R. 7304</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240207">February 7, 2024</action-date><action-desc><sponsor name-id="W000823">Mr. Waltz</sponsor> (for himself, <cosponsor name-id="H001085">Ms. Houlahan</cosponsor>, <cosponsor name-id="B000490">Mr. Bishop of Georgia</cosponsor>, <cosponsor name-id="B001298">Mr. Bacon</cosponsor>, <cosponsor name-id="D000230">Mr. Davis of North Carolina</cosponsor>, and <cosponsor name-id="N000193">Mr. Nunn of Iowa</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title II of the Social Security Act to establish that benefits paid to a parent caring for the child of an individual who died while performing active duty as a member of the Armed Services are not subject to deductions under the retirement earnings test.</official-title></form><legis-body id="HAB33C72425E349C297C32016D77F716C" style="OLC"><section id="HEAD1A37A64B24739904E568CE96408CE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting the Families of Our Fallen Patriots Act</short-title></quote>. </text></section><section id="H2FCE8DCEBC2F43FA96B869AE25ED27C5"><enum>2.</enum><header>Exemption from retirement earnings test</header><subsection id="HA43D3F50577B49418D262ABC61704647"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 203(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/403">42 U.S.C. 403(b)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H0EC46653227543DD9B7BBF5FE31CAF57" display-inline="no-display-inline"><paragraph id="HEFDECDCFE26A47D58783D7C3DC45DFE4" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In any case in which an surviving spouse or surviving divorced parent is entitled to a mother’s or father’s insurance benefit under section 202(g) and such benefit is based on the wages and self-employment income of a deceased individual who died while performing active duty as a member of the Armed Forces, the benefit to which such surviving spouse or surviving divorced parent is entitled on the basis of the wages and self-employment income of such deceased individual shall not be subject to deductions under this subsection.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3EFB75C501274F3698DE709FE2D1A29B"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to benefits payable for months that begin on or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
