display-inline="no-display-inline">The purpose of this Act is to extend financial and technical assistance to States, territories, the District of Columbia, and Indian Tribes, including under the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669">16 U.S.C. 669 et seq.</external-xref>), for the purpose of restoring habitat on State, Tribal, Federal, and private lands—</text><paragraph id="HF4E2C12296FB4CBC9191DC6BF0830C70"><enum>(1)</enum><text>to recover species currently listed as threatened or endangered under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) or under State law; and</text></paragraph><paragraph id="H2DECCF3B4B17463DACED6E6EFD92240E"><enum>(2)</enum><text display-inline="yes-display-inline">to prevent the need to list species under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) or under State law.</text></paragraph></section><section id="H88DFB8CDD7DB4926BC1EB7A8F8F88B60"><enum>3.</enum><header>GAO study</header><text display-inline="no-display-inline">Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study to examine the progress of States, territories, the District of Columbia, and Indian Tribes toward achieving the purpose described in section 2.</text></section><title id="HEF81CBE5CFA14423903D9D9F20F80072"><enum>I</enum><header>Wildlife Conservation and Restoration</header><section id="HEA7A57E158314AAAB34FE35AB56A9FD9"><enum>101.</enum><header>Wildlife Conservation and Restoration Subaccount</header><subsection id="H65883889F905488C8E0E9EEFC710EBBF"><enum>(a)</enum><header>In general</header><text>Section 3 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669b">16 U.S.C. 669b</external-xref>) is amended—</text><paragraph id="H74C562BFF42D4EBD9E4C451A93A89C53" commented="no"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H4ECE41AE45DC49609E68631DB89C42EF" commented="no"><enum>(A)</enum><text>by striking <quote>(1) An amount equal to</quote> and inserting <quote>An amount equal to</quote>; and</text></subparagraph><subparagraph id="H0C57A9CC11E747509ECBFBEF24B76515" commented="no"><enum>(B)</enum><text>by striking paragraph (2); and</text></subparagraph></paragraph><paragraph id="HC2AA8308DAA449CCA46ACDA7F3A67BB0"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H37EB201E13584EB2AE7DDC41827E4EF8"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting after <quote>(c)</quote> the following: <quote><header-in-text level="subsection" style="OLC">Wildlife Habitat Conservation and Restoration Subaccount.—</header-in-text></quote>;</text></subparagraph><subparagraph id="H3906730887A6473B8B910C365F9AE607"><enum>(B)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (10) and (11); and</text></subparagraph><subparagraph id="H7714C82A7E114443A1547738AEF69BD9"><enum>(C)</enum><text>by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" id="H60BFA799DEB44E828BAF957D62D99657" changed="added" reported-display-style="italic" committee-id="HII00"><paragraph id="H9310ADF8CE1B4803AA5E43DE40732981"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H417EC02C24764D24A6A61A49DA7ABB7B"><enum>(A)</enum><header>Restoration</header><text display-inline="yes-display-inline">The term <term>restoration</term> means the implementation of conservation actions and practices that reestablish or enhance environmental conditions and ecosystem functions that benefit the diversity, resilience, health, and productivity of plants and animals.</text></subparagraph><subparagraph id="H776EF82E94334FA4A75A2D72B4CB8E9A"><enum>(B)</enum><header>Rewilding</header><text>The term <term>rewilding</term> means a restoration approach that prohibits human management activities and relies only on natural processes to maintain or improve habitat.</text></subparagraph><subparagraph id="H7E9D6FB8ECD84FCBBA862C2A67D4FC72"><enum>(C)</enum><header>Territory and territories</header><text>The terms <term>territory</term> and <term>territories</term> mean the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands.</text></subparagraph></paragraph><paragraph id="H13C51CE8674B4ED5989E80DC8D351D05"><enum>(2)</enum><header>Establishment of Subaccount</header><subparagraph id="H09771250479C4B1DB069544380216433"><enum>(A)</enum><header>In general</header><text>There is established in the fund a subaccount to be known as the <quote>Wildlife Habitat Conservation and Restoration Subaccount</quote>.</text></subparagraph><subparagraph id="H1F0D290C985F4E94B33BCF1DFEACA6CA"><enum>(B)</enum><header>Availability</header><text>Amounts in the Subaccount shall be available until expended, subject to future appropriations, for apportionment in accordance with this Act.</text></subparagraph><subparagraph id="H03051CAF1F0F4CEAB5890665B5959F13"><enum>(C)</enum><header>Deposits into Subaccount</header><text display-inline="yes-display-inline">Subject to the availability of appropriations made in advance for such purposes, the Secretary shall allocate not more than $300,000,000 to the Subaccount for each of fiscal years 2025 through 2029.</text></subparagraph><subparagraph id="H2654DEC3AB2348E69D96DA6EC3FBCFAD"><enum>(D)</enum><header>Treatment of revenue</header><text display-inline="yes-display-inline">Funds received by a State fish and wildlife department as a result of a wildlife conservation and restoration program or project of such department that is carried out on Federal or State land and funded by the Subaccount shall be retained and used by such department to carry out additional authorized wildlife conservation and restoration programs or projects pursuant to the <short-title>America’s Wildlife Habitat Conservation Act</short-title>.</text></subparagraph><subparagraph id="H2F63560BE24542348BE8F52C14643C7C"><enum>(E)</enum><header>Sunset</header><text>No funds may be appropriated to the Subaccount after fiscal year 2029.</text></subparagraph></paragraph><paragraph id="H57B79ECB53BE47F98ABA74FA2D0CFCE2"><enum>(3)</enum><header>Supplement not supplant</header><text>Amounts transferred to the Subaccount shall supplement, but not replace, existing funds available to the States from—</text><subparagraph id="HD0505F86A46C423F836E1979AA34B75C"><enum>(A)</enum><text>the funds distributed pursuant to the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777">16 U.S.C. 777 et seq.</external-xref>); and</text></subparagraph><subparagraph id="H2BB0C6564549466A9C1D60889DC1E3A2"><enum>(B)</enum><text>the fund.</text></subparagraph></paragraph><paragraph id="HCA2EACA809044576914DAF6A40DF8621"><enum>(4)</enum><header>Innovation grants</header><subparagraph id="H90E3FCF071CA4D7582E66ADF8E13FD24"><enum>(A)</enum><header>In general</header><text>The Secretary shall distribute 10 percent of amounts in the Subaccount in each fiscal year through a competitive grant program to State fish and wildlife departments, the District of Columbia fish and wildlife department, fish and wildlife departments of territories, or to regional associations of fish and wildlife departments (or any group composed of more than 1 such entity).</text></subparagraph><subparagraph id="H0757196ADB58417980C5C7345DD007FC" commented="no"><enum>(B)</enum><header>Purpose</header><text>Recipients of a grant issued under subparagraph (A) shall use such grant funds for the purpose of catalyzing innovation of techniques, tools, strategies, or collaborative partnerships that accelerate, expand, or replicate effective and measurable recovery efforts for habitat of species of greatest conservation need and species listed under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>).</text></subparagraph><subparagraph id="HB0C9AA4EAACB494DBD83D3DFCCCA776A"><enum>(C)</enum><header>Review committee</header><text>The Secretary shall appoint a review committee comprised of—</text><clause id="H472C53AB61384AEC93024419CE07EDB9"><enum>(i)</enum><text>1 State Director from each regional association of State fish and wildlife departments;</text></clause><clause id="H156E6F32F3084DA1A494261337192CAA"><enum>(ii)</enum><text>the head of a department responsible for fish and wildlife management in a territory;</text></clause><clause id="H7DA10678A1C344B5A2E9D84936AF7DE7"><enum>(iii)</enum><text>1 delegate from the United States Fish and Wildlife Service, for the purpose of providing technical assistance;</text></clause><clause id="H24DEE6BCA39C40B78D57C4B1134485CB" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">2 individuals who represent 2 different nonprofit organizations, each of which participated in carrying out wildlife conservation and restoration activities using funds apportioned from the Subaccount during the 5-year period ending on the date of appointment of such individual; and</text></clause><clause id="HE09B346D2608485C8D9FF7CF69C8D2CD"><enum>(v)</enum><text display-inline="yes-display-inline">2 individuals who represent 2 different nonprofit hunting and fishing organizations who are each a member of—</text><subclause id="HDDBC4ECBFBA4422EAC0B40E71C9CF0D0"><enum>(I)</enum><text>the Hunting and Wildlife Conservation Council of the Department of the Interior and Department of Agriculture and classified as representing a <quote>wildlife &amp; habitat conservation/management organization</quote>; or</text></subclause><subclause id="HC59ED7FD22F34638B298B0277A2ED72A"><enum>(II)</enum><text>the Sport Fishing and Boating Partnership Council of the Department of the Interior and classified as representing a <quote>recreational fishery resource conservation organization</quote>.</text></subclause></clause></subparagraph><subparagraph id="H2A217349A1534ED0BE7B79D99F443D94"><enum>(D)</enum><header>Support from United States Fish and Wildlife Service</header><text>Using not more than 3 percent of the amounts distributed under subparagraph (A) to carry out a competitive grant program, the United States Fish and Wildlife Service shall provide any personnel or administrative support services necessary for such committee to carry out its responsibilities under this Act.</text></subparagraph><subparagraph id="H622B31390D2E4205838259292D87229B"><enum>(E)</enum><header>Evaluation</header><text>Such committee shall evaluate each proposal submitted under this paragraph and recommend projects for funding, giving preference to solutions that accelerate the recovery of habitat for species identified as priorities through regional scientific assessments of species of greatest conservation need.</text></subparagraph></paragraph><paragraph id="H8884BC9746764394B63A7429C6CC1267" commented="no"><enum>(5)</enum><header>Use of funds</header><subparagraph id="HCCBF7A19BFD142CC82A189D8EA0B3774"><enum>(A)</enum><header>In general</header><text>Funds apportioned from the Subaccount under paragraph (2)(B)—</text><clause id="H5E45EBD1D3984F23A3752C1AA94E87D7" commented="no"><enum>(i)</enum><text>shall be used for purposes and practices consistent with section 2 of the <short-title>America’s Wildlife Habitat Conservation Act</short-title>;</text></clause><clause id="H60006C4BF0B64A5C920951E5EA990C02" commented="no"><enum>(ii)</enum><text>shall be used to develop, carry out, revise, or enhance the Wildlife Conservation Strategy of a State, territory, or the District of Columbia, as required under section 4(e), by carrying out, revising, or enhancing existing wildlife conservation and restoration programs or strategies and developing and implementing new wildlife conservation and restoration programs or strategies, as determined by the appropriate State fish and wildlife department;</text></clause><clause id="H1BC36E9419EB4C4BB746C6A32EE92D0A" commented="no"><enum>(iii)</enum><text>shall be used to assist in the restoration of habitat for species found in the State, territory, or the District of Columbia that are listed as endangered species, threatened species, candidate species or species proposed for listing, or species petitioned for listing under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) or under State law;</text></clause><clause id="H231610421DFB45EAB001BE9300C72D21"><enum>(iv)</enum><text>may be used for management of animals, including harvesting;</text></clause><clause id="HA337A20DDAB84442B7EAEBED60D516B7" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">may be used for the conservation and restoration of habitat for