Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Administrator of General Services to establish a program to sell surplus Government motor vehicles to certain small businesses that provide ground transportation service, and for other purposes.</official-title></form><legis-body id="H133E39B8A39E4B59AECBAD84D32EC6F5" style="OLC"><section id="H23B1B7DA4892486783196B98883D6485" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business Transportation Investment Act of 2024</short-title></quote>.</text></section><section id="HD37DF9DEC82D46E9AC2C6D6831DB7875"><enum>2.</enum><header>Program to sell surplus Government motor vehicles to small businesses that provide ground transportation service</header><subsection id="HAA7FB33486C34CC1A82C90F2066FAF12"><enum>(a)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Administrator of General Services shall establish a program that offers for purchase one half of the annual inventory of motor vehicles that are surplus property from the Federal fleet to a covered small business before offering for purchase to any other buyer.</text></subsection><subsection id="H58D4DFBDB97C4296893AF0F0D22D2FF0"><enum>(b)</enum><header>Price</header><text>The Administrator shall sell any such motor vehicle to a covered small business for the price that is the lower of the following at the time of sale:</text><paragraph id="H3C1073F5B268423085DD9323D53A15C6"><enum>(1)</enum><text>At cost, after deducting any cost of administering the program and taking into consideration the depreciation of the motor vehicle.</text></paragraph><paragraph id="HF7A73D08E2A449D58C3B93C0E14C9726"><enum>(2)</enum><text>Open market value.</text></paragraph></subsection><subsection id="H037194BE2FB7413F922BD174AB70DC18"><enum>(c)</enum><header>Type of motor vehicle offered</header><text>The Administrator shall offer for purchase to a covered small business the motor vehicles that are the largest and most recent fuel-efficient models of the motor vehicles that are surplus property. </text></subsection><subsection id="HFB5331CA82784D18AC98162B5689342B"><enum>(d)</enum><header>Terms of purchase</header><paragraph id="HCB636B59582E48C48FCA5EE4DEFB871B"><enum>(1)</enum><header>Operator agreement</header><text>To participate in the program established under subsection (a), the operator of a covered small business shall agree to the following terms:</text><subparagraph id="HB0DC5279E295490A82705AF6C16D82F1"><enum>(A)</enum><text display-inline="yes-display-inline">The operator shall use each motor vehicle that is purchased through the program to provide ground transportation service.</text></subparagraph><subparagraph id="HBEF48E8E8F0B47AABFE6740D365AD6C5"><enum>(B)</enum><text>The operator shall continue to use any such motor vehicle to provide ground transportation service for not less than two years after the purchase of the motor vehicle unless the motor vehicle becomes unable to operate during that period.</text></subparagraph><subparagraph id="H6116CB653A73493998E639BF3C51A096"><enum>(C)</enum><text>If the operator sells any such motor vehicle before the end of the two-year period, the operator shall reimburse the Administrator in the amount that is the difference between the open market value of the motor vehicle and the amount that the operator paid to the Administrator for the motor vehicle.</text></subparagraph><subparagraph id="H8B5F0637C62844879A30CC9F25EABC31"><enum>(D)</enum><text>The operator shall donate not less than one out of every five of such motor vehicles to a local nonprofit organization after the motor vehicle is no longer used to provide ground transportation service. </text></subparagraph></paragraph><paragraph id="H281A4F1DF6224AF682E195F3F4A01252"><enum>(2)</enum><header>Maximum number of vehicles that may be purchased annually</header><text display-inline="yes-display-inline">An operator may not purchase through the program established under subsection (a) more than 50 vehicles in any fiscal year.