R. 7323</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240925">September 25, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">Amend title 38, United States Code, to direct the Secretary of Veterans Affairs to disapprove courses of education offered by a public institution of higher learning that does not charge the in-State tuition rate to a veteran using certain educational assistance under title 10 of such Code, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H8FD98CADAC9241CE9FC51D9C057384B5" style="OLC"><section id="H41C287B71E374A1BBEFCF235C88C71AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Montgomery GI Bill Selected Reserves Tuition Fairness Act of 2024</short-title></quote>. </text></section><section id="H53DFDCD5F8A7427CBBA244A849D5D25A"><enum>2.</enum><header>Department of Veterans Affairs disapproval of courses offered by public institutions of higher learning that do not charge veterans in-state tuition rate for purposes of selected reserve educational assistance program</header><subsection id="H8A26A13A9CFB40CCA2CA9500BFFBE117"><enum>(a)</enum><header>In general</header><text>Subsection (c) of section 3679 of title 38, United States Code, is amended—</text><paragraph id="H257768F999AA4E2D828B568814C4332D"><enum>(1)</enum><text>in paragraph (1), by inserting <quote>, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">chapter 1606</external-xref> of title 10,</quote> after <quote>chapter 30, 31, 33, or 35 of this title</quote>;</text></paragraph><paragraph id="H745139C16CDA435F8E0631A71B3C41E1"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following new subparagraph:</text><quoted-block id="HB4D0A1969F464AF5BE5188B49F1AF32F" style="OLC"><subparagraph id="HE2E2A37018D142D6BFA3F835AC74F837" indent="up1"><enum>(E)</enum><text>An individual who is entitled to assistance under section 16131 of title 10.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H3256D40B30044047BC5329425BC03F94"><enum>(3)</enum><text>in paragraph (6), by inserting <quote>, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">chapter 1606</external-xref> of title 10</quote> before the period at the end.</text></paragraph></subsection><subsection id="H45C692D5D1C94A1EBD260941768CB8BA"><enum>(b)</enum><header>Conforming amendments</header><text>Subsection (e) of such section is amended—</text><paragraph id="H237B5996390D4783A524A7EDBE34939C"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H06ED23D6F48545E2825B377D448E2843"><enum>(A)</enum><text>in subparagraph (A), by inserting <quote>, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">chapter 1606</external-xref> of title 10,</quote> after <quote>chapter 31, 33, or 35 of this title</quote>; and</text></subparagraph><subparagraph id="H4BB4105C66A547A99F637F04B1810E1C"><enum>(B)</enum><text>in subparagraph (B), by striking <quote>chapter 31 33, or 35 of this title</quote> and inserting <quote>chapter 31, 33, or 35 of this title, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">chapter 1606</external-xref> of title 10</quote>; and</text></subparagraph></paragraph><paragraph id="H5347DBD00B614D81BA82BB41EFC1665E"><enum>(2)</enum><text>in paragraph (2), by striking <quote>chapter 31 33, or 35 of this title</quote> and inserting <quote>chapter 31, 33, or 35 of this title, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">chapter 1606</external-xref> of title 10</quote>.</text></paragraph></subsection><subsection id="HC9EAFC11A54848D4A4B63E6424C321A7"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply with respect to an academic period that begins on or after August 1, 2025.</text></subsection></section><section id="H3CC7B80B6085427292CC31C0D5C26D05"><enum>3.</enum><header>Limitation on amount of entitlement to educational assistance payable for flight training under Post-9/11 Educational Assistance Program of Department of Veterans Affairs</header><subsection id="H53C150D5D12E40CC8E5A829E009590CE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 3313 of title 38, United States Code, is amended—</text><paragraph id="HA5A47335BFC94CF8A00829A6C5F7AA66"><enum>(1)</enum><text>in subsection (g)(3)(C), by striking <quote>In the case</quote> and inserting <quote>Subject to the limitation under subsection (m), in the case</quote>; and </text></paragraph><paragraph id="HD9227BDA3C9648D5BD052D26C06FC612"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="USC" id="H3F1F3780E5744B3080224B06CB245C24" display-inline="no-display-inline"><subsection id="H9B1D7D9E7D4E45C0AEB09871FD8ECCA9"><enum>(m)</enum><header>Limitation on use of entitlement for flight training</header><paragraph id="H0009DE13BE2E4B11B890D3B99E85ADFD" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of this chapter and subject to paragraphs (2) and (3), the maximum amount payable under this chapter to an individual, over the lifetime of the individual, for tuition and fees for the pursuit of a program of flight training offered by a public institution of higher learning that leads to a degree, certificate, or other non-college degree, regardless of how many such programs the individual pursues, is—</text><subparagraph id="H682CCB709C624BF9A734DE47B2CCA275"><enum>(A)</enum><text>in the case of an individual who first pursues such a program during the academic year beginning on August 1, 2025, $115,749; or</text></subparagraph><subparagraph id="HD2B84F9BD6334B2E9DEA10A76BBE4217"><enum>(B)</enum><text>in the case of an individual who first pursues such a program during an academic year beginning on August 1 of any subsequent year, the amount in effect under this subsection for the previous academic year beginning on August 1, as increased by the percentage increase equal to the most recent percentage increase determined under section 3015(h) of this title.</text></subparagraph></paragraph><paragraph id="H8E02F9F66E6F41C98AD8D0FF2FF5AF30" display-inline="no-display-inline"><enum>(2)</enum><header>Pursuit on less than a full-time basis</header><text display-inline="yes-display-inline">In the case of an individual who is entitled to educational assistance under this chapter by reason of any of paragraph (3) through (7) of section 3311(b) of this title, the maximum amount payable under paragraph (1) is—</text><subparagraph id="H3B0510247C324B5EA96FB92C212FE6F5"><enum>(A)</enum><text>the amount in effect under paragraph (1), multiplied by</text></subparagraph><subparagraph id="HA61ED69F7C7E4B91BC7429D415419EC1"><enum>(B)</enum><text>the same percentage applicable to the monthly amounts payable to the individual under paragraphs (2) through (6) of subsection (c).</text></subparagraph></paragraph><paragraph id="HF83EC4B8FDD0422884F164DE20FB63AC" display-inline="no-display-inline" commented="no"><enum>(3)</enum><header>Prior use of entitlement</header><text display-inline="yes-display-inline">In the case of an individual who is entitled to educational assistance under this chapter and who uses any of such entitlement prior to the pursuit of a program of flight training offered by a public institution of higher learning that leads to a degree, certificate, or other non-college degree, the maximum amount of payable to the individual under this subsection is—</text><subparagraph id="HF6DFF0AB8CF1483CAAE4B0008DB58E5B" commented="no"><enum>(A)</enum><text>the maximum total amount in effect under paragraph (1), minus</text></subparagraph><subparagraph id="H158FD9D825DE491E939070EAC7725EE9" commented="no"><enum>(B)</enum><text>the amount of entitlement to educational assistance the individual used before enrolling in such program.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDD5C1058092B43B5901E979E682FB993"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall take effect on August 1, 2025, and shall apply with respect to an individual who first pursues a program of flight training on or after August 1, 2025.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240925" chamber="House">Passed the House of Representatives September 25, 2024.</attestation-date><attestor display="yes">Kevin F.
