Governance and Transparency Act of 2024</short-title></quote>. </text></section><section id="H2A3B4361B7DD4F869CDBF4D0DEBB5042"><enum>2.</enum><header>Establishment of Federal agency artificial intelligence system governance requirements</header><subsection id="H9A6FCF1F77FB4A22AC86CF6D78BE5434"><enum>(a)</enum><header>Federal AI System Governance</header><paragraph id="HB042CF2F6F514C8B862792209A34F8DE"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">Chapter 35</external-xref> of title 44, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="H7F2D6A910ED843649384ABA37AFC1710" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HGO00"><subchapter id="HB93A93548A384C368AA762C4845AFC78"><enum>IV</enum><header>Artificial Intelligence System Governance</header><section id="H18C31B5D7EB94B028D824F3F3C516A1E"><enum>3591.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this subchapter, with respect to the design, development, acquisition, use, management, and oversight of artificial intelligence in the Federal Government, are to ensure the following:</text><paragraph id="H2340B7E5EEAD40C3AE56218D361E0767"><enum>(1)</enum><text>Actions that are consistent with the Constitution and any other applicable law and policy, including those addressing freedom of speech, privacy, civil rights, civil liberties, and an open and transparent Government.</text></paragraph><paragraph id="HA9428E4B2B2B4B19B694EEB4034A62EB"><enum>(2)</enum><text>Any such action is purposeful and performance-driven, including ensuring the following:</text><subparagraph id="HD8020F657FEF421790E9628D6DE5DFFA"><enum>(A)</enum><text>Such action promotes the consistent and systemic treatment of all individuals in a fair, just, and impartial manner.</text></subparagraph><subparagraph id="H32A3ACF0E736478EBBD51B60A9E4339A"><enum>(B)</enum><text>The public benefits of such action significantly outweigh the risks.</text></subparagraph><subparagraph id="H675C95DD174440F98CE76C55243DF2CD"><enum>(C)</enum><text>The risks and operations of such action do not unfairly and disproportionately benefit or harm an individual or subgroup of the public.</text></subparagraph><subparagraph id="HD1E1E4F524D84BA29261EAA92EDBCC61"><enum>(D)</enum><text>The risk of such action is assessed and responsibly managed, including before the use of artificial intelligence.</text></subparagraph></paragraph><paragraph id="H3C2901F1E6A1468FAEE4E58D18C12A76"><enum>(3)</enum><text>Any application of artificial intelligence is consistent with the use cases for which the artificial intelligence was trained, and the deployers of such application promote verifiably accurate, ethical, reliable, and effective use.</text></paragraph><paragraph id="H94EF219E29084984AE0D33BDDA31BF50"><enum>(4)</enum><text>The safety, security, and resiliency of artificial intelligence applications, including resilience when confronted with any systematic vulnerability, adversarial manipulation, and other malicious exploitation.</text></paragraph><paragraph id="H32FFFF3E2DFF4A45833672A1006BF083"><enum>(5)</enum><text>The purpose, operations, risks, and outcomes of artificial intelligence applications are sufficiently explainable and understandable, to the extent practicable, by subject matter experts, users, impacted parties, and others, as appropriate.</text></paragraph><paragraph id="H3F728165233E423B8D428EB360D30963"><enum>(6)</enum><text>Such action is responsible and accountable, including by ensuring the following:</text><subparagraph id="HE5D121180D7F4EFCB659A09C52EA45CD"><enum>(A)</enum><text>Human roles and responsibilities are clearly defined, understood, and appropriately assigned.</text></subparagraph><subparagraph id="HADF76A147BD5459F9D8832347169EAB0"><enum>(B)</enum><text>Artificial intelligence is used in a manner consistent with the purposes described in this section and the purposes for which each use of artificial intelligence is intended.</text></subparagraph><subparagraph id="H863C4F9AEE054E3EB823EF95C482375A"><enum>(C)</enum><text>Such action, as well as relevant inputs and outputs of artificial intelligence applications, are well documented and accountable.</text></subparagraph></paragraph><paragraph id="H027EA1C8C00C44F4A413D27F0D3FBAC0"><enum>(7)</enum><text>Responsible management and oversight by ensuring the following:</text><subparagraph id="H235E7A32884D4E11B0F9E0A05D01DFB5"><enum>(A)</enum><text>Artificial intelligence applications are regularly tested against the purposes described in this section.</text></subparagraph><subparagraph id="HE91418FDF17447DDBF3102B8AF062430"><enum>(B)</enum><text>Mechanisms are maintained to supersede, disengage, or deactivate applications of artificial intelligence that demonstrate performance or outcomes that are inconsistent with the intended use or this subchapter.</text></subparagraph><subparagraph id="H8C455DA76E114B3F8BABF7BC349CA5C8"><enum>(C)</enum><text>Engagement with impacted communities.</text></subparagraph></paragraph><paragraph id="H7528B7EA84E845909CD1984EAF084284"><enum>(8)</enum><text>Transparency in publicly disclosing relevant information regarding the use of artificial intelligence to appropriate stakeholders, to the extent practicable and in accordance with any applicable law and policy, including with respect to the protection of privacy, civil liberties, and of sensitive law enforcement, national security, trade secrets or proprietary information, and other protected information.