1.

Short title

This Act may be cited as the National Advisory Council on Indian Education Improvement Act or the NACIE Improvement Act.

National Advisory Council on Indian Education

(a)

Membership of NACIE

By not later than 180 days after the date of enactment of this Act and notwithstanding any other provision of section 6141 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7471), the President shall ensure that the National Advisory Council on Indian Education established under such section includes at least one member who is a president of a Tribal College or University (as defined in section 316(b) of the Higher Education Act of 1965 (20 U.S.C. 1059c(b)).(b)

Consideration of reports

(1)

Sharing of report with Secretaries of Education and Interior

By not later than June 30 of each year, the National Advisory Council on Indian Education shall provide the NACIE annual report submitted to Congress under section 6141(b)(3) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7471(b)(3)) for such year to the Secretary of Education and the Secretary of the Interior. (2)

Department of Education

The Secretary of Education, in preparing the budget materials submitted to Congress by the Secretary in support of the budget of the United States Government that is submitted under section 1105 of title 31, United States Code, shall consider the most recent NACIE annual report.(3)

Department of the Interior

The Secretary of the Interior, in consultation with the Education Subcommittee of the Tribal-Interior Budget Council, in preparing the budget materials submitted to Congress by the Secretary of the Interior in support of the budget of the United States Government that is submitted under section 1105 of title 31, United States Code, shall consider the most recent NACIE annual report.(c)

Definition

In this section, the term NACIE annual report means the report prepared under section 6141(b)(3) of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7471(b)(3)).
