which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to enable State Medicaid programs to provide comprehensive, coordinated care through a health home to individuals with sickle cell disease.</official-title></form><legis-body id="H24717B23FABB4EBCAC818F0B41A57EC3" style="OLC"><section id="H99610B2B0D7D4571994EC62FE80BADB9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sickle Cell Disease Comprehensive Care Act</short-title></quote>.</text></section><section id="H4F87D663B6C047208E87228CB40DBB03" commented="no"><enum>2.</enum><header>Enabling State Medicaid programs to provide care through health homes to individuals with sickle cell disease</header><text display-inline="no-display-inline">Section 1945 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396w-4">42 U.S.C. 1396w–4</external-xref>) is amended—</text><paragraph id="H838CC037469F4BC08B299B6A11DFA132" commented="no"><enum>(1)</enum><text>in subsection (a), by inserting <quote>(and, beginning January 1, 2025, to eligible individuals with sickle cell disease (as described under subsection (c)(5)))</quote> after <quote>chronic conditions</quote>; and</text></paragraph><paragraph id="H9C991DB4ADF04F4FB52DCAEDDD792DA4" commented="no"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="HB8CD5CA79558400E9019F5A694818215" commented="no"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>and each eligible individual with sickle cell disease</quote> after <quote>chronic conditions</quote>; and</text></subparagraph><subparagraph id="H9AFD0737029C46C490F5141249D8CC77" commented="no"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H909D9486E65D4F31BDB4B194F41566AD" display-inline="no-display-inline"><paragraph id="HDC2214243A684AA899F8106D34C05B23" commented="no"><enum>(5)</enum><header>Special rule relating to sickle cell disease health homes</header><subparagraph id="H952625EFE9794F0AA1C8CB28FB93278E" display-inline="no-display-inline" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning January 1, 2025, the Secretary may approve a State plan amendment under this section that is designed to provide health home services primarily to eligible individuals with sickle cell disease (in this section referred to as a <quote>sickle cell disease-focused State plan amendment</quote>).</text></subparagraph><subparagraph id="HCD967223ED4447E88831E15131351C89" commented="no"><enum>(B)</enum><header>Report requirements</header><text display-inline="yes-display-inline">In the case of a State with a sickle cell disease-focused State plan amendment, such State shall, at the end of the first 8 fiscal year quarters that such State plan amendment is in effect, submit to the Secretary a report on the following, with respect to eligible individuals with sickle cell disease provided health home services under such State plan amendment:</text><clause id="H793E0F24EE474584A421DCD025D99FF7" commented="no"><enum>(i)</enum><text>The quality of health care provided to such individuals, with a focus on outcomes relevant to the recovery of each such individual.</text></clause><clause id="H47170A1897974CC1BB395F65A24AA96D" commented="no"><enum>(ii)</enum><text>The access of such individuals to health care.</text></clause><clause id="H3F18B6975BD049CE9B8E22FB3E1E8F9B" commented="no"><enum>(iii)</enum><text>The total expenditures of such individuals for health care.</text></clause><continuation-text continuation-text-level="subparagraph" commented="no">For purposes of this subparagraph, the Secretary shall specify all applicable measures for determining quality, access, and expenditures.</continuation-text></subparagraph><subparagraph id="HC2788B5403B640389F712CC2EE2015F4" commented="no"><enum>(C)</enum><header>Best practices</header><text>Not later than June 30, 2025, the Secretary shall make publicly available on the internet website of the Centers for Medicare &amp; Medicaid Services best practices for designing and implementing a sickle cell disease-focused State plan amendment, based on clinical practice guidelines for sickle cell diseases developed by medical specialty societies and in consultation with sickle cell disease providers and patient advocacy organizations.</text></subparagraph><subparagraph id="H8F2A25E5427A42F8B809D9D22FB22733" commented="no"><enum>(D)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text><clause id="HF7A7C4A6A2014AF59318248D852EA7FE"><enum>(i)</enum><header>Eligible individual with sickle cell disease</header><text display-inline="yes-display-inline">The term <quote>eligible individual with sickle cell disease</quote> means, with respect to a State, an individual who satisfies all of the following:</text><subclause id="HD814679AB91C430EAC93BFBEA3F5A720" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">The individual is eligible for medical assistance under the State plan or under a waiver of such plan.</text></subclause><subclause id="HC9D743C7367B41FBAB4DE1A2C8A1FBA9" commented="no"><enum>(II)</enum><text>The individual has sickle cell disease.</text></subclause><subclause id="H09F0CD4722FA49D8A466BB390173A751"><enum>(III)</enum><text display-inline="yes-display-inline">The individual may or may not have previously received health home services under any other State plan amendment approved for the State under this section by the Secretary.</text></subclause></clause><clause id="HDE8263A4BF4B484C8F4D0FB27F803228"><enum>(ii)</enum><header>Sickle cell disease</header><text display-inline="yes-display-inline">The term <quote>sickle cell disease</quote> means an inherited blood disorder affecting red blood cells that occurs when an individual has inherited a sickle cell gene from each parent, as identified by a newborn screening or other genetic test.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H06FA3421D8CA4817813C140964FE5515"><enum>(3)</enum><text>in subsection (h)—</text><subparagraph id="H881908B3B531444C88E1EA810244FF1A"><enum>(A)</enum><text>in paragraph (4)(A)—</text><clause id="H50EADB425647427097930FBC54AA03C7"><enum>(i)</enum><text>by striking the period at the end and inserting <quote>; and</quote>;</text></clause><clause id="H9852602B19BF490A9817BB06515D2B42"><enum>(ii)</enum><text>by striking <quote>means comprehensive</quote> and inserting </text><quoted-block style="OLC" id="H35382EB6CBB84B8F87A2DAF1E741D76B" display-inline="yes-display-inline"><text>means—</text><clause id="HFC0968EB0E77436EA86596A2DC71F03D"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to eligible individuals with chronic conditions, comprehensive</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H40677F846EB342C88C397E446A107259"><enum>(iii)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" id="H1C9F92080FDD4E01B689FB38243041C3" display-inline="no-display-inline"><clause id="H3DCD7143D65C42839B8D9A6CA25D8DA9"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a State that provides for dental services and vision services (as defined by such State), with respect to eligible individuals with sickle cell disease, the services described in clause (i), dental services, and vision services.</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H1253765D0B48403F8289D830937F0EDF"><enum>(B)</enum><text>in paragraph (5), by inserting <quote>or a health home for eligible individuals with sickle cell disease</quote> after <quote>chronic conditions</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