species of greatest conservation need whose range is shared with another State, territory, Indian Tribe, or foreign government; </text></clause><clause id="HB1A07FFA89294629B26FD5A6557A3CD6" commented="no"><enum>(vi)</enum><text>may be used to manage, control, and prevent invasive species, disease, and other risks to the habitat of species of greatest conservation need;</text></clause><clause id="H507CFE7FA91C4A31B7A69A4CCBB9933A" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">may be used for forest and vegetation management activities if a primary purpose of such activity is to modify, improve, enhance, or create wildlife habitat or reduce the risk of damage or destruction to wildlife habitat due to wildfires, insects, or disease, including—</text><subclause id="H3680552B04C44E2B91F847C273507C39"><enum>(I)</enum><text>planting, seeding, and harvesting, including planting, seeding, and harvesting of native seeds;</text></subclause><subclause id="H5BB4DAA4BEC1425DBDA893FB4015C07B"><enum>(II)</enum><text>mechanical thinning;</text></subclause><subclause id="H7AD021886EA945CD8FB95F2597B2E956"><enum>(III)</enum><text>prescribed burning;</text></subclause><subclause id="H6D59D97B227041449939981C1F6E3107"><enum>(IV)</enum><text>chemical applications designed to restore natural range variation including creating and maintaining early seral communities; and</text></subclause><subclause id="HDC659F34504145C598B59B3501592A79"><enum>(V)</enum><text display-inline="yes-display-inline">prescribed haying and grazing practices;</text></subclause></clause><clause id="H0A527A13DA7E434B8313553211033E13"><enum>(viii)</enum><text display-inline="yes-display-inline">may be used to carry out voluntary, collaborative conservation work with willing landowners consistent with section 2 of the America’s Wildlife Habitat Conservation Act to keep private lands working; and</text></clause><clause id="HE33BF339D2034BCEAC7B62EAD4C8EA06" commented="no"><enum>(ix)</enum><text display-inline="yes-display-inline">may be used to provide incentives to private landowners to carry out habitat conservation work for threatened and endangered species or species of greatest conservation need on the land owned by such private landowners and to provide financial assistance or technical assistance to such private landowners to carry out such work.</text></clause></subparagraph><subparagraph id="HD26FA112F6354E4CA93ED1E75F82C39F"><enum>(B)</enum><header>Prohibited uses</header><text>Funds apportioned from the Subaccount may not be used for—</text><clause id="H4E2178609ADB472AA434AD6E2687715C"><enum>(i)</enum><text>rewilding;</text></clause><clause id="H969FC83D75034A72945DE2B97AAC8B2E"><enum>(ii)</enum><text display-inline="yes-display-inline">the reintroduction or management of a species in a manner not supported by the applicable State fish and wildlife management authorities; or</text></clause><clause id="HC5E0CFE2213E456A8C57B1A24246F897"><enum>(iii)</enum><text display-inline="yes-display-inline">climate-focused decisions that lack a connection to the State comprehensive plan developed under section 4(e)(1).</text></clause></subparagraph></paragraph><paragraph id="H895EC911581C4A9B8E5943F3C6668AC7"><enum>(6)</enum><header>Minimum required spending for endangered species recovery</header><text display-inline="yes-display-inline">Not less than 15 percent of the total amount apportioned to a State, territory, or the District of Columbia from the Subaccount during the period of fiscal years 2025 through 2029 shall be used for purposes described in paragraph (5)(A)(iii).</text></paragraph><paragraph id="H78A29EED02A045BABE66CAABF0141F30"><enum>(7)</enum><header>Public access to private lands not required</header><text>Apportionment of funds from the Subaccount may not be conditioned upon the provision of public access to private lands, waters, or holdings.</text></paragraph><paragraph id="H3692D103F3334C2FA7F4A86DF309BB8C"><enum>(8)</enum><header>Requirements for matching funds</header><subparagraph id="H97F089B127B34B63AF381589A5DE7C02"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For the purposes of the non-Federal fund matching requirement for a wildlife conservation and restoration program or project funded by the Subaccount, a State, territory, or the District of Columbia may use as matching non-Federal funds—</text><clause id="H89487617FFA7450FB7071F6F83B097A7"><enum>(i)</enum><text display-inline="yes-display-inline">in-kind contributions of services and materials;</text></clause><clause id="H6AA94C521BED4BC29038D6ABCB4AE8FF"><enum>(ii)</enum><text>voluntarily donated privately owned easements;</text></clause><clause id="HFA68E376F15142AF96E3A1FFC9B3F116"><enum>(iii)</enum><text>in circumstances described in subparagraph (B), revenue generated through the sale of State hunting and fishing licenses; and</text></clause><clause id="H3E5DDC5E4FDA4CB99344699E4A35493E"><enum>(iv)</enum><text>other sources consistent with part 80 of title 50, Code of Federal Regulations, as in effect on the date of the enactment of the <short-title>America’s Wildlife Habitat Conservation Act</short-title>.</text></clause></subparagraph><subparagraph id="H51C2AD29272B4ECDBD775CF4566A7BD9"><enum>(B)</enum><header>Circumstances described</header><text>Revenue described in subparagraph (A)(iii) may only be used to fulfill the requirements of such non-Federal fund matching requirement if—</text><clause id="H5176486635A14A7EB537EBC1AE0B4C06"><enum>(i)</enum><text>no Federal funds apportioned to the State fish and wildlife department of such State from the Wildlife Restoration Program or the Sport Fish Restoration Program have been reverted because of a failure to fulfill such non-Federal fund matching requirement by such State during the previous 2 years; and</text></clause><clause id="H6A9DFD94109E4987969DD3B79660B12C"><enum>(ii)</enum><text>the project or program being funded benefits the habitat of a species that is a—</text><subclause id="H3793DE1FC50E4DE8A56FE42D3D73F35E"><enum>(I)</enum><text>hunted or fished species; and</text></subclause><subclause id="HAE00502921E24B3A9834C0B82BBDE2B8"><enum>(II)</enum><text>species of greatest conservation need.</text></subclause></clause></subparagraph></paragraph><paragraph id="H17CD2EB529CE4A9695CE314C1ABD97BA"><enum>(9)</enum><header>State land acquisition</header><text>Land acquired by a State, territory, or the District of Columbia using funds apportioned from the Subaccount—</text><subparagraph id="HEE91C7477A0D4BD49FECE7552EFCA9AF"><enum>(A)</enum><text>may only be purchased from a willing seller;</text></subparagraph><subparagraph id="HB01D244E84DE4CE09D8D3CBB4E23EC39"><enum>(B)</enum><text>may only be so acquired for the purposes described in paragraph (5)(A)(iii);</text></subparagraph><subparagraph id="HEA6479923C334EF7BC77505F6622EE09"><enum>(C)</enum><text>may only be so acquired when no other source of Department of the Interior funding is available to purchase such land; and</text></subparagraph><subparagraph id="H0692624D4E3443339AAF04AF503C4CEE"><enum>(D)</enum><text>shall be open to the public for wildlife-related outdoor recreation, including hunting, trapping, fishing, or recreational shooting to the extent allowed by State law.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H2D4A9DBF5E1C4437B74DCEF5BCFEFFE8"><enum>(b)</enum><header>Allocation and apportionment of available amounts</header><text>Section 4 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669c">16 U.S.C. 669c</external-xref>) is amended—</text><paragraph id="H80436A4DC4A54CCBACD86E3D5FF386DC"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H3B3AEACBDDDF4189A407BAF3F524D0DE"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H59C4006DDE7C4A92B24A28DC39FFE5FD" commented="no"><enum>(i)</enum><text>by inserting <quote>, after deducting the amount distributed pursuant to section 3(c)(4),</quote> after <quote>Secretary of the Interior shall</quote>; </text></clause><clause id="H762C5380891E4676A029D963EE50F38C"><enum>(ii)</enum><text>in subparagraph (A)—</text><subclause id="H971292E4BCEE48479989ED792FEF54BA"><enum>(I)</enum><text>by striking <quote>to the District of inserting <quote>To Guam</quote>; and</text></subclause><subclause id="H5CB650AA95E04E929803654D9BBCF7F0"><enum>(II)</enum><text>by striking <quote>not more than one-fourth of 1 percent</quote> and inserting <quote>not less than one-third of 1 percent</quote>; and</text></subclause></clause><clause id="H4FE34632BC3D4BBF8764A161DDA858F9"><enum>(iv)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H96AFDC0B051A416991BB40F6F4D37AF6" changed="added" reported-display-style="italic" committee-id="HII00"><subparagraph (2)(A)—</text><clause id="H80390F48F89349FB9916BC3DDB7EF819"><enum>(i)</enum><text>by amending clause (i) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" display-inline="yes-display-inline">half of which is based on the ratio to which the land and water area of such State bears to the total land and water area of all such States;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="HBC06D0442259468E97FA36824416E8BC"><enum>(ii)</enum><text>in clause (ii)—</text><subclause id="H21016962E5A44436975EB162A2E1E985"><enum>(I)</enum><text>by striking <quote>two-thirds</quote> and inserting <quote>one-quarter</quote>; and</text></subclause><subclause id="HFE15EED386B14EC8AE2666CA3F675A8E"><enum>(II)</enum><text>by striking the period and inserting <quote>; and</quote>; and </text></subclause></clause><clause id="H348CEECFC8AB4461BCCC3585AC5BAE3E"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4C8C2E6870B44886B2DD93BBD8E3F781" changed="added" reported-display-style="italic" committee-id="HII00"><clause id="H53399C6102A647CCAD88A15B8CCF7E7F" indent="up1"><enum>(iii)</enum><text>one quarter of which is based upon the ratio to which the number of species listed as endangered or threatened under the Endangered Species Act of 1973 in such State bears to the total number of such species listed in all such States.</text></clause><after-quoted-block>; </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H7574AD977B1241C398E552DD9ADB602F"><enum>(C)</enum><text display-inline="yes-display-inline">by amending paragraph (2)(B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H397991E73054439A886FBE4EDF6552C3" changed="added" reported-display-style="italic" committee-id="HII00"><subparagraph id="H3FAC4FEE037A40539F633C6A28DE4C6A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The amounts apportioned under this paragraph shall be adjusted equitably so that no such State, unless otherwise designated, shall be apportioned a sum which is less than 1 percent or more than 5 percent of the amount available for apportionment under—</text><clause id="H19EDE8898AA24D6FA8A1BF6B9C49EBBA"><enum>(i)</enum><text display-inline="yes-display-inline">subparagraph (A)(i);</text></clause><clause id="H3151B7B380D74D6CA773D8C5FDD51BBF"><enum>(ii)</enum><text>subparagraph (A)(ii); and</text></clause><clause id="HD0A90C522F0F4BAC94A31AF739233820"><enum>(iii)</enum><text>the overall amount available for subparagraph (A).