which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Agricultural Foreign Investment Disclosure Act of 1978 to establish an additional reporting requirement, and for other purposes.</official-title></form><legis-body id="H90BA6377F8614D7A90C8D0FDF651AC0D" style="OLC"><section id="HBDA65F6F457248349287B861F6F21BDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AFIDA Improvements Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H8FA82EE8CD394389B8D2ECC0F094C9BE"><enum>2.</enum><header>Reporting; enforcement</header><subsection commented="no" display-inline="no-display-inline" id="HA86E89497F3F49B38336008A7CD640C4"><enum>(a)</enum><header display-inline="yes-display-inline">Reporting requirement</header><text>Section 2 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H30BD6D2B5E524A00A75D1F9C7D1EA6C1"><subsection commented="no" display-inline="no-display-inline" id="H5D30D84AD1F24A97B0086CDAB4C2532C"><enum>(g)</enum><header>Minimum ownership</header><text>In the case of agricultural land in which more than 1 foreign person acquires or transfers any interest, other than a security interest, the reporting requirements under this section shall apply to each foreign person who holds at least a 1 percent interest in that land—</text><paragraph commented="no" display-inline="no-display-inline" id="HE15A5CD2296349A193330C438C375C45"><enum>(1)</enum><text display-inline="yes-display-inline">directly through the first tier of ownership; or </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCBC3017A8DBF4F2CB28E410D08E37C87"><enum>(2)</enum><text display-inline="yes-display-inline">in the aggregate through an interest in other entities at various tiers.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H24312CCFE26E42F7BC6B6BF73AA89361"><enum>(b)</enum><header>Enforcement</header><text>Section 4 of the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3503">7 U.S.C. 3503</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H67EB5584AF7646199B1B177EFA3DC39C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the section designation and all that follows through <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H237C1505080A45F0BC6189648F4FFFEC"><section commented="no" display-inline="no-display-inline" id="HC022781323174239990B6E482228E565"><enum>4.</enum><header>Investigative actions</header><subsection commented="no" display-inline="no-display-inline" id="H607F1D2699D041D0B4C683018065A83B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>The Secretary</text></subsection></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB52D51F4C29740278E12EE4841B2B353"><enum>(2) </enum><text>by adding at the end the following:</text><quoted-block id="HCC15250D099F4D11ABF9C637B29851DE" display-inline="no-display-inline" style="OLC"><subsection id="HC9217D6F97B34E5BAA991094B20FC28D"><enum>(b)</enum><header>Actions by FPAC–BC</header><text>As part of the actions taken under subsection (a), the Farm Production and Conservation Business Center shall—</text><paragraph commented="no" display-inline="no-display-inline" id="H3EBCE9660AD44192B370EC6A1C3E31FD"><enum>(1)</enum><text display-inline="yes-display-inline">take such actions as are necessary to validate the data collected under section 2, including revising and validating information throughout the data collection process;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDE69D1B5AC784BCCB16B65EA0F66D65C"><enum>(2)</enum><text>take such actions as are necessary to ensure compliance with section 2(g); and</text></paragraph><paragraph id="H24A6BBF6D6074C62B3298EC5C4767AC1"><enum>(3)</enum><text>in coordination with the Farm Service Agency, to the maximum extent practicable, identify persons that have carried out an activity subject to a civil penalty described in paragraph (1) or (2) of section 3(a).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H3FA92DBA92FB4C59915E1F1D0E33F7EA"><enum>3.</enum><header>Agricultural foreign investment disclosure improvements</header><subsection commented="no" display-inline="no-display-inline" id="HCB4A93B837984E0E8B7AB256F39540C7"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HE611874B7F78428BA5C7E6C35F10D972"><enum>(1)</enum><header>AFIDA</header><text>The term <quote>AFIDA</quote> means the Agricultural Foreign Investment Disclosure Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501 et seq.</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3BDC5D0C4ACC458D8EC55235EB5C9790"><enum>(2)</enum><header>FPAC–BC</header><text>The term <quote>FPAC–BC</quote> means the Farm Production and Conservation Business Center.