R. 7220</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240205">February 5, 2024</action-date><action-desc><sponsor name-id="S001211">Mr. Stanton</sponsor> (for himself, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, <cosponsor name-id="E000296">Mr. Evans</cosponsor>, and <cosponsor name-id="G000589">Mr. Gooden of Texas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish in U.S. Citizenship and Immigration Services of the Department of Homeland Security an EB–5 Regional Center Program Advisory Committee.</official-title></form><legis-body id="H205C5CAF6F6E4702A178AEF703FA6501" style="OLC"><section id="H747BCDC52DC444FABD6D306D53F43E16" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>EB–5 Regional Center Program Advisory Committee Authorization Act</short-title></quote>.</text></section><section id="H2F093777AD674BB0910EA01B33749C67"><enum>2.</enum><header>EB–5 regional center program advisory committee</header><text display-inline="no-display-inline">Subtitle E of title IV of the Homeland Security Act of 2002 is amended by adding at the end the following new section:</text><quoted-block id="H2D78CFC13A604E279706E9B0577AC564" style="OLC"><section id="H76CA087C1FE8483F87F8878060FB6ECC"><enum>463.</enum><header>EB–5 regional center program advisory committee</header><subsection id="HA6E16761FAEF4C40BB4DFAF108B22AD3"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish within U.S. Citizenship and Immigration Services an EB–5 Regional Center Program Advisory Committee. The Advisory Committee shall be terminated upon adjudication of all benefits filed under section 203(b)(5) and 216A of the Immigration and Nationality Act from time to time or any other public law implementing the EB–5 Regional Center Program.</text></subsection><subsection id="H5ED980BEB0F146518DDF2C4D76C16EF9"><enum>(b)</enum><header>Duties</header><paragraph id="HAC8443B681AB4496AA41B129572E8BFD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Advisory Committee shall advise, consult with, report to, and make recommendations to the Director of U.S. Citizenship and Immigration Services regarding the EB–5 Regional Center Program.</text></paragraph><paragraph id="HB18E93A558F34C5790A392F849162A74"><enum>(2)</enum><header>Recommendations</header><subparagraph id="HFE13CF63FE26475FA739AD711189A836"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall develop recommendations for improvements to the EB–5 Regional Center Program within U.S. Citizenship and Immigration Services.</text></subparagraph><subparagraph id="H10F2587B59864B16A987C341CE483CA4"><enum>(B)</enum><header>Recommendations of subcommittees</header><text display-inline="yes-display-inline">Recommendations agreed upon by the subcommittees established under subsection (d) for any year shall be approved by a majority of the Advisory Committee before the Advisory Committee submits to the Director the annual report under paragraph (4) for that year. The Advisory Committee shall not make any petition or case-specific recommendations to the program under section 203(b)(5) and section 216A of the Immigration and Nationality Act.</text></subparagraph></paragraph><paragraph id="HF240C1BCAB8F4F9591B743256B7E4ECC"><enum>(3)</enum><header>Periodic reports</header><text display-inline="yes-display-inline">The Advisory Committee shall annually, or when deemed necessary by a majority of the Advisory Committee members, submit to the Director—</text><subparagraph id="H702D85864811482DA3E8994537DF93FB"><enum>(A)</enum><text>reports on matters identified by the Director; or</text></subparagraph><subparagraph id="H197243FE634E4EFA882F51B3AE705825"><enum>(B)</enum><text>reports on other matters identified by a majority of the members of the Advisory Committee.</text></subparagraph></paragraph><paragraph id="H7726B66C800F4998B9A6222E4266618B"><enum>(4)</enum><header>Annual report</header><text>The Advisory Committee shall submit to the Secretary of Homeland Security and Director an annual report providing information on the activities, findings, and recommendations of the Advisory Committee, including its subcommittees, for the preceding fiscal year. Not later than six months after the date that the Secretary of Homeland Security and the Director receives an annual report for a year, the Director shall publish a public version of the report describing the activities of the Advisory Committee and such related matters as would be informative to the public during that year.