigate instances of sexual assault and sexual harassment within the Coast Guard.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFC073BC9335F44F5BCCFA2913F0214A9"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/51">chapter 51</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HC7946EDFD17448FC8F81EC9BC2E0A8C3"><toc regeneration="no-regeneration"><toc-entry level="section">5116. Implementation status of directed actions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HAF035E7BD6E34EEC9A7059292E54A3BF"><enum>4.</enum><header>Independent review of Coast Guard reforms</header><subsection id="HB0EA2911B912485B9AD729FFF9B68118"><enum>(a)</enum><header>Government Accountability Office report</header><paragraph id="HF7779D6D9F7140BE8A764EF16068E63B"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate on the efforts of the Coast Guard to mitigate cases of sexual assault and sexual harassment within the service.</text></paragraph><paragraph id="H418B8FC82D6D494BB1919DE1FB2B2346"><enum>(2)</enum><header>Elements</header><text>The report required under paragraph (1) shall—</text><subparagraph id="HBA1FA5CA81AB4EDFA6448DDC51A45418"><enum>(A)</enum><text>evaluate—</text><clause id="H3494B6D06AF74A52B7879DE89A9E6B56"><enum>(i)</enum><text display-inline="yes-display-inline">the efforts of the Commandant of the Coast Guard to implement the directed actions from enclosure 1 of the memorandum titled <quote>Commandant's Directed Actions—Accountability and Transparency</quote> dated November 27, 2023;</text></clause><clause id="H5C089D365A4B4891805D2D76A66E7EED"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the Commandant of the Coast Guard met the reporting requirements under section 5112 of title 14, United States Code; and</text></clause><clause id="H67EDED60A7184CB4BA86684B20938F78"><enum>(iii)</enum><text display-inline="yes-display-inline">the effectiveness of the actions of the Coast Guard, including efforts outside of the actions described in the memorandum titled <quote>Commandant's Directed Actions—Accountability and Transparency</quote> dated November 27, 2023, to mitigate instances of sexual assault and sexual harassment and improve the enforcement relating to such instances within the Coast Guard, and how the Coast Guard is overcoming challenges in implementing such actions;</text></clause></subparagraph><subparagraph id="H9543AE23AD3442048D3A6326C8FDD5B6"><enum>(B)</enum><text display-inline="yes-display-inline">make recommendations to the Commandant for improvements to the efforts of the service to mitigate instances of sexual assault and sexual harassment and improve the enforcement relating to such instances within the Coast Guard; and</text></subparagraph><subparagraph id="H4F2E59F4942B41E9BD4DF44E247501B5"><enum>(C)</enum><text display-inline="yes-display-inline">make recommendations to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate to mitigate instances of sexual assault and sexual harassment in the Coast Guard and improve the enforcement relating to such instances within the Coast Guard, including proposed changes to any legislative authorities.</text></subparagraph></paragraph></subsection><subsection id="HFDE1A04315BC465583723333B71A5357"><enum>(b)</enum><header>Report by the Commandant</header><text>Not later than 90 days after the date on which the Comptroller General completes all actions under subsection (a), the Commandant of the Coast Guard shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that includes the following:</text><paragraph id="HCC4E43472D6D45068A3B53CCFE28E5A2"><enum>(1)</enum><text>A plan for Coast Guard implementation, including interim milestones and timeframes, of any recommendation made by the Comptroller General under subsection (a)(2)(B) with which the Commandant concurs.</text></paragraph><paragraph id="H158ED6E26492465C8911BE56D0E9CDCC"><enum>(2)</enum><text>With respect to any recommendation made under subsection (a)(2)(B) with which the Commandant does not concur, an explanation of the reasons why the Commandant does not concur.</text></paragraph></subsection></section><section id="H4FCEA60626A74811BBF22936D9A4486E"><enum>5.</enum><header>Requirement to maintain certain records</header><subsection id="H6CE72BF785F74857B085E73B656840DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/9">Chapter 9</external-xref> of title 14, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H8B0F1195891446CDA6F31CA68558E07B" display-inline="no-display-inline"><section id="H87B8F6A0320B489A9A0FA6BF1DA9858E"><enum>955.