distributes a mobile application that the Federal Government has prohibited for Government-owned devices to disclose that fact to any individual who downloads, updates, or otherwise uses such application, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="HF42F03155FC449F28C870456C0B729C8"><section id="H5F495ACBA9B944DAA84D613AF2564B39" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chinese-owned Applications Using The Information of Our Nation Act of 2023</short-title></quote> or the <quote><short-title>CAUTION Act of 2023</short-title></quote>.</text></section><section id="H4643944FB1E04F6EB91CC57F8A278DE3"><enum>2.</enum><header>Disclosure requirements</header><subsection id="H7E88B9966B1D469BA775B571AC4EB045"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any person that sells or distributes a covered application that the Federal Government has prohibited the use of for information technology and required to be removed from such information technology under the No TikTok on Government Devices Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>), before any individual downloads or updates the covered application, shall disclose, in a clear and conspicuous manner, that the use of the covered application is prohibited on Government-owned devices under law.</text></subsection><subsection id="HFEE2422D6B6140289890F5423D8AC65F" commented="no"><enum>(b)</enum><header>False information</header><text>It shall be unlawful for any person to knowingly provide false information with respect to the disclosure required under this section.</text></subsection><subsection id="H7ECEE652E14E4CD390820812CD33ACA6"><enum>(c)</enum><header>Enforcement</header><paragraph id="HC8C0C6F4960A4F079F3089A1FC39576C"><enum>(1)</enum><header>Unfair and deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of this section shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph id="HE5199F02A88E4C85BCF3BC64B71C374D"><enum>(2)</enum><header>Powers of the Federal Trade Commission</header><subparagraph id="H0DA4847710B24E4C9779757C6990B7A5"><enum>(A)</enum><header>In general</header><text>The Federal Trade Commission shall enforce this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section.</text></subparagraph><subparagraph id="H008FB17C45934D3A9E7A47B114804596"><enum>(B)</enum><header>Privileges and immunities</header><text>Any person that violates this section shall be subject to the penalties, provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="HB5A76985968E47E69429FE5D29F66A27"><enum>(3)</enum><header>Authority preserved</header><text>Nothing in this section shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></paragraph></subsection><subsection id="H9E2BC33BD45C4F83B7903841F169435B"><enum>(d)</enum><header>Effective date</header><text>This section shall take effect 180 days after the date of the enactment of this Act.</text></subsection><subsection id="H36CF0734DC1F46F68D1047E23C80743A"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HB4FF4C647AF34DA88379FACD382FF2FA"><enum>(1)</enum><header>Covered application</header><text display-inline="yes-display-inline">The term <term>covered application</term> has the meaning given that term in section 102 of division R of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>).</text></paragraph><paragraph id="HDD20FA2895CD4258A6BA9921B9BCD20B"><enum>(2)</enum><header>Individual</header><text>The term <term>individual</term> means a natural person residing in the United States.</text></paragraph><paragraph id="H94B874EE0C9F4C01AD549242D9CA64D4"><enum>(3)</enum><header>Information technology</header><text display-inline="yes-display-inline">The term <term>information technology</term> has the meaning given that term in section 102 of division R of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>).</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date>May 31,