</text></paragraph><paragraph id="H38B3B878C8294CF897F93AE5CC497FF5" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HCF2322EF8C524019B00B0302A5C96810"><enum>(b)</enum><header display-inline="yes-display-inline">MOU with CFIUS</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall enter into 1 or more memoranda of understanding with the Committee on Foreign Investment in the United States under which the Secretary shall provide the Committee with all relevant information relating to reports on foreign ownership of United States agricultural land submitted to the Secretary under section 2 of AFIDA (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref>), including information on—</text><paragraph commented="no" display-inline="no-display-inline" id="H6A5812645E114E28A2FA245022799E8C"><enum>(1)</enum><text display-inline="yes-display-inline">each report submitted to the Secretary; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC863882FA8984E02B5D667879C62D8DC"><enum>(2)</enum><text>with respect to each such report, the identity of the person submitting the report and the date of submission.</text></paragraph></subsection><subsection id="HB4548D53C4FC46F98AFDFB5E4F818C23"><enum>(c)</enum><header>AFIDA handbook updates</header><paragraph commented="no" display-inline="no-display-inline" id="H0D2EC8BBAFDF445596C77BDCF112F898"><enum>(1)</enum><header display-inline="yes-display-inline">First update</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall update the most recent version of the Farm Service Agency handbook entitled <quote>Foreign Investment Disclosure</quote> as determined necessary by the Secretary for the effective implementation of AFIDA, which update shall incorporate recommendations made by the report of the Government Accountability Office entitled <quote>Foreign Investments in U.S. Agricultural Land: Enhancing Efforts to Collect, Track, and Share Key Information Could Better Identify National Security Risks</quote> and dated January 18, 2024.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5BDCAA3534EF4F0285A56261C8F72307"><enum>(2)</enum><header>Subsequent updates</header><text>After updating the handbook described in paragraph (1) under that paragraph, the Secretary shall carry out an update of that handbook every 10 years thereafter, including by incorporating any recommendations of the Government Accountability Office.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1AC90DD5D6F64745AA8A23BDD42F70A3"><enum>(d)</enum><header display-inline="yes-display-inline">Analysis of streamlined process for electronic submission and retention of reports under AFIDA</header><paragraph commented="no" display-inline="no-display-inline" id="HCD5DF12C386844F6A9708DBE98DDCFA3"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of covered process</header><text>In this subsection, the term <term>covered process</term> means the streamlined process for electronic submission and retention of disclosures made under AFIDA required under section 773 of division A of the Consolidated Appropriations Act, 2023 (<external-xref legal-doc="usc" parsable-cite="usc/7/3501">7 U.S.C. 3501</external-xref> note; 136 Stat. 4509).</text></paragraph><paragraph id="HFDAF817989EC4EFF866F8846B0249074"><enum>(2)</enum><header>Analysis</header><text>Unless the covered process is established by not later than 1 year after the date of enactment of this Act, the FPAC–BC, in coordination with the Farm Service Agency, shall, by that date—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF078011FE48B41C4AF426B368F42CEA6"><enum>(A)</enum><text display-inline="yes-display-inline">carry out an analysis of the specific steps required to establish that process and the elements of that process; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE9710DFDDA514366A39CE982366E251F"><enum>(B)</enum><text display-inline="yes-display-inline">develop a timeline for specific implementation benchmarks to be met.</text></subparagraph></paragraph><paragraph id="H76C842F2ADD0404BAB41986667D88E47"><enum>(3)</enum><header>Report</header><text>The Secretary shall submit to the Committee on Agriculture, Nutrition, and Forestry of the Senate and the Committee on Agriculture of the House of Representatives a report describing the analysis and implementation timeline under paragraph (2), if applicable. </text></paragraph></subsection></section></legis-body></bill>
