<section id="H0B8E497E31144979AB0424213AC5AFDE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Americans from Foreign Adversary Controlled Applications Act</short-title></quote>.</text></section> <section id="HF005F0B724D34EE5B991BAA61241C0CE"><enum>2.</enum><header>Prohibition of foreign adversary controlled applications</header> <subsection id="HC32FAC4BD38647D7BBFE9B480E77B096"><enum>(a)</enum><header>In general</header> <paragraph id="H8ABFFFF1E1E84EE19A5B01DB57924EF1"><enum>(1)</enum><header>Prohibition of foreign adversary controlled applications</header><text>It shall be unlawful for an entity to distribute, maintain, or update (or enable the distribution, maintenance, or updating of) a foreign adversary controlled application by carrying out, within the land or maritime borders of the United States, any of the following:</text> 
<subparagraph id="HAACB54E7038E45D08AF1DE77350B8FB5"><enum>(A)</enum><text>Providing services to distribute, maintain, or update such foreign adversary controlled application (including any source code of such application) by means of a marketplace (including an online mobile application store) through which users within the land or maritime borders of the United States may access, maintain, or update such application.</text></subparagraph> <subparagraph id="H4CCF40F9A10544A8830EBD35A681625F"><enum>(B)</enum><text>Providing internet hosting services to enable the distribution, maintenance, or updating of such foreign adversary controlled application for users within the land or maritime borders of the United States.</text></subparagraph></paragraph> 
<paragraph id="H938927C279DF49DDA187CC5DC67A64BA"><enum>(2)</enum><header>Applicability</header><text>Subsection (a) shall apply—</text> <subparagraph id="H8BD04A43BA074CE683C57C17908767C0"><enum>(A)</enum><text>in the case of an application that satisfies the definition of a foreign adversary controlled application pursuant to subsection (g)(3)(A), beginning on the date that is 180 days after the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="H9CE7920E18BA4AE4AB50852D1350AC0F"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an application that satisfies the definition of a foreign adversary controlled application pursuant to subsection (g)(3)(B), beginning on the date that is 180 days after the date of the relevant determination of the President under such subsection.</text> </subparagraph></paragraph></subsection> <subsection id="HFA95B670D4BD4973BB2932CE24D7F683"><enum>(b)</enum><header>Data and information portability to alternative applications</header><text>Before the date on which a prohibition under subsection (a) applies to a foreign adversary controlled application, the entity that owns or controls such application shall provide, upon request by a user of such application within the land or maritime borders of United States, to such user all the available data related to the account of such user with respect to such application. Such data shall be provided in a machine readable format and shall include any data maintained by such application with respect to the account of such user, including content (including posts, photos, and videos) and all other account information.</text> </subsection> 
<subsection id="H349C5671796B4DE0AE4E21A5394192F3"><enum>(c)</enum><header>Exemptions</header> 
<paragraph id="HDAA2109D389843EFA578966CB8C6373C"><enum>(1)</enum><header>Exemptions for qualified divestitures</header><text>Subsection (a)—</text> <subparagraph id="HAD2970F2BED441E2868057375502D83A"><enum>(A)</enum><text>does not apply to a foreign adversary controlled application with respect to which a qualified divestiture is executed before the date on which a prohibition under subsection (a) would begin to apply to such application; and</text></subparagraph> 
<subparagraph id="H190538B8303B48AA8D2005966A93CA51"><enum>(B)</enum><text>shall cease to apply in the case of a foreign adversary controlled application with respect to which a qualified divestiture is executed after the date on which a prohibition under subsection (a) applies to such application.</text></subparagraph></paragraph> <paragraph id="H130A379708394813AF404A9F16E3D5DC"><enum>(2)</enum><header>Exemptions for certain necessary services</header><text>Subsections (a) and (b) do not apply to services provided with respect to a foreign adversary controlled application that are necessary for an entity to attain compliance with such subsections.</text></paragraph></subsection> 