</enum><header>Requirement to maintain certain records</header><subsection id="H731423B6193C4867ACF62A70BC65DF91"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard shall maintain all work product related to final action documenting a disposition decision on an investigation by the Coast Guard Investigative Service or other law enforcement entity investigating a Coast Guard member accused of misconduct for not less than 7 years from date of the disposition decision.</text></subsection><subsection id="H2D651A662CFF4103BB510700B3EE6362"><enum>(b)</enum><header>Final action memo</header><text>Upon a final action documenting a disposition decision described in subsection (a), the convening authority or final decision-making authority, as applicable, shall sign a final action memo that includes the following:</text><paragraph id="H719833252950478DA1B7089E6068E5C9"><enum>(1)</enum><text>A reference section listing the materials reviewed in making a disposition decision.</text></paragraph><paragraph id="H2CC8A6B4A897400A899A6F7D8E690EBE"><enum>(2)</enum><text display-inline="yes-display-inline">The Coast Guard Investigative Service report of investigation listed as either a reference or an enclosure. </text></paragraph><paragraph id="H7A70EEA72A434E2BA85628CFEA81854A"><enum>(3)</enum><text>The prosecution memo, signed by the convening authority or the final decision-making authority, listed and included as an enclosure.</text></paragraph><paragraph id="H5615BA77CF654B6D992EB3F02AE46F4D"><enum>(4)</enum><text display-inline="yes-display-inline">The completed Coast Guard Investigative Service report of adjudication listed and included as an enclosure.</text></paragraph><paragraph id="H7E348DC814F44E21A5FC53EB326ABAC2"><enum>(5)</enum><text>The disposition decision.</text></paragraph></subsection><subsection id="H1D8D257583014A18910BEFD93307A4A3"><enum>(c)</enum><header>Work product</header><text>In this section, the term <term>work product</term> includes—</text><paragraph id="H7177DE5286FA407EBB822EBCBBB97045"><enum>(1)</enum><text>a prosecution memo;</text></paragraph><paragraph id="H744B4D04F4ED44C281B746F53FE86FE5"><enum>(2)</enum><text>emails, notes, and other correspondence related to a disposition decision; and</text></paragraph><paragraph id="H64150FAB1ED84531B591927E4B245A3E"><enum>(3)</enum><text>the content described in paragraphs (1) through (5) of subsection (b).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDFDE4E19F54E48D1AB6149EDE230C531"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/9">chapter 9</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H0C1FA89E857344E6B4B47C2E603198CA" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">955. Requirement to maintain certain records.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H4CDB86AC90CB47A1A62EAFE6F07432BA"><enum>6.</enum><header>Study on Coast Guard Academy oversight</header><subsection id="H7EC35F31AEEF4B36AAC1F839E869D58A"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the Commandant of the Coast Guard, in consultation with relevant stakeholders, shall conduct a study on the governance of the Coast Guard Academy, including examining the roles, responsibilities, authorities, advisory functions, and membership qualifications and expertise of the Board of Visitors and Board of Trustees of such Academy.</text></subsection><subsection id="HE4314947CB2040819328F1AD3445FC95"><enum>(b)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a written report that contains—</text><paragraph id="H9567ACFB87354FB6A2624CC1261C31F3"><enum>(1)</enum><text>the results of the study required under subsection (a); and</text></paragraph><paragraph id="H7E6CDBB84A524062817938CDA7005F54"><enum>(2)</enum><text>recommendations to improve governance at the Coast Guard Academy.</text></paragraph></subsection></section><section id="HA22460C4048D4D4D921B56D9DB2E2C1A"><enum>7.