which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish an Office of the Community Development Advocate for the Community Development Financial Institutions Fund, to establish a process for decertification of community development financial institutions, and for other purposes.</official-title></form><legis-body id="H4F7458F871784B4DB799A9DE01570883" style="OLC"><section id="H36AE6BE127654D3D9B0D56F336AD403A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rural Credit Access Act of 2024</short-title></quote>.</text></section><section id="H2C70EB230E5D4E36B61424D6EBC9BA6F"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="HC96610AFD97748DDB90EE59EBA194868"><enum>(1)</enum><text display-inline="yes-display-inline">community development financial institutions are financial institutions that seek to expand economic opportunity in underserved rural investment areas and low-income communities by providing access to financial products and services for local residents and businesses that otherwise may not be accessible;</text></paragraph><paragraph id="HFE187860455B439684B257AD2DA8D559"><enum>(2)</enum><text display-inline="yes-display-inline">certification as a community development financial institution allows an institution to engage several programs outside of the Community Development Financial Institutions Fund to further support the communities they serve;</text></paragraph><paragraph id="H3F1228B2908A4F2C950CBBEF5F2978D3"><enum>(3)</enum><text display-inline="yes-display-inline">the Department of the Treasury must continue to support community development financial institutions by standing up an ombudsman office and creating an orderly and transparent process for decertification so as to not cause unintentional harm to the communities they serve; and</text></paragraph><paragraph id="H668C318745B446A1B6FA7C0FDFDCF1B6"><enum>(4)</enum><text display-inline="yes-display-inline">the establishment of such an office and process should only serve to provide certainty and clarity for community development financial institutions, not to reduce available funds for the substantive work of such institutions, and as such, appropriate support for the Fund to accomplish this goal must be made available.</text></paragraph></section><section id="HF370BF27F62A4106AAE6A0FF0CA44C9F"><enum>3.</enum><header>Establishment of an Office of the Community Development Advocate the Community Development Financial Institutions Fund</header><subsection id="H5D19AFF948FB479BABE04C70C351B802"><enum>(a)</enum><header>Ombudsman for the Community Development Financial Institutions Fund</header><text display-inline="yes-display-inline">Section 104 of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4703">12 U.S.C. 4703</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H8CAE571F989A4F2885858B64DD248FCE" display-inline="no-display-inline"><subsection id="H24BD05D43C9A4E3ABF5BD39C6AE91CCE"><enum>(l)</enum><header>Office of the Community Development Advocate</header><paragraph id="HA7CB113E17224D76BDE60DDCF7EF0F1F"><enum>(1)</enum><header>Designation</header><text display-inline="yes-display-inline">The Administrator shall establish in the Fund an Office of the Community Development Advocate (in this subsection referred to as the <quote>Office</quote>).</text></paragraph><paragraph id="H725CBECCF1E440B7A24D2A9622615621"><enum>(2)</enum><header>Community Development Advocate</header><subparagraph id="H9069B38445CD4941A33983503E937C5D"><enum>(A)</enum><header>In general</header><text>The head of the Office shall be the Community Development Advocate who shall—</text><clause id="H44E0C024045C40D3B41BB83744068061"><enum>(i)</enum><text display-inline="yes-display-inline">report directly to the Administrator; and</text></clause><clause id="HF9161248A71B4B59B2B0E120E1083806"><enum>(ii)</enum><text display-inline="yes-display-inline">be appointed by the Administrator from among individuals having experience in advocating to expand economic opportunity for targeted populations and investment areas.</text></clause></subparagraph><subparagraph id="H055098B8C918443F9269E4F3AC5AD6ED"><enum>(B)</enum><header>Compensation</header><text display-inline="yes-display-inline">The annual rate of pay for the Community Development Advocate shall be equal to the highest rate of annual pay for other senior executives who report to the Administrator.</text></subparagraph><subparagraph id="H707E413B4B9840A2863507EB753AB9D8"><enum>(C)</enum><header>Limitation on service</header><text display-inline="yes-display-inline">An individual who serves as the Community Development Advocate may not be employed by the Administrator—</text><clause id="H684BE49D1DBE43F38EBA9E49D44A3BF0"><enum>(i)</enum><text display-inline="yes-display-inline">during the 2-year period ending on the date of appointment as Community Development Advocate; or</text></clause><clause id="H45FF92393EAF4EBC8FE854A6BBEC0D3A"><enum>(ii)</enum><text display-inline="yes-display-inline">during the 5-year period beginning on the date on which the person ceases to serve as the Community Development Advocate.</text></clause></subparagraph></paragraph><paragraph id="HE08DAFA77BB74166B52DB31E09F97CB9"><enum>(3)</enum><header>Staff of Office</header><text display-inline="yes-display-inline">The Community Development Advocate may retain or employ independent counsel, research staff, and service staff, as the Community Development Advocate deems necessary to carry out the functions and duties of the Office.</text></paragraph><paragraph id="H05E57FBF067D495AB9722D71653ED927"><enum>(4)</enum><header>Duties</header><text display-inline="yes-display-inline">The Community Development Advocate shall ensure that community development financial institutions provide safe and affordable financial products and services to targeted populations and investment areas. Such duties may include the following:</text><subparagraph id="HECB9AAF290AD4B43AB30BB50B6ECEA64"><enum>(A)</enum><text display-inline="yes-display-inline">Collecting, addressing, and documenting complaints from institutions about—</text><clause id="HDE74FE6527EB4CB39D0D93F99717AC27"><enum>(i)</enum><text>the process of becoming a certified community development financial institution; and</text></clause><clause id="HCC519686DB0042CCA1D77BE9C658BD2F"><enum>(ii)</enum><text>the process of applying for grants or programs of the Fund.