which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 23, United States Code, to require transportation planners to consider projects and strategies to reduce greenhouse gas emissions, and for other purposes.</official-title></form><legis-body id="H57994DB92F2B402486D152B1FA74DBA0" style="OLC"><section section-type="section-one" id="HE3ECEFE46CD545D596BA90374F1592EF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Generating Resilient, Environmentally Exceptional National Streets Act</short-title></quote> or the <quote><short-title>GREEN Streets Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HD68FE253841343A08FA79CE703061639"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph commented="no" display-inline="no-display-inline" id="H2F342A6384F04BA4A6F591DF7356DAF0"><enum>(1)</enum><text>the Department of Transportation has existing authority to establish greenhouse gas-related performance measures; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42FFDFC956614C7FA634DE004EC83FCD"><enum>(2)</enum><text display-inline="yes-display-inline">performance measures help ensure meaningful greenhouse gas emissions reductions; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA8771DBCC8DA483994086982B2842F10"><enum>(3)</enum><text display-inline="yes-display-inline">Congress should build on that existing authority in order to ensure meaningful greenhouse gas emissions reductions.</text></paragraph></section><section id="HDA0D00979BBD47E7B36DC0D6DA16D2DA"><enum>3.</enum><header>Consideration of projects and strategies to reduce greenhouse gas emissions</header><subsection id="H605919FB6F8641F582E31B3F8AA55DE8"><enum>(a)</enum><header>National goals and performance management measures</header><text>Section 150 of title 23, United States Code, is amended—</text><paragraph id="H8488E0A4A043472FB24DEA8507C1CBE6"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HE36AD8227AC144728377A49520343E31"><enum>(A)</enum><text>by redesignating paragraph (7) as paragraph (8); and</text></subparagraph><subparagraph id="H9015FE7DDB1F4C83B2F6F9D0A63CC3F5"><enum>(B)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDF8399DDF64C411DBCDEC71421370394"><paragraph id="HAEEAB7A7E37242D4B122806EE845D068"><enum>(7)</enum><header>Combating climate change</header><text>To reduce carbon dioxide and other greenhouse gas emissions and improve the resilience of the transportation system.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCC739CAC70BA415E8E16E47CC0173431"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph commented="no" id="H1E00DFAA53EC47A69BBCF3C3EC2C17FE"><enum>(A)</enum><text>in paragraph (1)—</text><clause commented="no" id="HD3C6E5232031434B84B2DC11602BC77E"><enum>(i)</enum><text>by striking the paragraph designation and all that follows through <quote>Not later</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H111F709347D9449182044DDA7B220FE7"><paragraph commented="no" id="HEEF0CD7405A34ECEA304D78CFEA56A95"><enum>(1)</enum><header>Rulemaking</header><subparagraph commented="no" id="H5023816D2E3D4475BCF1213B47AA0166"><enum>(A)</enum><header>In general</header><text>Not later</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause commented="no" id="H59AD9DBE57954546B8443DF1D3BD6A4C"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA00E918E5546400DAFD546363348F9C3"><subparagraph commented="no" id="HD80F0DB2EAFE4B59AA678ED312736E40"><enum>(B)</enum><header>Updates</header><text>The Secretary shall periodically update the rulemaking promulgated under subparagraph (A) as necessary, including to implement the amendments made to this section by the <short-title>GREEN Streets Act</short-title>.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="HD761CC7C853F4ACBA225A6380FD3DB84"><enum>(B)</enum><text>in paragraph (5)—</text><clause commented="no" id="HBCD3CC358EFA49FABB1489042DB0CC33"><enum>(i)</enum><text>in subparagraph (A) by striking <quote>and</quote> at the end;</text></clause><clause commented="no" id="HAED031E3326540A7B315C02CBDC1E217"><enum>(ii)</enum><text>in subparagraph (B) by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause commented="no" id="HC500A3048FF9454E8A158C7E01930469"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H29A04D407A1047228249FFBC487B0292"><subparagraph commented="no" id="H3DBAF15AA9E646D7B409CD4972D02742"><enum>(C)</enum><text>transit accessibility (as defined in section 5326(a) of title 49);</text></subparagraph><subparagraph commented="no" id="H5D3045A0D715488FBF8885742271A950"><enum>(D)</enum><text>transit stop distance (as defined in section 5326(a) of title 49); and</text></subparagraph><subparagraph commented="no" id="H6C294B73BA254867B64D32B2AE70F2B7"><enum>(E)</enum><text>transit mode share (as defined in section 5326(a) of title 49).