</enum><header>Providing for the transfer of a cadet who is the victim of a sexual assault or related offense</header><text display-inline="no-display-inline">Section 1902 of title 14, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H8C722AE3CCD946259C9AE03F70EFB2C2" display-inline="no-display-inline"><subsection id="HDFFA6859A22D4DF687E2613AB44CF225"><enum>(f)</enum><header>Consideration of request for transfer of cadet who is the victim of sexual assault or related offense</header><paragraph id="H3B1FD193190742A592C233E87F00B25B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commandant shall provide for timely consideration of and action on a request submitted by a cadet appointed to the Coast Guard Academy who is the victim of an alleged sexual assault or other offense covered by section 920, 920c, or 930 of title 10 (article 120, 120c, or 130 of the Uniform Code of Military Justice) for transfer to a Service Academy or to enroll in a Senior Reserve Officers’ Training Corps program affiliated with another institution of higher education. </text></paragraph><paragraph id="H010108DBB08449B5AFD44A9D5308092F"><enum>(2)</enum><header>Rulemaking</header><text>The Commandant shall prescribe regulations to carry out this subsection that—</text><subparagraph id="H79A04E1A9AFD465089E0C066CAB4B089"><enum>(A)</enum><text>ensure that any cadet who has been appointed to the Coast Guard Academy is informed of the right to request a transfer pursuant to this subsection, and that any formal request submitted by a cadet is processed as expeditiously as practicable for review and action by the Superintendent;</text></subparagraph><subparagraph id="HBAC1F3C79A21462FA0B3BE6B2B4000DE"><enum>(B)</enum><text>direct the Superintendent of the Coast Guard Academy, in coordination with the Superintendent of the Service Academy to which the cadet requests to transfer—</text><clause id="H2AD257523F72437B84E34028139DE62E"><enum>(i)</enum><text>to act on a request for transfer under this subsection not later than 72 hours after receiving the formal request from the cadet;</text></clause><clause id="H059BEE4B7532485588DF4C33AE05FDBA"><enum>(ii)</enum><text>to approve such request for transfer unless there are exceptional circumstances that require denial of the request; and</text></clause><clause id="H0B758531AA4041249F19C7086FA3954A"><enum>(iii)</enum><text>upon approval of such request, to take all necessary and appropriate action to effectuate the transfer of the cadet to the Service Academy concerned as expeditiously as possible; and</text></clause></subparagraph><subparagraph id="HCAF2F5FBFC76471BB0F15AE51AA26737"><enum>(C)</enum><text>direct the Superintendent of the Coast Guard Academy, in coordination with the Secretary of the military department that sponsors the Senior Reserve Officers’ Training Corps program at the institution of higher education to which the cadet requests to transfer—</text><clause id="HC44EA5C3637C412DBFFA4A27C81D7D3A"><enum>(i)</enum><text>to act on a request for transfer under this subsection not later than 72 hours after receiving the formal request from the cadet;</text></clause><clause id="H937BBB8990CF430A841BF116978BE89F"><enum>(ii)</enum><text>subject to the cadet’s acceptance for admission to the institution of higher education to which the cadet wishes to transfer, to approve such request for transfer unless there are exceptional circumstances that require denial of the request; and</text></clause><clause id="HE9BA8F6E8F9F48FD9F87D85F421783D9"><enum>(iii)</enum><text>to take all necessary and appropriate action to effectuate the cadet’s enrollment in the institution of higher education to which the cadet wishes to transfer and to process the cadet for participation in the relevant Senior Reserve Officers’ Training Corps program as expeditiously as possible.</text></clause></subparagraph></paragraph><paragraph id="H395DDF9D61DF493E8DEE4863E8E03F36"><enum>(3)</enum><header>Denial of transfer request</header><text>If the Superintendent of the Coast Guard Academy denies a request for transfer under this subsection, the cadet may request review of the denial by the Secretary of the Department in which the Coast Guard is operating, who shall act on such request not later than 72 hours after receipt of the formal request for review.</text></paragraph><paragraph id="H5D80D291D08449EB9076B1DB780EAD12"><enum>(4)</enum><header>Confidentiality of records</header><text>The Secretary of the Department in which the Coast Guard is operating shall ensure that all records of any request, determination, transfer, or other action under this subsection remain confidential, consistent with applicable law and regulation.