</text></paragraph><paragraph id="H3A87FF88792B452582E7514ADEC7B19F"><enum>(5)</enum><header>Congressional notification</header><text>For each fiscal quarter beginning after the date of the enactment of this section, the Director shall provide to the Committees on the Judiciary, and the Committees on Appropriations a briefing on the activities of the Advisory Committee.</text></paragraph><paragraph id="HE7CE1FBAF0EE4C31B27EDBE056513748"><enum>(6)</enum><header>Conformity with the EB–5 Reform and Integrity Act of 2022</header><text display-inline="yes-display-inline">Nothing in this section may be construed to violate or be inconsistent with section 107 of the EB–5 Reform and Integrity Act of 2022.</text></paragraph></subsection><subsection id="H802AD14132EB46BAACF54894017EC78C"><enum>(c)</enum><header>Membership</header><paragraph id="H4E7B0D8C4C4F40E1918E3DDE55225D0D"><enum>(1)</enum><header>Appointment</header><subparagraph id="H4C8E5DBC16DD4558BB76F15D60B57BC6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall appoint the members of the Advisory Committee consisting of representatives of Federal, State, local and Tribal Governments and EB–5 regional centers in good standing representing projects from diverse geographies and diverse project types.</text></subparagraph><subparagraph id="H8EF72043E61D480EB4D9C5559F585201"><enum>(B)</enum><header>Composition</header><text display-inline="yes-display-inline">The membership of the Advisory Committee shall consist of not more than 35 members, each of whom represent a category referred to in subparagraph (C)(i). The member shall be considered the appointed regional center or governmental agency, and the member shall appoint, subject to Secretary approval, the individual that represents such regional center or governmental agency.</text></subparagraph><subparagraph id="H6AE5F1A106DE41CAA51B4EC5ACCB79AE"><enum>(C)</enum><header>Representation</header><clause id="H56961EBC9163472D8AB2A66D54519BCB"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Regional centers members shall be appointed only from regional centers in good standing and operating under the EB–5 Reform and Integrity Act of 2022, notwithstanding any lapse or termination of the EB–5 Regional Center Program, and each regional center member shall represent a regional center that has submitted petitions to sponsor no fewer than two projects in the same regional center category pursuant to clause (ii).</text></clause><clause id="H62A27BFF7DF74245BF24D03C31D8581B"><enum>(ii)</enum><header>Representation categories</header><text>Regional center members shall include at least two from each of the following categories:</text><subclause id="H3179DFE92F524EFAB096F58C22DD4BF1"><enum>(I)</enum><text>Regional Center—High unemployment area.</text></subclause><subclause id="H628C8B78CA9B4C26955AB97A2DD28933"><enum>(II)</enum><text>Regional Center—Rural.</text></subclause><subclause id="H3677BC36A88E4CFB9386C6759E2D67C1"><enum>(III)</enum><text>Regional Center—Infrastructure.</text></subclause><subclause id="H392BA23A69E044EDB14C28DD8551A85E"><enum>(IV)</enum><text>Regional Center—Census Region Northeast.</text></subclause><subclause id="H922B18586AD4419496B570E764FA8432"><enum>(V)</enum><text>Regional Center—Census Region South.</text></subclause><subclause id="H7E479482C3764BB1BF4D3B8EABDD2919"><enum>(VI)</enum><text>Regional Center—Census Region Midwest.</text></subclause><subclause id="H0E72EBEAC0D24D018780DF5F3825A646"><enum>(VII)</enum><text>Regional Center—Census Region West.</text></subclause></clause><clause id="H82E1B17A2A50441295F1BE1D77499B7E"><enum>(iii)</enum><header>Additional representation</header><text display-inline="yes-display-inline">Representatives shall, in addition, include at least one from each of the following categories:</text><subclause id="HA87382FBE0634187825F984EF2455FD7"><enum>(I)</enum><text>Mayor—City, large; Territory inside Urbanized Area and inside a Principal City with population of 250,000 or more.</text></subclause><subclause id="HD695070C31BD496983D2BB57C47A76A4"><enum>(II)</enum><text>Mayor—City, midsize; Territory inside Urbanized Area and inside a Principal City with population less than 250,000 and greater than or equal to 100,000.