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H8CACA7CA77C646A5B43119DC4695F5F8"><enum>(D)</enum><text>in paragraph (3), by striking <quote>3 percent</quote> and inserting <quote>one-third of 1 percent</quote>;</text></subparagraph></paragraph><paragraph id="H4F8768A2AA174275A1A3AB1D22FC0ECF"><enum>(2)</enum><text>in subsection (e) in paragraph (3), by striking id="H5510815C42A4447AA4E030F1B7A25B82"><enum>(f)</enum><header>Accountability</header><paragraph id="H3F4865F12C754B23944DCF608FC40FB9"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of the <short-title>America’s Wildlife Habitat Conservation Act</short-title> and every 2 years thereafter until the last day of fiscal year 2029, the head of each State fish and wildlife department shall submit to the Director of the United States Fish and Wildlife Service a report describing, with respect to such department during the preceding 2 years, the following:</text><subparagraph id="H1731E1EF999F48B99D1293B1E91F62C5"><enum>(A)</enum><text display-inline="yes-display-inline">A summary of each activity carried out using funds apportioned from the Subaccount, including—</text><clause id="H52F97D130DCA49EDAE27CBAF118EC485"><enum>(i)</enum><text>an accounting of the administrative costs associated with each such activity;</text></clause><clause id="HD1A7FA799F2F4DAE8046BA67F203C0E7" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">an accounting of land acquired, if any, from willing sellers by each State fish and wildlife department using funds from the Subaccount, including—</text><subclause id="H0EE3D9BB49BE41D2ABA6A4F3B575F7BF" commented="no"><enum>(I)</enum><text>the number of acres acquired;</text></subclause><subclause id="H495666BF27BA40CABBB438DE0FE2916D" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the endangered species, threatened species, candidate species or species proposed for listing, or species petitioned for listing under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) or State law associated with the land acquired;</text></subclause><subclause id="H94844529D3B14643B28D5F9038CAE529" commented="no"><enum>(III)</enum><text>the justification for such land acquisition; and</text></subclause><subclause id="HD7064D9F8D034428AED5695DD92B5B9D"><enum>(IV)</enum><text>a detailed explanation regarding why other sources of funding were not used for the land acquisition; and</text></subclause></clause><clause id="HAA0A6808D2894B1696ABD77187963E24"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of acres of habitat restored, enhanced, created, or conserved by each such activity.</text></clause></subparagraph><subparagraph id="HBBE0819AF3E142C0A9996509F9A0D3B3"><enum>(B)</enum><text>A summary of the results and effectiveness of each activity carried out using funds apportioned from the Subaccount, including, if determinable—</text><clause id="H307D45D5B4C349648EA9EA7C4D5D7733"><enum>(i)</enum><text display-inline="yes-display-inline">any change in the population trends of species of greatest conservation need; and</text></clause><clause id="H7B0FFD0A6C2B4C3BB9EDB029819D2885"><enum>(ii)</enum><text display-inline="yes-display-inline">any reduction in threats to species of greatest conservation need.</text></clause></subparagraph></paragraph><paragraph id="H74F325958AA54339BAA1F00BB9867F51" display-inline="no-display-inline"><enum>(2)</enum><header>Summary report</header><text>The Secretary shall, not later than 180 days after each deadline for the submission of reports under paragraph (1), submit a report summarizing each report received by the Secretary under paragraph (1) to—</text><subparagraph id="H1B8275196C374894B2ED8493BA31F9BB"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Environment and Public Works of the Senate; and</text></subparagraph><subparagraph id="H427231CE9C6F490EBF170E6738696FF0"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph><paragraph id="HA31E793E4023498FB9C9E55672B6AA35"><enum>(3)</enum><header>State defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>State</term> includes the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HFDED869B76A24DFC93636514CACB0D4A"><enum>102.</enum><header>Technical amendments</header><subsection id="H8BDFD86809194FB6AEF57813344C0DB0"><enum>(a)</enum><header>Definitions</header><text>Section 2 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669a">16 U.S.C. 669a</external-xref>) is amended—</text><paragraph id="H598C9B52876E4DFB8ACE83C6092894C8"><enum>(1)</enum><text>in paragraph (7), by striking <quote>including redesignating paragraphs (8) through (12), as so redesignated by subparagraph (A) of this paragraph, as paragraphs (9) through (13), respectively; and</text></subparagraph><subparagraph jurisdiction, or responsibility of a State, territory, or the District of Columbia to manage, control, or regulate fish and wildlife on lands and waters within the State, territory, or the District of Columbia including on Federal lands and waters.</text></subsection><subsection id="HDA10E326FC234158B3623A57E6303781"><enum>(b)</enum><header>No funds authorized for dam removal or modification</header><text display-inline="yes-display-inline"> None of the funds made available under this Act may be used to remove a federally owned dam or modify a federally owned dam in a manner that reduces storage or diversion capacity.</text></subsection><subsection id="H8A13F69C9F9A4767B7C08D13E5A99B27"><enum>(c)</enum><header>Prohibition on land transfers</header><text display-inline="yes-display-inline">The Federal Government may not accept a transfer, donation, or exchange of land or an interest in land from a State government, a fish and wildlife department of the District of Columbia or a territory, or a regional association of fish and wildlife departments if such land or interest in land was purchased using funds apportioned under this Act.</text></subsection><subsection id="H4E09714942CA4C14831F0623E4196749"><enum>(d)</enum><header>Territory defined</header><text>In this section, the term <term>territory</term> has the meaning given the term in section 3(c)(1).</text></subsection></section><section id="H46A4054557A24C2591984951AADA60B4"><enum>15.</enum><header>Statutory construction with respect to Alaska</header><text display-inline="no-display-inline">If any conflict arises between any provision of this Act and any provision of the Alaska National Interest Lands Conservation Act or the Alaska Native Claims Settlement Act, then the provision in the Alaska National Interest Lands Conservation Act or the Alaska Native Claims Settlement Act shall prevail.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title><title id="HA7934F589CB64AB8B31B814F887A98AA"><enum>II</enum><header>Tribal Wildlife Conservation and Restoration</header><section id="HA2B7FC5FA952441AAA50F44F468D9B3F"><enum>201.</enum><header>Indian Tribes</header><subsection id="HE3B0762BB6A14824A299EF8D228F6BF3"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1AA69802C3DD47F6B159C6CD838A75CF"><enum>(1)</enum><header>Account</header><text>The term <term>Account</term> means the Tribal Wildlife Conservation and Restoration Account established by subsection (b)(1).</text></paragraph><paragraph id="HBA2DCDC4EB964CFF913F1E593E2D6C47"><enum>(2)</enum><header>Conservation</header><text display-inline="yes-display-inline">The term <term>conservation</term> has the meaning given such term in section 2 of the Pittman-Robertson Wildlife Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/669a">16 U.S.C. 669a</external-xref>).</text></paragraph><paragraph id="H15C54F39FF4042F9AD54D2EAEC70BC3B"><enum>(3)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H3DE5B019FBA042528E8294DF890EA6AA"><enum>(4)</enum><header>Restoration</header><text display-inline="yes-display-inline">The term <term>restoration</term> means the implementation of conservation actions and practices that reestablish or enhance environmental conditions and ecosystem functions that benefit the diversity, resilience, health, and productivity of plants and animals.</text></paragraph><paragraph id="H67EF197591A043298FDC9E0C13D55296"><enum>(5)</enum><header>Rewilding</header><text display-inline="yes-display-inline">The term <term>rewilding</term> means a restoration approach that prohibits human management activities and relies only on natural processes to maintain or improve habitat.</text></paragraph><paragraph id="HDDEFA1BB5FD4429DAD97A78D02E4AD9E"><enum>(6)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H45E249FA9DC8445097F85263F7C4236B"><enum>(7)</enum><header>Tribal organization</header><text display-inline="yes-display-inline">The term <term>Tribal organization</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H599E44C98A1040BFA1C58583544B986C" commented="no"><enum>(8)</enum><header>Tribal species of greatest conservation need</header><text>The term <term>Tribal species of greatest conservation need</term> means, with respect to an Indian Tribe, any terrestrial, aquatic, or marine fauna or flora that such Indian Tribe determines is—</text><subparagraph id="H1950DBCC669A4083A622CDC18B0D465B" commented="no"><enum>(A)</enum><text>of low or declining population,</text></subparagraph><subparagraph id="H3EACAF2C7FC14725AA6CCD9328568C70" commented="no"><enum>(B)</enum><text>facing threats and in need of conservation attention; or</text></subparagraph><subparagraph id="H7B3D3C6727DF4B70BA824CDF67323BEE" commented="no"><enum>(C)</enum><text>of cultural importance to such Indian Tribe.</text></subparagraph></paragraph><paragraph id="H1740541300A441FC9D2027CC987D8F6D"><enum>(9)</enum><header>Wildlife</header><text display-inline="yes-display-inline">The term <term>wildlife</term> means any species of—</text><subparagraph id="HAF6E80842762473DB9B4E1F4AA26062B"><enum>(A)</enum><text>wild, free-ranging fauna, including fish; and</text></subparagraph><subparagraph id="H6DF1782F28AC4E2388993DACB9FB80F8"><enum>(B)</enum><text>fauna in a captive breeding program the object of which is to reintroduce individuals of a depleted indigenous species into previously occupied range of such species.</text></subparagraph></paragraph></subsection><subsection id="H5EBAC2AB4BFA40C6B3B98DE647EB80DB"><enum>(b)</enum><header>Tribal Wildlife Conservation and Restoration Account</header><paragraph id="H08B74264C85F4F77966695D69F26C883"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury an account to be known as the <quote>Tribal Wildlife Conservation and Restoration Account</quote>.</text></paragraph><paragraph id="H02FFB12C1139496B8BD9BF246BA7EEBB"><enum>(2)</enum><header>Availability</header><text>Amounts in the Account shall be available until expended, subject to future appropriations, for each fiscal year for apportionment in accordance with this section.</text></paragraph><paragraph id="H43FB927AE7694BF88747029A8674FA7C"><enum>(3)</enum><header>Deposits into Account</header><text>There is authorized to be appropriated to the Account $20,000,000 for each of fiscal years 2025 through 2029.</text></paragraph><paragraph id="HA628AFCF72994D239803BDE0906212E9"><enum>(4)</enum><header>Sunset</header><text>No funds may be appropriated to the Account after fiscal year 2029.</text></paragraph></subsection><subsection id="H3D94EB577FE24A8EB28BF3FD08C3A731" commented="no"><enum>(c)</enum><header>Distribution of amounts to Indian Tribes and Tribal organizations</header><text display-inline="yes-display-inline">Each fiscal year, the Secretary shall distribute amounts in the Account through a noncompetitive grant program according to guidelines, criteria, and reporting requirements determined by the Secretary, acting through the Director of the Bureau of Indian Affairs, in consultation with Indian Tribes and Tribal organizations.</text></subsection><subsection id="H5C6CD99929A14C10A8FD083A879EEFAC"><enum>(d)</enum><header>Wildlife management responsibilities</header><paragraph id="H2AFD6C5113784473BD0885D57F7B0085"><enum>(1)</enum><header>In general</header><text>The distribution guidelines and criteria described in subsection (c) shall be based, in part, upon the wildlife management responsibilities of an Indian Tribe.</text></paragraph><paragraph id="HAC38DFC3660D42FA832E6B09EFD26DC0"><enum>(2)</enum><header>Indian Tribes and Tribal organizations in Alaska</header><subparagraph id="H583CAACB1C9945E29FC03C1592BC1F1E"><enum>(A)</enum><header>In general</header><text>Any amounts allocated to an Indian Tribe or Tribal organization in Alaska under this section may only be used in a manner consistent with the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3101">16 U.S.C. 3101 et seq.</external-xref>), and <external-xref legal-doc="public-law" parsable-cite="pl/85/508">Public Law 85–508</external-xref> (commonly known as the <quote>Alaska Statehood Act</quote>) (48 U.S.C. note prec. 21).</text></subparagraph><subparagraph id="HE21AD9DF95644D11AA019918B8A60338"><enum>(B)</enum><header>Cooperative agreements</header><text display-inline="yes-display-inline">An Indian Tribe or Tribal organization in Alaska may enter into a cooperative agreement with the State of Alaska regarding a conservation project of mutual concern.