<subsection id="HE5444C27B74E4B558B891B36AEE88A68"><enum>(d)</enum><header>Enforcement</header> 
<paragraph id="H5EF7C08F57D64EC9B5DA1395766FB0DD"><enum>(1)</enum><header>Civil penalties</header> 
<subparagraph id="H7773D47688464FCC90DCDE1AE5B26ACC"><enum>(A)</enum><header>Foreign adversary controlled application violations</header><text>An entity that violates subsection (a) shall be subject to pay a civil penalty in an amount not to exceed the amount that results from multiplying $5,000 by the number of users within the land or maritime borders of the United States determined to have accessed, maintained, or updated a foreign adversary controlled application as a result of such violation.</text></subparagraph> <subparagraph id="HC5260F00FD5D45428B54CB4F352F7988"><enum>(B)</enum><header>Data and information violations</header><text>An entity that violates subsection (b) shall be subject to pay a civil penalty in an amount not to exceed the amount that results from multiplying $500 by the number of users within the land or maritime borders of the United States affected by such violation.</text></subparagraph></paragraph> 
<paragraph id="HC63AAF58C44D4E7D8202F13EBF6143A2"><enum>(2)</enum><header>Actions by Attorney General</header><text display-inline="yes-display-inline">The Attorney General—</text> <subparagraph id="H0FCBD2D3D2F640EB81F304310362FDA8"><enum>(A)</enum><text>shall conduct investigations related to potential violations of subsection (a) or (b), and, if such an investigation results in a determination that a violation has occurred, the Attorney General shall pursue enforcement under paragraph (1); and</text></subparagraph> 
<subparagraph id="HC154B4326B72481FBE1EDA46BA4FAC9C"><enum>(B)</enum><text>may bring an action in an appropriate district court of the United States for appropriate relief, including civil penalties under paragraph (1) or declaratory and injunctive relief.</text> </subparagraph></paragraph></subsection> <subsection id="H736E5C9B44254F2C9DEB92027F13A2FB"><enum>(e)</enum><header>Severability</header> <paragraph id="H69E472C8CC00471DBCCE805A2BDDA539"><enum>(1)</enum><header>In general</header><text>If any provision of this section or the application of this section to any person or circumstance is held invalid, the invalidity shall not affect the other provisions or applications of this section that can be given effect without the invalid provision or application.</text></paragraph> 
<paragraph id="H9F6D92043382433AAD184932DD7CCF11"><enum>(2)</enum><header>Subsequent determinations</header><text display-inline="yes-display-inline">If the application of any provision of this section is held invalid with respect to a foreign adversary controlled application that satisfies the definition of such term pursuant to subsection (g)(3)(A), such invalidity shall not affect or preclude the application of the same provision of this section to such foreign adversary controlled application by means of a subsequent determination pursuant to subsection (g)(3)(B).</text></paragraph></subsection> <subsection id="H967E9105052E4D6297F9DD3C74650C4C"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this Act may be construed—</text> 
<paragraph id="HA471AE44949545A593B9E857F1C9A891"><enum>(1)</enum><text>to authorize the Attorney General to pursue enforcement, under this section, other than enforcement of subsection (a) or (b);</text> </paragraph> <paragraph id="H3BA6329ABA284B318C28C05D3C36EAC2"><enum>(2)</enum><text>to authorize the Attorney General to pursue enforcement, under this section, against an individual user of a foreign adversary controlled application; or</text></paragraph> 
<paragraph id="H8134A3BF13874793890D83F108660262"><enum>(3)</enum><text>except as expressly provided herein, to alter or affect any other authority provided by or established under another provision of Federal law.</text></paragraph></subsection> <subsection id="H3F369FBEA6AB4A7590FC960706C24FF8"><enum>(g)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HC47408776DC947E4A7FE5BF53FE42392"><enum>(1)</enum><header>Controlled by a foreign adversary</header><text>The term <term>controlled by a foreign adversary</term> means, with respect to a covered company or other entity, that such company or other entity is—</text> <subparagraph id="H3E9AEEDC0F6A410E83281719CC77341A"><enum>(A)</enum><text>a foreign person that is domiciled in, is headquartered in, has its principal place of business in, or is organized under the laws of a foreign adversary country;</text></subparagraph> 