</text></paragraph><paragraph id="H128EE93C1D5C405295B926CAC76825B8"><enum>(9)</enum><text>Accountability for the following:</text><subparagraph id="H3B52369042924D3ABF6F1FC56FE27C72"><enum>(A)</enum><text>Implementing and enforcing appropriate safeguards necessary to comply with the purposes described in this section and the requirements of this subchapter, for the proper use and functioning of the applications of artificial intelligence.</text></subparagraph><subparagraph id="H59025E8542CA4B589F659598E31E4A40"><enum>(B)</enum><text>Monitoring, auditing, and documenting compliance with those safeguards, as appropriate.</text></subparagraph><subparagraph id="HA5AA774244E34CCE9BB8B904A91D1AC2"><enum>(C)</enum><text>Providing appropriate training to all agency personnel responsible for the design, development, acquisition, use, management, and oversight of artificial intelligence.</text></subparagraph></paragraph></section><section id="H7FF3F1A42C4B4671ACA4BD39BEF3FA12"><enum>3592.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="H205ADF0C6B8A43439D5BB18277EA36B3"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the definitions under sections 3502 shall apply to this subchapter.</text></paragraph><paragraph id="HE027325B09EA433595C72F9C7DE48C58"><enum>(2)</enum><header>Additional definitions</header><text>In this subchapter:</text><subparagraph id="H03395EACFDFD49E4B12D533EE694F34C"><enum>(A)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></subparagraph><subparagraph id="HC63A6C7510A746C6981C405A227B8E98"><enum>(B)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means the Committee on Oversight and Accountability of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph><subparagraph id="H859E388C3EA34F8AAAD36EFFB4127246"><enum>(C)</enum><header>Artificial intelligence</header><text display-inline="yes-display-inline">The term <term>artificial intelligence</term> has the meaning given the term in section 238(g) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; 10 U.S.C. note prec. 4061).</text></subparagraph><subparagraph id="H6D7316BE7B5E468CACA0863CCD1A0DD0"><enum>(D)</enum><header>Artificial intelligence system</header><text>The term <quote>artificial intelligence system</quote> means any data system, software, application, tool, or utility that operates in whole or in part using dynamic or static machine learning algorithms or other forms of artificial intelligence, whether—</text><clause id="HF95AF0C7B9AF47E2A9AE0049B91E65B9"><enum>(i)</enum><text>the data system, software, application, tool, or utility is established primarily for the purpose of researching, developing, or implementing artificial intelligence technology; or</text></clause><clause id="HF15CA64F44834EAAA57E99A8356E8998"><enum>(ii)</enum><text>artificial intelligence capability is integrated into another system or business process, operational activity, or technology system.</text></clause></subparagraph><subparagraph id="H6AE414B9F807467CAEC971B6311E7976"><enum>(E)</enum><header>Federal artificial intelligence system</header><text display-inline="yes-display-inline">The term <term>Federal artificial intelligence system</term> means an artificial intelligence system used in connection with a Federal information system.</text></subparagraph><subparagraph id="H526F77977239484FAE69823280B9B452"><enum>(F)</enum><header>Federal information system</header><text display-inline="yes-display-inline">The term <term>Federal information system</term> has the meaning given the term in section 11331(g) of title 40.</text></subparagraph><subparagraph id="H92350F73D6434A1088F6B74E35588F45"><enum>(G)</enum><header>National security system</header><text>The term <term>national security system</term> has the meaning given that term in section 3552(b) of title 44.</text></subparagraph></paragraph></section><section id="H7265B125FBDF46D381A3A48BAA8716D5"><enum>3593.</enum><header>Authority and functions of the Director</header><text display-inline="no-display-inline">The Director shall oversee the design, development, acquisition, use, management, and oversight of Federal artificial intelligence systems by agencies to implement the purposes described in section 3591. In performing such oversight, the Director shall do the following:</text><paragraph id="H43026C28DD5548C1A5AA6389A9BF9D6C"><enum>(1)</enum><text display-inline="yes-display-inline">Develop, coordinate, and oversee the implementation of policies, purposes, standards, and guidelines to ensure appropriate use of Federal artificial intelligence systems and the protection of civil rights, civil liberties, and privacy, including in conformity with section 552a of title 5 and other applicable laws, as well as the integrity of Federal information systems and information technology in accordance with the other requirements of this chapter.</text></paragraph><paragraph id="HBCD17C33C0EA4584B1AF1E058E31BC4A"><enum>(2)</enum><text>Oversee agency compliance with the requirements of this subchapter, including through any authorized enforcement action under section 11303(b)(5) of title 40 to ensure agency accountability and compliance.</text></paragraph><paragraph id="H8C25935A33264E05B002D46924967696"><enum>(3)</enum><text display-inline="yes-display-inline">Issue and update, as necessary, guidance to agencies to take steps to advance the governance of Federal artificial intelligence systems, manage risk, and remove relevant barriers to innovation, consistent with the requirements of this subchapter and, as appropriate the standards promulgated under section 22A of the National Institute of Standards and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/15/278h-1">15 U.S.C. 278h–1</external-xref>) pursuant to section 5302 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9441">15 U.S.C. 9441</external-xref>) that addresses the following:</text><subparagraph id="H11345F34FF9244F8B12941E0C3ABE444"><enum>(A)</enum><text>The development of policies regarding Federal acquisition, procurement, and use by agencies regarding artificial intelligence, including an identification of the responsibilities of agency officials managing the use of such technology.