<section id="H479B49F1668A4A3685017C347121E079" section-type="section-one"><enum>1.</enum><header>Reporting of determination of the Secretary of Veterans Affairs whether to include newly approved or licensed psychedelic drugs in the formulary of the Department of Veterans Affairs</header><text display-inline="no-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/81">Chapter 81</external-xref> of title 38, United States Code, is amended by inserting, after section 8125, the following new section (and conforming the table of sections at the beginning of such chapter accordingly):</text> <quoted-block style="USC" id="H4D1D0804E1AF4B2DBD718874C4CF80DA" display-inline="no-display-inline"> <section id="H2738B739246540FEA8CD7A19A6697A89"><enum>8125A.</enum><header>Reporting of determination whether to include newly approved or licensed psychedelic drugs in the formulary of the Department</header><text display-inline="no-display-inline">Not later than 180 days after a psychedelic drug is approved under section 505 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) or licensed under section 351 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>), the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report regarding such drug, that includes—</text> 
<paragraph id="H0C961869F5B8435CAD8CBDE73DD3B23A"><enum>(1)</enum><text>the determination of the Secretary whether to include such drug in the formulary of the Department; and</text></paragraph> <paragraph id="H1144E00C28A24825A6A04791BA6DE9D6"><enum>(2)</enum><text display-inline="yes-display-inline">the justification of the Secretary for such determination.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
