title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Autism Collaboration, Accountability, Research, Education, and Support Act of 2024</short-title></quote> or the <quote><short-title>Autism CARES Act of 2024</short-title></quote>.</text></section><section id="HA157170DDBF8429B9EDE62FB7C9BC089"><enum>2.</enum><header>National Institutes of Health activities</header><subsection id="H835685E9F9324950BD4906DFC7860471"><enum>(a)</enum><header>Expansion of activities</header><text display-inline="yes-display-inline">Paragraph (1) of section 409C(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284g">42 U.S.C. 284g(a)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="HAC0B9E9C6C644C41813CCED2B888E61F" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H2E72813A32CE4B81887DD2040DA24A4B"><enum>(1)</enum><header>Expansion of activities</header><text display-inline="yes-display-inline">The Director of NIH (in this section referred to as the <quote>Director</quote>), in coordination and consultation with the Administrator of the Administration for Community Living, and other agencies as appropriate, shall—</text><subparagraph id="HB477EE5111694BC5B321F10BA263B643"><enum>(A)</enum><text>subject to the availability of appropriations, expand, intensify, and coordinate the activities of the National Institutes of Health with respect to research on autism spectrum disorder, including—</text><clause id="HF19FDFC8C2CA47C9AB6EC2F6AE93B99D"><enum>(i)</enum><text>basic and clinical research in fields including pathology, developmental neurobiology, genetics, epigenetics, pharmacology, nutrition, immunology, neuroimmunology, neurobehavioral development, endocrinology, gastroenterology, toxicology, speech, language and hearing science, psychiatry, psychology, developmental behavioral pediatrics, and gerontology; and</text></clause><clause id="HC667E3850F4E47A1B3FAAF2855A8FF3E"><enum>(ii)</enum><text>research on interventions to maximize outcomes for individuals with autism spectrum disorder; and</text></clause></subparagraph><subparagraph id="H34CB5346418E48B3B4DAE6B323492B66"><enum>(B)</enum><text>ensure that research referred to in subparagraph (A)—</text><clause id="H9E277E3C333F461BA8193D6634A3596D"><enum>(i)</enum><text display-inline="yes-display-inline">investigates the causes (including possible environmental causes), diagnosis or ruling out, early and ongoing detection, prevention, intervention, services, supports across the lifespan for autistic individuals and caregivers, and treatment for autism spectrum disorder and co-occurring conditions, including dissemination and implementation of clinical care, supports, interventions, and treatments; and</text></clause><clause id="HB7D51E902AA54096AA8B3CBAC4A7AE1C"><enum>(ii)</enum><text display-inline="yes-display-inline">reflects the entire population of individuals with autism spectrum disorder, including the full range of cognitive, communicative, behavioral, and adaptive functioning, as well as co-occurring conditions and needs for support and services, including care necessary for physical safety.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5D69E1426C9D474B9A2EE8144F5E1A02"><enum>(b)</enum><header>Centers of excellence</header><text display-inline="yes-display-inline">Section 409C(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284g">42 U.S.C. 284g(b)</external-xref>) is amended—</text><paragraph id="HC22FEB064E42457FB75EF384320ECBA7"><enum>(1)</enum><text>in paragraph (2)—</text><subparagraph id="H49BCDBBF61394F03BD68D7F3513F2BE7"><enum>(A)</enum><text>by striking <quote>prevention, and treatment</quote> and inserting <quote>prevention, services, and treatment</quote>;</text></subparagraph><subparagraph id="HD505420B77014F539459CD4CE767DC5F"><enum>(B)</enum><text>by striking <quote>including the fields</quote> and inserting <quote>including in the fields</quote>; and</text></subparagraph><subparagraph id="H2DBC491D847D461E8D06389C0360E8BD"><enum>(C)</enum><text>by striking <quote>behavioral psychology, and clinical psychology</quote> and inserting <quote>behavioral psychology, clinical psychology, and gerontology</quote>;</text></subparagraph></paragraph><paragraph id="H3ABACA0AB5374D36B0E2A0118B933572"><enum>(2)</enum><text>in paragraph (5)(A), by striking <quote>not less than five centers</quote> and inserting <quote>not fewer than six centers</quote>; and</text></paragraph><paragraph id="H0FA37A53D1A84802966851FC2D03A8AD"><enum>(3)</enum><text>in paragraph (5)(B), by striking <quote>period of not to exceed</quote> and inserting <quote>period not to exceed</quote>.