R. 7524</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240507">May 7, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend title 40, United States Code, to require the submission of reports on certain information technology services funds to Congress before expenditures may be made, and for other purposes.</official-title></form><legis-body id="H657349530D624F31B20A8F45C96119E2" style="OLC"><pagebreak></pagebreak><section id="HF60AE749E34A4952A823D9A3AC683773" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>GSA Technology Accountability Act</short-title></quote>.</text></section><section id="HDB1F3BAC0B9947D28572D0C4B59C6A1A"><enum>2.</enum><header>Transparency of GSA funded information technology services</header><subsection id="HC679E337F5024031923F46ECF627DA3A"><enum>(a)</enum><header>Transparency on use of the federal citizen services fund</header><text>Section 323 of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block id="HFB251DB3167D4D01B58010CF390B311C" style="USC"><subsection id="HDC805B6F18884D14B6C857DE935C2ADE"><enum>(g)</enum><header>Requirement for annual report to congress</header><text>Not later than September 30 of each year, the Administrator shall submit to the Committee on Oversight and Accountability of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report that includes, at a minimum, a list of each program funded by expenditures during the previous fiscal year, or that have been funded by expenditures in the previous 5-year period, including the following:</text><paragraph id="H1B6E581FBD8C4061A6576B25BF006E00"><enum>(1)</enum><text>An explanation of the program.</text></paragraph><paragraph id="H8E601E552ED14634BC9CC0E48E792710"><enum>(2)</enum><text>Information about how the program is funded, including the amount of expenditures the program received in the previous fiscal year and total amount.</text></paragraph><paragraph id="H6917E2E0EDE14DC28B18C046789E5FCD"><enum>(3)</enum><text>The amount of reimbursements associated with or anticipated to be associated with the program from another source of funds or another agency, if applicable.</text></paragraph><paragraph id="H76AD2703B4674769AB171E82A7DAAE00"><enum>(4)</enum><text>A description of projects or initiatives associated with the program, including—</text><subparagraph id="H5EF5D8C2C7F143D9B65B11A6E7307E69" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">information about when the projects or initiatives were initiated and completed; and</text></subparagraph><subparagraph id="H8E53014CFFC34FADA08ED34B2150E563" commented="no"><enum>(B)</enum><text>funding information, to the extent practicable.</text></subparagraph></paragraph><paragraph id="H5D5F58248446475192C3208A51BF61E9"><enum>(5)</enum><text display-inline="yes-display-inline">Any additional information, data, or analysis used to determine the information estimated within the report, if applicable.</text></paragraph></subsection><subsection id="H15619B2099E4421C92CA155A8E7E827E"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4E41D085208A4466B5FBCAADF7FD4F9E"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="HA2DC2F5194CD4CA98CFBDD3EE772DDD5"><enum>(2)</enum><header>Expenditure</header><text>The term <term>expenditure</term> means any obligation of funds from the Fund.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H73395A0D71CB4F8684E973CE4E572E5A"><enum>(b)</enum><header>Transparency on use of the acquisition services fund</header><text>Section 321 of title 40, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HC2F5D5FCBFD14AAEACDC0B411AA41DA2" display-inline="no-display-inline"><subsection id="H749F67F0A5B549E5B61A563C975A08A7"><enum>(h)</enum><header>Requirement for annual report to congress</header><text>Not later than September 30 of each year, the Administrator shall submit to the Committee on Oversight and Accountability of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate a report that includes, at a minimum, a list of each program within the Technology Transformation Services funded by expenditures during the previous fiscal year, or that have been funded by expenditures in the previous 5-year period, including the following:</text><paragraph id="H46455C8000804EE0ACE117A263A071B1"><enum>(1)</enum><text>An explanation of the program.</text></paragraph><paragraph id="H91C65CF9BE8B48AA99FB5378EB84BE41"><enum>(2)</enum><text>Information about how the program is funded, including the amount of expenditures the program received in the previous fiscal year and total amount.</text></paragraph><paragraph id="HD4CA63B1D4C84A059B15E26315742483"><enum>(3)</enum><text>The amount of reimbursements associated with or anticipated to be associated with the program from another source of funds or another agency, if applicable.</text></paragraph><paragraph id="H9E4D717D16254DEAB28E9D2E9B23994F"><enum>(4)</enum><text>A description of projects or initiatives associated with the program, including—</text><subparagraph id="H73BF8A173CCD415A8B5A13059F210ED9" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">information about when the projects or initiatives were initiated and completed; and</text></subparagraph><subparagraph id="H11F596A872784235B159DC4E959F1F4D" commented="no"><enum>(B)</enum><text>funding information, to the extent practicable.</text></subparagraph></paragraph><paragraph id="H432A9B4B5E6848B7A90FD97DA4248AD9"><enum>(5)</enum><text display-inline="yes-display-inline">Any additional information, data, or analysis used to determine the information estimated within the report, if applicable.</text></paragraph></subsection><subsection id="HDDF71620E6F1480CB8DF40D05A6B113B"><enum>(i)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H15AF95B0841D491BB19E687BB3B02735"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="HA9B18556807E4BDC836DEA0ED644EF1D"><enum>(2)</enum><header>Expenditure</header><text>The term <term>expenditure</term> means any obligation of funds from the Acquisition Services Fund for programs referenced in subsection (h).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE59220F311FF4AE087FD114243C1C620"><enum>(c)</enum><header>Effective date</header><text>The amendment made by this Act shall take effect on the commencement of the first fiscal year after the date of the enactment of this Act.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240506" chamber="House">Passed the House of Representatives May 6, 2024.</attestation-date><attestor display="yes">Kevin F.
