BILL</legis-type><official-title display="yes">To require the Director of the Office of Personnel Management to establish a pilot program to identify and refer veterans for potential employment with Federal land management agencies, and for other purposes.</official-title></form><legis-body id="HE30B39E5EAD244E9B4810F2AD81DC0EF" style="OLC"><section section-type="section-one" id="H04E68BAE9EC64BD598BA0CCF0ACE72B7"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hire Veterans Act</short-title></quote>.</text></section><section id="H25FB94D24F7E422181B4FDF2D631EFD5"><enum>2.</enum><header>Pilot program on identification, appointment, or referral of veterans for potential employment with Federal land management agencies</header><subsection commented="no" display-inline="no-display-inline" id="H1DC1ADDB16234130879C6D970773A8E1"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section: </text><paragraph commented="no" display-inline="no-display-inline" id="H505992492BC942E6B6D3845EE3280C78"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA53A7286301945EE9445EC55091C9DD2"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Veterans’ Affairs of the Senate; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5ED5CF32C5614B039B3532103F48A7F6"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Agriculture, Nutrition, and Forestry of the Senate; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HECC74C5CDF79429BB2F99683ABDF28C9"><enum>(C)</enum><text display-inline="yes-display-inline">the Committee on Energy and Natural Resources of the Senate; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9EA7721FF874419B8CEA869305F0BA8A"><enum>(D)</enum><text display-inline="yes-display-inline">the Committee on Veterans’ Affairs of the House of Representatives; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H17DD21728AD343F39EBA68CC3094A925"><enum>(E)</enum><text display-inline="yes-display-inline">the Committee on Agriculture of the House of Representatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H09FE6A0A206D46A381E843C3A86C7AA4"><enum>(F)</enum><text display-inline="yes-display-inline">the Committee on Natural Resources of the House of Representatives. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE7A7BEC2648B4E17BA0B9E755C7A5057"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text>The term <term>Director</term> means the Director of the Office of Personnel Management.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDF4BF5A777BB45A19C99FEB98890ADBA"><enum>(3)</enum><header display-inline="yes-display-inline">Federal land management agency</header><text display-inline="yes-display-inline">The term <term>Federal land management agency</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H08CD1EDE534E455E86B6C0E394A1E53F"><enum>(A)</enum><text display-inline="yes-display-inline">the Forest Service; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H910C0687CE434B23A4EA265C7F8841B6"><enum>(B)</enum><text display-inline="yes-display-inline">the National Park Service;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H22D378503A2A4FF7A7520291AE343F3E"><enum>(C)</enum><text display-inline="yes-display-inline">the United States Fish and Wildlife Service;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5ECAC1BAB4154C0A9000C43D2AA0EB5B"><enum>(D)</enum><text display-inline="yes-display-inline">the Bureau of Land Management; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H37A57E35071340EEA640CFB6516500B7"><enum>(E)</enum><text display-inline="yes-display-inline">the Bureau of Reclamation. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAF1F2155AA5640B2B09BB8FA7189CAC3"><enum>(4)</enum><header>Noncompetitive</header><text>The term <term>noncompetitive</term>, when used with respect to an appointment, means an appointment made without regard to subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/33">chapter 33</external-xref> of title 5, United States Code, other than sections 3303 and 3328 of that title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE28D6DA753E149649BB994E01EAED35B"><enum>(5)</enum><header>Pilot program</header><text>The term <term>pilot program</term> means the pilot program established by the Director under subsection (b).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD31CC261466743709B3BCE4B584B8F7C"><enum>(6)</enum><header display-inline="yes-display-inline">Recognized postsecondary credential</header><text display-inline="yes-display-inline">The term <term>recognized postsecondary credential</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF67D4814467C4A2C9C570BFED8C43BCF"><enum> (7)</enum><header>Veteran</header><text>The term <term>veteran</term> has the meaning given the term in section 101 of title 38, United States Code. </text></paragraph></subsection><subsection id="H40E6847CFFC44AA084DE67B014FB58B5"><enum>(b)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of this Act, the Director (in consultation with the Secretary of Veterans Affairs, the Secretary of the Interior, and the Secretary of Agriculture) shall establish a pilot program to recruit veterans with relevant strengths and abilities and refer the veterans to supervisory or nonsupervisory positions in Federal land management agencies.