which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Controlled Substances Act to enhance the penalties applicable with respect to certain violations involving the use of interactive computer service to distribute a controlled substance, and for other purposes.</official-title></form><legis-body id="HA4440257D0124CAEAD2F3475B19588D9" style="OLC"><section id="HBB623C0DC4FD494FBD46458ABC7791ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drug-Free Social Media and Digital Communities Act of 2024</short-title></quote>. </text></section><section id="HC9F1672EA8E746609B72EFA77AC59065"><enum>2.</enum><header>Prohibition on use of interactive computer service to distribute a controlled substance</header><subsection id="H62AB79461BE1492484297D2AD7BD6270"><enum>(a)</enum><header>In general</header><text>The Controlled Substances Act is amended by inserting after section 423 (<external-xref legal-doc="usc" parsable-cite="usc/21/864">21 U.S.C. 864</external-xref>) the following:</text><quoted-block id="HFFE9904167AE41A6B14EFE1C1220797D" style="OLC"><section id="H1345A8EBAD1343138585639F1389B47B"><enum>424.</enum><header>Distribution through use of social media</header><subsection id="HCA4C28A4C53A4E329C9E98B8FEF4F338"><enum>(a)</enum><header>In general</header><paragraph id="H5FF5ACF2B1504EBC91A0F639580630D2"><enum>(1)</enum><header>Term of imprisonment; fine</header><text display-inline="yes-display-inline">Any person who violates section 401(a)(1) by distributing, dispensing, or possessing with intent to distribute or dispense a controlled substance through the use of a interactive computer service shall be subject to—</text><subparagraph id="H1D9C7C8BDEF94A4EB5C9417EA09C66D9"><enum>(A)</enum><text>twice the maximum term of imprisonment authorized by section 401(b);</text></subparagraph><subparagraph id="H76CBB94C85DD4FE3B0F3C4B9FCF7D02F"><enum>(B)</enum><text>at least twice any term of supervised release authorized by section 401(b) for a first offense; and</text></subparagraph><subparagraph id="HBFBEB59F9289428A9BC16633A46398D9"><enum>(C)</enum><text>a fine up to twice that authorized by section 401(b) in addition to any term of imprisonment authorized by this subsection.</text></subparagraph></paragraph><paragraph id="HD1201BA0F92845C9B5BB9E3C160C7252"><enum>(2)</enum><header>Minimum sentence</header><text>Except to the extent a greater minimum sentence is otherwise provided by section 401(b), a person sentenced under this subsection shall be sentenced to a term of imprisonment of not less than 1 year, except that the mandatory minimum sentencing requirement of this paragraph shall not apply to offenses involving 5 grams or less of marihuana.</text></paragraph><paragraph id="H357B580029AA4F7C9AE8827A3E0C1F79"><enum>(3)</enum><header>Interactive computer service defined</header><text display-inline="yes-display-inline">In this subsection, the term <quote>interactive computer service</quote> means any information service, system, or access software provider that provides or enables computer access by multiple users to a computer server, including specifically a service or system that provides access to the Internet and such systems operated or services offered by libraries or educational institutions.</text></paragraph></subsection><subsection id="HEA48E48D8E5B42338F25C48FBA5ABFFB"><enum>(b)</enum><header>Subsequent offenses</header><paragraph id="HBD99EBF8301D43F7A1AB44D97A81785B"><enum>(1)</enum><header>Term of imprisonment</header><text>Any person who commits a violation described in subsection (a)(1), after a prior conviction for a violation described in subsection (a)(1) has become final, is punishable—</text><subparagraph id="HE6FD91E543A946199BE67FE82D2DFE91"><enum>(A)</enum><text>by the greater of—</text><clause id="H8F91B122B00C458EBC772700F03CE688"><enum>(i)</enum><text>a term of imprisonment of not less than 3 years and not more than life imprisonment; and</text></clause><clause id="HE04948080B80477AAEEF61F824DD3906"><enum>(ii)</enum><text>3 times the maximum term of imprisonment authorized by section 401(b) for a first offense;</text></clause></subparagraph><subparagraph id="H6AC6303CAC974BDE91A55B5F8980B215"><enum>(B)</enum><text>by at least 3 times any term of supervised release authorized by section 401(b) for a first offense; and</text></subparagraph><subparagraph id="H6C2EE58AE2EF4F61BF6BBB8BCB5FE99F"><enum>(C)</enum><text>by a fine up to 3 times that authorized by section 401(b) in addition to any term of imprisonment authorized by this subsection.</text></subparagraph></paragraph><paragraph id="HDF2E5F3F48EF48F3929207C76999294A"><enum>(2)</enum><header>Minimum sentence</header><text>Except to the extent a greater minimum sentence is otherwise provided by section 401(b), a person sentenced under this subsection shall be sentenced to a term of imprisonment of not less than 3 years, except that penalties for third and subsequent convictions shall be governed by section 401(b)(1)(A).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1E67723AC622425C93DB69C9E330E04C" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents for the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended by adding after the item relating to section 423 the following:</text><quoted-block display-inline="no-display-inline" id="H83921C2D080A4A7B93C58512615E30B4" style="OLC"><toc><toc-entry level="section">Sec. 424.
