which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Lacey Act Amendments of 1981 to ensure fair enforcement of such Act.</official-title></form><legis-body id="HA53B7BBF128B454A8BCF681DE622AF58" style="OLC"><section id="HDA8259FE44214279A4668F432D3F33A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthen Wood Product Supply Chains Act</short-title></quote>.</text></section><section id="HD9340CA1101947559984B52B59AFD8F7" section-type="subsequent-section"><enum>2.</enum><header>Fair enforcement of Lacey Act Amendments of 1981</header><text display-inline="no-display-inline">Section 6 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3375">16 U.S.C. 3375</external-xref>) is amended—</text><paragraph id="H258CD0A9FE5749D394E17A101623CA5C"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="H361044EDEC0C4ABE8550F0255BB878AF"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" id="H7091A2AC4AA341DAAB27EAD56F3E69FB" display-inline="no-display-inline"><subsection id="H0757F6606AC347B392DE4DB926D0EB62"><enum>(c)</enum><header>Merchandise detained for inspection</header><paragraph id="H9D654C04D3354C77BA580F998C64B8B0"><enum>(1)</enum><header>In general</header><text>If a person authorized under subsection (a) to enforce this Act detains merchandise under this section, the Secretary shall, not later than 5 days after the date on which such detention is initiated—</text><subparagraph id="H87B1D73BBD644B779FBBCFB764105C01"><enum>(A)</enum><text>issue to the importer of such detained merchandise a notice of detention; or</text></subparagraph><subparagraph id="HD9809823B7D94381BB8415C780FA8069"><enum>(B)</enum><text>release to such importer the detained merchandise.</text></subparagraph></paragraph><paragraph id="HFF5E66E9D70346C09ACF698CEA6519D5"><enum>(2)</enum><header>Notice of detention</header><text display-inline="yes-display-inline">A notice of detention described in paragraph (1)(A) shall include the following:</text><subparagraph id="HD631BC00FEA24115A8D100BF8BAF3BDF"><enum>(A)</enum><text display-inline="yes-display-inline">A statement of the initiation of the detention, including the date on which the detained merchandise was detained for inspection.</text></subparagraph><subparagraph id="H46A6696A551440EE93EEEAEC9E5A7018"><enum>(B)</enum><text>A specific reason for the detention.</text></subparagraph><subparagraph id="H2EC2E53AC26E4A9EAE4F5336D100B63B"><enum>(C)</enum><text>The anticipated length of the detention.</text></subparagraph><subparagraph id="H5A16CFDA72364E2DA287C1EB0C118970"><enum>(D)</enum><text display-inline="yes-display-inline">A description of the tests or inquiries the Secretary will conduct with regard to the detained merchandise.</text></subparagraph><subparagraph id="H30DA852854A04E74B8843933F2E604E0"><enum>(E)</enum><text display-inline="yes-display-inline">A description of information, if any, that, if supplied to the Secretary, may accelerate the disposition of the detention.</text></subparagraph></paragraph><paragraph id="H977F1F8B01564284B8955C5B997893D8"><enum>(3)</enum><header>Transportation of detained merchandise to other location</header><text display-inline="yes-display-inline">Not later than 10 days after the date on which the Secretary issues a notice of detention under paragraph (1) for detained merchandise, the Secretary shall allow the importer of such detained merchandise to transport such detained merchandise to a location that is not under the control of the United States if—</text><subparagraph id="H51D9445899D74A1585FCBE3551FA9813" display-inline="no-display-inline"><enum>(A)</enum><text>the importer—</text><clause id="HD6E537995B73412380CE93DC0E78ABD4"><enum>(i)</enum><text>requests the transfer;</text></clause><clause id="H1689BE71DC634DC586664376A88A100D"><enum>(ii)</enum><text display-inline="yes-display-inline">pays all demurrage and storage fees associated with the detained merchandise; and</text></clause><clause id="H206BC8278213461890738A493327E486"><enum>(iii)</enum><text display-inline="yes-display-inline">provides a bond for removal from the custody of the United States; and</text></clause></subparagraph><subparagraph id="H3791AA11FDCF4549A4A23080760E3941"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary determines that such transportation will not frustrate the intent of this Act.</text></subparagraph></paragraph><paragraph id="H5D99F1974C31415EAFBBB4D99F934F48"><enum>(4)</enum><header>Replication of tests</header><text>If the Secretary conducts tests on detained merchandise, the Secretary shall provide the importer of such detained merchandise with—</text><subparagraph id="H4E7D8C5225D444CBBD7E0CF83C1C5627"><enum>(A)</enum><text>the results of such tests; and</text></subparagraph><subparagraph id="HD07591D7214040BCBC0ED3A9D4D6ABFF"><enum>(B)</enum><text>information sufficient for the importer to replicate such tests.