</text></subsection><subsection id="HE7831B77EE3047B3A77C08FB132317EB"><enum>(c)</enum><header>Publication of information application</header><paragraph commented="no" display-inline="no-display-inline" id="HE4FF1B0698864270ABEF45CBF848F46D"><enum>(1)</enum><header display-inline="yes-display-inline">Publication</header><text>The Director shall publicize, and disseminate information about, the pilot program on the website of the Office of Personnel Management.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49519FAE108E48C38493A9C0D3A22FE8"><enum>(2)</enum><header display-inline="yes-display-inline">Application</header><text>A veteran seeking to participate in the pilot program shall submit to the Director an application in such form, in such manner, and containing such information as the Director may require.</text></paragraph></subsection><subsection id="H8BB8BAE4AE2E46CB8633580577369C1B"><enum>(d)</enum><header>Tests of strengths and abilities</header><paragraph id="H124B002B60DD40DDAF21330B80746483"><enum>(1)</enum><header>Guidance</header><text>Not later than 180 days after the date of enactment of this Act, the Director (in consultation with the Secretary of Veterans Affairs, the Secretary of the Interior, and the Secretary of Agriculture) shall issue guidance on the development of individual tests to be administered for the purposes of the pilot program to determine the strengths and abilities of veterans for positions in the following career fields at Federal land management agencies:</text><subparagraph commented="no" display-inline="no-display-inline" id="H061B934D7F4A4DCCACE9E0ED61D5BF15"><enum>(A)</enum><text display-inline="yes-display-inline">Outdoor recreation management.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9F70DE15FEAB4C0F9CBC1B86545F3FFD"><enum>(B)</enum><text display-inline="yes-display-inline">Management of volunteers.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD5D7D8211AD5420790B2DD444CBC5E5E"><enum>(C)</enum><text display-inline="yes-display-inline">Fire planning and fire analysis. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H12E150B9AD3E4C6E901E6D3B326E9588"><enum>(D)</enum><text display-inline="yes-display-inline">Firefighting.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFE303965FD4A42A981CD085A47B5DDFD"><enum>(E)</enum><text display-inline="yes-display-inline">Aviation.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7C87A44339D44F92B540CC40BC52B81B"><enum>(F)</enum><text display-inline="yes-display-inline">Forest engineering. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H19C3B40D367D405D84C6B138DFF8F2F7"><enum>(G)</enum><text display-inline="yes-display-inline">Inventory monitoring of land under the management of a Federal land management agency. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8A77CB26AB714E5F8D92FC6C9381568C"><enum>(H)</enum><text display-inline="yes-display-inline">Landscape restoration.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8B63F5A7713C449DAD4A131B8A20BB4E"><enum>(I)</enum><text display-inline="yes-display-inline">Ecology.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H87806C74A0BE491F967CF794059EE06E"><enum>(J)</enum><text display-inline="yes-display-inline">Sustainability of ecosystems.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCEC5FD7A1EA444AF9864B93E7A494446"><enum>(K)</enum><text display-inline="yes-display-inline">Archeology.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE89BA261C204901A4D5D222555CE175"><enum>(L)</enum><text display-inline="yes-display-inline">Range management.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H50B267A5C8B44D0BB1592DAB038E189D"><enum>(M)</enum><text display-inline="yes-display-inline">Analysis of geospatial data.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE18A2FE02C954870A4F618CBA551FA57"><enum>(N)</enum><text display-inline="yes-display-inline">Biology.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC6CF35FB954C41228AA27E9269325C46"><enum>(O)</enum><text display-inline="yes-display-inline">Geology.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5D889DFDE939472384704E8DF9C0F884"><enum>(P)</enum><text display-inline="yes-display-inline">Land use.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H551BB03D72A74C768CD28D6D3D4E5142"><enum>(Q)</enum><text display-inline="yes-display-inline">Physical sciences. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3A3E941AEC6A4F70A921170299769991"><enum>(R)</enum><text display-inline="yes-display-inline">Civil Engineering. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD0E4A177D12348219E5BD3E2068DBC83"><enum>(S)</enum><text display-inline="yes-display-inline">Hydrology. </text></subparagraph><subparagraph id="H31060331CCE54DD0868FDAE0B153E2B7"><enum>(T)</enum><text>Land surveying.</text></subparagraph><subparagraph id="HD0E83DDDD8BE4D8BA4C54636873577F7"><enum>(U)</enum><text>Water reclamation.