as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Attorney General, in coordination with the Secretary of Homeland Security, to report to the appropriate committees on encounters with covered aliens included in the terrorist screening database.</official-title></form><legis-body id="HEA03A6FC83CC4A1EAD2AED29628D011C" style="OLC"><section id="H3073AB893859412D8BBD50F16412D6FD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Transparency in National Security Threats Act</short-title></quote>.</text></section><section id="H68F837C103084145B3924D0DFEDDA140" commented="no"><enum>2.</enum><header>Required provision of memorandum of understanding</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, the Attorney General shall submit to the appropriate committees the memorandum of understanding entitled <quote>Integration and Use of Screening Information to Protect Against Terrorism</quote>, effective September 16, 2003, and any successor memoranda. </text></section><section id="H6194CD8DD58542F7B5D17CE684AD4A33" section-type="subsequent-section"><enum>3.</enum><header>Required reports on encounters with aliens included in terrorist screening database</header><subsection id="H2AE739CFB14C4E30B52F9C687B8DE390"><enum>(a)</enum><header>Monthly reports</header><text display-inline="yes-display-inline">Subject to subsection (e) and not later than 30 days after the date of enactment of this Act, and every month thereafter, the Attorney General, in consultation with the Secretary of Homeland Security, shall submit to the appropriate committees a report, including, with respect to encounters, apprehensions, and arrests during the month immediately preceding the date of the report, the following information: </text><paragraph id="HD50EEFFF21F4473483ECD5F31DA46E90"><enum>(1)</enum><text>The total number of covered aliens, disaggregated by the geographic region of the encounter, apprehension, or arrest.</text></paragraph><paragraph id="H90BC5807BBAD4965A8D7D298FE42BF01"><enum>(2)</enum><text>The number of covered aliens who were paroled, admitted, or otherwise released into the United States.</text></paragraph><paragraph id="H5F6EE11DF28F4679B64970776D6F28EB"><enum>(3)</enum><text>The citizenship of the covered aliens. </text></paragraph></subsection><subsection id="H869517CCDE8F4F3EAC59AA32BE7894B0"><enum>(b)</enum><header>Additional information</header><text display-inline="yes-display-inline">The report under subsection (a) shall also contain, disaggregated by each covered alien, the following information:</text><paragraph id="HC9C78CFDE5544FD9B294665D79696C8A"><enum>(1)</enum><text>The geographic region of encounter, apprehension, or arrest for each covered alien.</text></paragraph><paragraph id="HD468103ECDD240259802ECFC8AD53D7A"><enum>(2)</enum><text>The derogatory information causing each covered alien to be included in the terrorist screening database.</text></paragraph><paragraph id="H391A0F6B8F9F4523B7EE5E8C6D4A7139"><enum>(3)</enum><text>The criminal history of each covered alien.</text></paragraph><paragraph id="HDB64FB928F2F40F0B84EBAD9D90CC6A4"><enum>(4)</enum><text>If the covered alien was paroled, admitted, or otherwise released into the United States.</text></paragraph><paragraph id="HE40EECD9CD034C03947E2B27F646D22B"><enum>(5)</enum><text>The citizenship of each covered alien.</text></paragraph><paragraph id="HA05F7F42C2014C19A63839255750E42F"><enum>(6)</enum><text>The immigration status of each covered alien and any previous immigration status of such alien, if any.</text></paragraph><paragraph id="HBF36732167DE4252BDFBF388CC8EF45D"><enum>(7)</enum><text>Case history information on each covered alien, including the alien’s immigration history, any applications made for an immigration benefit by the alien, and the alien file.</text></paragraph><paragraph id="H320EC507E387477EB22C7BA1005EE603"><enum>(8)</enum><text>The detention status of each covered alien.</text></paragraph><paragraph id="HACAA401ACEF041BAB9CFC68297471EB0"><enum>(9)</enum><text>For each covered alien who is not detained, the location of the covered alien at the time of the applicable report and, if such covered alien is enrolled in an alternative to detention program, the type of alternatives to detention on which such covered alien has been placed.</text></paragraph><paragraph id="HB411138AB5244646A3448654F25EF13B"><enum>(10)</enum><text>For each covered alien in the United States, whether the covered alien has been placed in removal proceedings and, for each covered alien not placed in removal proceedings, an explanation of the reason such covered alien was not placed in such proceedings.</text></paragraph><paragraph id="H6780F1F9BF234173B47213F780FE0D98"><enum>(11)</enum><text>The number of covered aliens removed from the United States, disaggregated by the country to which each alien was removed.