</text></paragraph></subsection><subsection id="H6874895C9AD64E1AA9234D7AB40FB408" commented="no"><enum>(c)</enum><header>Public input</header><text display-inline="yes-display-inline">Section 409C(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/284g">42 U.S.C. 284g(d)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="HC9967148697A4FADBE16BE6F8FC19546" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="H60AA0D64F0CF4389ADED3CF790F233ED" commented="no"><enum>(d)</enum><header>Public input</header><paragraph id="H25170E4686214F0EAB3F8075E9BD4409" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director shall under subsection (a)(1) provide for means through which the public can obtain information on the existing and planned programs and activities of the National Institutes of Health with respect to autism spectrum disorder and through which the Director can receive comments from the public regarding such programs and activities.</text></paragraph><paragraph id="HEB18B2D833BC4C43808819EAE78BCCF0" commented="no"><enum>(2)</enum><header>Opportunities</header><text display-inline="yes-display-inline">Such public input opportunities may include encouraging the centers under subsection (b)(1) to establish an external advisory board or adopting a comprehensive plan to ensure individuals with various backgrounds and perspectives are represented, among other activities. Such opportunities should consider including, as appropriate, individuals, family members, and caregivers of individuals with autism spectrum disorder who represent the entire population of individuals with autism spectrum disorder, including the full range of cognitive, communicative, behavioral, and adaptive functioning, to better inform research findings and future studies.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H5A2B8B2E0A934CF2BA2AA864805F3A34"><enum>3.</enum><header>Programs relating to autism</header><subsection id="HF5AA83A6E83349F6B89B4809B36FA0F9"><enum>(a)</enum><header>Developmental disabilities surveillance and research program</header><text>Section 399AA of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280i">42 U.S.C. 280i</external-xref>) is amended—</text><paragraph id="H871EB2236BDE4569930B6A3B27C47CAC"><enum>(1)</enum><text>in subsection (b)(1), by striking <quote>and causes</quote> and inserting <quote>causes, and life course</quote>; and</text></paragraph><paragraph id="HDE35CD2FE1C64C0A9AB2828629AFBA6B"><enum>(2)</enum><text>in subsection (e), by striking <quote>2024</quote> and inserting <quote>2029</quote>.</text></paragraph></subsection><subsection id="HAA0E8B723C774796B27E6011629F392A"><enum>(b)</enum><header>Autism education, early detection, and intervention</header><text>Section 399BB of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280i-1">42 U.S.C. 280i–1</external-xref>) is amended—</text><paragraph id="H5666C1FCCED546958CB9891EE6C2CAB5"><enum>(1)</enum><text>in subsection (a)(2), by striking <quote>subsequent interventions</quote> and inserting <quote>subsequent interventions and services</quote>;</text></paragraph><paragraph id="H026D9E0849ED43468AC6AC2345BA3900"><enum>(2)</enum><text>in subsection (b)(1), by striking <quote>culturally competent information</quote> and inserting <quote>culturally and linguistically responsive information</quote>;</text></paragraph><paragraph id="HFBE7EB7EBD6C4E779BA027D3D98EF896"><enum>(3)</enum><text>in subsection (b)(2)—</text><subparagraph id="H11E3EC5ADA8A4604879F3F7504954F9D"><enum>(A)</enum><text>by striking <quote>promote research</quote> and inserting <quote>promote research, which may include community-based participatory research,</quote>; and</text></subparagraph><subparagraph id="HB4088FD5FEF742649FB242A4C5FC9D5C"><enum>(B)</enum><text>by striking <quote>screening tools</quote> each place it appears and inserting <quote>screening and diagnostic tools</quote>;</text></subparagraph></paragraph><paragraph id="H9608BA8471964FADB6F42C7F9D3D976F"><enum>(4)</enum><text>in subsection (b)(3), by striking <quote>at higher risk</quote> and inserting <quote>at increased likelihood</quote>; </text></paragraph><paragraph id="H6E6E8C65BA3449F1B7BFA12A88ED1DAA"><enum>(5)</enum><text>in subsection (b)(4), by inserting <quote>, which may include such individuals utilizing parents and guardians trained to provide interventions, services, and supports</quote> before the semicolon at the end;</text></paragraph><paragraph id="HEFC54935595649A68CF89753ED5EE287"><enum>(6)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by