which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Higher Education Act of 1965 to create a demonstration project for competency-based education and clarify eligible competency-based education programs.</official-title></form><legis-body id="H184A6864DCFA41DE9F118F1CA538F820" style="OLC"><section id="H6E5CDCF2746B4FA48D0A836BAE1E1EF8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Empowering Learners through Competency-Based Education Act</short-title></quote>.</text></section><section id="H297FA27B77004CEF80C6EDE9C543AE2E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H94FC2498D9A64347A35826959639EC83"><enum>(1)</enum><text>Competency-based education, in which the measurement of learning in place of the measurement of time is a distinguishing feature, is an efficient, effective, and rigorous form of postsecondary education, the widespread adoption of which is necessary and desirable as a means of improving learning outcomes, student success, and reducing the cost of higher education in the United States, and it is therefore necessary to clarify the definition of and requirements for competency-based education so as to facilitate its application and availability.</text></paragraph><paragraph id="H1E91CC643049431DAE3466258611E087"><enum>(2)</enum><text>Reputable and responsible institutions of higher education have for many years developed, offered, and demonstrated the academic rigor, effectiveness, and outcomes of competency-based education.</text></paragraph><paragraph id="HA08A46B627ED429C9E0C46924B943A0D"><enum>(3)</enum><text>An increasing number of institutions of higher education now seek to develop and offer competency-based education.</text></paragraph><paragraph id="HC8DEA7A0012A4BD18278BA3B41DD14FC"><enum>(4)</enum><text>The collection and dissemination of complete and reliable information respecting the impact of competency-based education on the quality of learning, employability and employer acceptance, retention, time to completion, graduation rates, and cost will significantly enhance the adoption of competency-based education as an essential component of postsecondary education in the United States.</text></paragraph><paragraph id="H82CCB263D1F24E64B1C5C18EBDCB5B19"><enum>(5)</enum><text>It is in the public interest to improve the efficiency and value of postsecondary education and therefore support the offering of competency-based education.</text></paragraph></section><section id="H50194E05F33C48748AA32BE492E123CE"><enum>3.</enum><header>General definitions</header><text display-inline="no-display-inline">Section 103 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003</external-xref>) is amended by adding at the end the following:</text><quoted-block id="HE01B8073416E4CED9A766DD5AC7D5DE7" style="OLC"><paragraph id="HFD1E7B46142647D1AEFE0E3DAB4910A2"><enum>(25)</enum><header>Competency; competency-based education program</header><subparagraph id="HEA02173B552446CEBEC6DB1E77C9C3D3"><enum>(A)</enum><header>Competency</header><text>The term <term>competency</term> means the knowledge, skill, abilities and behaviors needed for a particular field of study or work-based context.</text></subparagraph><subparagraph id="HC3C5AD034EA94FD9A482720187A4BC4E"><enum>(B)</enum><header>Competency-based education program</header><text>The term <term>competency-based education program</term> means a postsecondary program, including one defined under section 481(b)(4), that provides competency-based education for which the accrediting agency or association of the institution of higher education offering such program has approved the program in accordance with such standards—</text><clause id="H64FE0B1E59FA4BE48948BA4621767DD1"><enum>(i)</enum><text>measures academic progress and credential attainment by the assessment of student learning in lieu of, or in addition to, credit or clock hours;</text></clause><clause id="H71BBC81A5FBF4E1C86CD12294A7D43B4"><enum>(ii)</enum><text>measures and assesses such academic progress and attainment in terms of a student’s mastery of competencies by identifying what students know through criterion referenced or performance-based assessment;</text></clause><clause id="H170ABDFC5AEA4300BEF581146675AB51"><enum>(iii)</enum><text>provides the educational content, activities, support, and resources necessary to enable students to develop and attain the competencies that are required to demonstrate mastery of such competencies in which instructors are responsible for providing academic assistance, when needed; and</text></clause><clause id="H978760B4D1C94F8EA182B1C370034B3E"><enum>(iv)</enum><text>upon a student’s demonstration or mastery of a set of competencies identified and required by the institution, leads to or results in the awarding of a credential.