</text></subclause><subclause id="HAD40C3E3E1D94512AA26F222085C4DD8"><enum>(III)</enum><text>Mayor—City, small; Territory inside Urbanized Area and inside a Principal City with population less thank 100,000.</text></subclause><subclause id="H60EFEC2732BA4597AE3FD388A95A9A6A"><enum>(IV)</enum><text>County Economic Development Officer—Urbanized Area.</text></subclause><subclause id="H1B91FEFC934F4C87896782E4D96CF405"><enum>(V)</enum><text>County Economic Development Officer—Urban Place Outside of Urbanized Area.</text></subclause><subclause id="H9DFCEFD602D64E31B133E82D09312F74"><enum>(VI)</enum><text>County Economic Development Officer—Rural Place.</text></subclause><subclause id="HEBA7B45BE364428F81D57EC5887970C1"><enum>(VII)</enum><text>State Economic Development Officer.</text></subclause><subclause id="H1DDF997A308C4D2A93210DFC35B4B4E9"><enum>(VIII)</enum><text>Department of State, ex officio.</text></subclause><subclause id="H00A2D32E46664056BA59215A9AEA79AF"><enum>(IX)</enum><text>Department of Commerce, ex officio.</text></subclause><subclause id="H84A4491CECC04C3AB5AEB59B870AF92D"><enum>(X)</enum><text>Trade association representing no fewer than 50 EB–5 regional centers.</text></subclause><subclause id="HF7F8A6C1C41F41999EBE22C0CAF70592"><enum>(XI)</enum><text>Other relevant fields identified by the Director.</text></subclause></clause><clause id="HDFE3FB90DCD647EE9A22D4CB4D84DF5D"><enum>(iv)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Advisory Committee shall include at least two members from each category under clause (ii) but not exceed three members from any one category.</text></clause></subparagraph></paragraph><paragraph id="HA34A0A5146CD4467A7B02DACE7F36B66"><enum>(2)</enum><header>Term of office</header><subparagraph id="H1FD5D14BE5CF48D786233FF5BC8F7454"><enum>(A)</enum><header>Terms</header><text display-inline="yes-display-inline">The term of each member of the Advisory Committee shall be two years, but a member may continue to serve, notwithstanding any term limit, until a successor is appointed. In the event that an individual representing the member is no longer associated with the member, the member shall appoint, subject to Secretary of Homeland Security approval, a new individual to serve the remaining term of such member.</text></subparagraph><subparagraph id="HCF5B8620E4CB45F5AE6D84B24FCA9C75"><enum>(B)</enum><header>Removal</header><text display-inline="yes-display-inline">The Director may review the participation of a member of the Advisory Committee and remove such member for cause at any time, after notifying the Secretary of Homeland Security.</text></subparagraph><subparagraph id="H83D9977736AC4CEDB425FC20A08F41B4"><enum>(C)</enum><header>Reappointment</header><text>A member of the Advisory Committee may be reappointed for a maximum of 6 consecutive terms.</text></subparagraph></paragraph><paragraph id="H047F7843EE354051BF1C056D77B3C2FF"><enum>(3)</enum><header>Prohibition on compensation</header><text display-inline="yes-display-inline">The members of the Advisory Committee may not receive pay or benefits from the United States Government by reason of their service on the Advisory Committee, other than pay and benefits for Federal employees serving on the Advisory Committee that are incident to their Federal employment.</text></paragraph><paragraph id="H32ED6428FF2C49289A51135C12D26E4F"><enum>(4)</enum><header>Meetings</header><subparagraph id="HD61C92145ED9469CB14FC1036C9E341D"><enum>(A)</enum><header>In general</header><text>The Director shall require the Advisory Committee to meet at least quarterly, and may convene additional meetings as necessary.</text></subparagraph><subparagraph id="H4ED4A69B96BF446E9625D77AD410BAC9"><enum>(B)</enum><header>Public meetings</header><text>At least one of the meetings referred to in subparagraph (A) shall be open to the public.</text></subparagraph><subparagraph id="H83F55855832B42A69258C78E7805F4A1"><enum>(C)</enum><header>Attendance</header><text>The Advisory Committee shall maintain a record of the persons present at each meeting.</text></subparagraph></paragraph><paragraph id="H17C53F89DD4346B0A0A803B7D503AB1B"><enum>(5)</enum><header>Chairperson</header><text>The Advisory Committee shall select, from among the members of the Advisory Committee—</text><subparagraph id="HEEE2A66E92874F8C9C8BAC45B8F28366"><enum>(A)</enum><text>a member to serve, for a term of 4 years, as chairperson of the Advisory Committee; and</text></subparagraph><subparagraph id="H480F4ADF188545DE945C47AEFAC5987B"><enum>(B)</enum><text>a member to serve as chairperson of each subcommittee of the Advisory Committee established under subsection (d).