</text></paragraph></subsection><subsection id="HB030E5488C8849DD9A3072B7368EE196" commented="no"><enum>(e)</enum><header>Exemption from certain property disposal requirements</header><text display-inline="yes-display-inline">The program established under subsection (a) shall not be subject to—</text><paragraph id="HC5E0317CDCD94259852D5C4F6B14FBEC" commented="no"><enum>(1)</enum><text>subchapter IV of chapter 5, title 40, United States Code;</text></paragraph><paragraph id="HE084AD8C8DC941ACA6ED6559A150E145" commented="no"><enum>(2)</enum><text>sections 545, 549, and 553 of title 40, United States Code;</text></paragraph><paragraph id="HC9BA457A1B404B1B8B894C8B41C0C794" commented="no"><enum>(3)</enum><text>any other provision of law authorizing the no-cost conveyance of motor vehicles owned by the Federal Government; or</text></paragraph><paragraph id="HC9BE26C3EABF4425A770A41A2E54AFE8" commented="no"><enum>(4)</enum><text>any congressional notification requirement other than that in subsection (f) of this Act.</text></paragraph></subsection><subsection id="HBC89C86850564979B5BB7BA2859F814D"><enum>(f)</enum><header>Report and recommendations</header><text>Not later than 5 years after the date of the enactment of this section, the Administrator shall submit to Congress a report that contains the following:</text><paragraph id="H84F321DDB35C47DB8061523061CCB875"><enum>(1)</enum><text>A review of the program established under subsection (a).</text></paragraph><paragraph id="HFD589EA6EDA740559181CDC3E52D7799"><enum>(2)</enum><text display-inline="yes-display-inline">A recommendation to continue or end the program. </text></paragraph></subsection><subsection id="HC5B180B2B35646C0B09DE4E08F012EBA"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF9CFBF6D12E04938943C50FFD3115005"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="H65B9FA6B9DA64287ACD998789D9167C2"><enum>(2)</enum><header>Covered small business</header><text display-inline="yes-display-inline">The term <term>covered small business</term> means a small business that provides ground transportation service.</text></paragraph><paragraph id="HA6E70306495E4369B4951931F54FED90"><enum>(3)</enum><header>Ground transportation service</header><text display-inline="yes-display-inline">The term <term>ground transportation service</term>—</text><subparagraph id="H866E6EA4006B4D7DBA9789A09A3A5E75"><enum>(A)</enum><text>means transportation for a passenger that is provided— </text><clause id="HB0F1CCFF27564F8F822EF9E7A4E3E366"><enum>(i)</enum><text>for compensation; and</text></clause><clause id="H74FC1178360C4C07A1B92B72C7B02F20"><enum>(ii)</enum><text>in a motor vehicle, including a taxicab, shuttle, over-the-road bus, or limousine; and</text></clause></subparagraph><subparagraph id="H99FE928F3C4B412796915441E79C2131"><enum>(B)</enum><text display-inline="yes-display-inline">includes paratransit transportation and non-emergency medical transportation.</text></subparagraph></paragraph><paragraph id="H4E15AF4C0FAE40FC9DA1C5BDD11D5C22"><enum>(4)</enum><header>Non-emergency medical transportation</header><text display-inline="yes-display-inline">The term <term>non-emergency medical transportation</term> means the provision of transportation services for individuals who require assistance in traveling to and from medical appointments, treatments, or healthcare facilities, but do not require immediate emergency medical intervention. </text></paragraph><paragraph id="H68865606145D447B890EFAA986A1ED65"><enum>(5)</enum><header>Nonprofit organization</header><text display-inline="yes-display-inline">The term <term>nonprofit organization</term> means an organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such code.</text></paragraph><paragraph id="H1140E5C2B24440D08635A79A429763E8"><enum>(6)</enum><header>Over-the-road bus</header><text display-inline="yes-display-inline">The term <term>over-the-road bus</term> has the meaning given that term in section 13102 of title 49, United States Code. </text></paragraph><paragraph id="HFB8BE85EFE1E4E14BE2860C684D71CE9"><enum>(7)</enum><header>Small business</header><text display-inline="yes-display-inline">The term <term>small business</term> has the meaning given the term <term>small business concern</term> in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>). </text></paragraph><paragraph id="H80EEA8DDD52A42838B9040B48B68CBF5"><enum>(8)</enum><header>Surplus property</header><text>The term <term>surplus property</term> has the meaning given that term in section 102 of title 40, United States Code.</text></paragraph></subsection></section></legis-body></bill>