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H63206933B4064BAAAB3D051C786E87EA"><enum>4.</enum><header>Reporting on competency-based education programs</header><text display-inline="no-display-inline">Section 131 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1015">20 U.S.C. 1015</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H4D1607FEDD11447FB0DB1B866F5FAD1E" style="OLC"><clause id="H188885D7B06548BC8CBCF490CFD69369"><enum>(i)</enum><header>Reporting on competency-based education programs</header></clause><paragraph id="H0875C4FF723C4FF1B4AA7042FBB50AB3"><enum>(1)</enum><text>Not later than 6 months after the date of enactment of the <short-title>Empowering Learners through Competency-Based Education Act</short-title>, the Secretary shall, for each institution that has more than 200 students enrolled in competency-based education programs in an academic year (as defined in section 481(a)), collect, verify, and make publicly available on the same data that is in College Scorecard, or any similar successor website.</text></paragraph><paragraph id="H153C67FBF67747B9A0679F4AA4E459C0"><enum>(2)</enum><text>Information on competency-based education programs conducted under this section as described at paragraph (3) of this subsection shall be collected by the Secretary for the purpose of evaluating best practices respecting the administration of such programs, including effects on student outcomes, time to credential, total price, and job placement, and shall annually report to the Congress respecting such findings.</text></paragraph><paragraph id="H2A5B7D1EDE564C8C8433334CDC1C8C1D"><enum>(3)</enum><text>For the purposes described in subsections (1) and (2) of this section, the Secretary shall collect the following information for each eligible institution offering competency-based education:</text><subparagraph id="H17E7CCD121384EF6ABDDACAB33F2B59F"><enum>(A)</enum><text>The tuition and fees of the program and any other components of student’s cost of attendance (as defined in section 472) that are required for enrollment.</text></subparagraph><subparagraph id="H45AF1463BD434C7A9D587577F40577F5"><enum>(B)</enum><text>The median earnings of students who complete and do not complete the program.</text></subparagraph><subparagraph id="H54F7618B07FA466CB382C2CD5BFCAA10"><enum>(C)</enum><text>The median time to credential.</text></subparagraph><subparagraph id="H510493B00B9548E99FAEC77420D740D0"><enum>(D)</enum><text>The number and percentage of students who complete a credential within 100 percent, 150 percent, and 200 percent of the published length of the program.</text></subparagraph><subparagraph id="H644DB86AB1FE4057A2A0C3C288A768F5"><enum>(E)</enum><text>The number and percentage of students completing the program who are employed not later than 180 days and 1 year, respectively, after completing the eligible program, if available.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H31B7074289544DDBB60F32A611558A92"><enum>5.</enum><header>Definitions of academic year and eligible program</header><text display-inline="no-display-inline">Section 481 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088</external-xref>) is amended—</text><paragraph id="H17A94CF61CAA4C6D8AFC291877EC8EC4"><enum>(1)</enum><text>in subsection (a)(2), by inserting the following:</text><quoted-block id="H3AC685B7F7E94452A2EFCB574E1B9536" style="OLC"><subparagraph id="HBC6393859DD442D7B4B14FCBDF5692E4"><enum>(C)</enum><text>For any program of competency-based education (as defined in section 103 of this Act), the term <term>academic year</term> shall require an equivalent to the credit and clock hour requirements in subparagraphs (A) and (B) of this subsection.