</text></paragraph><paragraph id="H21A4E1B5A9474F398B893203BEDB38A7"><enum>(5)</enum><header>Appointment to Service Academy</header><text>A cadet who transfers under this subsection may retain the cadet’s appointment to the Coast Guard Academy or may be appointed to the Service Academy to which the cadet transfers without regard to the limitations and requirements described in sections 7442, 8454, and 9442 of title 10.</text></paragraph><paragraph id="H14150782DF1B4B7EBD36E77AE242D898"><enum>(6)</enum><header>Appointment upon graduation</header><subparagraph id="H9580D527E2C0407A910F011851E1F7BB"><enum>(A)</enum><header>Preference</header><text>A cadet who transfers under this subsection to a Service Academy, is entitled, before graduating from such Academy, to state the preference of the cadet for appointment, upon graduation, as a commissioned officer in the Coast Guard.</text></subparagraph><subparagraph id="HA1702DC401B74B75BA432814FEBB2FE8"><enum>(B)</enum><header>Manner of appointment</header><text>Upon graduation, a cadet described in subparagraph (A) is entitled to be accepted for appointment as a permanent commissioned officer in the Regular Coast Guard in the same manner as graduates of the Coast Guard Academy as described in section 2101.</text></subparagraph></paragraph><paragraph id="H778865BAC9174CBDAB439C2FBB61EA5A"><enum>(7)</enum><header>Commission into Coast Guard</header><text>A cadet who transfers under this subsection to a Senior Reserve Officers’ Training Corps program affiliated with another institution of higher education is entitled upon graduation from the Senior Reserve Officers’ Training program to commission into the Coast Guard as described in section 3738a.</text></paragraph><paragraph id="HBEA8C523C7CB4B2AAF5A1B1950F0220E"><enum>(8)</enum><header>Service Academy defined</header><text>In this subsection, the term <quote>Service Academy</quote> has the meaning given such term in section 347 of title 10. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HD31FDD48B2ED467588E2BB0359B61BAE"><enum>8.</enum><header>Designation of officers with particular expertise in military justice or healthcare</header><subsection id="H9DD7F0A5EFBF4805B25C92558ABF33C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/21">chapter 21</external-xref> of title 14, United States Code is amended by adding at the end the following:</text><quoted-block style="USC" id="HDA7C7A63D68E4521A43DBD9796F4927B" display-inline="no-display-inline"><section id="H64725B8B0F2E40818D84E8F6E4039692"><enum>2132.</enum><header>Designation of officers with particular expertise in military justice or healthcare</header><subsection id="H43CDC358416A4AE0AF05362F5174AB1F"><enum>(a)</enum><header>Secretary designation</header><text>The Secretary may designate a limited number of officers of the Coast Guard as having particular expertise in—</text><paragraph id="H19ABFBA3EDAB4CFAA3AC06AA9A9BA52E"><enum>(1)</enum><text>military justice; or</text></paragraph><paragraph id="HDA5E7CA107554C31AE19E97F92FD42AD"><enum>(2)</enum><text>healthcare.</text></paragraph></subsection><subsection id="HCD71975371004ABF9B4CAE84D0FD42DB"><enum>(b)</enum><header>Promotion and grade</header><text>An individual designated under this section—</text><paragraph id="H494DAF8142444FE2B995DE974E027F12"><enum>(1)</enum><text>shall not be included on the active duty promotion list;</text></paragraph><paragraph id="H969AD47078C34D65853A86DBD760B02F"><enum>(2)</enum><text>shall be promoted under section 2126; and</text></paragraph><paragraph id="H698C327EF990413D9DA4B534341EBDEA"><enum>(3)</enum><text>may not be promoted to a grade higher than captain.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB56D35A2015D4DD099E653B3458C3BC6"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for chapter 21 of such title is amended by inserting after the item relating to section 2131 the following:</text><quoted-block style="USC" id="HD8B7D0FBDABA41AC84A1822105B46F3E" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">2132. and</text></paragraph><paragraph id="H2B86C30D3CA9486788C41BA7AEC25888"><enum>(3)</enum><text>the officers of the Reserve serving in connection with organizing, administering, recruiting, instructing, or training the reserve components.