Committees on <committee-name committee-id="HBA00">Financial Services</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide a framework for the Bureau of Consumer Financial Protection and the Department of Education to coordinate in providing assistance to and serving borrowers seeking to resolve complaints related to their private education or Federal student loans, and for other purposes.</official-title></form><legis-body id="H7655D1DD0B224168B82DAA334EC24C6E" style="OLC"><section id="H410716FEB0804A24B02F8ACC8E3A7227" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>CFPB Student Loan Integrity and Transparency Act</short-title></quote>. </text></section><section id="H5BD695A094C44771A006958E60A3401C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H5515F753ECCE4C54AECFFB062CC926DE"><enum>(1)</enum><header>Agency</header><text>The term <quote>agency</quote> means the Bureau or the Department, as applicable, and the term <quote>agencies</quote> means both the Bureau and the Department. </text></paragraph><paragraph id="H99521D284A0C4CE6B52D136293927EC6"><enum>(2)</enum><header>Bureau</header><text>The term <quote>Bureau</quote> means the Bureau of Consumer Financial Protection.</text></paragraph><paragraph id="HA2461FDAE4D2480FBEB316EBE3807120"><enum>(3)</enum><header>Complaint</header><text display-inline="yes-display-inline">The term <quote>complaint</quote> means a comment, inquiry, or request for assistance from a student loan borrower.</text></paragraph><paragraph id="H632F323C1EF448659F35D70A681DF88D"><enum>(4)</enum><header>Department</header><text>The term <quote>Department</quote> means the Department of Education.</text></paragraph><paragraph id="HC391F49C58B641088548A5EB2A79439A"><enum>(5)</enum><header>Director</header><text>The term <quote>Director</quote> means the Director of the Bureau.</text></paragraph><paragraph id="H5B165F0A3E2845848372F8AFC0FA5B43"><enum>(6)</enum><header>Federal consumer financial law</header><text display-inline="yes-display-inline">The term <quote>Federal consumer financial law</quote> has the meaning given that term under section 1002 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>).</text></paragraph><paragraph id="HDF42C9050F8141718D866C0608A20C20"><enum>(7)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <quote>institution of higher education</quote> has the meaning given that term under section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph id="H4C7D21F8912544CFBFC9F885BD59F455"><enum>(8)</enum><header>Nonpublic information</header><text>The term <quote>nonpublic information</quote> means—</text><subparagraph id="H888BBE21C3B14D0C95F16A7DB74165F6"><enum>(A)</enum><text display-inline="yes-display-inline">confidential information, as such term is defined under section 1070.2 of title 12, Code of Federal Regulations;</text></subparagraph><subparagraph id="H5041C73D48FE4CC988292CA8A774DDA1"><enum>(B)</enum><text>any information collected by the Department from persons engaged in student financial services activities pursuant to the Department’s oversight and other authorities that is not publicly available; and</text></subparagraph><subparagraph id="HA0A6668A8B9F43F49B3A81C69836C21A"><enum>(C)</enum><text>the name, address, or other personally identifiable information relating to any consumer, including any information so designated by a provider of information.</text></subparagraph></paragraph><paragraph id="HAAA8718B971D42CC8845F9AA644B88D5"><enum>(9)</enum><header>Private education loan</header><text display-inline="yes-display-inline">The term <quote>private education loan</quote> has the meaning given that term under section 140(a) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1650">15 U.S.C. 1650(a)</external-xref>).</text></paragraph><paragraph id="HD4968F42C4294847AE2FA7D3155B551F"><enum>(10)</enum><header>Provider</header><text>With respect to information shared between the agencies, the term <quote>provider</quote> means the agency providing the information to the other agency. </text></paragraph><paragraph id="H93A9141AC3BC4829BB1D6C4D091F5029"><enum>(11)</enum><header>Receiver</header><text display-inline="yes-display-inline">With respect to information shared between the agencies, the term <quote>receiver</quote> means the agency receiving the information from the other agency.