which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Communications Act of 1934 to require disclosures with respect to robocalls using artificial intelligence and to provide for enhanced penalties for certain violations involving artificial intelligence voice or text message impersonation, and for other purposes.</official-title></form><legis-body id="H2C9BEBD210D24C82B79A4546A18FE817" style="OLC"><section id="HB43058D169FB491893AAE45EA49F1B2C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quashing Unwanted and Interruptive Electronic Telecommunications Act</short-title></quote> or the <quote><short-title>QUIET Act</short-title></quote>.</text></section><section id="H1481D98F03DF42E1B653041053186B4A"><enum>2.</enum><header>Disclosure required for robocalls using AI</header><text display-inline="no-display-inline">Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD867D01EB8E34EB5BB0385B7505AE30C" display-inline="no-display-inline"><subsection id="HFCDD61499E854227B68B1C91A3707176"><enum>(k)</enum><header>Disclosure required for robocalls using AI</header><paragraph id="H6A6F477AB45D4FF183751F9A93448A43"><enum>(1)</enum><header>In general</header><text>If a person making a robocall uses artificial intelligence to emulate a human being, such person shall disclose at the beginning of the call or text message the fact that artificial intelligence is being used.</text></paragraph><paragraph id="H83B8C0EC49A149599C3F89B506FF3B28"><enum>(2)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H277F1929001B4D5A90207A4F59037687"><enum>(A)</enum><header>Robocall</header><clause id="H34167B0B2E2A4A7CBED24BFC207C796D"><enum>(i)</enum><header>In general</header><text>The term <quote>robocall</quote> means a call made or text message sent—</text><subclause id="H0C89F0FA0D23407F88079E73AC289A1F"><enum>(I)</enum><text>using equipment, whether hardware, software, or a combination thereof and including an automatic telephone dialing system, that makes a call or sends a text message to—</text><item id="HABB6E02A98EC4647B8459FEA94D2BD0C"><enum>(aa)</enum><text>stored telephone numbers; or</text></item><item id="H37BFB02F63864A2F94F0478C142AB466"><enum>(bb)</enum><text>telephone numbers produced using a random or sequential number generator; or</text></item></subclause><subclause id="HAEA77426A0A44396AD80E3723039A92C"><enum>(II)</enum><text>using an artificial or prerecorded voice or an artificially generated message.</text></subclause></clause><clause id="HC99693EA2ACA4A2BB728ECD3F25817C8"><enum>(ii)</enum><header>Limitation</header><text>For purposes of clause (i)(I), the term <quote>robocall</quote> does not include a call made or text message sent using equipment that requires substantial human intervention to make or send the call or text message.</text></clause></subparagraph><subparagraph id="H531589F6E5494B6594276E2EE2476AC0"><enum>(B)</enum><header>Text message</header><clause id="H65FFB6D995C44D2697A640B90B8EA12F"><enum>(i)</enum><header>In general</header><text>The term <quote>text message</quote> means a message consisting of text, images, sounds, or other information that is transmitted to or from a device that is identified as the receiving or transmitting device by means of a 10-digit telephone number, N11 service code, short code telephone number, or email address, or that is transmitted through application-to-person messaging, and includes—</text><subclause id="H7A00FAC4476748A5BBBE471F6ECBFA91"><enum>(I)</enum><text>a short message service (commonly referred to as <quote>SMS</quote>) message;</text></subclause><subclause id="H5781A3525E2C45D4BF0AD996367DAF8A"><enum>(II)</enum><text>a multimedia message service (commonly referred to as <quote>MMS</quote>) message; and</text></subclause><subclause id="HBC2FD56A7B8747249FEABCA413300F6C"><enum>(III)</enum><text>a rich communication service (commonly referred to as <quote>RCS</quote>) message. </text></subclause></clause><clause id="HC01124A09B3949C9971F12FDD4F3D217"><enum>(ii)</enum><header>Limitation</header><text>The term <quote>text message</quote> does not include a real-time, two-way voice or video communication. </text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1E6197FC16174A779CD6AD98E885A90C"><enum>3.</enum><header>Enhanced penalties for violations involving AI voice or text message impersonation</header><subsection id="H22FED49D34D04625BEA111D3B47CC84F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 227 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227</external-xref>), as amended by the preceding provisions of this Act, is further amended by adding at the end the following:</text><quoted-block style="OLC" id="H6BBA13A3B9254CA5BE5ED58FF8A6C1C6" display-inline="no-display-inline"><subsection id="H53234B9A40014852A90E4BA21FE2C943"><enum>(l)</enum><header>Enhanced penalties for violations involving AI voice or text message impersonation</header><text display-inline="yes-display-inline">In the case of a violation of this section with respect to which the party making the call or sending the text message uses artificial intelligence to impersonate an individual or entity with the intent to defraud, cause harm, or wrongfully obtain anything of value—</text><paragraph id="HC03AE926509A42969FEA09B8E40DE4F8"><enum>(1)</enum><text>the maximum amount of the forfeiture penalty that may be imposed under subsection (b)(4) or (e)(5)(A) of this section or subsection (b) of section 503 (as the case may be) shall be twice the maximum amount that may be imposed for such violation under such subsection without regard to this subsection; and</text></paragraph><paragraph id="HF8C389A73B4A4196958834848FE673C7"><enum>(2)</enum><text>the maximum amount of the criminal fine that may be imposed under subsection (e)(5)(B) of this section or section 501 (as the case may be) shall be twice the maximum amount that may be imposed for such violation under such subsection or section without regard to this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H02C03F61A51648AFA92490579FFAC70E"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall apply with respect to violations occurring after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