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF12029012E494F0090DCE27AE0A6519B"><enum>(3)</enum><text>Section 2126 of such title is amended, in the second sentence, by inserting <quote>and as to officers designated by the Secretary pursuant to section 2132</quote> after <quote>reserve components</quote>.</text></paragraph><paragraph id="H94F1EB9F1A3F4CF48894A80835037E12"><enum>(4)</enum><text>Section 3736(a) of such title is amended—</text><subparagraph id="HA8DB06C2B7ED483D86726E81BF756DFC"><enum>(A)</enum><text>in the first sentence, by striking <quote>promotion list and the</quote> inserting <quote>promotion list, officers designated by the Secretary pursuant to section 2132, and the officers on the</quote>; and</text></subparagraph><subparagraph id="H099301F7858E411ABBD3C4BF18CA2A4F"><enum>(B)</enum><text>in the second sentence, by striking <quote>promotion list or the</quote> and inserting <quote>promotion list, officers designated by the Secretary pursuant to section 2132, or the officers on the</quote>.</text></subparagraph></paragraph></subsection></section><section id="H2AC84557017C422BA4C312CC79F53AD5"><enum>9.</enum><header>Direct hire authority for certain personnel of Coast Guard</header><subsection id="H4A6415E6F34244ECAAD26A75831F7AC0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/25">chapter 25</external-xref> of title 14, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H3B65DA55F7494852A9DD05A1BEE20A79" display-inline="no-display-inline"><section id="H985C33B29F554B6FBE471303839CBA29"><enum>2517.</enum><header>Direct hire authority for certain personnel of Coast Guard</header><subsection id="HAB9D73414F0B41C3BE0C35DC71597774"><enum>(a)</enum><header>In general</header><text>The Commandant of the Coast Guard may appoint, without regard to the provisions of subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5 (other than section 3303 and 3328 of such chapter), qualified candidates to any non-clinical specialist intended to engage in the integrated primary prevention of harmful behaviors, including suicide, sexual assault, harassment, domestic abuse, and child abuse and qualified candidates to any criminal investigative law enforcement position of the Coast Guard Criminal Investigative Service intended to engage in the primary response to such harmful behaviors.</text></subsection><subsection id="HB2AD28E4C69B4C6F9E9BA063675A7FC0"><enum>(b)</enum><header>Sunset</header><text>Effective on September 30, 2034, the authority provided under subsection (a) shall cease.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H13D30FAFFF004C2498EF2A10341B0C0C"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis of chapter 25 of such title is amended by inserting after the item related to section 2516 the following:</text><quoted-block style="USC" id="HB839D5D8EAA74C088F8903B854DA3326" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">2517. Direct hire authority for certain personnel of United States Coast Guard.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H50B84383D90E44DCB818406C9DF0335D"><enum>10.</enum><header>Safe-to-report policy for Coast Guard</header><subsection id="HBAF1543EB6334B7C85E80049625855C8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/19">chapter 19</external-xref> of title 14, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H6F948EE7CBB5489D8270415310515FB9" display-inline="no-display-inline"><section id="HB575D0CBD25E4F57BB51E976BD3D572F"><enum>1907.</enum><header>Safe-to-report policy for Coast Guard</header><subsection id="HFA3FEBBD927044CBBE87FE5AD5B040A6"><enum>(a)</enum><header>In general</header><text>The Secretary of the department in which the Coast Guard is operating shall, in consultation with the Secretaries of the military departments, issue such regulations as are necessary to establish the safe-to-report policy described in subsection (b) that applies with respect to all members of the Coast Guard (including members of the reserve and auxiliary components of the Coast Guard) and cadets at the Coast Guard Academy.</text></subsection><subsection id="H25EA563A41E248F4958852EC92034A3F"><enum>(b)</enum><header>Safe-to-Report policy</header><text>The safe-to-report policy described in this subsection is a policy that prescribes the handling of minor collateral misconduct involving a member of the Coast Guard who is the alleged victim or reporting witness of a sexual assault.