striking <quote>culturally competent information</quote> and inserting <quote>culturally and linguistically responsive information</quote>;</text></paragraph><paragraph id="H92C0AC73F0C94C5CAE6B5D874849766D"><enum>(7)</enum><text>in subsection (c)(2)(A)(ii)—</text><subparagraph id="H6121DE791DD3465193132FA6DCF0E318"><enum>(A)</enum><text>by striking <quote>advocates,</quote> and inserting <quote>advocates, self-advocates,</quote>; and</text></subparagraph><subparagraph id="H49A5412E0A7C4B00A6D6E55604FC3678"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>culturally competent information</quote> and inserting <quote>culturally and linguistically responsive information</quote>;</text></subparagraph></paragraph><paragraph id="HBE88C26CA51448E69EA68CA8EB960D53"><enum>(8)</enum><text>by amending paragraph (1) of subsection (e) to read as follows:</text><quoted-block style="OLC" id="H9A08A53995524C99A136B4A4A7459E9A" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="HC23EBC1EDD444960B967B58E40DACB55"><enum>(1)</enum><header>Training</header><text display-inline="yes-display-inline">The Secretary, in coordination with activities conducted under title V of the Social Security Act, shall, subject to the availability of appropriations, strengthen the capacity of existing training programs and expand existing interdisciplinary training opportunities or opportunities to increase the number of programs that address the health and well-being of individuals who have or are at increased likelihood for autism spectrum disorder and other neurodevelopmental disabilities across their lifespan. Activities under the preceding sentence shall include—</text><subparagraph id="H20E649CBD43748BA90FB3CC1279CDFEC"><enum>(A)</enum><text>awarding competitive grants or cooperative agreements to public or nonprofit agencies, including institutions of higher education, to expand existing or develop new maternal and child health interdisciplinary leadership education in neurodevelopmental and related disabilities programs (similar to the programs developed under section 501(a)(2) of the Social Security Act) in States that do not have such a program;</text></subparagraph><subparagraph id="HF1FCF482B005408B831C772374F8F7E5"><enum>(B)</enum><text>ensuring that trainees under such training programs—</text><clause id="H0614D3FF6DB345FFB79649C4F0D4EBAC"><enum>(i)</enum><text>receive an appropriate balance of academic, clinical, and community opportunities;</text></clause><clause id="H0E3591AAC3F046DE8F894E658C8FACFD"><enum>(ii)</enum><text>are culturally and linguistically responsive;</text></clause><clause id="H37B28819CA4A4875AE3F460CC5BFB538"><enum>(iii)</enum><text>are from various backgrounds;</text></clause><clause id="HA26943114E684EF79AAE538207776A71"><enum>(iv)</enum><text>demonstrate a capacity to evaluate, diagnose or rule out, develop, and provide evidence-based interventions and programs to individuals with autism spectrum disorder and other developmental disabilities across their lifespan; and</text></clause><clause id="H2EDF5AC8971E4B21879B3E0658EDF869"><enum>(v)</enum><text>demonstrate an ability to use a person- and family-centered approach, which may include collaborating with research centers or networks to provide training for providers of respite care (as defined in section 2901);</text></clause></subparagraph><subparagraph id="H2922D91CAE98455F8C2DA53A305692B6"><enum>(C)</enum><text>ensuring that program sites provide culturally and linguistically responsive services; and</text></subparagraph><subparagraph id="HE3D22AA4A7394949A421A09BDEE28E4B"><enum>(D)</enum><text display-inline="yes-display-inline">encouraging training programs to partner with appropriate entities to build community capacity.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H25A137BF8CE441D2AE998D8DAEE9DA57"><enum>(9)</enum><text>in subsection (e)(2), by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="HED1503682C6A4F02B6D7571A286CC958" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subparagraph id="H68FCEC089B3548B19F97FCC8DC78311D"><enum>(C)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after September 30, 2024, the Comptroller General of the United States shall prepare and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report examining how to increase the number of developmental-behavioral pediatricians, including through the developmental behavioral pediatrician training program.