<subparagraph id="H3D418AF74E084C40A3E23E2D211F9164"><enum>(B)</enum><text>an entity with respect to which a foreign person or combination of foreign persons described in subparagraph (A) directly or indirectly own at least a 20 percent stake; or</text></subparagraph> <subparagraph id="H6781AF2DA542461BB3D035D1F81350A3"><enum>(C)</enum><text>a person subject to the direction or control of a foreign person or entity described in subparagraph (A) or (B).</text></subparagraph></paragraph> 
<paragraph id="H0C18E356CFD5481CA6152BBD60619405"><enum>(2)</enum><header>Covered company</header> 
<subparagraph id="H24BBB00B18EF4298891B704D9BBF0BDB"><enum>(A)</enum><header>In general</header><text>The term <term>covered company</term> means an entity that operates, directly or indirectly (including through a parent company, subsidiary, or affiliate), a website, desktop application, mobile application, or augmented or immersive technology application that—</text> <clause id="H0E31AF902AA14B58BD9D4038174587B1" display-inline="no-display-inline"><enum>(i)</enum><text>permits a user to create an account or profile to generate, share, and view text, images, videos, real-time communications, or similar content;</text></clause> 
<clause id="HCF81E0E076F34CA189CE9A5134DDAD9E"><enum>(ii)</enum><text>has more than 1,000,000 monthly active users with respect to at least 2 of the 3 months preceding the date on which a relevant determination of the President is made pursuant to paragraph (3)(B); </text></clause> <clause id="HDF00C8E8CC364EADBD898C8020849790"><enum>(iii)</enum><text>enables 1 or more users to generate or distribute content that can be viewed by other users of the website, desktop application, mobile application, or augmented or immersive technology application; and</text> </clause> 
<clause id="H6A1C24ED4B0B434DBDD7C36C275AE392"><enum>(iv)</enum><text>enables 1 or more users to view content generated by other users of the website, desktop application, mobile application, or augmented or immersive technology application.</text> </clause></subparagraph> <subparagraph id="H9C8BEA0571244CDD86022EDA1055A922"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered company</term> does not include an entity that operates a website, desktop application, mobile application, or augmented or immersive technology application whose primary purpose is to allow users to post product reviews, business reviews, or travel information and reviews.</text></subparagraph></paragraph> 
<paragraph id="HB5568894B1D94B058BC0D19DB8093F39"><enum>(3)</enum><header>Foreign adversary controlled application</header><text>The term <term>foreign adversary controlled application</term> means a website, desktop application, mobile application, or augmented or immersive technology application that is operated, directly or indirectly (including through a parent company, subsidiary, or affiliate), by—</text> <subparagraph id="H88C2137A4CC54F16B008825236CB4140"><enum>(A)</enum><text>any of—</text> 
<clause id="H98643A86AA084D248C6B5189D58322DE"><enum>(i)</enum><text>ByteDance, Ltd.;</text></clause> <clause id="H81D997952FA0405C801D95AEAECCA1D0"><enum>(ii)</enum><text>TikTok;</text></clause> 
<clause id="HDB3BA62775964A0792B6E43B35B99531"><enum>(iii)</enum><text> a subsidiary of or a successor to an entity identified in clause (i) or (ii) that is controlled by a foreign adversary; or</text></clause> <clause id="H3F9830E090FD4F0893290FFBBEDDBFE6"><enum>(iv)</enum><text>an entity owned or controlled, directly or indirectly, by an entity identified in clause (i), (ii), or (iii); or</text></clause></subparagraph> 
<subparagraph id="H369556F72F8D4F61A1F2A0EA31A36F45"><enum>(B)</enum><text>a covered company that—</text> <clause id="HA4AE0BB8C602469CAF8F2192139BBDE7"><enum>(i)</enum><text>is controlled by a foreign adversary; and</text></clause> 
<clause id="H30F851352C8742008517E40B7ECC561D"><enum>(ii)</enum><text>that is determined by the President to present a significant threat to the national security of the United States following the issuance of—</text> <subclause id="HF5B50997D5494773A9DE536F9E5D2370"><enum>(I)</enum><text>a public notice proposing such determination; and</text></subclause> 
