R. 7101</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240129">January 29, 2024</action-date><action-desc><sponsor name-id="A000377">Mr. Armstrong</sponsor> (for himself, <cosponsor name-id="G000589">Mr. Gooden of Texas</cosponsor>, <cosponsor name-id="G000576">Mr. Grothman</cosponsor>, <cosponsor name-id="F000474">Mr. Flood</cosponsor>, <cosponsor name-id="M000871">Mr. Mann</cosponsor>, and <cosponsor name-id="W000816">Mr. Williams of Texas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish requirements for the Federal Trade Commission with respect to certain rules related to automotive retailing, and for other purposes.</official-title></form><legis-body id="H45A3E94B0DA2413A87DB9C256B916F29" style="OLC"><section id="H97229BE5046F45EF80E58FBE673877AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Federal Trade Commission Review of Expensive and Detrimental Overregulation Act</short-title></quote> or the <quote><short-title>FTC REDO Act</short-title></quote>.</text></section><section id="H96A5328940994EF88E38457B5424B684"><enum>2.</enum><header>Automotive retailing rules</header><subsection id="H25452DB0E5254A53B9A9842D7E0524D3"><enum>(a)</enum><header>Rule rescinded</header><text display-inline="yes-display-inline">The final rule of the Commission titled <quote>Combating Auto Retail Scams Trade Regulation Rule</quote> and published in the Federal Register on January 4, 2024 (89 Fed. Reg. 590), shall have no force or effect.</text></subsection><subsection id="H139F528649F34274B6DCF1C01A9EEBC4"><enum>(b)</enum><header>Prohibition</header><text>The Commission may not finalize, implement, or enforce a covered proposed rule unless the Commission satisfies the requirements described in subsection (c), and any other requirements applicable under Federal law, with respect to the covered proposed rule.</text></subsection><subsection id="H099872C7130643009AD8D0C5E882F87C"><enum>(c)</enum><header>Requirements for covered proposed rules</header><paragraph id="HEB273F4F4C4942A787B61ABF6BFEB978"><enum>(1)</enum><header>Requirements for issuance</header><text display-inline="yes-display-inline">At least 30 days before publishing in the Federal Register a notice of proposed rulemaking with respect to a covered proposed rule, the Commission shall—</text><subparagraph id="H20709E43A8814763AF6B44108082D980"><enum>(A)</enum><text>complete—</text><clause id="HA4D476769E1B4EB4A1F5BEAC78B44A7D"><enum>(i)</enum><text>a quantitative study on automotive retailing that—</text><subclause id="H6AADCA9D18C04B678A9C0878F75BF86C"><enum>(I)</enum><text display-inline="yes-display-inline">uses a statistically valid national sample size of purchasers and lessees of motor vehicles from motor vehicle dealers;</text></subclause><subclause id="H04801A59F861471DA9664689DB68948C"><enum>(II)</enum><text>is noticed and subject to public comment for a period of not less than 30 days before publication;</text></subclause><subclause id="HD2964461F1F94720970EA3C38388BDE1"><enum>(III)</enum><text>is peer reviewed by an independent third party with knowledge of automotive retailing; and </text></subclause><subclause id="HD62FD4B9A650496DB3708803DC26F631"><enum>(IV)</enum><text>determines whether there is quantitative evidence of a prevalence of unfair or deceptive practices in automotive retailing that supports the necessity of the covered proposed rule;</text></subclause></clause><clause id="HE635AEE1A4764F01B96BBF369D1AE7B5"><enum>(ii)</enum><text>quantitative consumer testing that—</text><subclause id="H8C01183158B24F1696A8174E09B301FA"><enum>(I)</enum><text display-inline="yes-display-inline">uses a statistically valid national sample size of purchasers and lessees of motor vehicles from motor vehicle dealers;</text></subclause><subclause id="H20A99E855D3A4F24BB09F1A3FA097D68"><enum>(II)</enum><text display-inline="yes-display-inline">is noticed and subject to public comment for a period of not less than 30 days before