</text></subparagraph></paragraph><paragraph id="HBE9BDBF1935744398FDB57BB9E269D65"><enum>(5)</enum><header>Release or seizure</header><subparagraph id="H217509187E244CA19C82B76601475AE5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which merchandise is detained for inspection under this section, the Secretary shall—</text><clause id="HF398D7460F454F0CAAA543F5FD2794FE"><enum>(i)</enum><text>release such detained merchandise to the importer of such detained merchandise; or</text></clause><clause id="HA68A32AB1799491D95E5EB9D9E7EF973"><enum>(ii)</enum><text>seize such detained merchandise and issue a notification to the importer of such detained merchandise that such detained merchandise has been seized.</text></clause></subparagraph><subparagraph id="HA6798DE29A9941FA963E6C20602ED745"><enum>(B)</enum><header>Failure to release or seize</header><text display-inline="yes-display-inline">If the Secretary fails to release or seize detained merchandise under subparagraph (A) within the time period described in that subparagraph, such failure shall be deemed a seizure under subparagraph (A)(ii).</text></subparagraph></paragraph><paragraph id="H981519037DF442D1BF263AB55620BFF9"><enum>(6)</enum><header>Administrative review</header><subparagraph id="HC6F304985C4A4111A2A31359261C631F"><enum>(A)</enum><header>In general</header><text>An importer of detained merchandise may submit to the Secretary a request for administrative review of a seizure or deemed seizure of such detained merchandise under subparagraph (A)(ii) or (B) of paragraph (5), respectively.</text></subparagraph><subparagraph id="HAA05776231214966894B32D64822F71C"><enum>(B)</enum><header>Disposition of request</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which a request for administrative review is submitted by an importer under subparagraph (A), the Secretary shall—</text><clause id="H3BC0F9AB01C8495DBD3C11B1B157C5E8"><enum>(i)</enum><text>release to such importer the detained merchandise that is the subject of such request; or</text></clause><clause id="HE513CFB8C27C455F93F93E15D18C2375"><enum>(ii)</enum><text display-inline="yes-display-inline">affirm the seizure or deemed seizure under subparagraph (A)(ii) or (B) of paragraph (5), respectively, that is the subject of such request.</text></clause></subparagraph><subparagraph id="H545817F8CCDA4FCD8D80CE7898F35503"><enum>(C)</enum><header>Eligibility to file claim</header><text display-inline="yes-display-inline">If the Secretary, pursuant to a request for administrative review submitted by an importer of detained merchandise under subparagraph (A)—</text><clause id="H1C5868C5B8DB4290A1E665BA0D17A13C"><enum>(i)</enum><text>affirms the seizure or deemed seizure of such detained merchandise under subparagraph (B)(ii); or</text></clause><clause id="H07900C8F5DAB4C13B5A54071B1B69B01"><enum>(ii)</enum><text>fails to release or affirm the seizure or deemed seizure of such detained merchandise under clause (i) or (ii) of subparagraph (B), respectively, within the time period described in subparagraph (B);</text></clause><continuation-text continuation-text-level="subparagraph">the importer that submitted such request may file a claim for relief in the appropriate district court of the United States.</continuation-text></subparagraph></paragraph><paragraph id="H8A9443E775B44E238C281E326927C492"><enum>(7)</enum><header>Court proceedings</header><text>In a claim filed under paragraph (6)(C)(ii), the court shall grant appropriate relief to the importer of detained merchandise that filed such claim, which may include an order to release such detained merchandise to such importer, unless the Secretary establishes by a preponderance of the evidence that an admissibility decision with respect to such detained merchandise has not been reached for good cause.</text></paragraph><paragraph id="H8C55A0CC6DA4417989E4DA63845454B0"><enum>(8)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HF5A1D52B336D495B8695CAB521C16744"><enum>(A)</enum><header>Detained merchandise</header><text>The term <term>detained merchandise</term> means merchandise that is detained for inspection under this section.</text></subparagraph><subparagraph id="H3EEDDBF6D209494392645CE506C17C29"><enum>(B)</enum><header>Merchandise</header><text>The term <term>merchandise</term> means any fish or wildlife or plant imported for sale.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
