which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Board of Governors of the Federal Reserve System to study the impacts of the Board’s Reg II proposed rule, to complete a quantitative impact analysis of such rule, and to consider the results of such study and analysis before finalizing such rule, and for other purposes.</official-title></form><legis-body id="HA8AD7F2E25E442CA9AAA4B8C38B521BB" style="OLC"><section id="HAFFEE03B68514D398C85C56EA0A65A81" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Payments Act of 2024</short-title></quote>. </text></section><section id="H9D9435FA05EC4AB7AF51A53536C3A9A8"><enum>2.</enum><header>Study and quantitative impact analysis related to interchange transaction fee requirements</header><subsection id="HD8FA1DCB704D4D1F835BC07462663988"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System shall conduct the following:</text><paragraph id="H501879537D9B4AED945812749DC81FDA"><enum>(1)</enum><text> A study of—</text><subparagraph id="H77519946F5F64E69B09E7A550ECF6590"><enum>(A)</enum><text display-inline="yes-display-inline">the impacts of the Reg II proposed rule on—</text><clause id="HF4BD56E0A9BC4F42A7E9C0CC89833AF7"><enum>(i)</enum><text display-inline="yes-display-inline">consumers, including access to free or low- and no-cost deposit accounts;</text></clause><clause id="HC61CAE811D1B45D79873342D69B4679B"><enum>(ii)</enum><text display-inline="yes-display-inline">merchants’ costs of accepting debit cards; and</text></clause><clause id="HC5B118114E0F4F6B933A28C9AA4EF137"><enum>(iii)</enum><text>financial institutions’ efforts to mitigate fraud; and</text></clause></subparagraph><subparagraph id="HD37E92E9D0714EC8A06B3A6C511B313B"><enum>(B)</enum><text display-inline="yes-display-inline">the cumulative impacts of all proposed rules of Federal agencies issued between January 1, 2023, and the date of enactment of this Act that affect deposit accounts.</text></subparagraph></paragraph><paragraph id="HCD4D9F642CF84E088C175F5EDAA99610"><enum>(2)</enum><text display-inline="yes-display-inline">A quantitative impact analysis of the Reg II proposed rule to study—</text><subparagraph id="HC51B5BB982A54F83953F1DF6E2596D4E"><enum>(A)</enum><text display-inline="yes-display-inline">the potential impact of the rule on consumers, including the affordability of debit products and availability of low or no fee banking products serving low- and moderate-income communities; and</text></subparagraph><subparagraph id="HC360FC4EBD904DDF9A8AF6D79B2D4107"><enum>(B)</enum><text>the impact of the changes made by the rule on small insured depository institutions.</text></subparagraph></paragraph></subsection><subsection id="HCBE1F0AE3263401596B763208C136E0D"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System shall issue a report to the Congress containing all findings and determinations made in carrying out the study and the quantitative impact analysis required under subsection (a).</text></subsection><subsection id="H666BA18E6E8443FAA5FBAEC28E22DDDF"><enum>(c)</enum><header>Requirement To consider results of report before finalizing Reg II proposed rule</header><text display-inline="yes-display-inline">The Board of Governors may not finalize the Reg II proposed rule until after the issuance of the report required under subsection (b) and only after—</text><paragraph id="H3416610ED41C4AFFB7F19834C0C5B602"><enum>(1)</enum><text>considering the results contained in such report; and</text></paragraph><paragraph id="H02E61A5B2E154674940E6CEA9A232CEF"><enum>(2)</enum><text display-inline="yes-display-inline">taking into account—</text><subparagraph id="H2E5742DA4C7C4EDDBD6CD21DE2DFBB59"><enum>(A)</enum><text display-inline="yes-display-inline">the effect of the Reg II proposed rule on the capital and earnings of depository institutions; and</text></subparagraph><subparagraph id="H0730FF9945D54CCEA7F669ED2861EFAB"><enum>(B)</enum><text display-inline="yes-display-inline">whether the Board of Governors can determine that interchange fee caps provide net benefits to low- and moderate-income and underserved customers.</text></subparagraph></paragraph></subsection><subsection id="H6B912F01232541A0B26396824ACCA067"><enum>(d)</enum><header>Reg II proposed rule defined</header><text display-inline="yes-display-inline">The term <quote>Reg II proposed rule</quote> means the proposed rule titled <quote>Debit Card Interchange Fees and Routing</quote> (88 Fed. Reg. 78100; published November 14, 2023).</text></subsection></section></legis-body></bill>
