which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to include certified community behavioral health clinic services as a State plan option under the Medicaid program, and for other purposes.</official-title></form><legis-body id="HA87E649250D1475E878A5C5EC00E0562" style="OLC"><section id="H579D76A57E8444F49498AA80A1293632" section-type="section-one"><enum>1.</enum><header>Certified community behavioral health clinic services under medicaid</header><subsection id="HFB1E5CF7E1AA415682F1A68A2A56F0FA"><enum>(a)</enum><header>Definition of medical assistance</header><text>Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><paragraph id="H89CA87793EAB4B85A33E2501E43E320E"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HEA9B9D8E13934C21821F3C0C66A29D8B"><enum>(A)</enum><text>in paragraph (30), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="H67ED46A1A17F44519C33895D97863EFE"><enum>(B)</enum><text>by redesignating paragraph (31) as paragraph (32); and</text></subparagraph><subparagraph id="H681D99B7A7834A41810A737245DBF3C6"><enum>(C)</enum><text>by inserting after paragraph (30) the following new paragraph:</text><quoted-block id="H804EBD538A9E4ADDA3C70A5C280AF64A" style="OLC"><paragraph id="HB0E74429BBFC409E88743E364CF95C78"><enum>(31)</enum><text>certified community behavioral health clinic services, as defined in subsection (jj); and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H60B1107BAB3B4E239A79E6680ACA6B2B"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="H50754F29D82949F4869279950D56BB6A" style="OLC"><subsection id="HC975277391854290BF1BCEEBA59A306F"><enum>(jj)</enum><header>Certified community behavioral health clinic services</header><paragraph id="HEA5AAC1F353C4899A54642CE310734B0"><enum>(1)</enum><header>In general</header><text>The term <quote>certified community behavioral health services</quote> means any of the following services when furnished to an individual as a patient of a certified community behavioral health clinic (as defined in paragraph (2)), in a manner reflecting person-centered care and which, if not available directly through a certified community behavioral health clinic, may be provided or referred through formal relationships with other providers:</text><subparagraph id="HD391C538B19842198E21E28DDE2415CC"><enum>(A)</enum><text>Crisis mental health services, including 24-hour mobile crisis teams, emergency crisis intervention services, and crisis stabilization.</text></subparagraph><subparagraph id="HE27CB59A77014A489FA88201B5135013"><enum>(B)</enum><text>Screening, assessment, and diagnosis, including risk assessment.</text></subparagraph><subparagraph id="HCCB74755400F44DF89CBB448C70465AE"><enum>(C)</enum><text>Patient-centered treatment planning or similar processes, including risk assessment and crisis planning.</text></subparagraph><subparagraph id="HB128447AC6174676AACB7A68C00A5773"><enum>(D)</enum><text>Outpatient mental health and substance use services.</text></subparagraph><subparagraph id="H7926A8CBF5124748B1ABB703352472EE"><enum>(E)</enum><text>Outpatient clinic primary care screening and monitoring of key health indicators and health risk.</text></subparagraph><subparagraph id="HECEC4060B5144040B7069D7D03FAB3BC"><enum>(F)</enum><text>Intensive case management services.</text></subparagraph><subparagraph id="H38959E844D1E4382B08939BC104F1D54"><enum>(G)</enum><text>Psychiatric rehabilitation services.</text></subparagraph><subparagraph id="H58E9314274E344E88E1AB25AA722F646"><enum>(H)</enum><text>Peer support and counselor services and family supports.</text></subparagraph><subparagraph id="H17FC2D8052F14899BE4B9BD1E6CDA1FF"><enum>(I)</enum><text>Intensive, community-based mental health care for members of the Armed Forces and veterans who are eligible for medical assistance, particularly such members and veterans located in rural areas, provided the care is consistent with minimum clinical mental health guidelines promulgated by the Veterans Health Administration, including clinical guidelines contained in the Uniform Mental Health Services Handbook of such Administration.</text></subparagraph></paragraph><paragraph id="HB0B61281437C458990883D9DBB0293A7"><enum>(2)</enum><header>Certified community behavioral health clinic</header><text>The term <quote>certified community behavioral health clinic</quote> means an organization that—</text><subparagraph id="H4BB6ADBFABCE471F8E5E3CBA826E3978"><enum>(A)</enum><text>has been certified by a State as meeting the criteria established by the Secretary pursuant to subsection (a) of section 223 of the Protecting Access to Medicare Act as of January 1, 2024, and any subsequent updates to such criteria, regardless of whether the State is carrying out a demonstration program under this title under subsection (d) of such section;</text></subparagraph><subparagraph id="HBBF5C041A113437EAF5C9D565A83C4E8"><enum>(B)</enum><text>is engaged in furnishing all of the services described in paragraph (1); and</text></subparagraph><subparagraph id="H8D0E34C2696044FBB6742B68C3597232"><enum>(C)</enum><text>agrees, as a condition of the certification described in subparagraph (A), to furnish to the State or Secretary any data required as part of ongoing monitoring of the organization’s provision of services, including encounter data, clinical outcomes data, quality data, and such other data as the State or Secretary may require.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7E294C6EB9F943F8A34E73DF7F89E307"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to medical assistance furnished on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