</text></subparagraph><subparagraph id="H4809C5A6B8B649BAA5AE524EAD734B02"><enum>(B)</enum><text>The ownership and protection of data and other information created, used, processed, stored, maintained, disseminated, disclosed, or disposed of by a contractor or subcontractor (at any tier) on behalf of the Federal Government.</text></subparagraph><subparagraph id="H1D8F1863842A4B9FB6A8BD6051A4FAC1"><enum>(C)</enum><text>The protection of training data, algorithms, and other components of any Federal artificial intelligence system against misuse, unauthorized alteration, degradation, or being rendered inoperable.</text></subparagraph><subparagraph id="HA9AEFE6BCAD648838C498227EA77824C"><enum>(D)</enum><text display-inline="yes-display-inline">The removal of barriers to responsible agency use of artificial intelligence, such as information technology, data, workforce, and budgetary barriers, in order to promote the innovative application of those technologies while protecting privacy, civil liberties, civil rights, and economic and national security.</text></subparagraph><subparagraph id="H57BA187FC9574F048E987FAE9FE5E728"><enum>(E)</enum><text display-inline="yes-display-inline">The establishment of best practices for identifying, assessing, and mitigating any discrimination in violation of title VI of the Civil Rights Act of 1964 (42. U.S.C. 2000d et seq.), or any unintended consequence of the use of artificial intelligence, including policies to—</text><clause id="HA515EBA4F20A47879F4131D5245BF981"><enum>(i)</enum><text>identify data used to train artificial intelligence;</text></clause><clause id="H8B4E195D05164F6793CB03DC74D6FE73"><enum>(ii)</enum><text>identify data analyzed or ingested by Federal artificial intelligence systems used by the agencies; and</text></clause><clause id="H3E9518126DED459BADA431DC98251DCB"><enum>(iii)</enum><text display-inline="yes-display-inline">require periodic evaluation of Federal artificial intelligence systems, as appropriate.</text></clause></subparagraph></paragraph><paragraph id="H2AEC6E9590E94B77AD7F6C7A0E4F22E1"><enum>(4)</enum><text display-inline="yes-display-inline">Issue guidance for agencies to establish a plain language notification process, as necessary and appropriate and in conformity with applicable law, including section 552a of title 5, for individuals or entities impacted by an agency determination that has been based solely on an output from, or substantively and meaningfully informed, augmented, or assisted by a Federal artificial intelligence system, including the contents of any notice, including examples of what the notice may look like in practice.</text></paragraph><paragraph id="H78C6FB3334774E80A9C81D82BE72CA7B"><enum>(5)</enum><text display-inline="yes-display-inline">Issue guidance for agencies to review their appeals process and to make modifications, as necessary and appropriate, to account for determinations made solely by or substantively and meaningfully informed, augmented, or assisted by a Federal artificial intelligence system, including guidance on how an agency provides the impacted individual or entity the opportunity for an alternative review independent of the Federal artificial intelligence system, as appropriate.</text></paragraph><paragraph id="H211F4B544CA746468385E0AFF2938414"><enum>(6)</enum><text>Provide guidance and a template for the required contents of the agency plans described in section 3594(6) that uses a uniform resource locator that is in a consistent format across agencies such as the format <quote>agencyname.gov/AI</quote>.</text></paragraph><paragraph id="HC451A0BF42F3487BA2FA5B8CFF60A3B0"><enum>(7)</enum><text display-inline="yes-display-inline">Issue guidance, including a uniform required submission format and criteria for updating entries after significant changes, for the establishment of agency AI governance charters under section 3595, including defining high-risk Federal artificial intelligence systems, and publication under section 3596.</text></paragraph></section><section id="HAAC22EE79BF949639DBF8B891AFE6152"><enum>3594.</enum><header>Federal agency responsibilities</header><text display-inline="no-display-inline">The head of each agency shall do the following:</text><paragraph id="H69570DA4B81C4660B9E0B709B820DDC3"><enum>(1)</enum><text display-inline="yes-display-inline">Comply with the requirements of this subchapter and related policies, purposes, standards, and guidelines, including those under section 552a of title 5 and in guidance issued by the Director under section 3593.</text></paragraph><paragraph id="H057A99CD89884A8E966E2EB457B7992D"><enum>(2)</enum><text display-inline="yes-display-inline">Ensure that Federal artificial intelligence system management processes are integrated with agency strategic, operational, data, workforce planning, and budgetary planning processes, and other requirements under this chapter.</text></paragraph><paragraph id="HAD2BD20BDF6547FBB447F6531EB50F41"><enum>(3)</enum><text display-inline="yes-display-inline">Ensure that senior agency officials, including the Chief Information Officer, the Chief Data Officer, and the senior agency official for privacy, implement policies and procedures regarding Federal artificial intelligence systems under the control of such officers, assess and reduce any risks to such systems to an acceptable level, and periodically assess and validate management procedures and controls to ensure effective implementation of this subchapter.