R. 7491</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240229">February 29, 2024</action-date><action-desc><sponsor name-id="D000530">Mr. Deluzio</sponsor> (for himself and <cosponsor name-id="L000602">Ms. Lee of Pennsylvania</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a task force on waterway freight diversification and economic development in the Ohio, Allegheny, and Monongahela River corridors, and for other purposes.</official-title></form><legis-body id="H17E0928E6062413F919153D7962DAE1C" style="OLC"><section id="H36B6E7713367474CA7B73496F8C7A245" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Waterway Activation that Targets Economic Revitalization, Welcomes Activity, and Yields Success Act</short-title></quote> or the <quote><short-title>WATERWAYS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HCF785A829F8145A89B0032B6C4A10542"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="H8966DC6748614C128025AEFA37236C1A"><enum>(1)</enum><text>inland waterways provide a valuable resource for moving agricultural, energy, and other commodities to market in the United States;</text></paragraph><paragraph id="HC4673B213CF1498CB94947BA50F1BA94"><enum>(2)</enum><text>further utilization of the waterways would benefit the United States because barges are among the safest and most environmentally responsible ways to transport freight, with barge transport being more fuel efficient and having lower emissions than other methods, while also resulting in fewer injuries per worker than rail or truck transport;</text></paragraph><paragraph id="H452E2D0648D5492190127AB733FEF814"><enum>(3)</enum><text>given existing issues with supply chains, it is critical that the Federal Government work to expand and promote inland waterway access, especially in regions that are coal communities or have suffered from deindustrialization; and</text></paragraph><paragraph id="H1BBE7EF7447B4F549901B5E41CC27F5F"><enum>(4)</enum><text>it is of critical importance that the investments made possible by the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>; 135 Stat. 429), <external-xref legal-doc="public-law" parsable-cite="pl/117/169">Public Law 117–169</external-xref> (commonly known as the <quote>Inflation Reduction Act of 2022</quote>) (136 Stat. 1818), and other recent legislation, such as <external-xref legal-doc="public-law" parsable-cite="pl/117/167">Public Law 117–167</external-xref> (commonly known as the <quote>CHIPS and Science Act of 2022</quote>) (136 Stat. 1366), are made with an eye toward utilizing the inland waterways network to maximize the impact of those investments. </text></paragraph></section><section id="HF91109A91C3144379E457B25B42CB2A3"><enum>3.</enum><header>Task force on waterway freight diversification and economic development</header><subsection id="H3D83C1F0206C4DF9B13DE406CE49EA35"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H15FF46E8294B49EDB554BC01B3E8CFBA" commented="no"><enum>(1)</enum><header>Covered State</header><text>The term <term>covered State</term> means each of the States of Pennsylvania, West Virginia, Indiana, Illinois, Kentucky, Ohio, and Tennessee. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6117AF96D9543F1802AB48DFD89F3E1"><enum>(2)</enum><header>Interagency Working Group</header><text>The term <term>Interagency Working Group</term> means the Interagency Working Group on Coal and Power Plant Communities and Economic Revitalization established by section 218 of Executive Order 14008 (86 Fed. Reg. 7628; relating to <quote>Tackling the Climate Crisis at Home and Abroad</quote>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD177DCB8EB74ABCAB4D4E6D53A65E91"><enum>(3)</enum><header>Task force</header><text>The term <term>task force</term> means the task force established under subsection (b).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB63BF51E2F424845A428F8F4B43CBC8C"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text>The Interagency Working Group shall establish a task force on waterway freight diversification and economic development in the Ohio, Allegheny, and Monongahela River corridors.</text></subsection><subsection id="HB28F0CAD66154AEC9CCCFF3E53C53CF1"><enum>(c)</enum><header>Membership</header><paragraph commented="no" display-inline="no-display-inline" id="H383B14975653482287A6E03B87EA14BB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>The task force shall be composed of—</text><subparagraph id="HE9B6A0F8811044B6B3FEACE82AB7577B"><enum>(A)</enum><text> from the Federal Government, representatives of—</text><clause id="HFD65F303D8A34347ACBFD62AF7123CF9"><enum>(i)</enum><text>the Department of Transportation;</text></clause><clause id="HF1AA1E9AA5304F44B1A8D79A86FB7966"><enum>(ii)</enum><text>the Corps of Engineers;</text></clause><clause id="H92629F7166ED43EDA832FA2B3E3D15DF"><enum>(iii)</enum><text>the Department of