R. 7343</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240516">May 16, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to provide for the detention of certain aliens who commit assault against law enforcement officers.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="HFE2ECE3282444151A15CCBB7BC88325F"><pagebreak></pagebreak><section id="HC2672E8459E546C29AB755EFEFC949D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Detain and Deport Illegal Aliens Who Assault Cops Act</short-title></quote>.</text></section><section id="HE794E049FBCC4926AA97252F96FB5579"><enum>2.</enum><header>Detention of certain aliens who commit assault against law enforcement officers</header><text display-inline="no-display-inline">Section 236(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226(c)</external-xref>) is amended—</text><paragraph id="H825BD54F23EA447CAA9B181C53ED99AC"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H707343B6B55E427F9DC35FDE93A2CE6D"><enum>(A)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote>; </text></subparagraph><subparagraph id="HF53AEF0BB104434FA8E949368EB05D0E"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>, or</quote> and inserting a comma;</text></subparagraph><subparagraph id="H7F0D6B88F4AD45F18119F6EA97F4470D"><enum>(C)</enum><text>in subparagraph (D), by adding <quote>or</quote> at the end; and</text></subparagraph><subparagraph id="HE85FAD050FF747CDAC136F545D9B4ACA"><enum>(D)</enum><text>by inserting after subparagraph (D) the following: </text><quoted-block style="OLC" id="H802A1870177B428794C8497212EEDA44" display-inline="no-display-inline"><subparagraph id="H25A14FEA2EC34A8BA058CCE974317D61"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="HB09A7783C93A450AB50E915BBF7E00AA"><enum>(i)</enum><text display-inline="yes-display-inline">is inadmissible under section 212(a)(6)(A) or (C) or under section 212(a)(7); and</text></clause><clause id="H836E5E08CCE445B29EAF65050DBE38AA" indent="up1"><enum>(ii)</enum><text>is charged with, is arrested for, is convicted of, admits having committed, or admits committing acts which constitute the essential elements of any offense involving assault of a law enforcement officer, </text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD9A5B46225104AD5BAC99DF1F06BB2AF"><enum>(2)</enum><text>by redesignating paragraph (2) as paragraph (4); and</text></paragraph><paragraph id="H249C437AFB734C698D711EAB0E610292"><enum>(3)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" id="H18B0FEC20B95437C94103772DD8400C6" display-inline="no-display-inline"><paragraph id="H0DA7947339FB44EC87BF33C8C45BD768"><enum>(2)</enum><header>Circumstances</header><subparagraph id="H141D31C2985E4A2EADF89E21ED30D2E7"><enum>(A)</enum><header>In general</header><text>The circumstances referred to in paragraph (1)(E) are that the law enforcement officer was assaulted—</text><clause id="H8C403CC219B5456B9684E103141E820A"><enum>(i)</enum><text display-inline="yes-display-inline">while he or she was engaged in the performance of his or her official duties;</text></clause><clause id="H85B202B7789C4948ACE6129209A21448"><enum>(ii)</enum><text>because of the performance of his or her official duties; or</text></clause><clause id="HA58453F1B31E4E63A8F8441BFD9F7C78"><enum>(iii)</enum><text>because of his or her status as a law enforcement officer.</text></clause></subparagraph><subparagraph id="H9AA146060CFD4551904B01EBA38E8C03"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of paragraph (1)(E)—</text><clause id="H5B1887AA4E1C49EE97AB00B96FC7920E"><enum>(i)</enum><text>the term <quote>assault</quote> has the meaning given that term in the jurisdiction where the acts occurred; and</text></clause><clause id="H2CEA738208DA4668A45E5AC8ECF18F19"><enum>(ii)</enum><text>the term <quote>law enforcement officer</quote> is a person authorized by law—</text><subclause id="H7EE92B72B29342BF8D95E0E58AE710E3"><enum>(I)</enum><text>to engage in or supervise the prevention, detention, investigation, or prosecution, or the incarceration of any person for any criminal violation of law; </text></subclause><subclause id="HD0E9EE1BE9A54400B96C38BD748B622C"><enum>(II)</enum><text>to apprehend, arrest, or prosecute an individual for any criminal violation of law; </text></subclause><subclause id="HF892C8B65CBD4243829693793817A873"><enum>(III)</enum><text display-inline="yes-display-inline">to be a firefighter or other first responder; or</text></subclause><subclause id="H6840841D9DE74850A45CA97D823B82D8"><enum>(IV)</enum><text display-inline="yes-display-inline">to be a campus police officer or a school resource officer. </text></subclause></clause></subparagraph></paragraph><paragraph id="H9E1114A24B4049C59EF23DAA1A6A987A"><enum>(3)</enum><header>Detainer</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall issue a detainer for an alien described in paragraph (1)(E) and, if the alien is not otherwise detained by Federal, State, or local officials, shall effectively and expeditiously take custody of the alien.</text></paragraph><paragraph id="H0E80A335EDB04D2692E13BBBAC206E2C"><enum>(4)</enum><header>Annual report of the Secretary of Homeland Security</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall on an annual basis report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives the number of aliens described in paragraph (1)(E) who were detained in the custody of the Department of Homeland Security in the preceding year pursuant to such section. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H97F3B0CCF9CF4D2CB53B341668196A28"><enum>3.</enum><header>GAO Study</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall complete a study and submit a report to Congress on the number of aliens present in the United States who are inadmissible under section 212(a)(6)(A) or (C) or under section 212(a)(7) of the Immigration and Nationality Act who were detained, during the 5 year period preceding the date of the report, for committing an assault against a law enforcement officer.</text></section></legis-body><attestation><attestation-group><attestation-date date="20240515" chamber="House">Passed the House of Representatives May 15, 2024.</attestation-date><attestor display="yes">Kevin F.