</text></subparagraph></paragraph></subsection><subsection id="H59D4B7DF83E442E3B96C96BA9673524A" commented="no"><enum>(e)</enum><header>Use of amounts</header><paragraph id="H1091EAD632EF4BDB9CB17B8CEF6C5E3B" commented="no"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), amounts distributed to an Indian Tribe or Tribal organization under subsection (c)—</text><subparagraph id="H26B502DF6C8640B08857F53347A6868F" commented="no"><enum>(A)</enum><text>shall be used for purposes consistent with section 2;</text></subparagraph><subparagraph id="HAFC4C04029FC46548D0C6043E701AF7F" commented="no"><enum>(B)</enum><text>shall be used to carry out, develop, or enhance wildlife and habitat conservation and restoration programs;</text></subparagraph><subparagraph id="HD0FAF282092448AC84619A1E2A073002" commented="no"><enum>(C)</enum><text>shall be used to assist in the restoration of habitat for species found in the lands and waters of such Indian Tribe or Tribal organization that are listed as endangered species, threatened species, candidate species or species proposed for listing, or species petitioned for listing under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) or under State or Tribal law;</text></subparagraph><subparagraph id="H790A555D5052480CAF0D4B58AA86A567" commented="no"><enum>(D)</enum><text>may be used for management of animals, including harvesting;</text></subparagraph><subparagraph id="H190F892C324148F788A8C3F512A0ACB0" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">may be used for the conservation and restoration of habitat for Tribal species of greatest conservation need whose range is shared with another State, territory, Indian Tribe, or foreign government; </text></subparagraph><subparagraph id="H1A38271CE02F4247B941FB4B89723BC1" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">may be used to manage, control, and prevent invasive species, disease, and other risks to the habitat of Tribal species of greatest conservation need; and</text></subparagraph><subparagraph id="H5DFE3E64DBC5412F9A931E8CD4A4BF96" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">may be used for forest and vegetation management activities if the primary purpose of such activity is to modify, improve, enhance, or create wildlife habitat or reduce the risk of damage or destruction to wildlife habitat due to wildfires, insects, or disease, including—</text><clause id="HCB9773CB18074533B7AB40D9E391A328" commented="no"><enum>(i)</enum><text>planting, seeding, and harvesting, including planting, seeding, and harvesting of native seeds;</text></clause><clause id="H673DB2671D354BC7956F6FB18389513E" commented="no"><enum>(ii)</enum><text>mechanical thinning;</text></clause><clause id="H1CFB5E3B8E2445E4896BD82FA7239BC4" commented="no"><enum>(iii)</enum><text>prescribed burning;</text></clause><clause id="H1BEB779567F44CA59F7EA1A464CCFC53" commented="no"><enum>(iv)</enum><text>chemical applications designed to restore natural range of variation including creating and maintaining early seral communities; and</text></clause><clause id="HEB3FD883F22A429D8FCC358E804D443F"><enum>(v)</enum><text display-inline="yes-display-inline">prescribed haying and grazing practices.</text></clause></subparagraph></paragraph><paragraph id="HC1871A2744954E2496DD0A8D4513DAA6" commented="no"><enum>(2)</enum><header>Prohibited uses</header><text display-inline="yes-display-inline">Amounts distributed to an Indian Tribe or Tribal organization under subsection (c) may not be used for—</text><subparagraph id="HB8097C81020348A69F9D4FCED957BDE8" commented="no"><enum>(A)</enum><text>rewilding; or</text></subparagraph><subparagraph id="HE17F7233A0FB47918211FA2A124D6A9D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">the reintroduction or management of a species in a manner not supported by the applicable Tribal fish and wildlife management authorities.</text></subparagraph></paragraph></subsection><subsection id="H7CBABB4980304268B972C4C98142F05E"><enum>(f)</enum><header>Matching requirement</header><text display-inline="yes-display-inline">With respect to any grant issued under subsection (c) that exceeds $100,000, the Federal share of total costs of the project funded through such grant may not exceed 90 percent.</text></subsection><subsection id="H37D71C11BD9E44128C5A0AA083A7258A"><enum>(g)</enum><header>Public access not required</header><text>Amounts distributed to an Indian Tribe or Tribal organization under subsection (c) may not be conditioned upon the provision of public or non-Tribal access to Tribal or private lands, waters, or holdings.</text></subsection><subsection id="H004922C2CD944867B8FBC49836BFB868"><enum>(h)</enum><header>Administrative costs</header><text>Of the amounts deposited under subsection (b)(3) for each fiscal year, not more than 3 percent may be used by the Secretary for administrative costs.</text></subsection><subsection id="H03DEB82F18694ACF92F0C04BF6AE25BA"><enum>(i)</enum><header>Accountability</header><paragraph id="HDE55BBDE2B5F4A509A42ECB8D3F2EF61"><enum>(1)</enum><header>Tribal reports</header><text>Not later than the last day of fiscal year 2029, each Indian Tribe and Tribal organization that receives funds under this section shall submit to the Director of the Bureau of Indian Affairs a report describing, with respect to such Indian Tribe or Tribal organization during the preceding 5 years, the following:</text><subparagraph id="HBAA621D70A0C4ED9ACD215913D31A65E" display-inline="no-display-inline"><enum>(A)</enum><text>A summary of each activity carried out using funding received under subsection (c), including—</text><clause id="H8C5FAB9D0FFC4F0EA43A3CB425E35B59"><enum>(i)</enum><text>an accounting of the administrative costs associated with each such activity; and</text></clause><clause id="H116C40E9032E493B92AE28C974C7E57D"><enum>(ii)</enum><text>the number of acres of habitat restored, enhanced, or conserved by each such activity.</text></clause></subparagraph><subparagraph id="H042B87E5CB3D4F7BA98DBAB3C80FC3F4"><enum>(B)</enum><text display-inline="yes-display-inline">A summary of the results and effectiveness of each activity carried out using funding received under subsection (c), including, if determinable—</text><clause id="HE60C4DAFB8E54711A5EEB3AB18E5CC52"><enum>(i)</enum><text display-inline="yes-display-inline">any change in the population trends of species of greatest conservation need; and</text></clause><clause id="H6F1D13A0F4D9490B9E40691D7328110E"><enum>(ii)</enum><text display-inline="yes-display-inline">any reduction in threats to species of greatest conservation need.</text></clause></subparagraph></paragraph><paragraph id="HD99B3E7F09D940889F1148444A7D7830"><enum>(2)</enum><header>Summary report</header><text display-inline="yes-display-inline">The Director of the Bureau of Indian Affairs shall, not later than 180 days after each deadline for the submission of reports under paragraph (1), submit a report summarizing each report received by the Director under paragraph (1) to—</text><subparagraph id="HBFAA59DE3DB947EC8704D93D29F8D02D"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Environment and Public Works of the Senate; and</text></subparagraph><subparagraph id="H2CB56AD5B5F047A780CC4F6787426931"><enum>(B)</enum><text>the Committee on Natural Resources of the House of Representatives.</text></subparagraph></paragraph></subsection><subsection id="H4A129919C7D846D288FEA2E620B99894" commented="no" display-inline="no-display-inline"><enum>(j)</enum><header>Savings clause</header><text>Nothing in this section may be construed as modifying or abrogating a treaty with any Indian Tribe, or as enlarging or diminishing the authority, jurisdiction, or responsibility of an Indian Tribe or Tribal organization to manage, control, or regulate wildlife.</text></subsection><subsection display-inline="no-display-inline" commented="no" id="HEBBF3DD89E7A4D7B9861DDAECB2AEC9E"><enum>(k)</enum><header>Statutory construction with respect to Alaska</header><text>If any conflict arises between any provision of this section and any provision of the Alaska National Interest Lands Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/16/3101">16 U.S.C. 3101 et seq.</external-xref>) or the Alaska Native Claims Settlement Act (<external-xref legal-doc="usc" parsable-cite="usc/43/1601">43 U.S.C. 1601 et seq.</external-xref>), then the provision in the Alaska National Interest Lands Conservation Act or the Alaska Native Claims Settlement Act shall prevail.</text></subsection></section></title><title id="H6F6213FE0C004C928E501F77FAC57053" commented="no"><enum>III</enum><header>Conservation and Management for Wildlife Refuges</header><section id="H689E807622964AE58AED6BDCC70B5973" commented="no"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="HB6521BC08E194867805474F024B3CFEF" display-inline="no-display-inline" commented="no"><enum>(1)</enum><header>Authorized recreation services</header><text>The term <term>authorized recreation services</term> means similar and complementary recreation enhancement or improvement services carried out—</text><subparagraph id="HE6F808647F724FB9870BE2C46D2794D6" commented="no"><enum>(A)</enum><text>on lands and waters administered by the United States Fish and Wildlife Service, non-Federal land, or lands and waters owned by or held in trust for an Indian Tribe; and</text></subparagraph><subparagraph id="H2B3C23BA4CFE4458B79367E380638BAA" commented="no"><enum>(B)</enum><text>by the Secretary or a Governor, Indian Tribe, or county, as applicable, pursuant to a good neighbor agreement.</text></subparagraph></paragraph><paragraph id="HD33A3114E5734951945B71F9CDB5F778" commented="no"><enum>(2)</enum><header>Authorized restoration services</header><text>The term <term>authorized restoration services</term> means similar and complementary forest, rangeland, and watershed restoration services—</text><subparagraph id="HC6E7A046F71145ED9596AE9494822477" commented="no"><enum>(A)</enum><text>carried out—</text><clause id="HC93E0C059BBE407EA9740519341DEFAF" commented="no"><enum>(i)</enum><text>on lands and waters administered by the United States Fish and Wildlife Service, non-Federal land, or lands and waters owned by an Indian Tribe; and</text></clause><clause id="H5EC75F1BCF7A4763AA691FE591B2DFCE" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">by the Secretary or a Governor, Indian Tribe, or county, as applicable, pursuant to a good neighbor agreement; and</text></clause></subparagraph><subparagraph id="HD89208D1A8B049398B98206B5D5436B3" commented="no"><enum>(B)</enum><text>in the case of forest, rangeland, and watershed restoration services carried out on lands and waters administered by the United States Fish and Wildlife Service, such services shall be consistent with the purposes for which such lands were established.</text></subparagraph></paragraph><paragraph id="HE04F9C10D50F43C18EFF3112E972C929" commented="no"><enum>(3)</enum><header>County</header><text>The term <term>county</term> means—</text><subparagraph id="H7C2F0489C51148BBA6A00FA5E8E25443" commented="no"><enum>(A)</enum><text>the appropriate executive official of an affected county or parish; or</text></subparagraph><subparagraph id="H292A3CD670EB414CB9065B50B7178D0B" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">in any case in which multiple counties or parishes are affected, the appropriate executive official of a compact of the affected counties or parishes.</text></subparagraph></paragraph><paragraph id="HEDA754CF025D4F63A4476922DB1BA890" commented="no"><enum>(4)</enum><header>Forest, rangeland, and watershed restoration services</header><subparagraph id="H2BD6C85BE05C4CE095AEF348968E362F" commented="no"><enum>(A)</enum><text>The term <term>forest, rangeland, and watershed restoration services</term> means—</text><clause id="H986BE8E86CD84A469E20086D41D8A8E2" commented="no"><enum>(i)</enum><text>activities to reduce hazardous fuels;</text></clause><clause id="HEF81FC24C2E14FAD8F4090CDF29557F6" commented="no"><enum>(ii)</enum><text>activities to restore or improve fish, wildlife, and their habitats;</text></clause><clause id="H5F5F6E65F5774293BD136639DACD0A74" commented="no"><enum>(iii)</enum><text>activities to remove vegetation or other activities to promote healthy forest structure and composition;</text></clause><clause id="HFB761D46AD024451B005347ED0C57237" commented="no"><enum>(iv)</enum><text>activities to treat insect- or disease-infected trees;</text></clause><clause id="H6A4EAEB5931F46718F33DB754E48E76D" commented="no"><enum>(v)</enum><text>activities to control noxious or exotic weeds;</text></clause><clause id="H03504D127BEA4C3496EB976F1112F7B8" commented="no"><enum>(vi)</enum><text>activities to reestablish native plant species;</text></clause><clause id="H1316C14AAEA34CC6BC2B0A724A1CCD25" commented="no"><enum>(vii)</enum><text>activities to maintain a road or trail to restore or maintain water quality;</text></clause><clause id="HD709FD852F174839922C0F56E29F6E17"><enum>(viii)</enum><text>any other activities to restore or improve forest, rangeland, and watershed health, including fish and wildlife habitat; or</text></clause><clause id="HA8DF8CB271794E24AD75496D6D680B0D"><enum>(ix)</enum><text>any combination of activities described in clauses (i) through (viii).