</text></paragraph><paragraph id="H6B9A31617F214CB58AF1572E03CEE542"><enum>(12)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Education.</text></paragraph><paragraph id="HCE4845E63BB144D7BFB0721F4D380FE2"><enum>(13)</enum><header>Student financial services</header><text display-inline="yes-display-inline">The term <quote>student financial services</quote> means consumer financial products or services (as defined under section 1002 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5481">12 U.S.C. 5481</external-xref>)) that are related to students of institutions of higher education, including student loan origination and student loan servicing.</text></paragraph><paragraph id="H3520D6EEE29A459CA2B2E2F22428D0F5"><enum>(14)</enum><header>Title IV loans</header><text display-inline="yes-display-inline">The term <quote>title IV loans</quote> means loans made, insured, or guaranteed under title IV of the Higher Education Act of 1965.</text></paragraph></section><section id="HF81EC4F125FA45858F7B2E3DCB8B7AC2"><enum>3.</enum><header>Cooperation between the Bureau and the Department</header><subsection id="H99EA40D1DFB1448CB84DF6AFC9A31AFA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director and the Secretary shall—</text><paragraph id="H5E5245F3D49942A5B328ABC4A8D7DD85"><enum>(1)</enum><text>establish points of contact between the Bureau and the Department with respect to Bureau supervision and Department oversight matters that are of common jurisdiction to both the Bureau and the Department;</text></paragraph><paragraph id="H3421FA08B2B847F098A90ACC8E811E81"><enum>(2)</enum><text display-inline="yes-display-inline">share with each other the Bureau’s schedule of examinations and the Department’s schedule of reviews of persons engaged in offering or providing student financial services that are subject to the Bureau’s supervisory authority and the Department’s oversight authority;</text></paragraph><paragraph id="H94E3EFE3D1064EA7B17B6311EC006E29"><enum>(3)</enum><text display-inline="yes-display-inline">coordinate the Bureau’s supervision activities and the Department’s oversight activities to promote the efficient use of resources;</text></paragraph><paragraph id="H600ED0AFF86E4F03A8BD81CDE729CB0A"><enum>(4)</enum><text display-inline="yes-display-inline">meet at least quarterly to discuss observations about the nature of complaints received by the Bureau and the Department, characteristics of borrowers, and available information about resolution of complaints, as well as analysis and recommendations; and</text></paragraph><paragraph id="H92365ADFFCEA4E108436F07905637989"><enum>(5)</enum><text>work to ensure the Bureau and the Department understand the respective reporting categories and definitions of each agency and how such categories and definition relate to each other for comparison.</text></paragraph></subsection><subsection id="HF6CE551CB54D429D984F5CF2A9AE080C"><enum>(b)</enum><header>Sharing of information</header><paragraph id="HBAE176305CBE499DB5E1BFF8E6F646B8"><enum>(1)</enum><header>Bureau access to Department databases</header><text display-inline="yes-display-inline">For the purpose of the Bureau’s congressional reporting, research, market analysis, complaint resolution, enforcement, supervision, financial education, engagement, and rulemaking needs, the Secretary shall work with the Bureau to provide the Bureau with access to Department databases, as applicable.</text></paragraph><paragraph id="H408F84043BD74FCEA5D82470CCDA77BE"><enum>(2)</enum><header>Consumer complaints</header><subparagraph id="H9CE2A1712CEF48E1809DB77B2CE3D3EF"><enum>(A)</enum><header>Bureau access to Department consumer complaints</header><text display-inline="yes-display-inline">The Director may request and obtain information from the Secretary concerning consumer complaints and other information pertaining to specific entities or classes of entities that are relevant to the exercise of the Bureau’s supervisory, enforcement, or regulatory functions.</text></subparagraph><subparagraph id="H7C694F252FE54F17B4A8DE1598B78D04"><enum>(B)</enum><header>Sharing of student loan borrower complaints</header><clause id="HF0A2CD3B74F4470F930761147CDF5FFE"><enum>(i)</enum><header>In general</header><text>The Director and the Secretary shall transfer each complaint received by their agency from student loan borrowers to the other agency.