R. 7484</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240229">February 29, 2024</action-date><action-desc><sponsor name-id="B001309">Mr. Burchett</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require Members of Congress who are foreign nationals to file a statement of their status as a foreign national, and for other purposes.</official-title></form><legis-body id="H1CA915032F5F4785A30817EEDB721B8E" style="OLC"><section id="HD76F2365C3304320A411A412D1A8F2CB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dual Citizenship Disclosure Act</short-title></quote>.</text></section><section id="H528ED57B33C74F07B3DAEFCD6571E68F"><enum>2.</enum><header>Requiring statement of status as foreign national by Members of Congress</header><subsection id="HC433D80F00304077BD84B48E5CE073B9"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 90 days after taking the oath of office of a Member of Congress for a Congress, a Member who is a foreign national shall file with the appropriate congressional ethics committee a statement describing the Member’s status as a foreign national.</text></subsection><subsection id="HD62EE2AA0945425E8F4E9CEF1EEDF2F8"><enum>(b)</enum><header>Exception</header><text>Subsection (a) does not apply with respect to a Member of Congress who filed a statement required under subsection (a) during a previous Congress.</text></subsection><subsection id="H3BCF1DDEBC0C44F8B89DBE2954B67917"><enum>(c)</enum><header>Penalty for noncompliance</header><text>If a Member of Congress who is a foreign national fails to file the statement required under subsection (a), or if the appropriate congressional ethics committee determines that the statement is defective, the committee may impose a penalty on the Member of not more than $2,500, in addition to any other penalty applicable under the Rules of the House of Representatives or the Standing Rules of the Senate, as the case may be.</text></subsection><subsection id="HC530543A07C343BCBCB01032A51496DE"><enum>(d)</enum><header>Definitions</header><paragraph id="HCC609EDF3FE446E086D67E6AA17EA4E3"><enum>(1)</enum><header>Appropriate congressional ethics committee</header><text>In this Act, the term <term>appropriate congressional ethics committee</term> means—</text><subparagraph id="HDB5E37FED41441E48E7A423776733456"><enum>(A)</enum><text>the Committee on Ethics of the House of Representatives, in the case of a Representative in, or Delegate or Resident Commissioner to, the Congress; and</text></subparagraph><subparagraph id="HA8A6D31B47734ED48B02A62EC46F218D"><enum>(B)</enum><text>the Select Committee on Ethics of the Senate, in the case of a Senator.</text></subparagraph></paragraph><paragraph id="H850C27D00C6E464D94C52AAEAC48269B"><enum>(2)</enum><header>Foreign national</header><text>In this Act, term <quote>foreign national</quote> means a national of a foreign state, as such terms are defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></paragraph><paragraph id="H053F58110BD74A6FB62E7007AB6708A6"><enum>(3)</enum><header>Member of Congress</header><text display-inline="yes-display-inline">In this Act, the term <term>Member of Congress</term> means a Senator or a Representative in, or Delegate or Resident Commissioner to, the Congress.</text></paragraph></subsection><subsection id="HE7868945CF4C430186DEEF4262349D56"><enum>(e)</enum><header>Effective date</header><text>This Act shall apply with respect to the One Hundred Nineteenth Congress and each succeeding Congress.</text></subsection></section></legis-body></bill>