<subclause id="H24A558C3D04241E38867A322E9277046"><enum>(II)</enum><text>a public report to Congress, submitted not less than 30 days before such determination, describing the specific national security concern involved and containing a classified annex and a description of what assets would need to be divested to execute a qualified divestiture.</text></subclause></clause></subparagraph></paragraph> <paragraph id="H8806C235A37D40A5833DCF97CF091C35"><enum>(4)</enum><header>Foreign adversary country</header><text>The term <term>foreign adversary country</term> means a country specified in section 4872(d)(2) of title 10, United States Code.</text></paragraph> 
<paragraph id="H9BF098B0491242EA912CA0D99F0334C3"><enum>(5)</enum><header>Internet hosting service</header><text>The term <term>internet hosting service</term> means a service through which storage and computing resources are provided to an individual or organization for the accommodation and maintenance of 1 or more websites or online services, and which may include file hosting, domain name server hosting, cloud hosting, and virtual private server hosting.</text></paragraph> <paragraph id="HA1B0385E9FF440CC9F35F48B8AF98FB8"><enum>(6)</enum><header>Qualified divestiture</header><text>The term <term>qualified divestiture</term> means a divestiture or similar transaction that—</text> 
<subparagraph id="H4654A6A792B44D869930D46CD3251CAA"><enum>(A)</enum><text>the President determines, through an interagency process, would result in the relevant covered company no longer being controlled by a foreign adversary; and</text></subparagraph> <subparagraph id="H7B5ED71582884BC8A1B2719242877358"><enum>(B)</enum><text>the President determines, through an interagency process, precludes the establishment or maintenance of any operational relationship between the United States operations of the relevant foreign adversary controlled application and any formerly affiliated entities that are controlled by a foreign adversary, including any cooperation with respect to the operation of a content recommendation algorithm or an agreement with respect to data sharing.</text></subparagraph></paragraph> 
<paragraph id="H833C378B554344B6BC9EB4CB5373AD50"><enum>(7)</enum><header>Source code</header><text>The term <term>source code</term> means the combination of text and other characters comprising the content, both viewable and nonviewable, of a software application, including any publishing language, programming language, protocol, or functional content, as well as any successor languages or protocols.</text></paragraph> <paragraph id="HAE1649308BDA41B28CE0FCC4E7F69E73"><enum>(8)</enum><header>United states</header><text>The term <term>United States</term> includes the territories of the United States.</text> </paragraph></subsection></section> 
<section id="H31900EB1DECB4FFCB1679925A52FF189"><enum>3.</enum><header>Judicial review</header> 
<subsection id="H05815C698AF14EC0A7E36F4F100FDB27"><enum>(a)</enum><header>Right of action</header><text>A petition for review challenging this Act or any action, finding, or determination under this Act may be filed only in the United States Court of Appeals for the District of Columbia Circuit.</text></subsection> <subsection id="H7EF9E1474085455B9EAB83543F43D8BC"><enum>(b)</enum><header>Exclusive jurisdiction</header><text>The United States Court of Appeals for the District of Columbia Circuit shall have exclusive jurisdiction over any challenge to this Act or any action, finding, or determination under this Act.</text></subsection> 
<subsection id="HFB496F82765C473DAC41367A23A8EC82" commented="no"><enum>(c)</enum><header>Statute of limitations</header><text>A challenge may only be brought—</text> <paragraph id="H9CCFC9B9259847088FF29F7763146584" commented="no"><enum>(1)</enum><text>in the case of a challenge to this Act, not later than 165 days after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="HF58A3513596C4ECA9863FB2565FDF872" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of a challenge to any action, finding, or determination under this Act, not later than 90 days after the date of such action, finding, or determination.</text> </paragraph></subsection></section> </legis-body></bill>