</text></paragraph><paragraph id="H8A12887711A545E990357B0738C1686E"><enum>(4)</enum><text display-inline="yes-display-inline">Delegate to the agency Chief Information Officer established under section 3506 (or comparable official in an agency not covered by such section) the primary authority and accountability to ensure compliance with the agency requirements under this subchapter in coordination with any other appropriate senior agency official designated by the head of the agency.</text></paragraph><paragraph id="HFDAE5064F5BC48EFA724748675860884"><enum>(5)</enum><text display-inline="yes-display-inline">Ensure that contracts for the acquisition and procurement of a Federal artificial intelligence system are consistent with the requirements of this subchapter and any guidance issued by the Director under section 3593(3).</text></paragraph><paragraph id="H17B7E78867E14EF0A96708D53938CD03"><enum>(6)</enum><text>Maintain a plan, posted on a publicly available and centralized webpage of the agency and prepared in accordance with the template provided by the Director under section 3593(6), to—</text><subparagraph id="HC9EEBBDA237F47D68869C4AF90D6CABE"><enum>(A)</enum><text>achieve consistency with the requirements of this subchapter and guidance issued by the Director; and</text></subparagraph><subparagraph id="H28CF43BD49E74DB8BE45DEC840CCDD8D"><enum>(B)</enum><text>provide the public information about agency policies and procedures for governing Federal artificial intelligence systems, including the inventory of artificial intelligence use cases required by section 7225(a) of the Advancing American AI Act (subtitle B of title LXXII of <external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note).</text></subparagraph></paragraph><paragraph id="HF0B104AE408F4663AB480AD1F8E80D9A"><enum>(7)</enum><text display-inline="yes-display-inline">Establish procedures for notifying an individual or entity impacted by an agency determination made solely by an output from, or substantively and meaningfully informed, augmented, or assisted by a Federal artificial intelligence system in accordance with guidance issued by the Director under section 3593(4). </text></paragraph><paragraph id="H1A1B7DCF597940D5A9BF9A4A2AFED14E"><enum>(8)</enum><text display-inline="yes-display-inline">Modify the agency appeals process, as necessary and appropriate, to account for determinations made solely by or substantively and meaningfully informed, augmented, or assisted by a Federal artificial intelligence system, and to provide the impacted individual or entity the opportunity for an alternative review independent of the Federal artificial intelligence system, as appropriate, as established by the Director under section 3593(5).</text></paragraph><paragraph id="H06203F42C0B44713A59F93E87A942AFE"><enum>(9)</enum><text display-inline="yes-display-inline">In accordance with guidance issued by the Director under section 3593(7), oversee the establishment of AI governance charters for Federal artificial intelligence systems, including by—</text><subparagraph id="HC0CAD35928B349F6A204327757BC08FD"><enum>(A)</enum><text display-inline="yes-display-inline">establishing a process, led by each official identified in section 3594(4) to ensure that each Federal artificial intelligence system has an established AI governance charter that is regularly updated in accordance with the requirements under section 3595 and made publicly available on the webpage under paragraph (6);</text></subparagraph><subparagraph id="H7DEABF99BE0D4AE8925EF5E4EBBD931D"><enum>(B)</enum><text display-inline="yes-display-inline">submitting each AI governance charter to the Federal Register not later than 30-days after the initial establishment or termination of the charter, in conformity with guidance from the Director; and</text></subparagraph><subparagraph id="H5058F16D8BC844499B076B7014E2AA69"><enum>(C)</enum><text>submitting each AI governance charter to the Administrator for publication in a format established in the Directors guidance in accordance with section 3596.</text></subparagraph></paragraph><paragraph id="H50B34BF089BE432FB61D58DD015A493A"><enum>(10)</enum><text display-inline="yes-display-inline">In consultation with the Director, the Director of the Office of Personnel Management, and the Administrator of General Services, conduct regular training programs to educate relevant agency program and management officials, including employees supporting the functions of the Chief Information Officer, the Chief Data Officer, the Evaluation Officer, the senior privacy official, and the statistical official, as appropriate, about the management of Federal artificial intelligence systems and compliance with the requirements of this subchapter, which may be integrated with the training requirements and covered topics established by the Artificial Intelligence Training for the Acquisition Workforce Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/207">Public Law 117–207</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/41/1703">41 U.S.C. 1703</external-xref> note).</text></paragraph></section><section id="H5203590FD589419CA6B848823CDB30F6"><enum>3595.</enum><header>Agency AI Governance Charters</header><subsection id="H6D781B5564134CDBB436B6FA489FC461"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with the guidance established under section 3593(7), the head of each agency shall ensure that an accurate and complete AI governance charter is established for each Federal artificial intelligence system in use by the agency that is designated as a high-risk Federal artificial intelligence system or was trained on, uses, or produces a record maintained on an individual (as defined under section 552a(a) of title 5).