Energy;</text></clause><clause id="HF9C7491E6F0A40CABD1008DDE3F3E773"><enum>(iv)</enum><text>the Department of Commerce;</text></clause><clause id="H9C8E312D71BB4D72B6285773BF5B0C4B"><enum>(v)</enum><text>the Department of Agriculture;</text></clause><clause id="H08810FAC870D414FBEE2B456D849CBD3"><enum>(vi)</enum><text>the Economic Development Administration;</text></clause><clause id="H999FBFDEB5CD4E2B890F5AB5711751F0"><enum>(vii)</enum><text>the Maritime Administration;</text></clause><clause id="HAEB3CFB4819A4D95AD7345109AAFED59"><enum>(viii)</enum><text>the Department of Labor; </text></clause><clause id="HE9E3D53FECFE4A52913E05ACC8BF2DFE"><enum>(ix)</enum><text>the Appalachian Regional Commission; </text></clause><clause commented="no" display-inline="no-display-inline" id="HB83C3BD29DE04650A5B47FDBC1AF97ED"><enum>(x)</enum><text display-inline="yes-display-inline">the Coast Guard; </text></clause><clause commented="no" display-inline="no-display-inline" id="H15E318A96B9A4752A858B89C442AE45E"><enum>(xi)</enum><text display-inline="yes-display-inline">the Environmental Protection Agency;</text></clause><clause commented="no" display-inline="no-display-inline" id="HE4E2BD8FF4BF4848B00B4D33E8259A81"><enum>(xii)</enum><text>the Department of the Interior; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HD660694173EC45C9AA042738F86F6DDE"><enum>(xiii)</enum><text>any other Federal agency or department the Co-Chairs of the Interagency Working Group determine to be appropriate;</text></clause></subparagraph><subparagraph id="H37B786B63E7D4A8899CB8BDFA8CAE979"><enum>(B)</enum><text>at the discretion of a covered State, representatives of relevant agencies of the covered State; and</text></subparagraph><subparagraph id="H2F5B079662C44342AB3B75E5DD0E0E66"><enum>(C)</enum><text>local stakeholders involved in economic development, transportation, community development, and water resource development and conservation along the Ohio, Allegheny, and Monongahela River corridors, such as metropolitan and rural planning organizations, economic development districts, units of local government, and community-based organizations.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H04FD3C568094409B924A846BC419382D"><enum>(2)</enum><header>Appointment</header><text>The Co-Chairs of the Interagency Working Group shall appoint the members of the task force under paragraph (1). </text></paragraph></subsection><subsection id="HE688C11A4F3A41F5A41491CF570562C8" commented="no"><enum>(d)</enum><header>Duties</header><text>The task force shall—</text><paragraph commented="no" display-inline="no-display-inline" id="H99A24F1DC8C740F3B5B40D19673A54B4"><enum>(1)</enum><text display-inline="yes-display-inline">convene on an ad hoc basis to study, and develop recommendations to improve, waterway freight use and economic development in the Ohio, Allegheny, and Monongahela River corridors; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3869FDF4042D474EB4EE2E3E1538D652"><enum>(2)</enum><text display-inline="yes-display-inline">facilitate investment in the Ohio, Allegheny, and Monongahela River corridors by identifying critical projects and connecting those projects with Federal, State, and local funding opportunities;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H291DA39676EF4125BF659F83271A3676"><enum>(3)</enum><text>coordinate and activate stakeholders around waterway development; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8879DBEAB83A43B29EC1CB0F72D634DC"><enum>(4)</enum><text>submit to the Interagency Working Group an annual report that describes—</text><subparagraph commented="no" display-inline="no-display-inline" id="HD7AAC5848B6D4851A7F58AD2345C48F8"><enum>(A)</enum><text display-inline="yes-display-inline">the recommendations of the task force under paragraph (1) and the progress in implementing those recommendations; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9D4F8416B21F4E07BA079FC099AF9A1F"><enum>(B)</enum><text>the activities of the task force under paragraphs (2) and (3). </text></subparagraph></paragraph></subsection><subsection id="HF5F84C34718E4082B90DA375CA5EB000"><enum>(e)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2024 through 2034, to remain available until expended.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H25AB89EC385140ABB3028F2A866934CB"><enum>4.</enum><header>Savings provision</header><text display-inline="no-display-inline">Nothing in this Act—</text><paragraph commented="no" display-inline="no-display-inline" id="HB778CBC439F942138E45942608E36214"><enum>(1)</enum><text>satisfies any requirement for government-to-government consultation with an Indian Tribe; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H13A8FDDEED084E5DBBA561DD1356932A"><enum>(2)</enum><text>affects or modifies a treaty or any other right of an Indian Tribe.</text></paragraph></section></legis-body></bill>