</text></clause><clause id="H2F2F86BFFF8E48D08B023028651AA51A"><enum>(ii)</enum><header>Deadline for sharing certain complaints</header><text display-inline="yes-display-inline">With respect to a complaint received by the Bureau related to the origination, disbursement, or servicing of a title IV loan or a complaint received by the Department related to a private education loan, the applicable agency shall direct the complaint to the other agency within 10 days of receipt of the complaint.</text></clause></subparagraph><subparagraph id="H9DFF8A321D6847D18ADBABBDC54F529E"><enum>(C)</enum><header>Addressing complaints related to defaulted title IV loans</header><text display-inline="yes-display-inline">The Director and the Secretary shall establish an efficient collaborative process to address complaints received by the Bureau about private collection agency actions related to defaulted title IV loans.</text></subparagraph><subparagraph id="HE4862FD5954D431995C027F83D80BEFB"><enum>(D)</enum><header>Standards for the format and sharing of complaint data</header><clause id="H9C4FCBED58DE422C8A1E76C6FADE4BC5"><enum>(i)</enum><header>Format</header><text display-inline="yes-display-inline">In providing complaint data described under this paragraph, the Director and the Secretary shall provide the complaint data in a secure, digital format.</text></clause><clause id="HB1852465327B47EAADB3BF85DF3D76D2"><enum>(ii)</enum><header>Process</header><text display-inline="yes-display-inline">The Director and the Secretary shall establish an efficient, secure, and legally compliant process to provide complaint data.</text></clause></subparagraph></paragraph><paragraph id="H69843631E6DC46099D3D356ADC25B10B"><enum>(3)</enum><header>Certain tax return information</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6103">Section 6103(l)(13)(D)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block style="OLC" id="H2BACDEE453484562A980ABA0A9AA8D55" display-inline="no-display-inline"><clause id="H78F625E15A2B41D7AA2F92FAC1A396D5"><enum>(vii)</enum><header>Redisclosure to the Bureau of Consumer Financial Protection</header><text display-inline="yes-display-inline">Authorized persons may redisclose return information received under subparagraph (C) to the Director of the Bureau of Consumer Financial Protection to the extent necessary to carry out the oversight activities of the Bureau of Consumer Financial Protection.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H73136069F0A44905B9D28400252C1334"><enum>(4)</enum><header>Other information</header><text display-inline="yes-display-inline">In addition to the information permitted to be shared under this section, the Director and the Secretary may share any other information with each other as the Director and the Secretary determine appropriate.</text></paragraph><paragraph id="HFE14C81077BB483192670F81AD2A90FC"><enum>(5)</enum><header>Amendment to title 5</header><text>Section 552a(b) of title 5, United States Code, is amended—</text><subparagraph id="H30590B460BF24C8897A2FC740AD32849"><enum>(A)</enum><text>in paragraph (11), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H97462B861936438AB4522CBAEC6B2DF4"><enum>(B)</enum><text>in paragraph (12), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="HA1121C6804DE4DCCBFAA51216245658C"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="USC" id="HDB8365A1A15F40F6841AD17A48256047" display-inline="no-display-inline"><paragraph id="HAD7D1A4FB2704592910622D570C81C0A"><enum>(13)</enum><text display-inline="yes-display-inline">a disclosure between the Secretary of Education and the Director of the Bureau of Consumer Financial Protection authorized under the CFPB Student Loan Integrity and Transparency Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB4A539F68E2C4D39A8F65FAFB33FC105"><enum>(6)</enum><header>Data privacy</header><subparagraph id="H92E2101B15014281B2202CBF6C9F9FAA"><enum>(A)</enum><header>Memorandum of understanding</header><text display-inline="yes-display-inline">The Director and the Secretary shall enter into one or more memoranda of understanding to address data privacy issues related to information shared between the Bureau and the Department pursuant to this Act.