</text></subsection><subsection id="H7F481CCC8E604475A29F0728EE4BEBDE" display-inline="no-display-inline"><enum>(b)</enum><header>Contents of charters</header><text>An AI governance charter for a Federal artificial intelligence system shall, at a minimum, include the following:</text><paragraph id="HF962B1F5DF174A9AAFE10BFB2D338F0A"><enum>(1)</enum><text>The name and an identifying summary of the Federal artificial intelligence system, including the following:</text><subparagraph id="HB0F018B63BC5474AB7C190FE8B5D707E"><enum>(A)</enum><text display-inline="yes-display-inline">A descriptive summary of each purpose and relevant use case of the system, as may be documented on the inventory established under section 7225 of the Advancing American AI Act (subtitle B of title LXXII of <external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note).</text></subparagraph><subparagraph id="H96839AA51273444384738AF50C90B124"><enum>(B)</enum><text display-inline="yes-display-inline">The bureau, department, or office using or operating the system, and to the extent practicable, each program designated on the website required under section 1122(a)(2) of title 31 associated with use of the system.</text></subparagraph><subparagraph id="H521898C6286A4873A4EE6F7F2AE415F6"><enum>(C)</enum><text>The name and direct contact information for a designated agency official responsible for the overall outputs of the system.</text></subparagraph><subparagraph id="H89CE372B32A3455A9BAFE4BA6A8ED772"><enum>(D)</enum><text display-inline="yes-display-inline">The name and direct contact information for a designated agency official responsible for the ongoing maintenance of the system which may be the same official designated under subparagraph (C).</text></subparagraph></paragraph><paragraph id="H56F0F9F8625B4AB39407E2D7FE5F833F"><enum>(2)</enum><text>Information about how the Federal artificial intelligence system was developed and funded, including the following:</text><subparagraph id="H6DBEBB9E546246589B0797B91B281F15"><enum>(A)</enum><text>Other individuals or entities that have developed, maintained, managed, and operated the system.</text></subparagraph><subparagraph id="HD8E56A8D4BE649498E59A799E9603E8A"><enum>(B)</enum><text>Information about any relevant Federal award including any associated contract, grant, cooperative agreement, or other transaction agreement.</text></subparagraph></paragraph><paragraph id="H4F3BDF3B2BD846809E553D5D4C82063A"><enum>(3)</enum><text>Information about the training, validation, and testing of the Federal artificial intelligence system, including the following:</text><subparagraph id="HD1B10CC6AB4645BE95F21C45B0E434F2"><enum>(A)</enum><text display-inline="yes-display-inline">A description of the type of data or data assets used in the training, validation, and testing of the Federal artificial intelligence system or, if such information is not available, a statement describing why such information is not available.</text></subparagraph><subparagraph id="H1E393D24C44848B298C6A646BFD15936"><enum>(B)</enum><text>A designation of whether any of the data or data assets used in training, validating, or testing the Federal artificial intelligence system are classified as an open Government data asset or a public data asset or a designated system of record described under paragraph (7).</text></subparagraph><subparagraph id="HC52FA73ACF0F4423888CBB30B901EC52"><enum>(C)</enum><text>Information on how to access any open Government data asset or public data asset identified under subparagraph (B).</text></subparagraph><subparagraph id="H2E32DDB0ED9A45DAA12F7295EF549A9A"><enum>(D)</enum><text display-inline="yes-display-inline">A listing of audits, testing, or other risk assessments of the Federal artificial intelligence system, including contact information of the individual or entity that conducted such assessments.</text></subparagraph></paragraph><paragraph id="HC2BBAB278BAA498CB64482DDC9796B46"><enum>(4)</enum><text>Information about ongoing oversight and maintenance of the Federal artificial intelligence system, including a description of the ongoing testing, monitoring, or auditing of the Federal artificial intelligence system, including information about the cadence of testing, as appropriate, and the entity responsible for such testing.</text></paragraph><paragraph id="H346C2D48508040C9A1FD14D7728532C8"><enum>(5)</enum><text>Information about how the system is used by the agency, including—</text><subparagraph id="H8E03FB8D362E4D03AB2C55B970345406"><enum>(A)</enum><text>the date the agency began using the system and the intended life span of use, if appropriate; and</text></subparagraph><subparagraph id="HE6D695A53C274B75AAA6B9AD2BE653C4"><enum>(B)</enum><text>whether any agency determinations have been or are intended to be based solely on an output from, or informed, augmented, or assisted by the Federal artificial intelligence system, and—</text><clause id="H17921F12FFF346D3A39A23FDD4406DD7"><enum>(i)</enum><text>a summary of how the Federal artificial intelligence system or the data or data assets produced by the Federal artificial intelligence system is used to inform, augment, or assist in making these determinations;</text></clause><clause id="HC2D6D8B6552C425984478CE41FCBA384"><enum>(ii)</enum><text>information about other agencies or federally funded entities that use or rely on these determinations; and</text></clause><clause id="H2C5702AEFE514AB6A61E090450D7C423"><enum>(iii)</enum><text>a description of any associated notice or modified appeal process as required under section 3593(4) and 3593(5).