</text></clause></subparagraph><subparagraph id="HFA9A7D8CFA974D7AA5C8E94F70071DB9" commented="no"><enum>(B)</enum><text>The term <term>forest, rangeland, and watershed restoration services</term> does not include—</text><clause id="H8140A7186D07476AB32E019F2EBD2FDC" commented="no"><enum>(i)</enum><text>construction, reconstruction, repair, or restoration of paved roads or parking areas, other than—</text><subclause id="H2D1D6A4619A54E80BDC7E8B5DF677183" commented="no"><enum>(I)</enum><text>activities described in subparagraph (A)(vii); or</text></subclause><subclause id="HD2E94C0B99CE46F094E7F32F846A018E" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">the reconstruction, repair, or restoration of a National Wildlife Refuge System road or other road on United States Fish and Wildlife Service land that is necessary to carry out authorized restoration services pursuant to a good neighbor agreement; or</text></subclause></clause><clause id="HEBEB1EC68980427EB40812444A0BC0C3" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">construction, alteration, repair, or replacement of public buildings or works.</text></clause></subparagraph></paragraph><paragraph id="HCB3BEFD7D3EF4C1197613E29DFA04CA8" commented="no"><enum>(5)</enum><header>Good neighbor agreement</header><text>The term <term>good neighbor agreement</term> means a cooperative agreement or contract, including a sole source contract, entered into between the Secretary and a Governor, Indian Tribe, or county, as applicable, to carry out authorized recreation services or authorized restoration services.</text></paragraph><paragraph id="H3E674D12F0BF4C11AA646E84DCE1D577" commented="no"><enum>(6)</enum><header>Governor</header><text display-inline="yes-display-inline">The term <term>Governor</term> means the Governor or any other appropriate executive official of an affected State, Indian Tribe, or territory or possession of the United States.</text></paragraph><paragraph id="HD0A50BCEA2EE430CAFB29CA64F31B321" commented="no"><enum>(7)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="HE0C67AD66CCA40639FB210A3E843C904" display-inline="no-display-inline" commented="no"><enum>(8)</enum><header>Recreation enhancement or improvement services</header><text>The term <term>recreation enhancement or improvement services</term> means—</text><subparagraph other day use areas;</text></clause><clause id="H8FB897A585E444F49755893B029EDD38"><enum>(iii)</enum><text>restroom or shower facilities;</text></clause><clause id="H86B7DFA1E4AE4F42B71DBFCD488BF6AA" commented="no"><enum>(iv)</enum><text>shooting ranges;</text></clause><clause id="H1CB923F8855545E5938E1C7EF0165DBF" commented="no"><enum>(v)</enum><text>paved or permanent roads or parking areas that serve existing recreation facilities or areas;</text></clause><clause id="H12B13D7609874D9897D49487E0A8FBBC" commented="no"><enum>(vi)</enum><text>fishing piers, wildlife viewing platforms, docks, or other constructed features at a recreation site;</text></clause><clause id="HCB6EB6980FD64806AF4455806C9EC140" commented="no"><enum>(vii)</enum><text>boat landings;</text></clause><clause id="H77CC54066F084AE8B8109ADEAA13FA90" commented="no"><enum>(viii)</enum><text>hunting or fishing sites;</text></clause><clause id="HC9BF601678EE465EA2F5E162E30E300B"><enum>(ix)</enum><text>visitor centers or other interpretative sites; or</text></clause><clause id="H67D2BD51DA8D447C9BD9F4CB48DB68F2"><enum>(x)</enum><text display-inline="yes-display-inline">levees and drainage structures to improve wetland habitat; and</text></clause></subparagraph><subparagraph id="HBED95AE0A2DD4A0A83D50459FC55F2DA" commented="no"><enum>(B)</enum><text>activities that create, improve, or restore access to existing recreation facilities or areas.</text></subparagraph></paragraph><paragraph id="H7D89AE514C4F4BE3A6105B2416883718" commented="no"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Fish and Wildlife Service.</text></paragraph></section><section id="H124D6E787A8446FAB5B9080F92AD15BF" commented="no"><enum>302.</enum><header>Good neighbor authority for United States Fish and Wildlife Service</header><subsection id="H2714D159CF0A46278E22031B9D56B1AC" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may enter into a good neighbor agreement with a Governor, Indian Tribe, or county to carry out authorized restoration services or authorized recreation services in accordance with this title. </text></subsection><subsection id="HEDCA07B5FE804A0D82BE4F721CC5E5E5" commented="no"><enum>(b)</enum><header>Restoration activities requiring timber sales</header><paragraph id="H9E795D157D9841B0AFF188EE52F62838" commented="no"><enum>(1)</enum><header>Approval of silviculture prescriptions and marking guides</header><text>The Secretary shall provide or approve all silviculture prescriptions and marking guides to be applied on Federal land in all timber sale projects conducted under this section.</text></paragraph><paragraph id="HB8A8F904799648A592D6023FD8E8FC0F" commented="no"><enum>(2)</enum><header>Treatment of restoration services revenue</header><text display-inline="yes-display-inline">Funds received from the sale of timber by a Governor, Indian Tribe, or county under a good neighbor agreement shall be retained and used by the Governor, Indian Tribe, or county, as applicable—</text><subparagraph id="H4D6A878667C8493794298E3D2169A126" commented="no"><enum>(A)</enum><text>to carry out authorized restoration services under the good neighbor agreement; and</text></subparagraph><subparagraph id="HBF5660ABB46444E484C50003713DD02A" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">if there are funds remaining after carrying out subparagraph (A), to carry out authorized restoration services or authorized recreation services under other good neighbor agreements.</text></subparagraph></paragraph><paragraph id="HEC2D6A95AC9947AC9EA4825D5B6EF5AD" commented="no"><enum>(3)</enum><header>Termination of authority</header><text>The authority provided under paragraph (2) shall terminate on October 1, 2032.</text></paragraph></subsection><subsection id="H0C8578472D9C4981B64B02826C3B27DC"><enum>(c)</enum><header>Recreation services fees</header><text display-inline="yes-display-inline">Nothing in this title may be construed to allow a Governor, Indian Tribe, or county to charge entrance, standard amenity, or expanded amenity fees on National Wildlife Refuge System lands and waters as described in section 803 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6802">16 U.S.C. 6802</external-xref>).</text></subsection><subsection id="H0F608B93CECD40BABDAD8A7E47D3B59D" commented="no"><enum>(d)</enum><header>Retention of National Environmental Protection Act of 1969 responsibilities</header><text display-inline="yes-display-inline">Any decision required to be made under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) with respect to any authorized restoration services or authorized recreation services carried out under this section on lands and waters administered by the United States Fish and Wildlife Service may not be delegated to a Governor, Indian Tribe, or county.</text></subsection><subsection id="H8E16089DBDAC40F6B18D3746F2F1370C" commented="no"><enum>(e)</enum><header>Public availability</header><text>The Secretary shall make each good neighbor agreement available to the public.</text></subsection><subsection id="HC1ECC3A24F304DD0B580DAC073455514" commented="no"><enum>(f)</enum><header>Exclusions</header><text>The authority provided by this section does not apply to—</text><paragraph id="H382338B6B57F42208822EFD99295D514" commented="no"><enum>(1)</enum><text>a component of the National Wilderness Preservation System;</text></paragraph><paragraph id="HF074618BFF2C4F34804B9874FE0699B0" commented="no"><enum>(2)</enum><text>Federal land on which the removal of vegetation is prohibited or restricted by an Act of Congress or a Presidential proclamation (including the applicable implementation plan); or</text></paragraph><paragraph id="H8FE5B5129FF1490492FDF857DAE80471" commented="no"><enum>(3)</enum><text>a wilderness study area.</text></paragraph></subsection></section><section id="H0EAA39FFA2A04DA9A559DB6904CA0E1F" commented="no"><enum>303.</enum><header>Stewardship end result contracting projects</header><subsection id="H45F88454384B4989AE7DB6EE65AD5519" commented="no"><enum>(a)</enum><header>In general</header><text>The Secretary, through an agreement or contract, as appropriate, may enter into stewardship contracting projects with a private person or other public or private entity to perform forest, rangeland, and watershed restoration services on lands and waters administered by the United States Fish and Wildlife Service that meet local and rural community needs.</text></subsection><subsection id="H4100FF61FFE14790848D6FF95F4CB460" commented="no"><enum>(b)</enum><header>Agreements or contracts</header><paragraph id="H6BFFBBC686E84D40974886B09FD5CE6B" commented="no"><enum>(1)</enum><header>Procurement procedure</header><text>A source for performance or an agreement or contract entered into under subsection (a) shall be selected on a best-value basis, including consideration of source under other public and private agreements or contracts.</text></paragraph><paragraph id="H645430E72B8E421B93DDA5F332DF4CDC" commented="no"><enum>(2)</enum><header>Contract for sale of timber or forest products</header><text>A contract entered into under this section may, at the discretion of the Secretary, be considered a contract for the sale of timber or forest products under such terms as the Secretary may prescribe without regard to any other provision of law.</text></paragraph><paragraph id="H407A3967B9594B5A8EB97AE37CEF3B13" commented="no"><enum>(3)</enum><header>Term</header><text display-inline="yes-display-inline">The Secretary may enter into an agreement or contract under subsection (a) for an initial period of not more than 20 years.</text></paragraph><paragraph id="HA25CF5BF5B4B4CA29E69F453654812C4" commented="no"><enum>(4)</enum><header>Offsets</header><subparagraph id="H803D12E7A087493A923B277105108D1E" commented="no"><enum>(A)</enum><header>In general</header><text>The Secretary may apply the value of timber or forest products removed as an offset against the cost of forest, rangeland, and watershed restoration services received pursuant to an agreement or contract under this section.</text></subparagraph><subparagraph id="H0F7D97FAEA9445D08AF4022F3EE65F79" commented="no"><enum>(B)</enum><header>Value of offset</header><text>The value of timber or other forest products used as an offset—</text><clause id="H87ED79B3A30B4C6FA733CFB9D7F00606" commented="no"><enum>(i)</enum><text>shall be determined using appropriate methods of appraisal commensurate with the quantity of products to be removed; and</text></clause><clause id="H7F459A1A02454223AC0C154B39B8B61F" commented="no"><enum>(ii)</enum><text>may—</text><subclause id="H24B26DF8F8BA413396F3A2B741FA135C" commented="no"><enum>(I)</enum><text>be determined using a unit of measure appropriate to the contracts; and</text></subclause><subclause id="HB8D4EC30D1CD4237A5E80C2DC47A5CB6" commented="no"><enum>(II)</enum><text>may include valuing products on a per-acre basis.