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HB800D7F834D447CB95341E2441A0D592"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA0DD00AE5CED4D20B6EED7D12E191E7F"><paragraph commented="no" display-inline="no-display-inline" id="HCC11FD6C42224166ABB96F1C6AA7ABDC"><enum>(7)</enum><header display-inline="yes-display-inline">Greenhouse gas emissions on public roads</header><text display-inline="yes-display-inline">For the purpose of carrying out section 119(f)(3), the Secretary shall establish—</text><subparagraph id="HC07648DBBE514F0083717C14A3DAF381"><enum>(A)</enum><text>minimum standards for States to use in decreasing per capita vehicle miles traveled on public roads, including through—</text><clause id="HF8AEC495599F424DA711339C71D31246"><enum>(i)</enum><text>alignment of zoning and land use policy and planning;</text></clause><clause id="HAA010FECBF424E9ABFEC5893362ECCDF"><enum>(ii)</enum><text>investment in active and safe transportation infrastructure, such as sidewalks, trails, and bike lanes; and</text></clause><clause id="H25D777D5077B4935A2735ACDE3BF2D32"><enum>(iii)</enum><text>public transit;</text></clause></subparagraph><subparagraph id="H1C34A6DA21D04F2BA4125E135E816582"><enum>(B)</enum><text>minimum standards for States to use in improving the resilience of public roads;</text></subparagraph><subparagraph id="HF9C586582053497C81DC0DDC5E81E3EC"><enum>(C)</enum><text>in consultation with the Administrator of the Environmental Protection Agency, minimum standards for the reduction of greenhouse gas emissions on public roads, with the goal of achieving net-zero emissions and the goals described in section 201 of Executive Order 14008 (86 Fed. Reg. 7622 (January 27, 2021); relating to <quote>Tackling the Climate Crisis at Home and Abroad</quote>); and</text></subparagraph><subparagraph id="HF2FBA2234F76433EA44F31C45F1F9DAB"><enum>(D)</enum><text>measures for States to use to assess—</text><clause id="H2EAF05A4BC5F42B6B8D0FD44B8CE8886"><enum>(i)</enum><text>carbon dioxide emissions on public roads; </text></clause><clause commented="no" display-inline="no-display-inline" id="H495C1A77BFF44BE3B573DBE596B27FB6"><enum>(ii)</enum><text display-inline="yes-display-inline">air pollutants and multipollutants on public roads, including noise pollution; and</text></clause><clause id="HE0273CD7AA5942838ECE2EAFA097C1E3"><enum>(iii)</enum><text>any other greenhouse gas emissions on public roads, as determined to be appropriate by the Secretary.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" id="HDCCBDC5E377D4410A203BACAE58D8162"><enum>(3)</enum><text>in subsection (d)(1)—</text><subparagraph commented="no" id="H061F4CA619A6476B890497D6D6666974"><enum>(A)</enum><text>by striking <quote>subsection (c), each State shall set</quote> and inserting <quote>subsection (c)(1)(A), and not later than 1 year after each update of that rulemaking under subsection (c)(1)(B), each State shall set or update, as applicable,</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H724D9ACE8B1B4FBD86B122D9A22FCD76"><enum>(B)</enum><text>by striking <quote>and (6)</quote> and inserting <quote>(6), and (7)</quote>.