</text></clause></subparagraph></paragraph><paragraph id="H90D23D0484AE4B1BADB2EA19F51E9196"><enum>(6)</enum><text>Information about data or data assets produced by the Federal artificial intelligence system, including a description of the data or data assets produced, altered, or augmented by the system, including—</text><subparagraph id="H392F3D764E104081AF80F3A479701D35"><enum>(A)</enum><text>a designation of whether any of the data or data assets are classified as an open Government data asset or a public data asset or are included in a designated system of record described under paragraph (7);</text></subparagraph><subparagraph id="HC684C5A54E8A44A0B8A4357EE8DBE0A0"><enum>(B)</enum><text>information on how to access any such open Government data asset or public data asset identified under subparagraph (A); and</text></subparagraph><subparagraph id="H30C56AE0478648A9AD74F7463A49BCCA"><enum>(C)</enum><text>information about any other agency or federally funded entity known to use or otherwise rely upon the data or data assets identified under this paragraph.</text></subparagraph></paragraph><paragraph id="H655FE1D18A44459496A96CA8025D26EF"><enum>(7)</enum><text>Information on whether the system was trained on, uses, or produces a record maintained on an individual (as defined under section 552a(a) of title 5), including—</text><subparagraph id="H8C17BA99BE0E4D54BDA4BB620F4A398E"><enum>(A)</enum><text>a listing of any designated system of record including a reference to any associated notice in the Federal Register for the establishment or revision of such system of record, as required under section 552a(d) of title 5; or</text></subparagraph><subparagraph id="HE606AAE4675342A19C01DB1E9F84973C"><enum>(B)</enum><text>a description of any system of record that has been exempted under subsection (j) or (k) of section 552a of title 5, including the statement required under section 553(c) of title 5 that documents the reasons why the system of records is exempted.</text></subparagraph></paragraph></subsection><subsection id="HE6F64432C1E64F6B91C08D056A80E3ED"><enum>(c)</enum><header>Regular updates required</header><text display-inline="yes-display-inline">The head of each agency shall establish procedures to ensure that each AI governance charter for the agency is updated to capture any significant change to the Federal artificial intelligence system, consistent with guidance established in section 3593(7) and not less than 30 days after such change has been implemented.</text></subsection><subsection id="H6A918A24DD974A0687912953BC1A83CF"><enum>(d)</enum><header>Requirement for publication</header><text display-inline="yes-display-inline">An AI governance charter required under subsection (a) shall be made public on the agency webpage noticed in the Federal Register, and published on the Federal AI System Inventory established under section 3596, in accordance with procedures established by the agency under section 3594(9) in conformity with guidance issued by the Director under section 3593(7) before a Federal artificial intelligence system is used by an agency, except that—</text><paragraph id="H63EE7DB900C54E688FC50AB26EAF03CC"><enum>(1)</enum><text>the head of an agency may, with advance approval of the Director and notification to the appropriate congressional committees, including the relevant authorizing committee in the House of Representatives and the Senate, and the relevant agency Inspector General, waive the publication requirement under this subsection; or</text></paragraph><paragraph id="H99368B9F50374A6A9B17104FCF8221B5"><enum>(2)</enum><text display-inline="yes-display-inline">in order to protect properly classified national security information, a charter may be submitted to the Director, appropriate congressional committees, including the relevant authorizing committee in the House of Representatives and the Senate, and the relevant agency Inspector General in lieu of the publication requirement of this subsection.</text></paragraph></subsection><subsection id="H716C7C0697864356BBAFCA0FC15793A0"><enum>(e)</enum><header>Exemptions</header><text>A Federal artificial intelligence system is exempt from the requirements of this section if the system is used—</text><paragraph id="HFC013D2B7003468B8B802D301105DC02"><enum>(1)</enum><text display-inline="yes-display-inline">solely for the purpose of research or development, except that the purposes described and guidance promulgated under this subchapter should inform any such research, development, testing, or evaluation directed at future applications of Federal artificial intelligence systems; or</text></paragraph><paragraph id="H9B71CA9BEABB414FBBFC01BA8AC8C17E"><enum>(2)</enum><text>in a national security system, in whole or in part, if the agency maintains a complete and regularly updated nonpublic version of each AI governance charter in accordance with subsections (a) and (b) and the guidance required by section 3593(7).</text></paragraph></subsection></section><section id="H00C41C9C4DF849D3B89E5DB653AFF432"><enum>3596.