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H8E799A555F1547508832EED03A197B6F"><enum>(2)</enum><text>for purposes of this Act, the term <term>eligible program</term> includes a competency-based education program.</text></paragraph></section><section id="H37CCEB6180E9448EA8E3657EA54476CC"><enum>6.</enum><header>Competency-based education demonstration projects</header><text display-inline="no-display-inline">Part G of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1088">20 U.S.C. 1088 et seq.</external-xref>) is amended by inserting after section 486A the following:</text><quoted-block id="HBAA46E9BF97F4EB5A7B8140459F9F7EF" style="OLC"><section id="H98B4AC434E2A4BDEB8995C85F6BF3516"><enum>486B.</enum><header>Competency-based education demonstration projects</header><subsection id="H3C1ACA872C444A65B88B8AF1D102A429"><enum>(a)</enum><header>Demonstration projects authorized</header><text>The Secretary shall select, in accordance with subsection (d), eligible entities that voluntarily seek to carry out competency-based education demonstration projects for a duration of 5 years and receive waivers or other flexibility described in subsection (e) to carry out such projects.</text></subsection><subsection id="HE0E6918BA9994157B50F9D9E5EFB9758"><enum>(b)</enum><header>Application</header><paragraph id="H9D665E80C5274432AAA0A9C9FAA74952"><enum>(1)</enum><header>In general</header><text>Each eligible entity desiring to carry out a demonstration project under this section shall submit an application to the Secretary, at such time and in such manner as the Secretary may require.</text></paragraph><paragraph id="H475636FED5804D7F862F24D4DC85704E"><enum>(2)</enum><header>Outreach</header><text>The Secretary shall, prior to any deadline to submit applications under paragraph (1), conduct outreach to institutions of higher education, in particular to institutions eligible for programs under titles III and V of this Act, as well as institutions that predominantly enroll adult learners or students with disabilities, or are located in rural areas.</text></paragraph><paragraph id="H3FD78747BF074310B1C11396B5DD012E"><enum>(3)</enum><header>Amendments</header><subparagraph id="H11869FD29C2F436E96E4E7E2024082E3"><enum>(A)</enum><header>In general</header><text>An eligible entity that has been selected to carry out a demonstration project under this section may submit to the Secretary amendments to the eligible entity’s approved application under paragraph (1), at such time and in such manner as the Secretary may require, which the Secretary shall approve or deny within 30 days of receipt.</text></subparagraph><subparagraph id="H7D66093848984EC582048AD1E0220C51"><enum>(B)</enum><header>Expanding enrollment</header><text>Notwithstanding the assurance required with respect to maximum enrollment under paragraph (4)(N), an eligible entity whose demonstration project has been evaluated under subsection (g)(2) not less than twice, may submit to the Secretary an amendment to the eligible entity’s application under paragraph (1) to increase enrollment in the project to more than 3,000 students, but not more than 5,000 students, and which shall specify—</text><clause id="H6F24A17090404CA88AE3BEFEE04DC808"><enum>(i)</enum><text>the proposed maximum enrollment and annual enrollment growth for the project;</text></clause><clause id="H18D3B273195443ADAA17026830CA7373"><enum>(ii)</enum><text>how the eligible entity will successfully carry out the project with such maximum enrollment and enrollment growth;</text></clause><clause id="H575CF8DF2AEE4C0EAB6DAC1D78CE564D"><enum>(iii)</enum><text>any other amendments to the eligible entity’s application under paragraph (1) that are related to such maximum enrollment or enrollment growth; and</text></clause><clause id="H246DC2807ED846349CFF91ACBBCB3686"><enum>(iv)</enum><text>the Secretary shall determine whether to approve or deny an amendment submitted under clause (i) for a demonstration project based on the project’s evaluations under subsection (g)(2).