</text></subparagraph></paragraph></subsection><subsection id="HDB035613CF9445949794E7757CF3BEF4"><enum>(b)</enum><header>Metropolitan transportation planning</header><paragraph id="H08C94007D5154143ABEE927A19C65323"><enum>(1)</enum><header>Federal-aid highways</header><text>Section 134(h) of title 23, United States Code, is amended—</text><subparagraph id="H0734BA9C5C60449DB465F22B96B934E1"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H79FFE4F25C034D9B8FAE8BD268D2E776"><enum>(i)</enum><text>by redesignating subparagraphs (F) through (J) as subparagraphs (H) through (L), respectively; and</text></clause><clause id="HF3F07CDE40034CB28F33E31557D4B50A"><enum>(ii)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3776850150F34B5D96B8D8DCF5D027F1"><subparagraph id="H1882CA8977EF487F9277C7AF8926D8F5"><enum>(F)</enum><text>reduce carbon dioxide and other greenhouse gas emissions;</text></subparagraph><subparagraph id="H220AEBB2D1EC4CE3A7B0FEDF647CD8D9"><enum>(G)</enum><text>decrease per capita vehicle miles traveled;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HA38E756443044B8C930591606BE0F71E"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H91F632BC7840474BA9A9034259EB7309"><paragraph id="H97B7A46CE3FB44A2AFA05A611693160C"><enum>(4)</enum><header>Analysis of projects that increase traffic capacity</header><subparagraph commented="no" display-inline="no-display-inline" id="H69F0CE0865DC41AA853F68589358C90D"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="HA72AA4579D614E0E96DFFD2722DC0C95"><enum>(i)</enum><header display-inline="yes-display-inline">Covered project</header><text>The term <term>covered project</term> means a project that—</text><subclause id="HEEC837D025E74721A5910A5BCFDAF66E"><enum>(I)</enum><text>uses funds made available under this title to increase traffic capacity, including—</text><item id="H00094833C12A4E6A8BF86DE613A5375B"><enum>(aa)</enum><text>by adding new travel lanes, including on an existing road; or</text></item><item id="H652E55637407453B99E18D1E6FA9405C"><enum>(bb)</enum><text>by converting shoulder lanes into new travel lanes; or</text></item></subclause><subclause id="HBCF90DD2FDBE45E48D40198366D93B29"><enum>(II)</enum><text>is projected to receive not less than $25,000,000 of Federal funds made available under this title.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HBF2C53F8459049E7A036CD23A65AA8DA"><enum>(ii)</enum><header display-inline="yes-display-inline">Environmental justice community</header><text display-inline="yes-display-inline">The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and Indigenous communities, that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB20421ECF9BA4FD0ADD200D5415EC20A"><enum>(B)</enum><header display-inline="yes-display-inline">Analysis</header><text>In furtherance of the planning goals described in subparagraphs (F) and (G) of paragraph (1), a metropolitan planning organization, with input from local community-based organizations with relevant expertise, shall conduct and publish an analysis of—</text><clause commented="no" display-inline="no-display-inline" id="H82FA2F08264545E093AB5869CF3AC7FE"><enum>(i)</enum><text display-inline="yes-display-inline">the impact on per capita vehicle miles traveled, mobile source greenhouse gas emissions, and non-single-occupancy-vehicle trips, including trips by bicycle, pedestrian travel, public transportation, and passenger rail, prior to approval of each covered project within the metropolitan planning area; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HAD1DA7FDE91444EC95812F12BA483160"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to environmental justice communities served by the metropolitan planning organization, air pollution, toxic air contaminants, and other environmental justice metrics measured by a Federal environmental justice tool, such as the environmental justice mapping and screening tool created by the Environmental Protection Agency. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCEF65AAFA5A647FB83408ECA32566201"><enum>(5)</enum><header>Requirement for new capacity projects</header><text>Before carrying out a project to construct new capacity for single occupancy passenger vehicles, a metropolitan planning organization shall submit to the Secretary and make publicly available documents that demonstrate—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0F90EDC7D3584763A75DBA5EA926C93E"><enum>(A)</enum><text display-inline="yes-display-inline">that the metropolitan planning organization has shown progress in achieving a state of good repair on the National Highway System, as defined in the asset management plan of the State under section 119(e);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF886B2B036A84925ADC04FCB47BD94E6"><enum>(B)</enum><text>that the project—</text><clause commented="no" display-inline="no-display-inline" id="H0B9A4541D8C24D349858231EE1CCAA40"><enum>(i)</enum><text