</text></subparagraph><subparagraph id="HEDE09627FF8B42D28E284750BBD75C4A"><enum>(B)</enum><header>Safeguarding nonpublic information</header><text display-inline="yes-display-inline">The Director and the Secretary shall establish and maintain such safeguards as are necessary and appropriate to protect the confidentiality of any nonpublic information received by their agency pursuant to this Act (as well as any derived information), including—</text><clause id="HFC72F5B0C18D47DCA53C917A0BFACBD0"><enum>(i)</enum><text>restricting access to the nonpublic information to only those of officers, employees, and contractors who have a need for such information to carry out the receiver’s responsibilities under applicable law;</text></clause><clause id="H6D02146CEA70426D85AA9559D7E7B28C"><enum>(ii)</enum><text>informing those persons who are provided access to the nonpublic information of their responsibilities under this Act; and</text></clause><clause id="H6EE996E7AB5C4EDD974E29E7AA9FDA8C"><enum>(iii)</enum><text>ensuring that the nonpublic information is protected in accordance with the standards applicable to Federal agencies for protection of the privacy and confidentiality of personally identifiable information and for data security and integrity.</text></clause></subparagraph></paragraph></subsection><subsection id="H80D2F94E06C54A5DBBE4644E2BF9EF81"><enum>(c)</enum><header>Handling of complaints by the Bureau</header><text display-inline="yes-display-inline">The Director shall—</text><paragraph id="HDA4568D39C3E4FCDACC5159CD3FEF752"><enum>(1)</enum><text>accept complaints related to private education loans and the servicing of title IV loans; and</text></paragraph><paragraph id="HA70B8402CB06436A9E86EF9A3D24E028"><enum>(2)</enum><text display-inline="yes-display-inline">process such complaints, including, where appropriate, providing the complaints to the applicable servicer and providing any response from the servicer to the borrower, in accordance with section 1034 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5534">12 U.S.C. 5534</external-xref>).</text></paragraph></subsection><subsection id="HC95FE9D3FCBB46BFBB06B03142885580"><enum>(d)</enum><header>Title IV loan servicer requirement</header><text display-inline="yes-display-inline">The Secretary may not enter into an agreement with a contractor or vendor for the servicing of title IV loans unless the contractor or vendor, as part of that agreement, agrees to provide the Bureau, upon request, any information that the contractor or vendor is required to provide the Department.</text></subsection><subsection id="H51D39F900EFA45E5AF10D2004BD598EB"><enum>(e)</enum><header>Responsibilities of the agencies by type of complaint</header><paragraph id="H4750C3F7F92E4E6DB67FF25E582FF8E4"><enum>(1)</enum><header>Complaints regarding the title IV loan programs</header><text display-inline="yes-display-inline">With respect to complaints regarding the title IV loan programs, the Department is responsible for—</text><subparagraph id="H01CAF6459D8748119625A32F57D8EA5E"><enum>(A)</enum><text>program issue resolution;</text></subparagraph><subparagraph id="H17961B092A3E40D18AF31EAB4B6DC21E"><enum>(B)</enum><text>attempting to resolve such complaints; and</text></subparagraph><subparagraph id="HAB195D454F364575AB1FB2558102EDD8"><enum>(C)</enum><text>as appropriate, discussing such complaints with the Bureau regarding the impact, if any, on Federal consumer financial law.</text></subparagraph></paragraph><paragraph id="HFC2D24F07F024F01968D826094B78BCF"><enum>(2)</enum><header>Complaints regarding title IV loans with Federal consumer financial law issues</header><subparagraph id="H4409202116BB4051BC9087E108CC26CD"><enum>(A)</enum><header>In general</header><text>With respect to complaints regarding title IV loans with Federal consumer financial law issues—</text><clause id="H9A3F26CB6C7E4D74B62FEA28B6CFEA55"><enum>(i)</enum><text>the Department shall collaborate with the Bureau;</text></clause><clause id="HBC4369518C0242F5A14C59725856E27F"><enum>(ii)</enum><text>the Bureau is responsible for providing the Department with expertise, analysis, and recommendations regarding resolution consistent with Federal consumer financial law; and</text></clause><clause id="H45BDFA3CA9004D23A8DE909E4921AC76"><enum>(iii)</enum><text display-inline="yes-display-inline">the Department is responsible for attempting to resolve informally such complaints, in accordance with section 141(f)(3)(A) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1018">20 U.S.C. 1018(f)(3)(A)</external-xref>), with the Bureau’s input.