publication; and</text></subclause><subclause id="HCB97726A43E04495A3403D5930F830D1"><enum>(III)</enum><text>determines whether new mandates, including disclosures, under the covered proposed rule would—</text><item id="HE74CA872BF224BF3B7355DC5CB80BBBD"><enum>(aa)</enum><text>enhance consumer understanding, education, and protection; and</text></item><item id="H6CED7F58E0AA4825A8E3B69720FFA00C"><enum>(bb)</enum><text>not unduly impair legitimate business activity, including as compared to alternative approaches that may provide similar benefits; and</text></item></subclause></clause><clause id="H3FF725D02E4847998AC73AB57A96C0ED"><enum>(iii)</enum><text>a detailed economic analysis of the costs and benefits of the covered proposed rule that—</text><subclause id="H9AF6CC4569124517AD6FE840F0CCFB30"><enum>(I)</enum><text display-inline="yes-display-inline">is noticed and subject to public comment for a period of not less than 30 days before publication;</text></subclause><subclause id="HCCC4A61A5FC0468195BB53CB0BE984B0"><enum>(II)</enum><text display-inline="yes-display-inline">is peer reviewed by an independent third party with knowledge of automotive retailing from the perspective of consumers and motor vehicle dealers;</text></subclause><subclause id="H50C68B80AB42439C853EAB4833055E56"><enum>(III)</enum><text>includes an assessment of the costs for consumers and small businesses, including as a result of new disclosures and paperwork; and </text></subclause><subclause id="H3B6FE752C44047FDA059B0A101738B23"><enum>(IV)</enum><text>compares the mandates of the covered proposed rule to more targeted and less burdensome alternatives that achieve similar benefits; and</text></subclause></clause></subparagraph><subparagraph id="H85D4C6338A714193A626B907B5DE8303"><enum>(B)</enum><text>submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a copy of the covered proposed rule and the results of the study, testing, and analysis conducted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="H4AB541B7D3724595815BF6DDCA62D1E3"><enum>(2)</enum><header>Requirements for finalization</header><text display-inline="yes-display-inline">The Commission may only finalize, implement, or enforce a covered proposed rule—</text><subparagraph id="HD82F30E1A6A84A1185E784499AA25087"><enum>(A)</enum><text>if—</text><clause id="H7D3332B423BB408D94CF3417B56B0D84"><enum>(i)</enum><text display-inline="yes-display-inline">an advance notice of proposed rulemaking with respect to the covered proposed rule was published in the Federal Register;</text></clause><clause id="H839E000482E14D2C9AF7224C6AC7A6A8"><enum>(ii)</enum><text display-inline="yes-display-inline">a notice of proposed rulemaking with respect to the covered proposed rule that includes the results of the study, testing, and analysis conducted under paragraph (1)(A) was published in the Federal Register; and</text></clause><clause id="H11186E89E02244FB8457BFBB57697FD8"><enum>(iii)</enum><text>the covered proposed rule was open for public comment for a period of at least 120 days; and</text></clause></subparagraph><subparagraph id="H09AC501DCE094EF39BAF09C3CEA2E42E"><enum>(B)</enum><text display-inline="yes-display-inline">if the duties, disclosures, penalties, and other mandates imposed by the covered proposed rule apply equally to franchised, independent, and direct sellers of automobiles.</text></subparagraph></paragraph></subsection><subsection id="HABB4D83BF70C41D8A8D2A9DB039CF3BB"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="H6EC73ECAF1984559B660BB6C772534DD"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="H8B63EDFAFE724F7BB7E3F5BF1E265372"><enum>(2)</enum><header>Covered proposed rule</header><text>The term <term>covered proposed rule</term> means any rule proposed by the Commission on or after January 4, 2024, that is similar or related to the final rule described in subsection (a).</text></paragraph></subsection></section></legis-body></bill>