</text></clause></subparagraph></paragraph><paragraph id="HBBEFD6A9ACF34732B4B0B307AB43241A"><enum>(4)</enum><header>Contents</header><text>Each application under paragraph (1) shall include—</text><subparagraph id="H0DACFB7FC2434FDF9400692D32B5E564"><enum>(A)</enum><text>a description of each competency-based education program to be offered by the eligible entity under the demonstration project;</text></subparagraph><subparagraph id="H68AD3C75C6BC43A18AC4CBA0B835B5ED"><enum>(B)</enum><text>a description of the alignment of the proposed competency-based education program to the institution’s mission, and evidence of institutional commitment to such program;</text></subparagraph><subparagraph id="H6A9D93C35FAF4BD78BEA40446EC97AD8"><enum>(C)</enum><text>a description of how each program will work with employers and local industry to assess and incorporate competencies that are relevant in the labor market and how the program aligns with employer needs;</text></subparagraph><subparagraph id="HDF3BFCE6B1FF40448FDCFCAE4C26D0F2"><enum>(D)</enum><text>a description of the proposed academic design, academic and support services, delivery, business, and financial models for the demonstration project, including explanations and supporting documents of how each competency-based education program offered under the demonstration project will—</text><clause id="H55683105609A44C98EB4A1156FA127D6"><enum>(i)</enum><text>result in the achievement of competencies;</text></clause><clause id="H482215E43F6944618AD93EB4509FB7A2"><enum>(ii)</enum><text>differ from standard credit or clock hour approaches, in whole or in part; and</text></clause><clause id="H3CFBD4D67EA64AAE87E6CBFD0A47C2BF"><enum>(iii)</enum><text>may result in an improvement in one or more student outcomes metrics described in subparagraph (R)(i);</text></clause></subparagraph><subparagraph id="H04B08253F0D9443182776318F536C525"><enum>(E)</enum><text>a description of how each competency-based education program offered under the demonstration project will award academic credit to advance the progress of a student toward completion of a certificate or degree that is used by in-demand employers for making employment decisions;</text></subparagraph><subparagraph id="HD04327D32388496C88CBEB3BADAE1E0E"><enum>(F)</enum><text>a description of how each competency-based education program offered under the demonstration project is aligned with a career pathway (as defined in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>)), if applicable;</text></subparagraph><subparagraph id="H1564C5C274CF483AA3CE55DE84D8F6CC"><enum>(G)</enum><text>a description of the meaningful role of the appropriate instructors of the eligible entity in the development, design, implementation, delivery, and evaluation of each such competency-based education program;</text></subparagraph><subparagraph id="H329E58626CF9488FB9440052743F3DEC"><enum>(H)</enum><text>a description of how the eligible entity will facilitate transfer, postsecondary study, and employer understanding by articulating a competency-based transcript from a competency-based education program offered under the demonstration project to a credit or clock hour transcript at another program at the eligible entity and to other institutions of higher education;</text></subparagraph><subparagraph id="HE403214F92844AF3B43D31FC173755C9"><enum>(I)</enum><text>a description of the statutory and regulatory requirements described in subsection (e) for which the eligible entity is seeking a waiver or other flexibility, and why such waiver or flexibility is necessary to carry out the demonstration project;</text></subparagraph><subparagraph id="H0A372E1A00BA45D1B1A28DE136EDA80A"><enum>(J)</enum><text>a description of indicators of a program’s effectiveness to inform how a third party will reliably assess student learning for each competency-based education program offered under the demonstration project, if applicable;</text></subparagraph><subparagraph id="HCFF62B941CAD46E5A450AB33F4247DEB"><enum>(K)</enum><text>a description of how the eligible entity will develop and evaluate the competencies and assessments of student knowledge administered as part of the demonstration project, including whether there is a relationship between the competency unit and a traditional credit or clock hour, the average time it takes to earn a competency, how such competencies and assessments are aligned with workforce needs and any other considerations the institution