</enum><header>AI Governance Charter Inventory</header><text display-inline="no-display-inline">The Administrator of General Services shall maintain a single, public online interface for centrally cataloging agency AI governance charters which shall be known as the <quote>Federal AI System Inventory</quote>. The Administrator and the Director shall—</text><paragraph id="HA9B42AF677BA46D4A07C3FBF38279C1D"><enum>(1)</enum><text>ensure that each agency, as appropriate, submits AI governance charters for publication on the interface, in a publicly accessible machine-readable and open format to facilitate searchability and bulk download of the inventory; and</text></paragraph><paragraph id="HB9D8C8DF4D544FDFBFA1703E85A9226E"><enum>(2)</enum><text>provide a clear process and mechanism for each agency to make timely revisions and updates.</text></paragraph></section><section id="H9C6F2453E18545F3A3AD0A566FADD656"><enum>3597.</enum><header>Independent evaluation</header><subsection id="H3989BD9E2F4E4345BE6C3B3F1E174FFB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of the enactment of this subchapter, and every 2 years thereafter, the Inspector General appointed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/4">chapter 4</external-xref> of title 5 for each agency shall perform an independent evaluation of the Federal artificial intelligence governance policies and practices of the agency and submit to the head of the agency, the Director, and the appropriate congressional committees, a report which may include a classified annex. The report shall include at a minimum—</text><paragraph id="HE33B33292C0F4F818D5DA04EBA7FCB86"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the comprehensive compliance of the agency with the requirement under section 3595 for each Federal artificial intelligence system in use or maintained by an agency to have an established, and appropriately noticed, AI governance charter, including timely revisions to reflect significant changes and appropriate use of the exemptions described under section 3595(e); and</text></paragraph><paragraph id="HB1140078367948D8B5CD1FDE5BF40BB6"><enum>(2)</enum><text display-inline="yes-display-inline">an assessment of compliance by the agency with artificial intelligence governance policies and practices with the requirements of this subchapter.</text></paragraph></subsection><subsection id="H67E6B7869E2E42FC921478FC3C0D1E6F"><enum>(b)</enum><header>Comptroller general</header><text>The Comptroller General shall periodically evaluate and submit to Congress a report on the—</text><paragraph id="H60ABF19170234F29AC2FF1673101C7C3"><enum>(1)</enum><text>effectiveness of agency Federal artificial intelligence system governance policies and practices;</text></paragraph><paragraph id="HE52ABC19E83F4B91A89A2FD97E1FB207"><enum>(2)</enum><text>implementation of the requirements of this subchapter by the Director, Administrator, and agencies; and</text></paragraph><paragraph id="HD42E4E6E2AA7408FA06608E4AA85DB3C"><enum>(3)</enum><text>extent to which the requirements of this subchapter and related implementing guidance and policies reflect technology advancements and provide any legislative recommendations as appropriate.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HF871676DAD5A46A9A402920E69088139" commented="no"><enum>(2)</enum><header>Table of sections</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HAD28855EE48641359153B3925ECEF018" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HGO00"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H7F2D6A910ED843649384ABA37AFC1710" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded" changed="added" reported-display-style="italic" committee-id="HGO00"><toc-entry idref="HB93A93548A384C368AA762C4845AFC78" level="subchapter">Subchapter IV—Artificial Intelligence System Governance</toc-entry><toc-entry idref="H18C31B5D7EB94B028D824F3F3C516A1E" level="section">3591. Independent evaluation.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H03F6F11125084A829F620471C214033D"><enum>(b)</enum><header>OMB guidance</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this Act, the Director of the Office of Management and Budget, in consultation with the Director of the National Institute of Standards and Technology, the Administrator of General Services, the Director of the Office of Science and Technology Policy, and the head of any other relevant agency as determined by the Director of the Office of Management and Budget, shall issue a memorandum to the head of each agency establishing guidance that implements the requirements of subchapter IV of title 35 of title 44, as added by this section, that—</text><paragraph id="HEAD2CCB9DAAB44D98DA8965BE9F96F22"><enum>(1)</enum><text display-inline="yes-display-inline">does not conflict with the requirements of and uses the working group established under section 7224(d) of the Advancing American AI Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note); and</text></paragraph><paragraph id="H921FBE0C06B24917AD974F41C1EBC1CD"><enum>(2)</enum><text>shall be reviewed and updated, as necessary, every 2 years for the next 10 years after the first such issuance and periodically thereafter.