</text></clause></subparagraph><subparagraph id="H1730C807CD2C47018346B7DE01849A53"><enum>(B)</enum><text display-inline="yes-display-inline">Working with the Administrator and institutions to address complaints where possible, including the following:</text><clause id="H9E3CFA9836DF433993093FA590D7CF48"><enum>(i)</enum><text>Obtaining clarity relating to determinations or notices of noncompliance of an institution.</text></clause><clause id="H36E15571EF14438C9E8AB6E830E44C7E"><enum>(ii)</enum><text>Ensuring reasonable responsiveness of the Administrator to inquiries from institutions.</text></clause><clause id="HF4AEB35070304661A96ACF136ACFD3F7"><enum>(iii)</enum><text>Facilitating coordination between the Administrator and appropriate Federal banking agencies to ensure full understanding of issues related to safety and soundness of community development financial institutions or legal and regulatory obligations of such institutions.</text></clause><clause id="H6D31BBBA851645298C441C1B53C066BB"><enum>(iv)</enum><text>Ensuring that community development financial institutions have timely access to technical assistance for application systems administered by the Administrator.</text></clause></subparagraph><subparagraph id="H9AD534DF098F4195859B7AFADB8121F2"><enum>(C)</enum><text>Assess the efficiency and efficacy of the certification and application processes described in subparagraph (A) and assess whether the Fund has adequate resources for the number of applicants.</text></subparagraph></paragraph><paragraph id="H3BB5A36413174ED3A72FDE7E80376DF6"><enum>(5)</enum><header>Report</header><text display-inline="yes-display-inline">The Community Development Advocate shall submit to Congress, the Administrator, and the Community Development Advisory Board an annual report that includes—</text><subparagraph id="H774CBD6ED58340EC96F2E48B4513D9E8"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of the responsiveness of the Administrator to inquiries from community development financial institutions;</text></subparagraph><subparagraph id="H097ED934406441EC82CB70BA071C30E6"><enum>(B)</enum><text display-inline="yes-display-inline">an assessment of the length of time taken to review applications for certification or recertification from such institutions;</text></subparagraph><subparagraph id="HE1913231986145B8A405243CB2A610A8"><enum>(C)</enum><text display-inline="yes-display-inline">the results of the assessments conducted under paragraph (4)(C); and</text></subparagraph><subparagraph id="H50C330AB7FDF4F86B937D435D179DF04"><enum>(D)</enum><text display-inline="yes-display-inline">such other information, as determined by the Community Development Advocate.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HE82002ECEC4446D9B5AEB55EF3FF4120"><enum>4.</enum><header>Process for decertification of community development financial institutions</header><text display-inline="no-display-inline">Section 119(a) of the Riegle Community Development and Regulatory Improvement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/12/4717">12 U.S.C. 4717</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="H940DEAEE66394251BE07EE7F0679072E" style="OLC"><paragraph id="H4934DB89416A4D6A845640CA7E170F90"><enum>(3)</enum><header>Decertification</header><text>Not later than 180 days after the date of the enactment of this paragraph, the Administrator shall promulgate regulations to establish a process for revoking the certification of a community development financial institution under this Act. Such process shall include—</text><subparagraph id="HD42DA71244364462A5715A8E6372C53D" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">provision of clear, written guidance from the Administrator regarding what constitutes noncompliance that would result in the revocation of a certification;</text></subparagraph><subparagraph id="H3E28D167D3274259B414376144539786"><enum>(B)</enum><text>the provision of meaningful, detailed, and individualized notice of noncompliance to the institution;</text></subparagraph><subparagraph id="HD6E6A0EE98D9464BA9736D312ACC4464"><enum>(C)</enum><text display-inline="yes-display-inline">identification in such notice of a reasonable period to allow the institution to cure such noncompliance, which period may be extended by the Administrator, in consultation with the Community Development Advocate;</text></subparagraph><subparagraph id="H51FEBF780323421BAA549C6399362DF0" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">if the Administrator provides a notice to an institution describing noncompliance relating to fraud or misrepresentation of the institution, streamlined processes for decertification of such institution;</text></subparagraph><subparagraph id="H0DEA7EE8B9314B16A41A25847BE62A15"><enum>(E)</enum><text>provision of the contact information for the Office of Ombudsman; and</text></subparagraph><subparagraph id="H9520F0FC081C46C8BE963C8CCE92859C" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">a wind-down process for a community development financial institution for which certification has been revoked, established in consultation with the appropriate Federal banking agency (as defined in section 3 of the Federal Deposit Insurance Act), to ensure the safety and soundness of the United States financial system. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H18C72B5462094E7094B9A28AB78AFCC8"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated $1,000,000 to the Administrator of the Community Development Financial Institutions Fund to carry out this section.</text></section></legis-body></bill>