made when it developed its unit of competency;</text></subparagraph><subparagraph id="H35CA041F8A594DD5B9F7CB8055EDE052"><enum>(L)</enum><text>a description of the proposal for determining a student’s Federal student aid eligibility under this title for participating in the demonstration project, the award and distribution of such aid, and the safeguards to ensure that students are making satisfactory progress that warrants the disbursement of such aid;</text></subparagraph><subparagraph id="HECED23AA2DB54D65BCD1451D4120486B"><enum>(M)</enum><text>an assurance that the demonstration project at each eligible entity—</text><clause id="HEC9428489A9D4F639682D52BC775249E"><enum>(i)</enum><text>will enroll a minimum of 30 students and a maximum of 3,000 students or, in the case of an eligible entity with an application amendment approved under paragraph (3)(B), the maximum enrollment approved under such paragraph;</text></clause><clause id="H16B1132591824106AC0F3BD508062C4F"><enum>(ii)</enum><text>will identify and disseminate best practices with respect to the demonstration project to the Secretary and to other eligible entities carrying out a demonstration project under this section;</text></clause><clause id="HCA0F9A2EF7D74B97A27B1881BEE7667D"><enum>(iii)</enum><text>operates under an agreement with the accrediting agency or association of the eligible entity to establish the standards described in subsection (c); and</text></clause><clause id="HA7D0ED4E534B499EA96FEE03B4021C39"><enum>(iv)</enum><text>uses available funds solely for purposes of awarding academic credit to eligible students based on the achievement of competencies and for the related costs or fees of demonstrating the achievement of competencies;</text></clause></subparagraph><subparagraph id="H5B61140DBD9C4D9688BDAFA85CA6A778"><enum>(N)</enum><text>a description of the population of students to whom competency-based education under the demonstration project will be offered, including demographic information and prior educational experience, disaggregated by students who are Federal Pell Grant recipients, the race of the students, students with disabilities, students who are veterans or members of the Armed Forces, adult learners, and first generation college students, and how such eligible entity will, when appropriate, address the specific needs of each such population of students when carrying out the demonstration project;</text></subparagraph><subparagraph id="H41C5BDA3426E47F6B5BBBB53D189E23A"><enum>(O)</enum><text>a description of how the institution is ensuring that students participating in the demonstration project will not, on average, be eligible for more or less Federal assistance under this title than such students would have been eligible for under a program measured in credit or clock hours;</text></subparagraph><subparagraph id="HB0B4457A754742DB9401A5365320ABD6"><enum>(P)</enum><text>the cost of attendance for each competency-based education program offered under the demonstration project, disaggregated by each of the applicable costs or allowances described in paragraphs (1) through (13) of section 472, and the estimated amount of the cost of attendance of each such program to be covered by need-based grant aid and merit-based grant aid from Federal, State, institutional, and private sources; and</text></subparagraph><subparagraph id="H16AC5822F602465D882C4C151C1C4034"><enum>(Q)</enum><text>a description of how the eligible entity will use data to—</text><clause id="H7AF55DFD7BA1457CBBD5CCC31BD67CB5"><enum>(i)</enum><text>define and measure student outcomes;</text></clause><clause id="H47983BA15D8F455388C312C69A224AD1"><enum>(ii)</enum><text>ensure that each competency-based education program under the demonstration project meets the benchmarks established in accordance with subsection (d)(2)(E);</text></clause><clause id="HE94AD67CC4D94153BFF386F13B3D7994"><enum>(iii)</enum><text>confirm relevancy of competencies in the labor market; and</text></clause><clause id="HCCC28AE5EA684E6CAC05D57643848544"><enum>(iv)</enum><text>improve each such program.