</text></subclause></clause></subparagraph><subparagraph id="H8563F5CBFC0A45FC8E0971E6813E9D0F" commented="no"><enum>(C)</enum><header>Contracting officer</header><text>Notwithstanding any other provision of law, the Secretary may determine the appropriate contracting officer to enter into and administer an agreement or contract under this section.</text></subparagraph></paragraph></subsection><subsection id="HBC6B43617D0548E0B967F61A4A98A2B7" commented="no"><enum>(c)</enum><header>Receipts</header><paragraph id="H8DEE818A1DAE4A07926739436F7C9688" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary may collect monies from an agreement or contract under this section if the collection is a secondary objective of negotiating the contract that will best achieve the purpose of this section.</text></paragraph><paragraph id="H6B727A4827284EAEAD358640C045A28A" commented="no"><enum>(2)</enum><header>Disposition and availability of moneys</header><text>Monies from an agreement or contract under this section shall remain available until expended for forest, rangeland, and watershed restoration services at the project site from which the monies are collected, or at another project site.</text></paragraph></subsection><subsection id="HACC96E82D1D74C098DE6CAD340D026D2" commented="no"><enum>(d)</enum><header>Relation to other laws</header><text>Notwithstanding any other provision of law, the value of services received by the Secretary under a stewardship contract project conducted under this section, and any payments made or resources provided by the contractor or Secretary, shall not be considered monies received from United States Fish and Wildlife Service lands.</text></subsection><subsection id="H0774970601C04BD3897E30C68CF7A2C0" commented="no"><enum>(e)</enum><header>Costs of removal</header><text>Notwithstanding the fact that a contractor did not harvest the timber or forest product, the Secretary may collect deposits from a contractor covering the costs of removal of timber or other forest products.</text></subsection><subsection id="HB5EFB0D1861F498CA71FE97AEABAE3F9" commented="no"><enum>(f)</enum><header>Performance and payment guarantees</header><paragraph id="HB326EBC38FD94784979EAA37FC9A7EE6" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary may require performance and payment bonds under sections 28.103–2 and 28.103–3 of the Federal Acquisition Regulation, in an amount that the contracting officer considers sufficient to protect the investment in receipts by the Federal Government generated by the contractor from the estimated value of the forest products to be removed under a contract under this section.</text></paragraph><paragraph id="H59A7FF8F505E40EAA67FF52F3FE98356" commented="no"><enum>(2)</enum><header>Excess offset value</header><text>If the offset value of the timber or forest products exceeds the value of the resource improvement treatments, the Secretary may—</text><subparagraph id="H2AD39FFADF704909B262369C4D618D05" commented="no"><enum>(A)</enum><text>use the excess to satisfy any outstanding liabilities from cancelled agreements or contracts; or</text></subparagraph><subparagraph id="HC5E06BDAAEF94D3FBFD9319C9477ED5E" commented="no"><enum>(B)</enum><text>if there are no outstanding liabilities described in subparagraph (A), apply the excess to other authorized stewardship projects.</text></subparagraph></paragraph></subsection><subsection id="H6616A0CACA9947DFBCC160A2D4480B96" commented="no"><enum>(g)</enum><header>Cancellation ceilings</header><text>Notwithstanding section 3903(b)(1) of title 41, United States Code, the Secretary may obligate funds in stages that are economically or programmatically viable to cover any potential cancellation or termination costs for an agreement or contract under this section.</text></subsection><subsection id="H660D39ADDFAB4BE2AC4551ABC176A1AC" commented="no"><enum>(h)</enum><header>Monitoring and evaluation</header><paragraph id="H31D3FDAD13944BB698CBFDE06F5781D9" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a monitoring and evaluation process that accesses the stewardship contracting projects conducted under this section.</text></paragraph><paragraph id="H7B2F85EB7E2B48BF87C5D0C45746F9AC" commented="no"><enum>(2)</enum><header>Participants</header><text>Other than the Secretary, participants in the process described in this paragraph may include—</text><subparagraph id="HE207E1EC009F47419493AA22673A2E98" commented="no"><enum>(A)</enum><text>any cooperating governmental agencies, including Tribal governments; and</text></subparagraph><subparagraph id="HCBE40C1B1ED149A89F46A886C2F930D7" commented="no"><enum>(B)</enum><text>other interested groups or individuals.</text></subparagraph></paragraph></subsection></section><section id="HEEDA615F19B845878BFA17F018F20F3A"><enum>304.</enum><header>Technical amendments</header><subsection id="H9770EAA01CB0435580E18BC57CF5F69F"><enum>(a)</enum><header>Good neighbor authority</header><text display-inline="yes-display-inline">Section 8206 of the Agricultural Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/16/2113a">16 U.S.C. 2113a</external-xref>) is amended—</text><paragraph id="HD268EC2BAE75480DB969E27AF2263DD8"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H99894469AD444362A2E7AB31B66D4A9B"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)(B), by inserting <quote>, Indian tribe,</quote> after 2113a(a)</external-xref>)—</text><paragraph id="HBFC9DB657C944709B097350A17312C73"><enum>(1)</enum><text>before the date of the enactment of this Act, if the project was initiated after the date of the enactment of the Agriculture Improvement Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/334">Public Law 115–334</external-xref>); or</text></paragraph><paragraph id="HA0E550EDF3D142B680E421A7A00D555D"><enum>(2)</enum><text>on or after the date of the enactment of this Act.</text></paragraph></subsection></section></title><title id="HAA4CB321590B49A893FA28589E061AC0"><enum>IV</enum><header>Incentivizing Wildlife Conservation on Private Lands</header><section id="HBF08BDEA3D464B0FB13A2F220858A905" section-type="section-one"><enum>401.</enum><header>Candidate Conservation Agreements with Assurances</header><subsection id="H1D699C31F18F433FBCBAE6FF4974B9C1"><enum>(a)</enum><header>Listing determinations</header><text display-inline="yes-display-inline">Section 4(b)(1) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(b)(1)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H3CD60B30037245B69ED72531C7A277BB" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HII00"><subparagraph id="H93765A87ECBB4E6C985DF562D965D89D"><enum>(C)</enum><header>Candidate Conservation Agreements with Assurances</header><text display-inline="yes-display-inline">In making a determination under subsection (a)(1) with respect to a species, the Secretary shall take into account and document the effect of any net conservation benefit (as that term is defined in section 10(k)) of any Candidate Conservation Agreement with Assurances or any programmatic Candidate Conservation Agreement with Assurances (as those terms are defined in that subsection) relating to such species.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD83D048CDCB34030B41B854C60E8B47E"><enum>(b)</enum><header>Candidate Conservation Agreements with Assurances</header><text>Section 10 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H26380718282D4B809C7FC84883344994" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HII00"><subsection id="HF0D6542A34944BBA9B8EAFBB5D27853E"><enum>(k)</enum><header>Candidate Conservation Agreements with Assurances</header><paragraph id="H221F84B43A114FBE85962AEAD5EA56A4"><enum>(1)</enum><header>Proposed Agreement</header><text display-inline="yes-display-inline">A covered party may submit a proposed Agreement to the Secretary.</text></paragraph><paragraph id="HA9B445CDDA2C469CB3B8293F1BC88622"><enum>(2)</enum><header>Approval</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the receipt of a proposed Agreement under paragraph (1), the Secretary shall approve the proposed Agreement if the Secretary determines that the proposed Agreement— </text><subparagraph id="H925F0553EAF84692B92EB46F2FADDD6A"><enum>(A)</enum><text display-inline="yes-display-inline">sets forth specific management activities that the covered party will undertake to conserve the covered species;</text></subparagraph><subparagraph id="HDDFB0D5BDED2481294DF78D63579EA63"><enum>(B)</enum><text display-inline="yes-display-inline">provides a positive estimate of the net conservation benefit of such management activities to the covered species;</text></subparagraph><subparagraph id="H0E44BF74586446788DFF7B9FA2705D8C" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">describes, to the maximum extent practicable, the existing population levels of the covered species or the existing quality of habitat;</text></subparagraph><subparagraph id="H81BAD45B30A54070A5214F713D999952"><enum>(D)</enum><text display-inline="yes-display-inline">includes a monitoring plan to be carried out by the parties to the Agreement; and</text></subparagraph><subparagraph id="H172088B761814840AEDBF46E3417854F"><enum>(E)</enum><text display-inline="yes-display-inline">provides assurances to the covered party that no additional conservation measures will be required and additional land, water, or resource use restrictions will not be imposed on the covered party if the covered species becomes listed after the effective date of such Agreement.</text></subparagraph></paragraph><paragraph id="H4C82823381F24D64B4690BD4B602375B" commented="no"><enum>(3)</enum><header>Denial</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the receipt of a proposed Agreement under paragraph (1), the Secretary shall—</text><subparagraph id="H8CFB63AE4A584488AFA3C5DB2C061EE8"><enum>(A)</enum><text>deny the proposed Agreement if the Secretary determines that the proposed Agreement does not meet the requirements described in paragraph (2); and</text></subparagraph><subparagraph id="HCF4785D2E8F44E93972C209986197B52"><enum>(B)</enum><text>provide the submitting covered party a written explanation for such determination and the adjustments required for the Secretary to approve such proposed Agreement.</text></subparagraph></paragraph><paragraph id="HE3A716961A054379800F80932FC42A00" commented="no"><enum>(4)</enum><header>Programmatic Candidate Conservation Agreement with Assurances</header><subparagraph id="HAF45C550691A4646B52B9819ACE72C4D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may enter into a Candidate Conservation Agreement with Assurances with a covered party that authorizes such covered party—</text><clause id="H4047EE83871445189C366B9BAFE01B81"><enum>(i)</enum><text display-inline="yes-display-inline">to administer such Candidate Conservation Agreement with Assurances;</text></clause><clause id="H716C42ADA57642389E7359A04473DE79"><enum>(ii)</enum><text display-inline="yes-display-inline">to hold any permit issued under this section with regard to such Candidate Conservation Agreement with Assurances;</text></clause><clause id="H23036EE8DEFD4C43AA90E60F1F0003FF"><enum>(iii)</enum><text display-inline="yes-display-inline">to enroll other covered parties within the area covered by such Candidate Conservation Agreement with Assurances in such Candidate Conservation Agreement with Assurances; and</text></clause><clause id="HA01D50E452194DE5B919ACFB01D1D174"><enum>(iv)</enum><text>to convey any permit authorization held by such covered party under clause (ii) to each covered party enrolled under clause (iii).