</text></subparagraph><subparagraph id="H888BB39981704C5BA95BE942E6A4E0DE"><enum>(V)</enum><text>Finance, budget, and administration.</text></subparagraph></paragraph><paragraph id="H2D824E8066DD4061950AE1C17C5DB431"><enum>(2)</enum><header>Waiver</header><text>For purposes of the pilot program, the Director (in consultation with, as appropriate, the Secretary of Agriculture or the Secretary of the Interior) may waive any requirement for a recognized postsecondary credential for a position in a career field described in paragraph (1), if the Director determines that such a waiver is necessary. </text></paragraph><paragraph id="H76A44B1E904F488BB48D1D330537E6EC"><enum>(3)</enum><header>Administration</header><text>The head of a Federal land management agency shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HDA28B2B92B6D4955AB0550C18766ECD9"><enum>(A)</enum><text display-inline="yes-display-inline">administer a test developed described in paragraph (1) to each veteran who applies for participation in the pilot program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC10B56221261473F9D21A4A010AABB24"><enum>(B)</enum><text display-inline="yes-display-inline">develop assessments to measure the relative capacity and fitness of veterans described in subparagraph (A) of this paragraph for positions in the career fields described in paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H84A70040A6074C0CB420A1A380779D0D"><enum>(C)</enum><text>refer each veteran described in subparagraph (A) to the official employment website of the Federal Government.</text></subparagraph></paragraph><paragraph id="HE79E906AEB824E46AD343DE82A38CAC2"><enum>(4)</enum><header>Management</header><text>The Director (in consultation with the Secretary of Veterans Affairs) shall develop a method to oversee and manage the employment of veterans within Federal land management agencies in positions in the career fields that are covered by the pilot program. </text></paragraph></subsection><subsection id="H9A1D7C64F961457399CC95B855B6BD42"><enum>(e)</enum><header>Appointment and referral</header><text>The head of a Federal land management agency (in consultation with the Secretary of Veterans Affairs), with respect to a veteran who has taken a test administered under subsection (d)(3)(A)—</text><paragraph id="HD83A32B01FCA46B59CF30B5DE52BBCF6"><enum>(1)</enum><text>if the veteran has demonstrated through the test the necessary strengths and abilities for a vacant supervisory or nonsupervisory position in a career field covered by the pilot program in the Federal land management agency, as determined by the head of the Federal land management agency, may make a noncompetitive career-conditional appointment of the veteran to that vacant position; or</text></paragraph><paragraph id="H633D0B8C052E43C8A7F03DFA7397F5ED"><enum>(2)</enum><text>if the veteran has not demonstrated through the test the necessary strengths and abilities for a vacant supervisory or nonsupervisory position in a career field covered by the pilot program in the Federal land management agency, as determined by the head of the Federal land management agency—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4008D045318B42EDB4610668B5814C2B"><enum>(A)</enum><text display-inline="yes-display-inline">shall refer the veteran to a recruiter of that Federal land management agency for participation in a training program that the agency shall establish for the purposes of this section, which shall provide the veteran with the strengths and abilities for a position in such a career field;</text></subparagraph><subparagraph commented="no" id="H8802037C60B34238905E8B91528E1A5F"><enum>(B)</enum><text>shall, after the participation by the veteran in a training program described in subparagraph (A), re-administer that test, for the purpose of re-evaluation, to the veteran as frequently as the head of the Federal land management agency determines appropriate until the veteran demonstrates through the test the necessary strengths and abilities; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD8BDD815CFB4C1CA100FFCD2D7F5AFD"><enum>(C)</enum><text display-inline="yes-display-inline">may, if the veteran has demonstrated through the test the necessary strengths and abilities, make a noncompetitive career-conditional appointment of the veteran to a position in such a career field.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1EE9F8D875EB4A908EFF54E857490D6B"><enum>(f)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter until the termination of the pilot program, the Director (in consultation with the Secretary of Veterans Affairs and the heads of the Federal land management agencies) shall submit to the appropriate committees of Congress a report on the pilot program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H1C4865CE716149059AAFB1604E48417B"><enum>(g)</enum><header>Termination</header><text display-inline="yes-display-inline">The pilot program shall terminate on the date that is 5 years after the date on which the Director establishes the pilot program. </text></subsection></section></legis-body></bill>