display-inline="yes-display-inline">supports the achievement of performance targets of the State established under section 150; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H7A786F164EF64558A8718975C37A2B37"><enum>(ii)</enum><text>is more cost effective, as determined by a benefit-cost analysis, than—</text><subclause commented="no" display-inline="no-display-inline" id="HFE536E01F92B4D2BB8AE03B4377F2404"><enum>(I)</enum><text display-inline="yes-display-inline">an operational improvement to the facility or corridor;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF9CE4FCEE3E14CBF8DE4781FA0FE2849"><enum>(II)</enum><text>the construction of a public transportation project eligible for assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H9695DBAD69764FF2B0FD2A0468D937D2"><enum>(III)</enum><text>the construction of a non-single occupancy passenger vehicle project that improves freight movement; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H66A5BE7CAC404FCFBC4A3417A68AC39C"><enum>(C)</enum><text>that the metropolitan planning organization has a public plan for maintaining and operating the new asset while continuing progress in achieving a state of good repair as described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H637D15CC5EE8423E8A013E52E8C3C411"><enum>(2)</enum><header>Public transportation</header><text>Section 5303(h)(1) of title 49, United States Code, is amended—</text><subparagraph id="HEA03C8F9883E4E86B960E4A2EA8050E6"><enum>(A)</enum><text>by redesignating subparagraphs (F) through (I) as subparagraphs (H) through (K), respectively; and</text></subparagraph><subparagraph id="HE634CB62887642969B10C881EDD2A411"><enum>(B)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAE4ACCF038864F9A82914D016DF27AEB"><subparagraph id="HFA6C094E670F4380A3A395993DAF439C"><enum>(F)</enum><text>reduce carbon dioxide and other greenhouse gas emissions;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A92F6D4CB414874B00D65C4562B1351"><enum>(G)</enum><text>decrease per capita vehicle miles traveled;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HB903B79326A14E899F4DFD528A1D852D"><enum>(c)</enum><header>Statewide and nonmetropolitan transportation planning</header><paragraph id="H499F78171AEF40419E08357DFF772C72"><enum>(1)</enum><header>Federal-aid highways</header><text>Section 135(d) of title 23, United States Code, is amended—</text><subparagraph id="H375BAF7D8C0E454F845FD39F25982F48"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H751DB17E4F4F4E928C96A57837F516F4"><enum>(i)</enum><text>by redesignating subparagraphs (F) through (J) as subparagraphs (H) through (L), respectively; and</text></clause><clause id="H7FC7E6F4B3CF4AEC83C5DF65BA331885"><enum>(ii)</enum><text>by inserting after subparagraph (E) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H729B45E03F8849FA975BF5689B859A84"><subparagraph id="H8A1FD7B80E2B40609308BB093B211FB3"><enum>(F)</enum><text>reduce carbon dioxide and greenhouse gas emissions;</text></subparagraph><subparagraph id="HBD767C0DCDB54B43BF617999349D14DD"><enum>(G)</enum><text>decrease per capita vehicle miles traveled;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HF094A155FD4941C3B5752CEE24E3BD96"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H74247833E18542C8A8D298D1590E6A99"><paragraph id="H6D641093192D4C0E8CB67D231383B7BC"><enum>(4)</enum><header>Analysis of projects that increase traffic capacity</header><subparagraph commented="no" display-inline="no-display-inline" id="H253C1F4170C44F1481C2F3F72B47466E"><enum>(A)</enum><header>Definitions</header><text>In this paragraph:</text><clause commented="no" display-inline="no-display-inline" id="H193C8F8A13FC4E24AAE0C5FDF1C48073"><enum>(i)</enum><header display-inline="yes-display-inline">Covered project</header><text>The term <term>covered project</term> means a project that—</text><subclause id="H1AE2BA9A3DAB43328A57D7C697B41B18"><enum>(I)</enum><text>uses funds made available under this title to increase traffic capacity, including—</text><item id="HBEC691D5833C4C65B77EAF0D1C2F60F9"><enum>(aa)</enum><text>by adding new travel lanes, including on an existing road; or</text></item><item id="H77DB8331FC41496D94E8429FB6D01D03"><enum>(bb)</enum><text>by converting shoulder lanes into new travel lanes; or</text></item></subclause><subclause id="HD40EB19F48FD49F3AE255B7E914BC3B5"><enum>(II)</enum><text>is projected to receive not less than $25,000,000 of Federal funds made available under this title. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H663B38CCDF1847C28D7E96A327A0FC23"><enum>(ii)</enum><header display-inline="yes-display-inline">Environmental justice community</header><text display-inline="yes-display-inline">The term <term>environmental justice community</term> means a community with significant representation of communities of color, low-income communities, or Tribal and Indigenous communities, that experiences, or is at risk of experiencing, higher or more adverse human health or environmental effects.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB81E798651E9470A849A28EC8968D252"><enum>(B)</enum><header display-inline="yes-display-inline">Analysis</header><text>In furtherance of the planning goals described in subparagraphs (F) and (G) of paragraph (1), a State shall conduct and publish an analysis of—</text><clause commented="no" display-inline="no-display-inline" id="HFFAC24B7DB2246C696EEEDFD9FC43A43"><enum>(i)</enum><text display-inline="yes-display-inline">the impact on per capita vehicle miles traveled, mobile source greenhouse gas emissions, and non-single-occupancy-vehicle trips, including trips by bicycle, pedestrian travel, public transportation, and passenger rail, prior to approval of each covered project within the State; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H0E66251528A04B39A0C7E6F23396BD2C"><enum>(ii)</enum><text display-inline="yes-display-inline">with respect to environmental justice communities served by the State, air pollution, toxic air contaminants, and other environmental justice metrics measured by a Federal environmental justice tool, such as the environmental justice mapping and screening tool created by the Environmental Protection Agency. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H877DA88E892D49889EE31C73A8D09A90"><enum>(5)</enum><header>Requirement for new capacity projects</header><text>Before carrying out a project to construct new capacity for single occupancy passenger vehicles, a State shall submit to the Secretary and make publicly available documents that demonstrate—</text><subparagraph commented="no" display-inline="no-display-inline" id="H96313A8214224746B43EDA4C4F1C9883"><enum>(A)</enum><text display-inline="yes-display-inline">that the State has shown progress in achieving a state of good repair on the National Highway System, as defined in the asset management plan of the State under section 119(e);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8DAADA396EFC4082AE4723B7FD591679"><enum>(B)</enum><text>that the project—</text><clause commented="no" display-inline="no-display-inline" id="HFD15D265D0224F3EA1D2D5386C2F640E"><enum>(i)</enum><text display-inline="yes-display-inline">supports the achievement of performance targets of the State established under section 150; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H68C25DF7B4F34F569721BA48238ADA9D"><enum>(ii)</enum><text>is more cost effective, as determined by a benefit-cost analysis, than—</text><subclause commented="no" display-inline="no-display-inline" id="HB794D84E40334ACA98C42C51913AAEA5"><enum>(I)</enum><text display-inline="yes-display-inline">an operational improvement to the facility or corridor;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB93C30DEF2BD480DB4F97BE80ECE9C83"><enum>(II)</enum><text>the construction of a public transportation project eligible for assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6BCAF2027184401B8CAFAEE316FADE1D"><enum>(III)</enum><text>the construction of a non-single occupancy passenger vehicle project that improves freight movement; and</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBD25609BB4014EF48AB4B95E3DD6495E"><enum>(C)</enum><text>that the State has a public plan for maintaining and operating the new asset while continuing progress in achieving a state of good repair as described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H1DA655B11EE44DB6B94D7A913C637B8A"><enum>(2)</enum><header>Public transportation</header><text>Section 5304(d)(1) of title 49, United States