</text></clause></subparagraph><subparagraph id="H3DAD3DC0342143D1B3DE3BA13C124D33"><enum>(B)</enum><header>Publication</header><text display-inline="yes-display-inline">Upon receipt of a proposed programmatic Candidate Conservation Agreement with Assurances under paragraph (1) and before approving or denying such a proposed programmatic Candidate Conservation Agreement with Assurances under paragraph (2) or (3), respectively, the Secretary shall—</text><clause id="H2B359681D260409F92776885B0E39A37" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">not later than 30 days after the date of such receipt, publish the proposed programmatic Candidate Conservation Agreement with Assurances in the Federal Register for public comment for a period of not less than 60 days;</text></clause><clause id="H80EDCEEF93484AFA971DDD515FEE5214"><enum>(ii)</enum><text>review any comments received under clause (i); and</text></clause><clause id="HF3A51D63C43E4655BEA0CE45813423F1" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">after the close of the public comment period for the proposed programmatic Candidate Conservation Agreement with Assurances, publish in the Federal Register—</text><subclause id="HF6F0D8484C444B929D0E2F6E86FB3069"><enum>(I)</enum><text>any comments received under clause (i); and</text></subclause><subclause id="HBFD3978B70BD4D1283A6C3FB97900B62"><enum>(II)</enum><text display-inline="yes-display-inline">the approval or denial of the proposed programmatic Candidate Conservation Agreement with Assurances under paragraph (2) or (3), respectively.</text></subclause></clause></subparagraph></paragraph><paragraph id="H548AF9B7F663488E95A15BD2742FB5D8"><enum>(5)</enum><header>Incidental take authorization</header><text>If a covered species is listed under section 4, the Secretary shall issue a permit to the relevant covered party under this section allowing incidental take of and modification to the habitat of such covered species consistent with the Agreement.</text></paragraph><paragraph id="HD52F8FB19CD74EB79F0DA1C3B30145F0"><enum>(6)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">The Secretary shall, upon request, provide a covered party with technical assistance in developing a proposed Agreement.</text></paragraph><paragraph id="H24F0A0B5E6314919ADDCE58393E86040" commented="no"><enum>(7)</enum><header>Applicability to Federal land</header><text>An Agreement may apply to a covered party that conducts activities on land administered by any Federal agency pursuant to a permit or lease issued to the covered party by that Federal agency.</text></paragraph><paragraph id="HCAD7100A7E7749B28985E0395CA14512" commented="no"><enum>(8)</enum><header>Exemption from consultation requirement</header><text>An Agreement approved under this subsection shall be deemed to have been granted an exemption under section 7(h) for the purposes of that section.</text></paragraph><paragraph id="H8E749312641E40308CED761320674238" commented="no"><enum>(9)</enum><header>Exemption from disclosure</header><text display-inline="yes-display-inline">Information submitted by a private party to the Secretary under this subsection shall be exempt from disclosure under section 552(b)(3)(B) of title 5, United States Code.</text></paragraph><paragraph id="H211D4E47B7824570B62230993CF33B36"><enum>(10)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HAFD04627493342FFBC786BD7EFCC6DCB"><enum>(A)</enum><header>Agreement</header><text>The term <term>Agreement</term> means—</text><clause id="H36F5774AD43F4F42BC011189F61A878E"><enum>(i)</enum><text>a Candidate Conservation Agreement with Assurances; or</text></clause><clause id="H92E35DDCF9C349258922C7A44249D6FD"><enum>(ii)</enum><text>a programmatic Candidate Conservation Agreement with Assurances.</text></clause></subparagraph><subparagraph id="H79826D43939C40278492A155F507BDD7"><enum>(B)</enum><header>Candidate Conservation Agreement with Assurances</header><text display-inline="yes-display-inline">The term <term>Candidate Conservation Agreement with Assurances</term> means any voluntary agreement, including a conservation benefit agreement, between the Secretary and a covered party in which—</text><clause id="H840F00CA87BD44AB8C4D933FD207D2E6"><enum>(i)</enum><text>the covered party commits to implementing mutually agreed upon conservation measures for a candidate species; and</text></clause><clause id="HE1355F98D0FE42FFBD1831F2DEF3F501"><enum>(ii)</enum><text>the Secretary provides assurances that, if such candidate species is listed pursuant to section 4—</text><subclause id="H0AA388B1AF5F475FB9F44487A4C8BA72"><enum>(I)</enum><text>the covered party shall incur no additional obligations beyond actions agreed to in the agreement with respect to conservation activities required under this Act; and</text></subclause><subclause id="H5867CAFAE2A3439281397486B68B8091"><enum>(II)</enum><text>no additional land, water, or resource use restrictions shall be imposed on the covered party beyond those included in the agreement.</text></subclause></clause></subparagraph><subparagraph id="H9564AD8DD3834418917C9E050B414B7D"><enum>(C)</enum><header>Candidate species</header><text display-inline="yes-display-inline">The term <term>candidate species</term> means a species—</text><clause id="H0C7131A61567494586DBD13489588B88"><enum>(i)</enum><text>designated by the Secretary as a candidate species under this Act; or</text></clause><clause id="H35C25EA9C1A64B07BD6565D3B82C9F48"><enum>(ii)</enum><text>proposed to be listed pursuant to section 4.</text></clause></subparagraph><subparagraph id="HF1B882FA49194170A16C9C2C0367E8D8"><enum>(D)</enum><header>Covered party</header><text display-inline="yes-display-inline">The term <term>covered party</term> means a—</text><clause id="H89F4269B07DF43219729B67C0DACB845"><enum>(i)</enum><text>party that conducts activities on land administered by a Federal agency pursuant to a permit or lease issued to the party;</text></clause><clause id="H34BE10892EEA4F578440872CF7B646A4"><enum>(ii)</enum><text>private property owner;</text></clause><clause id="HB0F86D6BAC9F4044BECDD2419D0CC88A"><enum>(iii)</enum><text>county; </text></clause><clause id="H1DE5CC818F664F4A828064BAE1A9F082"><enum>(iv)</enum><text>State or State agency; or</text></clause><clause id="HEDE47A9E630542628E805068FA671148"><enum>(v)</enum><text>Tribal government.</text></clause></subparagraph><subparagraph id="H34A3528F313745A4B507653B371020AC"><enum>(E)</enum><header>Covered species</header><text>The term <term>covered species</term> means, with respect to an Agreement, the species that is the subject of such Agreement. </text></subparagraph><subparagraph id="H4CE32D311FB74F53B658C294FE5F61E0"><enum>(F)</enum><header>Net conservation benefit</header><text display-inline="yes-display-inline">The term <term>net conservation benefit</term> means the net effect of an Agreement, determined by comparing the existing situation of the candidate species without the Agreement in effect and a situation in which the Agreement is in effect, on a candidate species, including—</text><clause id="H62CAFDFF788F4A21B1ABC62CB3FBAD05"><enum>(i)</enum><text>the net effect on threats to such species;</text></clause><clause id="HBB7DA315B3C04679B283524040065717"><enum>(ii)</enum><text>the net effect on the number of individuals of such species; or</text></clause><clause id="H3750A4325EED4373B966C442802AF089"><enum>(iii)</enum><text>the net effect on the habitat of such species.</text></clause></subparagraph><subparagraph id="HA5AF8A7DE93E4BF28CF7A4C35F62781A" commented="no"><enum>(G)</enum><header>Programmatic Candidate Conservation Agreement with Assurances</header><text display-inline="yes-display-inline">The term <term>programmatic Candidate Conservation Agreement with Assurances</term> means a Candidate Conservation Agreement with Assurances described in paragraph (4)(A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H8E44CC142A8D4505B1772B9D1F7D0EF8"><enum>402.</enum><header>Designation of critical habitat</header><text display-inline="no-display-inline">Section 4(a)(3) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533(a)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HDB2501E07B7F49D68289755542B4D681" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HII00"><subparagraph id="H7D9597F156784EA88DCAA54A5D4A978F"><enum>(C)</enum><header>Privately owned or controlled land</header><text display-inline="yes-display-inline">The Secretary may not designate as critical habitat under subparagraph (A) any privately owned or controlled land or other geographical area that is subject to a land management plan that—</text><clause id="H5D62EF18C6A94BF2B57AC78969E9E629" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines is similar in nature to an integrated natural resources management plan described in section 101 of the Sikes Act (<external-xref legal-doc="usc" parsable-cite="usc/16/670a">16 U.S.C. 670a</external-xref>);</text></clause><clause id="H4FC88FFF485443E0B3A05DC151EDBE3D"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H8971D5673C324ED4B97CFE3E1A2248DC"><enum>(I)</enum><text>is prepared in cooperation with the Secretary and the head of each applicable State fish and wildlife agency of each State in which such land or other geographical area is located; or</text></subclause><subclause id="HDADFB4C67B7E43CF98EDCD517EFE0088"><enum>(II)</enum><text>is submitted to the Secretary in a manner that is similar to the manner in which an applicant submits a conservation plan to the Secretary under section 10(a)(2)(A);</text></subclause></clause><clause id="HA6F2742E4D1A4D9E973F20A82A5C758E"><enum>(iii)</enum><text>includes an activity or a limitation on an activity that the Secretary determines will likely conserve the species concerned;</text></clause><clause id="H3205CEEC63B24D7DA5428D9EB870F7E4" commented="no"><enum>(iv)</enum><text>the Secretary determines will result in—</text><subclause id="HF762C5B87AE7422C87B40FC890747BF0" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">an increase in the population of the species concerned above the population of such species on the date that such species is listed as threatened or endangered; or</text></subclause><subclause id="H51D9F4CBD7DB4F90A5DAEB9CE291CF5F" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">maintaining the same population of such species on the land or other geographical area as the population that would likely occur if such land or other geographical area is designated as critical habitat; and</text></subclause></clause><clause id="H5AAD373074B84F4B8C4C0B8EB6E14E93" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, will minimize and mitigate the impacts of any activity that will likely result in an incidental taking of the species concerned.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC03EC5D10F5C4C439F6F530DB09AD1D4"><enum>403.</enum><header>Availability of certain information</header><subsection id="HFD677E1AB7AB44529BD2EF35D005FB38"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), information regarding the occurrence of, including the specific location of, a species of fish or wildlife or plant may not be made available to the public under section 552 of title 5, United States Code.</text></subsection><subsection id="HE158869CB3B4415BBE005F4C0B0DBB39"><enum>(b)</enum><header>Exception</header><paragraph id="H8D475B854E134FC0B91037A4829473BF"><enum>(1)</enum><header>Voluntary public disclosure of occurrences on Federal land</header><text display-inline="yes-display-inline">The Secretary may make publicly available information described in subsection (a) with respect to Federal land.</text></paragraph><paragraph id="HF5222AE59D124D5AA1918F4526C45158"><enum>(2)</enum><header>Sharing information with particular entities</header><subparagraph id="HB79EC5A9F43E4B76AD2ED961289A5872"><enum>(A)</enum><header>In general</header><text>The Secretary may make available, to an entity listed in subparagraph (B), information described in subsection (a) upon receipt—</text><clause id="H3F2E72DF77064ACDA7BBF66CC355D951"><enum>(i)</enum><text>of a written request submitted by that entity; and</text></clause><clause id="H89353D87FFDE4767911CE74BB715BE23"><enum>(ii)</enum><text>written permission from each owner or manager of the land or water within which the species of fish or wildlife or plant occurs.</text></clause></subparagraph><subparagraph id="HDFF7F944802E4C09A030DD998AA5CAAD"><enum>(B)</enum><header>Entities</header><text display-inline="yes-display-inline">An entity referred to in clause (i) is—</text><clause id="HF06B7670EFA64D018CF4E8FA814107B9" display-inline="no-display-inline"><enum>(i)</enum><text>a Federal agency;</text></clause><clause id="H6A0975FB44C2422BAEE540D113B0E85A"><enum>(ii)</enum><text>a State governmental agency;</text></clause><clause id="H076EC1B8CBCA402C8B7D42BCBF91EF69" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">an Indian Tribe (as such term is defined in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>));</text></clause><clause id="HAB1EC19574C0414EA125C8D21C9455FB"><enum>(iv)</enum><text>a bona fide educational or research institution; or</text></clause><clause id="H78EE377EF93842C7AF12D938279B7C92"><enum>(v)</enum><text>a landowner or land manager of privately owned land.