which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><action display="yes"><action-date date="20240522">May 22, 2024</action-date><action-desc>Additional sponsors: <cosponsor name-id="N000147">Ms. Norton</cosponsor>, <cosponsor name-id="L000599">Mr. Lawler</cosponsor>, <cosponsor name-id="S001185">Ms. Sewell</cosponsor>, <cosponsor name-id="G000551">Mr. Grijalva</cosponsor>, <cosponsor name-id="D000096">Mr. Davis of Illinois</cosponsor>, and <cosponsor name-id="C001120">Mr. Crenshaw</cosponsor></action-desc></action><action display="yes"><action-date date="20240522">May 22, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on February 1, 2024</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize the Traumatic Brain Injury program.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HIF00" reported-display-style="italic" id="H8DA16171214145C293CFDDE20BC54A1F"><section id="H4F1F5F38C6624D52B0997FA3BF4A3079" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Dennis John Beningo Traumatic Brain Injury Program Reauthorization Act of 2024</short-title></quote>.</text></section><section id="H4113A18441E84FBD8193B4527C62D521"><enum>2.</enum><header>National program for traumatic brain injury surveillance and registries</header><text display-inline="no-display-inline">Section 393C of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280b-1d">42 U.S.C. 280b–1d</external-xref>) is amended by striking subsection (b).</text></section><section id="HDD90203719194F6A96E8F6B56C56B337"><enum>3.</enum><header>Prevention and control of injuries</header><text display-inline="no-display-inline">Section 394A(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280b-3">42 U.S.C. 280b–3(b)</external-xref>) is amended by striking <quote>fiscal years 2020 through 2024</quote> and inserting <quote>fiscal years 2025 through 2029</quote>.</text></section><section id="H5FF8E4487B7F46EC9F319C436CA016E5"><enum>4.</enum><header>State grants for projects regarding traumatic brain injury</header><text display-inline="no-display-inline">Section 1252 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300d-52">42 U.S.C. 300d–52</external-xref>) is amended—</text><paragraph id="H5605BF0A7D19453C86C96C5841A55E05"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c)(1), by striking <quote>that is not less than $1 for each $2 of Federal funds provided under the grant.</quote> and inserting the following: </text><quoted-block style="OLC" id="HF368475303734C9AA98E8A2C08654F1A" display-inline="yes-display-inline" changed="added" reported-display-style="italic" committee-id="HIF00"><text>that is—</text><subparagraph id="H4FE186E5C3C7430D9263E65197B9B618"><enum>(A)</enum><text display-inline="yes-display-inline">for fiscal years 2020 through 2024, not less than $1 for each $2 of Federal funds provided under the grant; and</text></subparagraph><subparagraph id="HA18FD627170C4A889CEA0CE17CEAB258"><enum>(B)</enum><text display-inline="yes-display-inline">for fiscal year 2025 and each succeeding fiscal year, not less than $0.50 for each $2 of Federal funds provided under the grant.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H3583E089AA7A4D658BB2306831C5F109"><enum>(2)</enum><text>by striking subsection (e);</text></paragraph><paragraph id="H76C9D7F510AF4AC8AFFAF6F028C39E28"><enum>(3)</enum><text display-inline="yes-display-inline">by redesignating subsections (f) through (i) as subsections (e) through (h), respectively;</text></paragraph><paragraph id="H89E17E74B9A44472A511B7DDDAC40C93"><enum>(4)</enum><text>by amending subsection (g)(2), as so redesignated, to read as follows:</text><quoted-block style="OLC" id="H0FFA31AD6F2343A3AF928596CDDD5E1D" changed="added" reported-display-style="italic" committee-id="HIF00"><paragraph id="HA2AB582A41FA41F8A5FFFA63238C4C11"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H7273808BA557430189E08174C4C345C8"><enum>(A)</enum><text>The term <quote>traumatic brain injury</quote> means an acquired injury to the brain.</text></subparagraph><subparagraph id="H6EA3150379A64B5992842D3AFDF87F1F" indent="up1"><enum>(B)</enum><text>Such term—</text><clause id="H8552B66C59D54AF7ACE8A78F8925C87A"><enum>(i)</enum><text>does not include brain dysfunction caused by congenital or degenerative disorders, nor birth trauma; and</text></clause><clause id="HB383C40A9E95434D88913A5825FDD392"><enum>(ii)</enum><text>may include—</text><subclause id="H94EE4F81F017446D8B0DA17A099032F1"><enum>(I)</enum><text>brain injuries caused by anoxia due to trauma; and</text></subclause><subclause id="HDB5B0B2472F4415594B1FA96DB63FF3E"><enum>(II)</enum><text>damage to the brain from an internal or external source that results in toxicity, surgery, or vascular disorders not associated with aging.</text></subclause></clause></subparagraph><subparagraph id="HC550447C4D36473691A22F65B4BA16E1" indent="up1"><enum>(C)</enum><text>The Secretary may revise the definition of such term as the Secretary determines necessary, after consultation with States and other appropriate public or nonprofit private entities.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HD05DCE3DC8E2454C80573FF4CE446F01"><enum>(5)</enum><text>in subsection (i), as so redesignated, by striking <quote>fiscal years 2020 through 2024</quote> and inserting <quote>fiscal years 2025 through 2029</quote>.</text></paragraph></section><section id="H2BDDCF9FA4E64B21AA51238E6188ACDA" commented="no"><enum>5.</enum><header>State grants for protection and advocacy services</header><text display-inline="no-display-inline">Section 1253(l) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300d-53">42 U.S.C. 300d–53(l)</external-xref>) is amended by striking <quote>fiscal years 2020 through 2024</quote> and inserting <quote>fiscal years 2025 through 2029</quote>.</text></section><section id="H838A62E39D7F404D89BEA7FC07F1F522"><enum>6.</enum><header>Report on designating brain injury as a chronic condition</header><text display-inline="no-display-inline">The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, shall—</text><paragraph id="H7495838B2932405ABC1F7EDBCDBBFD7A"><enum>(1)</enum><text>examine the evidence base for designating brain injury as a chronic condition that can impact individuals with brain injury across the lifespan; and</text></paragraph><paragraph id="H9A52575064CA46C5B55E3C8772FBAEE4"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 2 years after the date of enactment of this Act—</text><subparagraph id="H94CAE48C06A049C59A33CEC2994E0601"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Health, Education, Labor, and Pensions of the Senate a report detailing the findings, conclusions, and recommendations of the examination described in paragraph (1); and</text></subparagraph><subparagraph id="HF1D09144996F4DFA9BAE1F6457E12462"><enum>(B)</enum><text>make publicly available on the website of the Centers for Disease Control and Prevention the report described in subparagraph (A).</text></subparagraph></paragraph></section></legis-body><endorsement display="yes"><action-date date="20240522">May 22, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