</text></clause></subparagraph><subparagraph id="H1A3DD23211EB4AE48E3B3CCD7B7C8941"><enum>(B)</enum><header>Interagency process to discuss, track, and resolve complaints</header><text display-inline="yes-display-inline">The Director and the Secretary shall determine an efficient process to—</text><clause id="HA6FC56A491E346F4AB97A501B94A3D7D"><enum>(i)</enum><text display-inline="yes-display-inline">discuss and track complaints related to both a title IV loan and a private education loan; and</text></clause><clause id="H56D8FFAAD28B4A9BA5FDD18C3254E596"><enum>(ii)</enum><text display-inline="yes-display-inline">collaborate, where possible, to attempt to resolve such complaints, including through the use of the ombudsmen established under section 1035 of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5535">12 U.S.C. 5535</external-xref>) and section 141(f) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1018">20 U.S.C. 1018(f)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="H3C33E9F5409F4B56882CEF8700CDF995"><enum>(3)</enum><header>Complaints regarding private education loans with Federal consumer financial law issues</header><text display-inline="yes-display-inline">With respect to complaints regarding private education loans, the Bureau is responsible for—</text><subparagraph id="HA0AB393212CC454BB601D53058FA55ED"><enum>(A)</enum><text display-inline="yes-display-inline">attempting to resolve informally such complaints, in accordance with section 1035(c)(1) of the Consumer Financial Protection Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5535">12 U.S.C. 5535(c)(1)</external-xref>); and</text></subparagraph><subparagraph id="HD33ECED92B52459EB50FF155F1147C60"><enum>(B)</enum><text display-inline="yes-display-inline">as appropriate, discussing issues with the Department regarding products offered by institutions of higher education or to students or prospective students, or other issues that may impact Federal programs overseen by the Department.</text></subparagraph></paragraph></subsection><subsection id="H53C91547C5DA49D8880A2D84050B8251"><enum>(f)</enum><header>Payment of costs</header><paragraph id="H36A1A23DE4E5402E80F786C27DBE4D56"><enum>(1)</enum><header>In general</header><text>The Bureau and the Department shall each bear its own costs of complying with this Act.</text></paragraph><paragraph id="HB627CC8AD1EB46B38701085289C86B40"><enum>(2)</enum><header>Interagency agreement for transfer of funds</header><text>If funds are transferred between the Bureau and the Department for the provision of goods or services authorized by this Act, including access to Department databases described under subsection (b)(1), such transfer shall be accomplished by a separate interagency agreement.</text></paragraph></subsection><subsection id="H0D5042CBF5DE4BBE8DB5747D68E56500"><enum>(g)</enum><header>Rules of Construction</header><paragraph id="H8AAD9AD9F9C345228AF7F116BDF7ACC6"><enum>(1)</enum><text display-inline="yes-display-inline">Nothing in this Act may be construed to limit the existing authorities of the Bureau or the Department.</text></paragraph><paragraph id="H79C6276773884689A17A7A38B07A0346"><enum>(2)</enum><text display-inline="yes-display-inline">Nothing in this Act may be construed to prohibit the Bureau or the Department from entering into memoranda of understanding to establish additional policies and procedures related to the requirements of this Act.</text></paragraph><paragraph id="H293BAD85CAC44A59A55E68EA5D78C3CC"><enum>(3)</enum><text display-inline="yes-display-inline">Nothing in this Act may be construed to prevent an agency from complying with a legally valid or enforceable order of a court of competent jurisdiction, or, if compliance is compulsory, with a request or demand from a duly authorized committee of the United States Senate or House of Representatives.</text></paragraph></subsection></section></legis-body></bill>