</text></clause></subparagraph><subparagraph id="H08CF3D79E286489893AE4CFC096DAC5F"><enum>(C)</enum><header>Requirements</header><text display-inline="yes-display-inline">A written request submitted under subparagraph (A) by an entity listed in subparagraph (B) shall—</text><clause id="HA4268413217440DC9EB3DA3B1263DA23"><enum>(i)</enum><text display-inline="yes-display-inline">describe the specific site or area for which information described in subsection (a) is sought;</text></clause><clause id="H456D0D5686F34E869B4504B57D358A57"><enum>(ii)</enum><text>explain the purpose for which such information is sought; and</text></clause><clause id="HB6EA98D5A1124C53A0CBED375F47B12D"><enum>(iii)</enum><text>describe the manner and degree to which the entity is able to maintain the confidentiality of such information.</text></clause></subparagraph></paragraph></subsection></section></title><title id="H84CDDE3A0F654E44B88EA724379F8B06"><enum>V</enum><header>Forest Information Reform</header><section id="HE1DCC133A5ED44E8A8D2C7A0AC07379B"><enum>501.</enum><header>No additional consultation required</header><subsection id="H8BC2759CC30747F4BCF44CA089036B6E"><enum>(a)</enum><header>Forest Service plans</header><text>Section 6(d)(2) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/16/1604">16 U.S.C. 1604(d)(2)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H3B1AEECB063B49B3A802FA7DC5B20912" changed="added" reported-display-style="italic" committee-id="HII00"><paragraph id="HE609EC458F3544F5B19609D075BA4AD9"><enum>(2)</enum><header>No additional consultation required under certain circumstances</header><text>Notwithstanding any other provision of law, the Secretary shall not be required to reinitiate consultation under section 7(a)(2) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) or section 402.16 of title 50, Code of Federal Regulations (or a successor regulation), on a land management plan approved, amended, or revised under this section when—</text><subparagraph id="H76CFA195F6934C0F9FCDDED0933DFE12"><enum>(A)</enum><text display-inline="yes-display-inline">a new species is listed or critical habitat is designated under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></subparagraph><subparagraph id="H994737B9AC9D452396091C0A32DB6C57"><enum>(B)</enum><text>new information reveals effects of the land management plan that may affect a species listed or critical habitat designated under that Act in a manner or to an extent not previously considered.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE6EAFFFC6B134AEDA08092D43B67BB10"><enum>(b)</enum><header>Bureau of Land Management plans</header><text display-inline="yes-display-inline">Section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H5483D41837854808B87FAAF3E6C69493" changed="added" reported-display-style="italic" committee-id="HII00"><subsection id="H040AC28A6FAE42E2B27F35E6FD051F84"><enum>(g)</enum><header>No additional consultation required under certain circumstances</header><text>Notwithstanding any other provision of law, the Secretary shall not be required to reinitiate consultation under section 7(a)(2) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) or section 402.16 of title 50, Code of Federal Regulations (or a successor regulation), on a land use plan approved, amended, or revised under this section when—</text><paragraph id="H8ECAD2A3133A4D1FA9C8005E00A0E141"><enum>(1)</enum><text display-inline="yes-display-inline">a new species is listed or critical habitat is designated under the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); or</text></paragraph><paragraph id="H147EB5C73FA94936B261D68ED1C2149A"><enum>(2)</enum><text>new information reveals effects of the land use plan that may affect a species listed or critical habitat designated under that Act in a manner or to an extent not previously considered.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title><title id="HA017264B7C6E400098B894C4A15AD79A"><enum>VI</enum><header>Providing for Greater Incentives to Recover Listed Species</header><section id="H278702CE78CF414192D1C81FBCF763A2"><enum>601.</enum><header>Protective regulations under Endangered Species Act of 1973</header><subsection id="HBC4266AB874540709C973211B60DF0B9"><enum>(a)</enum><header>Amendment to definition</header><text display-inline="yes-display-inline">Section 3(3) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532(3)</external-xref>) is amended by striking <quote>and transplantation, and, in the extraordinary case where population pressures within a given ecosystem cannot be otherwise relieved, may include</quote> and inserting <quote>transplantation, and, at the discretion of the Secretary,</quote>. </text></subsection><subsection id="H23C7F7A3F39F43A383C97CE4239E74B2"><enum>(b)</enum><header>Protective regulations</header><text display-inline="yes-display-inline">Section 4 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1533">16 U.S.C. 1533</external-xref>) is amended—</text><paragraph id="H3E983BFF951C44A58E52C1CB9459877B"><enum>(1)</enum><quoted-block style="OLC" display-inline="no-display-inline" id="H26A5A095D0AE4ED2B894840C4A31E98E" changed="added" reported-display-style="italic" committee-id="HII00"><subsection id="HF5E1AC3F53AC4D3C9D81F62B0744C128"><enum>(d)</enum><header>Protective regulations</header><paragraph id="HE9FD8F27C578491189E3974123B62167"><enum>(1)</enum><header>In general</header><text>Whenever any species is listed as a threatened species pursuant to subsection (c), the Secretary shall issue such regulations as are necessary and advisable to provide for the conservation of that species.</text></paragraph><paragraph id="HCF75AC873188421B9BE58992AF5FC62D"><enum>(2)</enum><header>Recovery goals</header><text>If the Secretary issues a regulation under paragraph (1) that prohibits an act described in section 9(a), the Secretary shall, with respect to the species that is the subject of such regulation—</text><subparagraph id="H45E98647739C45E18FFA2CB93F22CBD2"><enum>(A)</enum><text>establish objective, incremental recovery goals;</text></subparagraph><subparagraph id="H69EB050B28F9400FB4772EA758EBF7EA"><enum>(B)</enum><text>provide for the stringency of such regulation to decrease as such recovery goals are met; and</text></subparagraph><subparagraph id="HDE20783C4DDC40639DF580AC235A6179"><enum>(C)</enum><text display-inline="yes-display-inline">provide for State management within such State, if such State is willing to take on such management, beginning on the date on which the Secretary determines all such recovery goals are met and, if such recovery goals remain met, continuing until such species is removed from the list of threatened species published pursuant to subsection (c).</text></subparagraph></paragraph><paragraph id="HBDD8FB1350324C32A41BDCDA6558C2EF"><enum>(3)</enum><header>Cooperative agreement</header><text>A regulation issued under paragraph (1) that prohibits an act described in section 9(a)(1) with respect to a resident species shall apply with respect to a State that has entered into a cooperative agreement with the Secretary pursuant to section 6(c) only to the extent that such regulation is adopted by such State.</text></paragraph><paragraph id="H4523306DE3B043A489180700C78DED4D"><enum>(4)</enum><header>State recovery strategy</header><subparagraph id="H67332BE6D7C043AE89002782F2666195"><enum>(A)</enum><header>In general</header><text>A State may develop a recovery strategy for a threatened species or a candidate species and submit to the Secretary a petition for the Secretary to use such recovery strategy as the basis for any regulation issued under paragraph (1) with respect to such species within such State.</text></subparagraph><subparagraph id="HB42F7C93528847ACB5578011A8B8E910"><enum>(B)</enum><header>Approval or denial of petition</header><text display-inline="yes-display-inline">Not later than 120 days after the date on which the Secretary receives a petition submitted under subparagraph (A), the Secretary shall—</text><clause id="H5CBA2C09B6A54028BB945635133EBBF3"><enum>(i)</enum><text>approve such petition if the recovery strategy is reasonably certain to be implemented by the petitioning State and to be effective in conserving the species that is the subject of such recovery strategy; or</text></clause><clause id="H82FA66924AD146F6845822C5D7510DCA"><enum>(ii)</enum><text>deny such petition if the requirements described in clause (i) are not met.</text></clause></subparagraph><subparagraph id="HE6391F3C17FA408D851692786F7CEB35"><enum>(C)</enum><header>Publication</header><text>Not later than 30 days after the date on which the Secretary approves or denies a petition under subparagraph (B), the Secretary shall publish such approval or denial in the Federal Register.</text></subparagraph><subparagraph id="H4726E25756CA4ACEB848F14B76A5124C"><enum>(D)</enum><header>Denial of petition</header><clause id="H51BD4189C4A8422DB15E54E03942B77D"><enum>(i)</enum><header>Written explanation</header><text>If the Secretary denies a petition under subparagraph (B), the Secretary shall include in such denial a written explanation for such denial, including a description of the changes to such petition that are necessary for the Secretary to approve such petition.</text></clause><clause id="HFB1DF23281884DADBAD7177404F06FD7"><enum>(ii)</enum><header>Resubmission of denied petition</header><text>A State may resubmit a petition that is denied under subparagraph (B).</text></clause></subparagraph><subparagraph id="HDEE079E9617E4F85ACD71EFCFF65E1BF"><enum>(E)</enum><header>Use in protective regulations</header><text display-inline="yes-display-inline">If the Secretary approves a petition under subparagraph (B), the Secretary shall—</text><clause id="H3168FF5FEC804A5C927A2BBDD088678B"><enum>(i)</enum><text>issue a regulation under paragraph (1) that adopts the recovery strategy as such regulation with respect to the species that is the subject of such recovery strategy within the petitioning State; and</text></clause><clause id="H3347B27B5984407C874DA070920B8E88"><enum>(ii)</enum><text>establish objective criteria to evaluate the effectiveness of such recovery strategy in conserving such species within such State.</text></clause></subparagraph><subparagraph id="H1B1164B9F0D84BA5B2F383C5082898B3"><enum>(F)</enum><header>Revision</header><text>If a recovery strategy that is adopted as a regulation issued under paragraph (1) is determined by the Secretary to be ineffective in conserving the species that is the subject of such recovery strategy in accordance with the objective criteria established under subparagraph (E)(ii) for such recovery strategy, the Secretary shall revise such regulation and reissue such regulation in accordance with paragraph (1).</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H3CA4F9D4817941EB94FC340C4AE94AA3"><enum>(2)</enum><text>in subsection (f)(1)(B)—</text><subparagraph id="H5D8D76AFBCBF4FAFA0896E6B9C8DD144"><enum>(A)</enum><text>in clause (ii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HC3E24C9E37474DA68B5B3FA7BC8E1323"><enum>(B)</enum><text>in clause (iii), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H6FCC37F734F54E0EB13C031D2F208A75"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" display-inline="yes-display-inline">with respect to an endangered species, objective, incremental recovery goals in accordance with subsection (d)(2)(A) for use under that subsection if such endangered species is changed in status from an endangered species to a threatened species under subsection (c)(2)(B)(ii). id="H355305777490491FBEB5741343328AA5"><enum>VII</enum><header>Rescissions and repeals</header><section id="H3E9F30080CA1464F90347AAE4E0CADCC"><enum>701.</enum><header>Rescission of funds</header><subsection id="HC82A80BC53114B48945D0744093A74C3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any unobligated covered funds are hereby