</text></paragraph></subsection><subsection id="HB72C9779865D4E2094087CEF2B5E8957"><enum>(c)</enum><header>Requirement to list AI governance charters in agency system of records notice under the Privacy Act</header><text display-inline="yes-display-inline">Section 552a(e) of title 5, United States Code, is amended—</text><paragraph id="H175C7CEE8ABA47E189023930F9D1E750"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4)—</text><subparagraph id="HE010302C204F4BD5A934C4E96A1BEA68"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (H), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H16400E227A2C4757A0121A6888F04826"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (I), by striking the semicolon and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HE8881D8EF9D64C62AE605B4F402BE8E2"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block id="HB1F5F46FB70E41EDAEFCF4C94E56A8F6" style="OLC" changed="added" reported-display-style="italic" committee-id="HGO00"><subparagraph id="H5796148D9A3B47F88E6D150E35ED1166"><enum>(J)</enum><text>a reference to any agency AI governance charter required under section 3595 of title 44 that is associated with a Federal artificial intelligence system which was trained on, uses, or produces records contained within the system of record;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HBC362F83234E4672B206C20E650D46A5"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (11) and (12) as paragraphs (12) and (13), respectively; and</text></paragraph><paragraph id="HE2CEEAE6A72D4322BE7C559837BCA7D1"><enum>(3)</enum><text>by inserting after paragraph (10) the following new paragraph:</text><quoted-block id="H4B7253B0134C45AC9E253163ACA2E303" style="OLC" changed="added" reported-display-style="italic" committee-id="HGO00"><paragraph id="HEB270D80957E49C793A0D97F288DE989"><enum>(11)</enum><text>establish appropriate policies and procedures, in accordance with the requirements of subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44 to ensure the security, confidentiality, and integrity of records that a Federal artificial intelligence system uses, produces, or modifies;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H6320B8478FCD4887BAB789C19D696E78" commented="no"><enum>(d)</enum><header>Technical and conforming repeals</header><text>The following are repealed:</text><paragraph id="H7882A7BBB43246C58899FB541BAB38D6" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Subsections (a) and (d) of section 7224 of the Advancing American AI Act (subtitle B of title LXXII of <external-xref legal-doc="public-law" parsable-cite="pl/117/263">Public Law 117–263</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note).</text></paragraph><paragraph id="H7A5F8452007A4ED9B1C417A1C387C07A" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Section 104 of the AI in Government Act of 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/40/11301">40 U.S.C. 11301</external-xref> note). </text></paragraph></subsection><subsection id="HDD6C5CE8B5524DD78CDB744ECCE6C2BD" commented="no"><enum>(e)</enum><header>Contracting regulations</header><text display-inline="yes-display-inline">Not later than 6 months after the date on which the first guidance is established pursuant to subsection (b), the Federal Acquisition Regulation shall be revised to—</text><paragraph id="HDB32313F677F4EFCB0A95AC444B3E3CF" commented="no"><enum>(1)</enum><text>implement the amendments made by this section; and</text></paragraph><paragraph id="HFDE270BC6D4C4FD98960B7846149911D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">require that any contractor or subcontractor (at any tier) with the Federal Government that builds, provides, operates, or maintains (pursuant to a contract entered into on or after such date of enactment) Federal artificial intelligence systems is required to provide the information that the agency is required to report in accordance with the guidance issued pursuant to section 3593(5) of title 44, United States Code, as added by subsection (a), and any agency requirement under section 3595(a) of such title.</text></paragraph></subsection><subsection id="H980D937AF740455C81C80B9E1E38A6DF" commented="no"><enum>(f)</enum><header>Rules of construction</header><paragraph id="H3E383E214E9D457C92C495DCEB498328" commented="no"><enum>(1)</enum><header>Agency actions</header><text>Nothing in this Act, or an amendment made by this Act, shall be construed to authorize the head of an agency to take an action that is not authorized by this Act, an amendment made by this Act, or other law.</text></paragraph><paragraph id="H163C0481BB11474EB3997203062362B0" commented="no"><enum>(2)</enum><header>Protection of rights</header><text>Nothing in this Act, or an amendment made by this Act, shall be construed to permit the violation of the rights of any individual protected by the Constitution of the United States, including through censorship of speech protected by the Constitution of the United States or unauthorized surveillance.</text></paragraph><paragraph id="H1B28C253D5644DE9B8BC2DB8273B6DAE" commented="no"><enum>(3)</enum><header>Protection of privacy</header><text>Nothing in this Act, or any amendment made by this Act, shall be construed to impinge on the privacy rights of individuals or allow unauthorized access, sharing, or use of personal data.</text></paragraph><paragraph id="H927CE87C515541FABEAC2D7E7CB8389C"><enum>(4)</enum><header>Protection of information</header><text>Nothing in this Act, or any amendment made by this Act, shall be construed to require, or otherwise compel, the public disclosure of information that could be withheld under section 552(b) of title 5, United States Code.</text></paragraph></subsection><subsection id="H4CA33D781D95418DA1E78A131BE7A01E"><enum>(g)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HDFAD8F8154484DFF8630F02A31774020" commented="no"><enum>(1)</enum><header>Agency</header><text display-inline="yes-display-inline">The term <term>agency</term> has the meaning given that term in section 3502 of title 44, United States Code. </text></paragraph><paragraph id="H4295C7D07096429AA8D42DFB3DF066ED" commented="no"><enum>(2)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Management and Budget, unless otherwise indicated.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20241218">December 18, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