</text></clause></subparagraph></paragraph></subsection><subsection id="HE976D80D195541269E2BB650F5486B81"><enum>(c)</enum><header>Recognition by accrediting agency or association</header><text>Unless a program has already been recognized as a competency-based education program (including as a direct assessment program) by the accrediting agency or association of the eligible entity, in order to carry out a competency-based education program under a demonstration project under this section, an eligible entity shall include in its application under subsection (b), a letter from the accrediting agency or association of the eligible entity that describes how it will establish and enforce certain standards with respect to such competency-based education program.</text></subsection><subsection id="HA998B6470E984050A5CABF00BC5C54CE"><enum>(d)</enum><header>Selection</header><paragraph id="HA7ADCF57443642A689A62D6C119321D6"><enum>(1)</enum><header>In general</header><text>Not later than 12 months after the date of enactment of the <short-title>Empowering Learners through Competency-Based Education Act</short-title>, the Secretary shall select eligible entities to carry out an demonstration project under this section under which at least one competency-based education program is offered at each eligible entity.</text></paragraph><paragraph id="HD985A7EC995B47D492676EDF7838E995"><enum>(2)</enum><header>Considerations</header><text>In selecting eligible entities under paragraph (1), the Secretary shall—</text><subparagraph id="H14B1E81092054769AA06FDB17156452A"><enum>(A)</enum><text>consider the number and quality of applications received;</text></subparagraph><subparagraph id="HFAA8DEB1E5E94ECBA96607C1D9DC24C9"><enum>(B)</enum><text>consider an eligible entity’s—</text><clause id="HAEF679E561AD4EDFA8B17CC776DBD886"><enum>(i)</enum><text>ability to successfully execute the demonstration project as described in the eligible entity’s application under subsection (b);</text></clause><clause id="H60253B9D148145319C28E3C2DA493E7A"><enum>(ii)</enum><text>commitment and ability to effectively finance the demonstration project;</text></clause><clause id="HB4485D564B3546C5932B5D51166A5E8F"><enum>(iii)</enum><text>ability to provide administrative capability and the expertise to evaluate student progress based on measures other than credit hours or clock hours;</text></clause><clause id="H49D58DE11C5042ECB1EB0829ECCC59F6"><enum>(iv)</enum><text>history of compliance with the requirements of this Act;</text></clause><clause id="HD84D7DD4289A40C0BAE93B7B5FFAF7D5"><enum>(v)</enum><text>commitment to work with the Secretary to evaluate the demonstration project and the impact of the demonstration project under subsection (g)(2);</text></clause><clause id="HE3993C7A5DCA462A9F4A60DB6B8F272D"><enum>(vi)</enum><text>commitment and ability to assess student learning through a third party, as applicable;</text></clause><clause id="H85B4C9B8344142C2A1A97EE6E8B00453"><enum>(vii)</enum><text>commitment of the accrediting agency or association of the eligible entity to establish and enforce the standards described in subsection (c); and</text></clause><clause id="H66AB596627E24FE4B7A8A2E90331A647"><enum>(viii)</enum><text>commitment to collaboration with an employer to determine how the demonstration project will meet employer needs;</text></clause></subparagraph><subparagraph id="H3DEA97DD072A4D469A291E7808E245FE"><enum>(C)</enum><text>ensure the selection of a diverse group of eligible entities with respect to size, mission, student population, and geographic distribution;</text></subparagraph><subparagraph id="H302A968FA1444D7194E3FA2E1B8A2659"><enum>(D)</enum><text>not limit the types of programs of study or courses of study approved for participation in a demonstration project; and</text></subparagraph><subparagraph id="H72AF372E6FDB411589379A5994C033CF"><enum>(E)</enum><text>not select an eligible entity that, for 1 or both of the preceding 2 fiscal years—</text><clause id="H745B2A4564084AC987C6206B0C636DCF"><enum>(i)</enum><text>was under probation or an equivalent status from the accrediting agency or association of the eligible entity; and</text></clause><clause id="H5ACF1AE046924E1A973EB488F107643B"><enum>(ii)</enum><text>was under sanction from the authorization agency of the State in which the eligible entity is located.