R. 7096</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240125">January 25, 2024</action-date><action-desc><sponsor name-id="S001145">Ms. Schakowsky</sponsor> (for herself and <cosponsor name-id="W000822">Mrs. Watson Coleman</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Consumer Product Safety Act to strike provisions relating to the maximum civil penalties for violations of product safety standards.</official-title></form><legis-body id="HA94C1543A2894A0DA733DC05CBB25BD9" style="OLC"><section id="H33EEF075E65D4B3EBE515E4C3700962E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Advocacy and Protection Act</short-title></quote> or the <quote><short-title>CAP Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H50F858D15B8E4250A8C787FE40935E87"><enum>2.</enum><header>Amendments to the Consumer Product Safety Act</header><subsection id="HC70F59B45C4F469F9A1DDE2C0E28EA7B"><enum>(a)</enum><header>Civil penalty cap</header><text>Section 20(a)(1) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(a)(1)</external-xref>) is amended—</text><paragraph id="H1A590B02B39E4DE5B738C6112DCDE121"><enum>(1)</enum><text>in the first sentence, by striking <quote>$100,000</quote> and inserting <quote>$250,000</quote>;</text></paragraph><paragraph id="HE3CC13CD51BC4F6091AC04E3EABF62EB"><enum>(2)</enum><text>in the second sentence—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCED3B1A22129402D914F9437AED3E42E"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or (11)</quote> and inserting <quote>(11), (12), (15), or (16)</quote>; and</text></subparagraph><subparagraph id="H830DA3A60EB64259A29284719EF1688E"><enum>(B)</enum><text>by striking <quote>, except that the maximum civil penalty shall not exceed $15,000,000 for any related series of violations</quote>; and</text></subparagraph></paragraph><paragraph id="H6B4E7A747662487AB8C7AB21DDE6AB77"><enum>(3)</enum><text>in the third sentence by striking <quote>, except that the maximum civil penalty shall not exceed $15,000,000 for any related series of violations</quote>.</text></paragraph></subsection><subsection id="H3E9D693E6C6F4D5482BD9A9AB58A7C3D"><enum>(b)</enum><header>Adjustment for inflation</header><text>Section 20(a)(3) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(a)(3)</external-xref>) is amended—</text><paragraph id="H324B18C9DC38492A8C61DF58858D74FA"><enum>(1)</enum><text>by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HFAE94E0FFB6F4831B422F7C7BBC8D183"><subsection id="HA8FEFCA412674ED0833FD6FAF5C48ECA"><enum>(B)</enum><text>Not later than one year after the date of enactment of this subparagraph, and not later than January 15 of every year thereafter, the Commission shall—</text><paragraph id="H3844F598DB4B47D0A8A7BF402A30012A"><enum>(i)</enum><text>in accordance with subparagraph (C), determine the inflation adjusted maximum civil penalty for an individual violation; and</text></paragraph><paragraph id="HB3903931A7C34741A255D7168B708392"><enum>(ii)</enum><text>publish each such inflation adjusted maximum civil penalty for an individual violation in the Federal Register.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H7F85999D6CB7447E8C18DE6CA8831988"><enum>(2)</enum><text>by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9482BDA12D71418ABF00529C6CCC8AF1"><subsection id="HD32FD49AB63B4B9FAECC8111B3311D47"><enum>(C)(i)</enum><text>The Commission shall adjust civil penalties in accordance with this subparagraph and shall make such adjustment notwithstanding section 553 of title 5, United States Code.</text></subsection><subsection id="HA2E117A53CB345C4B5C4C8FE73EB834E"><enum>(ii)</enum><text>The inflation adjusted maximum civil penalty for the purposes of subparagraph (B) shall be determined by increasing the prior year maximum civil monetary penalty by the cost-of-living adjustment. Any increase determined under this subparagraph shall be rounded to the nearest multiple of $1.</text></subsection><subsection id="HCE8426B2F2C2497B9EBB418891761F9E"><enum>(iii)</enum><text>For purposes of this subparagraph—</text><paragraph commented="no" display-inline="no-display-inline" id="H670933D00A8C4C02BD0A232FB60030C7"><enum>(I)</enum><text display-inline="yes-display-inline">the term <term>cost-of-living adjustment</term> means the percentage (if any) by which—</text><subparagraph commented="no" display-inline="no-display-inline" id="H671A738A6F80458D8188794F6E98422C"><enum>(aa)</enum><text display-inline="yes-display-inline">the Consumer Price Index for the month of October preceding the date of the adjustment; exceeds</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H269766AD2F7E415EAD3E4956326EA6DA"><enum>(bb)</enum><text display-inline="yes-display-inline">the Consumer Price Index for the month of October 1 one year before the month of October referred to in item (aa); and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD73D480A26334E3D97E6BD0448018144"><enum>(II)</enum><text>the term <term>Consumer Price Index</term> means the Consumer Price Index for all-urban consumers published by the Department of Labor.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H83C4FBA7C9D14E5AB1C13F65213AA8CE"><enum>(iv)</enum><text>If the civil penalty subject to a cost-of-living adjustment is, during the 12 months preceding a required cost-of-living adjustment, increased by law by an amount greater than the amount of the adjustment required under subparagraph (B), the Commission is not required to make the cost-of-living adjustment otherwise required for that year.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H7984DCB374A24BC1A8A58517684B2E60"><enum>(3)</enum><text>by striking subparagraph (D).</text></paragraph></subsection><subsection id="H6FE377BEBC4C4834B5FCADFC1CABD238"><enum>(c)</enum><header>Technical amendment</header><text>Section 20(c) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(c)</external-xref>) is amended, in the second sentence, by striking <quote>including, the</quote> and inserting <quote>including the</quote>.</text></subsection><subsection id="HC1DE2E342F6D48A5AA2619123D853907"><enum>(d)</enum><header>Technical amendment</header><text>Section 20(d) of the Consumer Product Safety Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2069">15 U.S.C. 2069(d)</external-xref>) is amended, in the first sentence, by striking <quote>man</quote> and inserting <quote>person</quote>.</text></subsection></section></legis-body></bill>
