R. 7102</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240305">March 5, 2024</action-date><action-desc>Received; read twice and placed on the calendar</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To establish an Office of Native American Affairs within the Small Business Administration, and for other purposes.</official-title></form><legis-body id="H84254CC0B37E4B14A353768737DA2418" style="OLC"><section id="H1F804164F81F48DD985B72E42BE7FA8E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Native American Entrepreneurial Opportunity Act</short-title></quote>.</text></section><section id="H5CC1F89EEDA84CD6AAA2F377C5A159B7"><enum>2.</enum><header>Office of Native American Affairs</header><text display-inline="no-display-inline">The Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631 et seq.</external-xref>) is amended—</text><paragraph id="H3F9D92E9608447119F6D58C96632388A"><enum>(1)</enum><text>by redesignating section 49 (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note) as section 50; and</text></paragraph><paragraph id="HA7887912F0B349C3A86B9B9BADB5DD0F"><enum>(2)</enum><text>by inserting after section 48 (<external-xref legal-doc="usc" parsable-cite="usc/15/657u">15 U.S.C. 657u</external-xref>) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD347C23784E4466C83197C78FB29968E"><section id="H9A1E30C217D2481896FBB796B75AC423"><enum>49.</enum><header>Office of Native American Affairs</header><subsection id="H04EE31FD40CB4846ABBE7B9752A571D4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HEA6084A3696042299904DDD03DF5F610"><enum>(1)</enum><header>Assistant Administrator</header><text display-inline="yes-display-inline">The term <term>Assistant Administrator</term> means the Assistant Administrator for Native American Affairs appointed under subsection (c).</text></paragraph><paragraph id="HA73D3B5C8F184DA7B487007F997F5536"><enum>(2)</enum><header>Indian Tribe</header><text>The term <term>Indian Tribe</term> has the meaning given the term <term>Indian tribe</term> in section 8(a)(13). </text></paragraph><paragraph id="H8AD3BFD9E0F347E8BA60AE0EB1E4AECC"><enum>(3)</enum><header>Native Hawaiian Organization</header><text>The term <term>Native Hawaiian Organization</term> has the meaning given the term in section 8(a)(15).</text></paragraph><paragraph id="H1B448D9B16C94E669A657196CAB312D1"><enum>(4)</enum><header>Office</header><text>The term <term>Office</term> means the Office of Native American Affairs described in this section.</text></paragraph></subsection><subsection id="H17B22B463020474698FBCA1A4A0CF240"><enum>(b)</enum><header>Establishment</header><paragraph id="H46ED059AA09C436B94C9633881EC899F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is established within the Administration the Office of Native American Affairs, which shall be responsible for establishing a working relationship with Indian Tribes and Native Hawaiian Organizations by targeting programs of the Administration relating to entrepreneurial development, contracting, and capital access to—</text><subparagraph id="HDB72A81935594ECF85D97BC4C6DE8F49"><enum>(A)</enum><text>establish or expand small business concerns owned and controlled by individuals who are members of Indian Tribes or Native Hawaiian Organizations; and</text></subparagraph><subparagraph id="HC5CFDA15BF464B578AF10DE9FE4931F8"><enum>(B)</enum><text>promote economic development in Indian country (as defined in section 1151 of title 18, United States Code).</text></subparagraph></paragraph><paragraph id="H7CA28797BDD743958EE682918C55BFB7"><enum>(2)</enum><header>Connection with other programs</header><text>To the extent reasonable, the Office shall educate Indian Tribes and Native Hawaiian Organizations about programs administered by other Federal agencies related to the interests described in paragraph (1). </text></paragraph></subsection><subsection id="HD19B1BF49C004081BB1B5080666101B3"><enum>(c)</enum><header>Assistant Administrator</header><text display-inline="yes-display-inline">The Office shall be headed by an Assistant Administrator for Native American Affairs, who shall—</text><paragraph id="HF1C1244AAA6C4497A2EDB9E529027B47"><enum>(1)</enum><text>be appointed by and report to the Administrator;</text></paragraph><paragraph id="H2BCB11D97FB64FE39887CF9015B074DE"><enum>(2)</enum><text>have knowledge of Native American cultures and experience providing culturally tailored small business development assistance to Native Americans; </text></paragraph><paragraph id="H0590EEFF9C7F4F55B5B02310A58647B3" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">provide assistance to Indian Tribes and Native Hawaiian Organizations and small business concerns owned and controlled by individuals who are members of Indian Tribes or Native Hawaiian Organizations;</text></paragraph><paragraph id="H739CCC8CC32F4768AC64D4E7D5830D4E" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">formulate policies, and promote policies and existing programs, to better address the entrepreneurial, capital access, business development, and contracting needs of persons described in paragraph (3);</text></paragraph><paragraph id="H30FCA072D54940C8A685C51558F507E6"><enum>(5)</enum><text>collaborate with Associate Administrators within the Administration and officials of other Federal agencies to develop policies and plans to implement programs of the Administration to holistically address the needs described in paragraph (4);</text></paragraph><paragraph id="HEB775CD8FE6E45E4B495AFFDCB274A6E"><enum>(6)</enum><text display-inline="yes-display-inline">provide assistance, including grants, contracts, cooperative agreements, or other financial assistance, to Indian Tribes and Native Hawaiian Organizations, or to private nonprofit organizations governed by members of Indian Tribes or Native Hawaiian Organizations that have the experience and capability to use the assistance to—</text><subparagraph id="HB6085F894CC54C28841D30DBACEE2D17"><enum>(A)</enum><text>deploy training, counseling, workshops, educational outreach, and supplier events; and</text></subparagraph><subparagraph id="H6DB46DFDFB294AD3BEC3218335D498AB"><enum>(B)</enum><text>access the entrepreneurial, capital, and contracting programs of the Administration; </text></subparagraph></paragraph><paragraph id="HA260ABE429C24F638201B6BBBFBB6AF8"><enum>(7)</enum><text>assist the Administrator in conducting, or conduct, Tribal consultation to solicit input and facilitate discussion of potential modifications to programs and procedures of the Administration; and </text></paragraph><paragraph id="H876040ACEA1A4F7B9DB36C0AD22D2C23"><enum>(8)</enum><text>recommend annual budgets for the Office. </text></paragraph></subsection><subsection id="H144082BD9F5446B7939D0F84AC8AFF21" commented="no"><enum>(d)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">On an annual basis until the termination date, the Assistant Administrator shall submit to Congress a report on the effectiveness of the Office of Native American Affairs that includes the number of clients served in Tribal communities, the number of consultations conducted, and the number of trainings held in Tribal country.</text></subsection><subsection id="H6414FA826EFF45CA941056137D3CD8B1"><enum>(e)</enum><header>Termination</header><text display-inline="yes-display-inline">The authority under this section shall terminate 7 years after the date of the enactment of this section. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0F094635C30E4F358A755AAE1EB79625"><enum>3.</enum><header>Compliance with CUTGO</header><text display-inline="no-display-inline">No additional amounts are authorized to be appropriated to carry out this Act or the amendments made by this Act. </text></section></legis-body><attestation><attestation-group><attestation-date date="20240229" chamber="House">Passed the House of Representatives February 29, 2024.</attestation-date><attestor display="yes">Kevin F.
