R. 7461</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240226">February 26, 2024</action-date><action-desc><sponsor name-id="V000133">Mr. Van Drew</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to prohibit providers of broadband internet access service from charging consumers above certain amounts for certain equipment.</official-title></form><legis-body id="HA212CA42F0354848B0625CCCBFC8E382" style="OLC"><section id="H89F76CF13699452FA877301FE3B38CD9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadband Equipment Rental Reform Act</short-title></quote>. </text></section><section id="H28BA848141DA4C1E8F23F043D805FE59"><enum>2.</enum><header>Prohibition on charging consumers above certain amounts for certain rented equipment</header><text display-inline="no-display-inline">Section 642 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/562">47 U.S.C. 562</external-xref>) is amended—</text><paragraph id="H5754596C3C8A4C6E93DD5A4857770DC9"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph><paragraph id="H16A5A418EC8F43E19ABFE146A29F87EF"><enum>(2)</enum><text>by inserting after subsection (c) the following: </text><quoted-block style="OLC" id="HCDED65358EBC448B9ED705C3057EF4A4" display-inline="no-display-inline"><subsection id="H011CABA66B8B497FA4DC56358734CCDC"><enum>(d)</enum><header>Prohibition on charging consumers above certain amounts for certain equipment</header><text display-inline="yes-display-inline">A provider of fixed broadband internet access service that enters into a contract with a consumer after the date of the enactment of this paragraph for the provision of such service may not charge the consumer for renting, leasing, or otherwise providing to the consumer equipment (such as a router or modem) employed on the premises of the consumer for the provision of such service, if the consumer has paid to the provider through monthly rental fees the price offered to the consumer by the provider (at the time the contract was entered into) for purchasing the equipment from the provider. </text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