</text></clause></subparagraph></paragraph></subsection><subsection id="HA3ADADD2C1D647DBABCC7F3D1B014C1B"><enum>(e)</enum><header>Waivers and other flexibility</header><paragraph id="HA47F6CB4E744400E8B8558AD475BB184"><enum>(1)</enum><header>In general</header><text>With respect to any eligible entity selected to carry out a demonstration project under this section, the Secretary may—</text><subparagraph id="HDBF199F47AD94B76BE767FCBA59D2ABA"><enum>(A)</enum><text>waive any requirements of the provisions of law (including any regulations promulgated under such provisions) listed in paragraph (2) for which the eligible entity has provided a reason for waiving under subsection (b)(4)(J); or</text></subparagraph><subparagraph id="H95671974CFD44027B4B2CFBEDBFDAC7C"><enum>(B)</enum><text>provide other flexibility, but not waive, any requirements of the provisions of law (including any regulations promulgated under such provisions) listed in paragraph (3) for which the eligible entity has provided a reason with which the Secretary agrees for such flexibility under subsection (b)(4)(J).</text></subparagraph></paragraph><paragraph id="H9DA4485FDA084D92859AEF9C02068404"><enum>(2)</enum><header>Provisions eligible for waivers</header><text>The Secretary may waive the following under paragraph (1)(A):</text><subparagraph id="H9B409A19B67141C1BA8BB3C73B0D9E68"><enum>(A)</enum><text>Subparagraphs (A) and (B) of section 102(a)(3).</text></subparagraph><subparagraph id="HA1DD516573E244E7AE2D4F87D2FFFB83"><enum>(B)</enum><text>Section 484(l)(1).</text></subparagraph></paragraph><paragraph id="H145AE816578C4CE5AA9983BA91B00148"><enum>(3)</enum><header>Provisions eligible for flexibility</header><text>The Secretary may provide the flexibility described in paragraph (1)(B) with respect to the requirements under provisions in title I, part F of this title, or this part, that inhibit the operation of a competency-based education program, relating to the following:</text><subparagraph id="HA3A885179B9B4EBAB4B37EBE98F4F7DF"><enum>(A)</enum><text>Documenting attendance.</text></subparagraph><subparagraph id="H9D0B2D0CAF6A422FA6CFCFF2A3113A98"><enum>(B)</enum><text>Weekly academic activity.</text></subparagraph><subparagraph id="HECE563A61F334ACB80843B2CA977F402"><enum>(C)</enum><text>Minimum weeks of instructional time.</text></subparagraph><subparagraph id="HE69474D5EF3C4F1D87D772B58EB9DC91"><enum>(D)</enum><text>Requirements for credit hour or clock hour equivalencies if an institution proposes a measure clearly defined in its application that accounts for the academic intensity of study.</text></subparagraph><subparagraph id="H5260360056A54CC291BFAB9EF1B91F27"><enum>(E)</enum><text>Requirements for regular and substantive interaction with the instructor.</text></subparagraph><subparagraph id="HDA722AD7FAB94A30BA65E60242190A15"><enum>(F)</enum><text>Definitions of the terms <term>academic year</term>, <term>full-time student</term>, <term>part-time student</term>, <term>term</term> (including <quote>standard term</quote>, <quote>non-term</quote>, and <quote>non-standard term</quote>), <quote>satisfactory academic progress</quote>, <quote>educational activity</quote>, <quote>program of study</quote>, and <quote>payment period</quote>.</text></subparagraph><subparagraph id="H31C401ED28384F3DBAF85751FA9C3A6B"><enum>(G)</enum><text>Methods of disbursing student financial aid by institutions of higher education selected, as of the date of enactment of the <short-title>Empowering Learners through Competency-Based Education Act</short-title>, as experimental sites under section 487A(b)(3) to carry out competency-based education programs.</text></subparagraph></paragraph></subsection><subsection id="HC5A6F4FD522A4E1DAB6B98871CDD4E52"><enum>(f)</enum><header>Notification</header><text>Not later than 9 months after the date of enactment of the <short-title>Empowering Learners through Competency-Based Education Act</short-title>, the Secretary shall make available to the authorizing committees and the public a list of eligible entities selected to carry out a demonstration project under this section, which shall include for each such eligible entity—</text><paragraph id="H156C5DD667494218BE86E9076415EB0C"><enum>(1)</enum><text>the specific waiver or other flexibility from statutory or regulatory requirements offered under subsection (e); and</text></paragraph><paragraph id="H41F976DF413B4A8991CE77154F5F0122"><enum>(2)</enum><text>a description of the competency-based education programs, and its associated accreditation standards, to be offered under the project.