</text></subparagraph></paragraph></subsection><subsection id="H67A1371D334047E7AF5A92B33CAF0162"><enum>(d)</enum><header>Subcommittees</header><paragraph id="HC176BD76C7F548FB9534E548C881C9ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director and the Advisory Committee shall establish subcommittees within the Advisory Committee to address EB–5 Regional Center Program issues, including the following:</text><subparagraph id="HC484C04A202E4088B5C906266EE58B9A"><enum>(A)</enum><text display-inline="yes-display-inline">Administration, including—</text><clause id="HEB1A1FD256FC459A8CCB7B10397969E2"><enum>(i)</enum><text>agency staffing;</text></clause><clause id="H92F16D61072A48B7A0E703B200D93166"><enum>(ii)</enum><text>petition processing times;</text></clause><clause id="HCF4FEDE1962C4843B77B1E87E5CF5D61"><enum>(iii)</enum><text>improved communication between the Agency and EB–5 Regional Center stakeholders;</text></clause><clause id="HCA8689B8566C4FD9B07FFF9D76EB6D93"><enum>(iv)</enum><text>fraud prevention; and</text></clause><clause id="H22ED01EBB69C4DEF844709C7997EE8C4"><enum>(v)</enum><text>compliance with securities laws.</text></clause></subparagraph><subparagraph id="HED53E959D79F496E93BBC5CB3305267F"><enum>(B)</enum><text display-inline="yes-display-inline">Impact, including—</text><clause id="HF6CCEE3094184842A9CA11DFB3914EA6"><enum>(i)</enum><text>job creation and job retention; and</text></clause><clause id="H246BEE279D4340C3A7346C1174DBD69A"><enum>(ii)</enum><text>capital investment.</text></clause></subparagraph><subparagraph id="HA47800F70EC146C6838E73169BE11573"><enum>(C)</enum><text display-inline="yes-display-inline">Policy, subject to applicable requirements under law, including—</text><clause id="H663F01AC3A3F42999AF0F62C8EEF23EB"><enum>(i)</enum><text display-inline="yes-display-inline">legislative interpretation and specific policies and guidelines of U.S. Citizenship and Immigration Services relevant to the EB–5 Regional Center Program;</text></clause><clause id="H31431234B87C488E916B74E68E03BBA9"><enum>(ii)</enum><text>policymaking procedures outside of formal legislative or regulatory rule-making processes;</text></clause><clause id="H5512B3B7E8DB47C5841810335A9CABA1"><enum>(iii)</enum><text>regulations;</text></clause><clause id="HE07AAECBEA0D465693E32902C5B6FC6A"><enum>(iv)</enum><text>financial structuring of investments; and</text></clause><clause id="HAC670681493B4489886A6CCAB54CC19C"><enum>(v)</enum><text display-inline="yes-display-inline">source of funds issues.</text></clause></subparagraph><subparagraph id="H61B479BBF78D489E9F01D7D8309A8973"><enum>(D)</enum><text>Other such issues relevant to the EB–5 Regional Center Program and requested by members of the Advisory Committee.</text></subparagraph></paragraph><paragraph id="HA7134BDCAED3441AA138E256231B603D"><enum>(2)</enum><header>Additional subcommittees</header><text>In addition to the subcommittees established pursuant to paragraph (1), the Advisory Committee chairperson, in coordination with the Director, shall establish within the Advisory Committee such additional subcommittees that the majority of the Advisory Committee determine to be necessary.</text></paragraph><paragraph id="H68876A8085FB4AD5AA3097B779AC82C8"><enum>(3)</enum><header>Meetings and reporting</header><text display-inline="yes-display-inline">Each subcommittee shall meet at least quarterly, and at least once in-person annually, and submit to the Advisory Committee for inclusion in the annual report required under subsection (b)(4) information, including activities, findings, and recommendations, regarding subject matter considered by the subcommittee.</text></paragraph><paragraph id="H6855E46542FD4CD18FAD1B01A2170CE8"><enum>(4)</enum><header>Subject matter experts</header><text>The chair of the Advisory Committee shall appoint members to subcommittees.</text></paragraph></subsection><subsection id="HDB2E2680FD4A478F8EC0B94FE0727F41"><enum>(e)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Committee and its subcommittees.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