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H9ABAB75257064A5982C328D1663992EE"><enum>(10)</enum><text>in subsection (f)—</text><subparagraph id="HE28B4C88D4B3429BA020D20117B5D701"><enum>(A)</enum><text>by striking <quote>promote research</quote> and inserting <quote>promote research, including community-based participatory research,</quote>;</text></subparagraph><subparagraph id="H687BB0777D8941C69177138AB7853D9C"><enum>(B)</enum><text>by striking <quote>physical and behavioral health of individuals</quote> and inserting <quote>physical and behavioral health, and communication needs, of individuals</quote>; and</text></subparagraph><subparagraph id="H645294DFDFE8473C9E2FB75F4E6D9B44"><enum>(C)</enum><text>by striking <quote>disseminate information related to such research and guidelines</quote> and inserting <quote>disseminate information relating to such research and guidelines to improve the quality of life and long-term outcomes</quote>; and</text></subparagraph></paragraph><paragraph id="H288084FF110048038C37A54B1B75DBD8"><enum>(11)</enum><text>in subsection (g), by striking <quote>2024</quote> and inserting <quote>2029</quote>.</text></paragraph></subsection><subsection id="H520B6510CF9B4F9C9C4270B07671E211"><enum>(c)</enum><header>Interagency Autism Coordinating Committee</header><text>Section 399CC of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280i-2">42 U.S.C. 280i–2</external-xref>) is amended—</text><paragraph id="H80C91F0FBB8140A2B229D594B9F098B3"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="HDB26F182DFF546498C5085B1BB2BC320"><enum>(A)</enum><text>in paragraph (2), by striking <quote>develop a summary</quote> and inserting <quote>develop and update a summary</quote>;</text></subparagraph><subparagraph id="HC0B575D7D5094C6BA3C6091A7D025F2C"><enum>(B)</enum><text>in paragraphs (3) and (4), by striking <quote>make recommendations</quote> and inserting <quote>make and update recommendations</quote>; and</text></subparagraph><subparagraph id="H2C0FEBBD73A54D1E947F18E6022C3E25"><enum>(C)</enum><text>by striking paragraphs (5) and (6) and inserting the following:</text><quoted-block style="OLC" id="H527C2D78BC774E6D8302A38F9C5F1BD1" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="HAADCF47274FD4ED79741C80C5EDBA436"><enum>(5)</enum><text display-inline="yes-display-inline">develop and update a strategic plan for the conduct of, and support for, autism spectrum disorder research, including as practicable for services and supports, for individuals with an autism spectrum disorder across the lifespan of such individuals and the families of such individuals, and across the entire population of individuals with autism spectrum disorder, including the full range of cognitive, communicative, behavioral, and adaptive functioning, as well as co-occurring conditions and needs for support and services, including care necessary for physical safety, which such plan shall include proposed budgetary requirements and recommendations to ensure that autism spectrum disorder research, and services and support activities to the extent practicable, of the Department of Health and Human Services and of other Federal departments and agencies are not unnecessarily duplicative; and</text></paragraph><paragraph id="H295E1C3B56BE4B348DCEF5D27E648C74"><enum>(6)</enum><text display-inline="yes-display-inline">submit to the Congress and President—</text><subparagraph id="HC4F53623E4D34A66996ED83DA4C79352"><enum>(A)</enum><text>an annual update on the summary of advances described in paragraph (2); and</text></subparagraph><subparagraph id="H1C9135760564435EBC3A6D48EB9ED778"><enum>(B)</enum><text>each update to the strategic plan described in paragraph (5), including any steps that have already been taken to implement the recommendations in such updated strategic plan and progress made in achieving the goals outlined in such updated strategic plan.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4345DB6488474A3B933DAB3D2ECD766D"><enum>(2)</enum><text>in subsection (f), by striking <quote>2024</quote> and inserting <quote>2029</quote>.