Code, is amended—</text><subparagraph id="HFFB15D12265F43A2BA87167B3D84E780"><enum>(A)</enum><text>by redesignating subparagraphs (F) through (I) as subparagraphs (H) through (K), respectively; greenhouse gas emissions on public roads</header-in-text></quote>; and</text></paragraph><paragraph id="H861017A073DF4D3EB2F5C81A125D3DD1"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB0F94D46C73F434188E48ED84D01C517"><paragraph id="HD06FC7F417B64F37ABD4992A6F772EFC"><enum>(3)</enum><header>Greenhouse gas emissions on public roads</header><subparagraph id="HA4C2D84CA40E4748A5727DC13E6ABCBC"><enum>(A)</enum><header>Penalty</header><clause id="H7AC102197FCD4FE08EBE46FD9F3F43F6"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), if a State reports, in a performance target report under section 150(e), that the State has not achieved the targets of the State for performance measures described in section 150(d) pertaining to the minimum standards for public roads established by the Secretary under section 150(c)(7), the State shall be required, during the following fiscal year—</text><subclause commented="no" display-inline="no-display-inline" id="H133E7B8305974625910328FDB712BB40"><enum>(I)</enum><text display-inline="yes-display-inline">to obligate 33 percent of the amount apportioned to the State under section 104(b)(1) for the purpose of achieving the targets through projects described in clause (iii); and</text></subclause><subclause id="HBE1E6E40BB6C4AC4AEE8EA9AB6FF1D4D"><enum>(II)</enum><text>to obligate 10 percent of the amount apportioned to the State under section 104(b)(2) (other than amounts suballocated to metropolitan areas and other areas of the State under section 133(d)) for the purpose of achieving the targets through projects described in clause (iii).</text></subclause></clause><clause id="H46D69E2F6F7E4D8B83254F18C4A503E7"><enum>(ii)</enum><header>Increase</header><text>Each fiscal year after the date of enactment of this paragraph, the amount required to be obligated under clause (i)(I) shall be increased by 2 percent over the amount required to be obligated in the previous fiscal year.</text></clause><clause commented="no" display-inline="no-display-inline" id="HEF33A0A5685046CFBE6766D28CCD1190"><enum>(iii)</enum><header>Projects described</header><text>A project referred to in clause (i) is any of the following:</text><subclause commented="no" display-inline="no-display-inline" id="H46409223322C435397FB3970D61946E9"><enum>(I)</enum><text display-inline="yes-display-inline">A project on a Federal-aid highway.</text></subclause><subclause id="HB82EF889FA1A4D1D92379C2E86625EB6"><enum>(II)</enum><text>Transit expansion, including an expansion of regular bus routes, arterial bus rapid transit, highway bus rapid transit, rail transit, and intercity passenger rail.</text></subclause><subclause id="H7381495E66C04F1BB7EBA3B14A589270"><enum>(III)</enum><text>Transit service improvements, including an increased service level.</text></subclause><subclause id="H33297024BD6046509C3B5B698491202A"><enum>(IV)</enum><text>Transit fare reduction or transit priority treatments.</text></subclause><subclause id="HA140DC6EF71B436DB766BA2E16BA2397"><enum>(V)</enum><text>A project for active transportation infrastructure.</text></subclause><subclause id="H85CEF6BF0243414A8F10C80B3270E945"><enum>(VI)</enum><text>A project for micromobility infrastructure and service, including shared vehicle services.</text></subclause><subclause id="H5DF0E41466AF49CB86AE331B474A4324"><enum>(VII)</enum><text>A land use project, including residential and other density increases, mixed-use development, and transit-oriented development. </text></subclause></clause></subparagraph><subparagraph id="H3FD8888FA0C648AD81CC4A58C3D9F8C8"><enum>(B)</enum><header>Restoration</header><text>The obligation requirement in subparagraph (A)(i)(I) for a fiscal year shall remain in effect for each subsequent fiscal year until the date on which the Secretary determines that the State has achieved the targets of the State for performance measures described in section 150(d) pertaining to the minimum standards for public roads established by the Secretary under section 150(c)(7).