</text></subsection><subsection id="H126C65E36CE3482E85DC16BF497DCAF2"><enum>(c)</enum><header>Mitigating and aggravating circumstances</header><text>In issuing regulations under subsection (a), the Secretary shall specify mitigating circumstances that decrease the gravity of minor collateral misconduct or the impact of such misconduct on good order and discipline and aggravating circumstances that increase the gravity of minor collateral misconduct or the impact of such misconduct on good order and discipline for purposes of the safe-to-report policy.</text></subsection><subsection id="HCAFFA35591FD4642B39D91F0A41F7BA7"><enum>(d)</enum><header>Tracking of collateral misconduct incidents</header><text>In conjunction with the issuance of regulations under subsection (a), Secretary shall develop and implement a process to anonymously track incidents of minor collateral misconduct that are subject to the safe-to-report policy established under such regulations.</text></subsection><subsection id="H538AFAD6B89B48B180D40F70AC1E8988"><enum>(e)</enum><header>Definition of minor collateral misconduct</header><text>In this section, the term <quote>minor collateral misconduct</quote> means any minor misconduct that is punishable under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/47">chapter 47</external-xref> of title 10 that—</text><paragraph id="H3724DECDA74E4DC8926A86C4DA29B06B"><enum>(1)</enum><text>is committed close in time to or during a sexual assault and directly related to the incident that formed the basis of the sexual assault allegation;</text></paragraph><paragraph id="HD2D84B4BDD754AF38A794BF31329D829"><enum>(2)</enum><text>is discovered as a direct result of the report of sexual assault or the ensuing investigation into such sexual assault; and</text></paragraph><paragraph id="H3EB053939AC747A4B1712ED42A6749E8"><enum>(3)</enum><text>does not involve aggravating circumstances (as specified in the regulations issued under subsection (a)) that increase the gravity of the minor misconduct or the impact of such misconduct on good order and discipline.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HED877D6E0316446EBBCA71E56AE30DF6"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/19">chapter 19</external-xref> of title 14, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/14/1906">section 1906</external-xref> the following: </text><quoted-block style="USC" id="H1337F4D4CCD54EC3835069A967AD106F" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1907. id="H3C23DC4AC94E435A85D1279F932129A2"><enum>11.</enum><header>Modification of delivery date of Coast Guard sexual assault report</header><text display-inline="no-display-inline">Section 5112(a) of title 14, United States Code, is amended by striking <quote>January 15</quote> and inserting <quote>March 1</quote>.</text></section><section id="H17D8670A43554296AF1BC0E5B79FB9DD"><enum>12.</enum><header>Higher-level review of board of determination decisions</header><subsection id="H83C57C21F4D141A7843B2C8C327A7C59"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2158 of title 14, United States Code, is amended—</text><paragraph id="H09F4C020A7054B1899648C3270374136"><enum>(1)</enum><text>in the first sentence by striking <quote>The Secretary</quote> and inserting the following: </text><quoted-block style="USC" id="HD32D99762F3545CCBDA489D237120407" display-inline="no-display-inline"><subsection id="HB892036DCF954761A8FFE4C7F3E5CC4A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary</text></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H3216551BB6794739A7E836C8B5E16AFC"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="USC" id="H30CFADB236434E46B8B334BEAB432B01" id="H485C55D3FEB444A7AD77F5C7D10ED719"><enum>(1)</enum><header>In general</header><text>If a board convened under this section determines that the officer should be retained when the officer’s record indicates that the officer has committed a sexual assault offense, the board shall forward the record of the proceedings and recommendation of the board for higher-level review, in accordance with regulations prescribed by the Secretary.</text></paragraph><paragraph id="HFF0F37793FC54875A37ECDD4D386D5F1"><enum>(2)</enum><header>Authority</header><text>The official exercising higher-level review shall have authority to forward the case for consideration by a Board of Inquiry in accordance with section 2159.