</text></paragraph></subsection><subsection id="H1D1DFD370F5E42CCAD410A8DD1B3ADEA"><enum>(c)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, and every month thereafter, the Attorney General, in coordination with the Secretary of Homeland Security, shall publish, on a publicly accessible website the information in paragraphs (1), (2), and (3) of subsection (a) for the month immediately preceding the date of the report. </text></subsection><subsection id="HE7F522C7B3E4402184B500B2243BCEF2"><enum>(d)</enum><header>Instance reports</header><text>Subject to subsection (e) and beginning not later than 30 days after the date of enactment of this Act, and within 96 hours of each encounter, apprehension, or arrest of a covered alien, the Attorney General, in coordination with the Secretary of Homeland Security, shall notify the appropriate committees of any such encounter, apprehension, or arrest. The notification shall include the following:</text><paragraph id="HF861649D39AA4307AEE35A5FBEBAEF5B"><enum>(1)</enum><text display-inline="yes-display-inline">The derogatory information causing each covered alien to be included in the terrorist screening database.</text></paragraph><paragraph id="H0E3F42D62F8144628B31CEBE881062EB"><enum>(2)</enum><text>The citizenship of the covered alien.</text></paragraph><paragraph id="HEC9F5BEB83414D41A7DBDC68406C80E5"><enum>(3)</enum><text display-inline="yes-display-inline">The geographic region where the covered alien was encountered, apprehended, or arrested.</text></paragraph><paragraph id="H190969067C934A8A99713CC01789CE52"><enum>(4)</enum><text display-inline="yes-display-inline">The detention status of each covered alien. </text></paragraph></subsection><subsection id="H00227C82C6594A1592CC7C2C483AF966" commented="no"><enum>(e)</enum><header>Classification</header><text>Only the following may be submitted in a classified setting:</text><paragraph id="H57A20FB3BC4D4E419F7300BD6647640A" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Any information described in subsection (b)(2). </text></paragraph><paragraph id="H066EF8CD5D8F4C5A9F041CAA260AE6EA" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Any information described in subsection (d)(1).</text></paragraph></subsection></section><section id="H1803225B18014FC4A86D628F1D153176"><enum>4.</enum><header>Required provision of special interest country list</header><subsection id="HAA4084762A454F0E807F31272BC1E6BF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Attorney General shall provide to the appropriate committees the special interest countries list. </text></subsection><subsection id="H94AA115F611241E280942CDD9D77173B"><enum>(b)</enum><header>Revision</header><text display-inline="yes-display-inline">Not later than 30 days after any revision to the special interest countries list, the Attorney General shall notify the appropriate committees of such revision.</text></subsection></section><section id="HB081B44DD94846338E13FFC2D5325366"><enum>5.</enum><header>Required reporting on encounters</header><text display-inline="no-display-inline">Not later than 30 days after the date of enactment of this Act, and every month thereafter, the Secretary of Homeland Security shall publish on a publicly accessible website the number of aliens, disaggregated by citizenship, who—</text><paragraph id="H2E253F5CF808482DBF9ADE810883ADEE"><enum>(1)</enum><text>are inadmissible under the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)); and</text></paragraph><paragraph id="H50B8FF5F50224AEC900501664FBC6C9E"><enum>(2)</enum><text display-inline="yes-display-inline">during the month immediately preceding the date of publication, were encountered by the Secretary of Homeland Security along the United States border. </text></paragraph></section><section id="H7BD716F1CCCF4C85A5C7AD722D94D9A9"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H55B8FB818F1B4001BED133EBBAF3B3DD"><enum>(1)</enum><header>Alien</header><text display-inline="yes-display-inline">The term <term>alien</term> shall have the meaning given such term in section 101(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)</external-xref>). </text></paragraph><paragraph id="H408406835C8A48968C91B4DDDBE62809"><enum>(2)</enum><header>Appropriate committees</header><text display-inline="yes-display-inline">The term <term>appropriate committees</term> means the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate. </text></paragraph><paragraph id="H5C3C6783E8AE4B11BEA74AD41EDBF401"><enum>(3)</enum><header>Covered alien</header><text>The term <term>covered alien</term> means an alien—</text><subparagraph id="HC73DF84DD3344D7885AE75490FB3F928"><enum>(A)</enum><text display-inline="yes-display-inline">who is encountered, apprehended, or arrested by the Secretary of Homeland Security; and</text></subparagraph><subparagraph id="H7D0A3F8E108C4248A9CBA020612FD925"><enum>(B)</enum><text display-inline="yes-display-inline">whose identifying information is found to be included within the terrorist screening database. </text></subparagraph></paragraph><paragraph id="H13FD6EF020C745FCAEE490EDD16E9F47"><enum>(4)</enum><header>Terrorist screening database</header><text display-inline="yes-display-inline">The term <term>terrorist screening database</term> shall have the meaning given such term in section 2101 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621</external-xref>).</text></paragraph><paragraph id="H13863AD5FE5346BF8F25F18CB03C9A32"><enum>(5)</enum><header>Special interest country list</header><text>The term <term>special interest country list</term> means the list maintained by the Director of the Federal Bureau of Investigation that identifies any country determined by the Director to be a country of special interest. </text></paragraph></section></legis-body></bill>