</text></paragraph></subsection><subsection id="H7779E97A035A4EC59BF3AC9B821D2FB3"><enum>(g)</enum><header>Evaluation and report</header><paragraph id="HF2BA7CF0708F4D0183E3331DBBC913FE"><enum>(1)</enum><header>Evaluation</header><text>The Secretary shall evaluate the demonstration programs authorized under this section on an annual basis. Such evaluations specifically shall review—</text><subparagraph id="HCB8B64D1778F4985AF6BDED2A5DF201F"><enum>(A)</enum><text>the extent to which the institution, has met the goals set forth in its application to the Secretary;</text></subparagraph><subparagraph id="H534E3233CAEA4B389C17DCCE3D3F9720"><enum>(B)</enum><text>the number and types of students participating in the programs offered, including the progress of participating students toward recognized certificates or degrees and the extent to which participation in such programs increased;</text></subparagraph><subparagraph id="H71790C78D6154B398098A270A7B22F56"><enum>(C)</enum><text>issues related to student financial assistance for competency-based education; and</text></subparagraph><subparagraph id="HC869F21E54AE49FEA6621D07200FD09E"><enum>(D)</enum><text>the extent to which statutory or regulatory requirements not waived under the demonstration program present difficulties for students or institutions.</text></subparagraph></paragraph><paragraph id="HD9B2D083186B4DCB9060162B1F181DA6"><enum>(2)</enum><header>Report</header><text>No later than 1 year after the conclusion of the demonstration program, the Secretary shall provide a final report to the authorizing committees regarding—</text><subparagraph id="H75DE3B11885245C0BDA628DB11F707FB"><enum>(A)</enum><text>the demonstration programs authorized under this section;</text></subparagraph><subparagraph id="H62317B87A24141F2891647472068EA77"><enum>(B)</enum><text>the number and types of students receiving assistance under this title for instruction leading to a recognized credential, certificate, or degree, including the progress of such students toward recognized credential, certificate, and the degree to which participation in such programs leading to such certificates increased;</text></subparagraph><subparagraph id="H49E87AF4F919476F8C4DB31A25275486"><enum>(C)</enum><text>identified policies that present impediments to the development and use of competency-based education; and</text></subparagraph><subparagraph id="H812B9045667E4BA98B3BAEF73CF63B5A"><enum>(D)</enum><text>any new understanding of competency and competency-based education and recommendations on how the definitions of such terms should be modified.</text></subparagraph></paragraph></subsection><subsection id="H40E89D667AE14E07883B97BA340E1AD9"><enum>(h)</enum><header>Oversight</header><text>In conducting the demonstration program authorized under this section, the Secretary shall, on a continuing basis—</text><paragraph id="H2BC5DE479A794A6CAED3910AA719F68E"><enum>(1)</enum><text>assure compliance of institutions with the requirements of this title (other than the sections and regulations that are waived under subsections (b)(2) and (b)(3)(D)); and</text></paragraph><paragraph id="H25DF40BD204B4E189720E0A10243E0A2"><enum>(2)</enum><text>provide technical assistance;</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H93976721979D4F3FA12D2E55B72EABB9"><enum>7.</enum><header>Rules of construction</header><text display-inline="no-display-inline">Nothing in this Act shall prevent a program that is an eligible program as of the date of enactment of the <short-title>Empowering Learners through Competency-Based Education Act</short-title>, including an eligible program that met the requirements of a direct-assessment program under section 481(b)(4) (as in effect the day before the date of enactment of this Act), from continuing to be an eligible program during the period that such program meets the requirements under the Higher Education of Act 1965.</text></section></legis-body></bill>