</text></paragraph></subsection><subsection id="H13E16971A69043DEA863DFC4DFA6E91B"><enum>(c)</enum><header>Sexual assault offense</header><text>In this section, the term <quote>sexual assault offense</quote> means a violation of section 920 or 920b of title 10, United States Code (article 120 or 120b of the Uniform Code of Military Justice) or attempt to commit an offense specified under section 920 or 920b as punishable under section 880 of such title (article 80 of the Uniform Code of Military Justice).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HC8A92A7B920E4A29A56CAA53C2F5E23B"><enum>13.</enum><header>Review of discharge or dismissal</header><subsection id="H6164C47DC0204472B808CE1F32F4A4A9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/14/25">chapter 25</external-xref> of title 14, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="H2E125850B97A4477BC1D444FE1E1550F" display-inline="no-display-inline"><section id="H615B13B1832F4004B8D0B6FB77DB3968"><enum>2517.</enum><header>Review of discharge or dismissal</header><subsection id="H12042B185386488DACDA1D3C709BCEF6"><enum>(a)</enum><header>Downgrade</header><paragraph id="H25BD5737D717490C9655922978558214"><enum>(1)</enum><header>In general</header><text>In addition to the requirements of section 1553 of title 10, a board of review for a former member of the Coast Guard established pursuant to such section may, upon a motion of the board and subject to review by the Secretary of the department in which the Coast Guard is operating, downgrade an honorable discharge or dismissal to a general (under honorable conditions) discharge or dismissal upon a finding that a former member of the Coast Guard, while serving on active duty as a member of the armed forces, committed sexual assault or sexual harassment in violation of section 920, 920b, or 934 of this title (article 120, 120b, or 134 of the Uniform Code of Military Justice).</text></paragraph><paragraph id="HE1D464C900A04A69B2CCE2BDE3350491"><enum>(2)</enum><header>Evidence</header><text>Any downgrade under paragraph (1) shall be supported by clear and convincing evidence.</text></paragraph><paragraph id="H0450216670314310837F6BAFE5C54318"><enum>(3)</enum><header>Limitation</header><text>The review board under paragraph (1) may not downgrade a discharge or dismissal of a former member of the Coast Guard if the same action described in paragraph (1) was considered prior to separation from active duty by an administrative board in determining the characterization of discharge as otherwise provided by law and in accordance with regulations prescribed by the Secretary of the Department in which the Coast Guard is operating.</text></paragraph></subsection><subsection id="H4E0A19418C2A45DFB67DD33EE644E0ED"><enum>(b)</enum><header>Procedural rights</header><paragraph id="H24FF8CC58BD44A8CBBB12EF2EF02433E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A review by a board established under section 1553 of title 10 shall be based on the records of the armed forces concerned and such other evidence as may be presented to the board.</text></paragraph><paragraph id="H5E06F8FF6B744487B2AE976FCCA55476"><enum>(2)</enum><header>Evidence by witness</header><text>A witness may present evidence to the board in person or by affidavit.</text></paragraph><paragraph id="HD3D80D12783A4507864E6F4A740E0355"><enum>(3)</enum><header>Appearance before board</header><text>A person who requests a review under this section may appear before the board in person or by counsel or an accredited representative of an organization recognized by the Secretary of Veterans Affairs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/59">chapter 59</external-xref> of title 38.</text></paragraph><paragraph id="H1D49C4D1CE8C46DF84E968BD81B11E2A"><enum>(4)</enum><header>Notification</header><text>A former member of the Coast Guard who is subject to a downgrade in discharge characterization review under subsection (b)(3) shall be notified in writing of such proceedings, afforded the right to obtain copies of records and documents relevant to the proceedings, and the right to appear before the board in person or by counsel or an accredited representative of an organization recognized by the Secretary of Veterans Affairs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/59">chapter 59</external-xref> of title 38.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H84C401E218584CD593C91E5B72BCEF6A"