</text></paragraph></subsection><subsection id="H0A11B71A2D9546F683A9A4A7B464C3B1"><enum>(d)</enum><header>Reports to Congress</header><text display-inline="yes-display-inline">Section 399DD of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280i-3">42 U.S.C. 280i–3</external-xref>) is amended—</text><paragraph id="H32885506C7D846159AE94D69C266C63E"><enum>(1)</enum><text>by striking <quote>Autism CARES Act of 2019</quote> each place it appears and inserting <quote><short-title>Autism CARES Act of 2024</short-title></quote>;</text></paragraph><paragraph id="HB28E6A517B7F4DB58747E833EE979BB8"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a), by amending paragraph (1) to read as follows:</text><quoted-block style="OLC" id="HAD225EE9F2444A59BF337057C8366A32" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="H07D41B2AE4384A3D8ADC811E1E10141D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 4 years after September 30, 2024, the Secretary, in consultation and coordination with other Federal departments and agencies that serve individuals with autism spectrum disorder, shall prepare and submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives, and make publicly available, including through posting on the internet website of the Department of Health and Human Services, a progress report on activities related to autism spectrum disorder and other developmental disabilities. Such report shall include activities and research related to the entire population of individuals with autism spectrum disorder, including the full range of cognitive, communicative, behavioral, and adaptive functioning, as well as co-occurring conditions and needs for support and services, including care necessary for physical safety.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HA8B632B88202438F834FAE043544FCEE"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HD505858AE256469C878E81D44E900BAA" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><subsection id="H4BD1C957B85441798C0097B2EF9283E9"><enum>(c)</enum><header>Update on young adults and youth transitioning to adulthood</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of the <short-title>Autism CARES Act of 2024</short-title>, the Secretary, in coordination with other Federal departments and agencies that serve individuals with autism spectrum disorder, shall prepare and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate an update to the report required pursuant to section 6 of the Autism Cares Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/157">Public Law 113–157</external-xref>) concerning young adults with autism spectrum disorder and the challenges related to the transition from existing school-based services to those services available during adulthood.</text></subsection><subsection id="HFF03D6B89EFF4A5BABD6F11506425F22" commented="no"><enum>(d)</enum><header>Professional judgment budget</header><text>For each fiscal year through fiscal year 2029, the Director of the National Institutes of Health, in coordination with other relevant agencies, as appropriate, shall prepare and submit, directly to the President for review and transmittal to Congress, after reasonable opportunity for comment, but without change, by the Secretary and the Interagency Autism Coordinating Committee established under section 399CC(a), an annual budget estimate for carrying out the strategic plan developed and updated under section 399CC(b)(5).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC26739B234044DBF9065055087EB9260"><enum>(e)</enum><header>Authorization of appropriations</header><text>Section 399EE of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280i-4">42 U.S.C. 280i–4</external-xref>) is amended—</text><paragraph id="HFC8DE9512FAC4815A789BADFA50EE5D7"><enum>(1)</enum><text>in subsection (a), by striking <quote>$23,100,000 for each of fiscal years 2020 through 2024</quote> and inserting <quote>$28,100,000 for each of fiscal years 2025 through 2029</quote>;</text></paragraph><paragraph id="H110F6BBEF7E547F38ED74D23340E0B78"><enum>(2)</enum><text>in subsection (b), by striking <quote>$50,599,000 for each of fiscal years 2020 through 2024</quote> and inserting <quote>$56,344,000 for each of fiscal years 2025 through 2029</quote>; and</text></paragraph><paragraph id="HD1E11D4F06794D6E8693E87D8793AB36"><enum>(3)</enum><text>in subsection (c), by striking <quote>there are authorized to be appropriated $296,000,000 for each of fiscal years 2020 through 2024</quote> and inserting <quote>there is authorized to be appropriated $341,000,000 for each of fiscal years 2025 through 2029</quote>.</text></paragraph></subsection></section></legis-body><official-title-amendment>Amend the title so as to read: <quote>A bill to amend the Public Health Service Act to enhance and reauthorize activities and programs relating to autism spectrum disorder, and for other purposes.</quote>.</official-title-amendment><endorsement display="yes"><action-date>July 30, 2024</action-date><action-desc>Reported with amendments, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
