R. 7453</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240223">February 23, 2024</action-date><action-desc><sponsor name-id="V000133">Mr. Van Drew</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to prohibit providers of broadband internet access service from increasing rates or enforcing data caps or allowances during an emergency or major disaster, and for other purposes.</official-title></form><legis-body id="HB38FE9BDB0814B77B928A3A496166D1D" style="OLC"><section id="HD1216880F3084020B80AAE8AFCC22104" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>New Overages in Crisis Areas Prevention Act </short-title></quote> or the <quote><short-title>NO CAP Act</short-title></quote> .</text></section><section id="HF21BDB7BF38C44C2BE3E1B780AE34687"><enum>2.</enum><header>Requirements for broadband providers during emergencies and major disasters</header><text display-inline="no-display-inline">Title VII of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/601">47 U.S.C. 601 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H09A694AE720D438BBFA2BD752F3CB420" display-inline="no-display-inline"><section id="H28441E21D3A34156B454EC786C083FCF"><enum>723.</enum><header>Requirements for broadband providers during emergencies and major disasters</header><subsection id="H7577E0AD67CE44EE8561279D652DC245"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">During a covered period with respect to a covered area, a provider of broadband internet access service may not, with respect to a customer of such provider in such area—</text><paragraph id="H2EA6D7F2C0CF41CAA3B5A27FF1957B88"><enum>(1)</enum><text>increase any rate, fee, or other charge relating to such service;</text></paragraph><paragraph id="H372E30C171454BBABF1AD31849CAC0D6"><enum>(2)</enum><text>impose any rate, fee, or other charge relating to such service that did not apply before such period; or</text></paragraph><paragraph id="HA4475B14B95541D2B0FDF9323852801E"><enum>(3)</enum><text>enforce any data cap or allowance, regardless of whether such data cap or allowance applied before such period.</text></paragraph></subsection><subsection id="H78E59AD5462142B59944829959A2578B"><enum>(b)</enum><header>Inapplicability to mobile broadband internet access service</header><text>This section does not apply with respect to mobile broadband internet access service.</text></subsection><subsection id="HA2D33E6B816040ADB6B2ECB6A8314082"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD62107FDAFBB49219026480CB6E09436"><enum>(1)</enum><header>Broadband internet access service</header><subparagraph id="HAD879E1F1AF54F32B3F385F19CF6BDC1"><enum>(A)</enum><header>In general</header><text>The term <quote>broadband internet access service</quote> means a mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service, but excluding dial-up internet access service.</text></subparagraph><subparagraph id="H7147AB1116A44E45AF3DDF5793E403D4"><enum>(B)</enum><header>Functional equivalent; evasion</header><text>The term <quote>broadband internet access service</quote> includes any service that—</text><clause id="H5F0C027139904FF0896EE2D1957FDCF3"><enum>(i)</enum><text>provides a functional equivalent of the service described in subparagraph (A); or</text></clause><clause id="H2A1FA1E4FD4D4039B39C840F0BE16A1B"><enum>(ii)</enum><text>is used to evade the protections set forth in this section.</text></clause></subparagraph></paragraph><paragraph id="H7FF9AED3E9FD4C17875FFB39EDE77670"><enum>(2)</enum><header>Covered area</header><text>The term <quote>covered area</quote> means a geographical area with respect to which—</text><subparagraph id="H4D578F661C3E458FA964961CF96C4F1B"><enum>(A)</enum><text>a major disaster or emergency is declared under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); or</text></subparagraph><subparagraph id="HFEF56748595449FFB142E5568B1564F2"><enum>(B)</enum><text>a public health emergency is declared under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>).</text></subparagraph></paragraph><paragraph id="H467481FFFBA348E6B4A04B8C6DFDD5A3"><enum>(3)</enum><header>Covered period</header><text>The term <quote>covered period</quote> means, with respect to a covered area, the period that—</text><subparagraph id="H5062BE62D67747EE899D0AFB70E75F22"><enum>(A)</enum><text>begins on the date of the declaration with respect to such area of—</text><clause id="HC89B5FAA11F04076B044EBEC04F58193"><enum>(i)</enum><text display-inline="yes-display-inline">a major disaster or emergency under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); or</text></clause><clause id="HBEC4BE19177E491B91B88C6159AD964F"><enum>(ii)</enum><text display-inline="yes-display-inline">a public health emergency under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>); and</text></clause></subparagraph><subparagraph id="H19D9E8A685454CABA301169ABC510755"><enum>(B)</enum><text>ends on the date that is 60 days after the termination of such major disaster, emergency, or public health emergency (as the case may be).</text></subparagraph></paragraph><paragraph id="HA40174E47C5C4B658B032D072DFC4B1A"><enum>(4)</enum><header>Data cap or allowance</header><text>The term <quote>data cap or allowance</quote> means a limit on, or a fee-based structure with the purpose of limiting, the number of bits a customer may download or upload using broadband internet access service during a period of time specified by the provider of such service.</text></paragraph><paragraph id="HABD7511146B64053BB07B08E2F27F833"><enum>(5)</enum><header>Educational institution</header><text>The term <quote>educational institution</quote> means—</text><subparagraph id="H1C27DC06290A468FAA5E0813A257F846"><enum>(A)</enum><text>an elementary school (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>));</text></subparagraph><subparagraph id="HAC566F2F39714609962822820ECBFFC1"><enum>(B)</enum><text>a secondary school (as defined in such section); and</text></subparagraph><subparagraph id="HB50C4D76C8014D6C81F8D3643DA7BA4F"><enum>(C)</enum><text>an institution of higher education (as defined in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>)).</text></subparagraph></paragraph><paragraph id="H0F12379CDF73463DB7EA1F4E962625C3"><enum>(6)</enum><header>Mobile broadband internet access service</header><subparagraph id="HFF0E31955886484C844684F59FCE6D34"><enum>(A)</enum><header>In general</header><text>The term <quote>mobile broadband internet access service</quote> means a broadband internet access service that serves end users primarily using mobile stations.</text></subparagraph><subparagraph id="H135F8168085442E2B175B0B59F31907F"><enum>(B)</enum><header>Inclusions</header><text>The term <quote>mobile broadband internet access service</quote> includes—</text><clause id="HFE015C5B8228487BB2F8C33DEAC5A373"><enum>(i)</enum><text>broadband internet access services that use smartphones or mobile-network-enabled tablet computers as the primary endpoints for connection to the internet; and</text></clause><clause id="HC21AAA3340434362800A6FF21603965A"><enum>(ii)</enum><text>mobile satellite broadband services.</text></clause></subparagraph><subparagraph id="HE431DD2970944EBF94AB504B32C17779"><enum>(C)</enum><header>Exclusion</header><text>The term <quote>mobile broadband internet access service</quote> does not include a broadband internet access service provided to an educational institution and made available by such institution for educational purposes to students enrolled at such institution.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