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HC37A9262F94848E48492E09A92A108DB"><enum>(e)</enum><header>Transit accessibility</header><paragraph commented="no" id="H8D07DB3748E24A3C94ED57EB2448DF38"><enum>(1)</enum><header>Transit access</header><text>Section 5326 of title 49, United States Code, is amended—</text><subparagraph commented="no" id="H01FA7B4A37164C9BA22FD0BDFDCD42CA"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="USC">and accessibility</header-in-text></quote> after <quote><header-in-text level="section" style="USC">management</header-in-text></quote>;</text></subparagraph><subparagraph commented="no" id="H510EA38C58984FFCA769AC3E0F5CFA46"><enum>(B)</enum><text>in subsection (a)—</text><clause commented="no" id="HFFC45B1916054076B012CB91A4D9FD1F"><enum>(i)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (5) and (6), respectively; and</text></subparagraph><subparagraph commented="no" id="H370CDC9CCACD414190EF43990B8274F8"><enum>(B)</enum><text>any State in which there exists a metropolitan planning area with a population of not fewer than 250,000 individuals on the date of enactment of the <short-title>GREEN Streets Act</short-title>.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H85D461723D514D4081D45B43E1B4C25F"><enum>(3)</enum><header>First last mile accessibility</header><text>The term <term>first last mile accessibility</term> means the requirement of a traveler to travel—</text><subparagraph commented="no" display-inline="no-display-inline" id="H096C10081FA84E41A4679F769101D5E3"><enum>(A)</enum><text display-inline="yes-display-inline">from the starting point of their journey to the place of transportation; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEB9A4D2145594ED298FFF8FE5BCD3BAE"><enum>(B)</enum><text display-inline="yes-display-inline">from place of transportation to their final destination.</text></subparagraph></paragraph><paragraph commented="no" id="H5077EFF7BA9042FE91F091B4F6ABD581"><enum>(4)</enum><header>Transit accessibility</header><text>The term <term>transit accessibility</term> means the share of jobs, health care facilities, grocery stores and other food suppliers, schools, and other destinations accessible by public transportation in any 45-minute period.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="HB399AD616F014148BAB9DB366E67B23A" commented="no"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5B646E81B71540F59F75A31ACA56E076"><paragraph commented="no" id="H9755B7B71AF14B868A7EAF983A984896"><enum>(7)</enum><header>Transit mode share</header><text>The term <term>transit mode share</term> means the percentage of trips taken by public transportation for both commuting and noncommuting trips.</text></paragraph><paragraph commented="no" id="H90511028FAE74D64AF8780C231B45AC4"><enum>(8)</enum><header>Transit stop distance</header><text>The term <term>transit stop distance</term> means the average distance by census block to the nearest transit stop, passenger station, or terminal providing regularly scheduled service.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph commented="no" id="H2173A6435CFB477EBA3D295723AB7BB1"><enum>(C)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></subparagraph><subparagraph commented="no" id="H805248EA46484CBCA276BEB19C9E29CE"><enum>(D)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFD0FB766E9D04B108FBF9D1E69BE7116"><subsection commented="no" id="H5D9E4E7A39444E5099D1985F3B007F77"><enum>(c)</enum><header>Transit access</header><paragraph commented="no" id="H0D4A95886F444DFF86F6C7B445880900"><enum>(1)</enum><header>Standards and performance measures</header><text>Not later than 1 year after the date of enactment of the <short-title>GREEN Streets Act</short-title>, the Secretary shall establish national transit access standards and performance measures for—</text><subparagraph commented="no" id="H7CC74C8B12C34883AC7C23EB10436A07"><enum>(A)</enum><text>transit accessibility;</text></subparagraph><subparagraph commented="no" id="H72BD702F403249228C393C67165EB225"><enum>(B)</enum><text>transit stop distance; </text></subparagraph><subparagraph commented="no" id="HB19C899846D44B7D815F53023ABA9692"><enum>(C)</enum><text>transit mode share;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A08D58566744DE898ED79AC9FA71050"><enum>(D)</enum><text>first last mile accessibility; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA2E9C128CBF04FB696ED3B5722B8B5D6"><enum>(E)</enum><text>accessibility for individuals with disabilities in accordance with guidance issued by the Access Board on accessibility for transportation vehicles, streets, and sidewalks.</text></subparagraph></paragraph><paragraph id="H94ED8DA366DA4A808BE8335A2909498B"><enum>(2)</enum><header>Performance targets and initial report</header><text>Not later than 180 days after the date on which the Secretary establishes the standards and performance measures under paragraph (1), the Secretary shall—</text><subparagraph id="H6E994BE44FC24174994F5F56697F5B85"><enum>(A)</enum><text>require each covered entity to—</text><clause id="HD6C813292298402A9C6EBEED485695D6"><enum>(i)</enum><text>establish targets for the covered entity relating to each of the standards and performance measures described in paragraph (1); and</text></clause><clause id="H34F0DC42FECC442D900D4F2E5A2020B8"><enum>(ii)</enum><text>submit to the Secretary a report describing—</text><subclause id="HFB457C29E719442FBB20921E2037098E"><enum>(I)</enum><text>the performance of the covered entity with respect to each of the standards and performance measures described in paragraph (1); and</text></subclause><subclause id="HDA90D95843474E0FA4675FC9DB01993C"><enum>(II)</enum><text>by functional classification, the share of housing units and roadways in the covered entity that have—</text><item id="HF0864C19336B4796B65B1E72523A09D0"><enum>(aa)</enum><text>sidewalks;</text></item><item id="HF5E6F74E522E40C6BCD9EBBBB8231EFC"><enum>(bb)</enum><text>crosswalks;</text></item><item id="H5B8BF46EA2C7412CAC0471351E2E90BB"><enum>(cc)</enum><text>dedicated bike lanes; or</text></item><item commented="no" display-inline="no-display-inline" id="HFD71ACF82F454F05BF310728DDE6F24E"><enum>(dd)</enum><text>other forms of dedicated nonmotorized facilities; and</text></item></subclause></clause></subparagraph><subparagraph id="H56E27D27755A471D9EEEB4E863BFBAF6"><enum>(B)</enum><text>provide technical assistance, including analytical tools, to assist a covered entity in—</text><clause id="HD7B509D093874EE4A5673AFD2E835AEA"><enum>(i)</enum><text>establishing targets under subparagraph (A)(i); and</text></clause><clause id="H9786B751C3634C9F9C9CE5C155BE28B1"><enum>(ii)</enum><text>reporting on performance under subparagraph (A)(ii).</text></clause></subparagraph></paragraph><paragraph commented="no" id="H8FC6758A605C4A40B6880C2DB116FED5"><enum>(3)</enum><header>Subsequent reports</header><subparagraph commented="no" id="H5D34A180E7FB4A25B6E37DD197646C1E"><enum>(A)</enum><header>Timing</header><text>Not later than 180 days after receipt of the initial report under paragraph (2)(A)(ii), the Secretary shall establish a schedule for the submission of subsequent reports by each covered entity.</text></subparagraph><subparagraph commented="no" id="HCD2A7911965A4D51854B146BECBE1E9B"><enum>(B)</enum><header>Contents</header><text>Each subsequent report under this paragraph shall describe—</text><clause commented="no" id="H27982D7CCA1049E691F6692C32755BBF"><enum>(i)</enum><text>the progress of the covered entity in meeting the targets of the covered entity relating to the standards and performance measures described in paragraph (1), including any change in performance since the submission of the previous report;</text></clause><clause commented="no" id="H6AB8B1D61DC94FEEBD83CE28A1D9122B"><enum>(ii)</enum><text>any revision of existing targets or establishment of new targets relating to the standards and performance measures described in paragraph (1); and</text></clause><clause commented="no" id="HB542A4C3ECD143DA96D45F5D299568F8"><enum>(iii)</enum><text>any proposal for the revision of existing targets or the establishment of new targets relating to the standards and performance measures described in paragraph (1).</text></clause></subparagraph><subparagraph commented="no" id="H186ED14B06AE40A8B57D3AE0C208BBE4"><enum>(C)</enum><header>Technical assistance</header><text>The Secretary shall provide technical assistance, including analytical tools, to assist a covered entity in—</text><clause commented="no" id="H327ADEF15AF64FAD9BA1BBA9B2DADAB6"><enum>(i)</enum><text>reporting on performance under this paragraph;
