R. 7080</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240125">January 25, 2024</action-date><action-desc><sponsor name-id="C001054">Mr. Carl</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reinstate pre-pandemic telework policies of Executive agencies, and for other purposes.</official-title></form><legis-body id="HF5867624B6714B31973BCDC71A6611EA" style="OLC"><section id="HAEB822B31CFF4CB89457C7988907B840" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Earn Your Keep Act</short-title></quote>. </text></section><section id="H879BF0913ADB407E8B8BBB662E5FF9BB"><enum>2.</enum><header>Reinstatement of pre-pandemic Executive agency telework policies</header><subsection id="H92B16CC820C54BEF9B602A188EA6056F"><enum>(a)</enum><header>In general</header><text>Not later than 30 days after the date of enactment of this Act, the head of each Executive agency shall reinstate the telework policies in use by such Executive agency on December 31, 2019.</text></subsection><subsection id="H289B444BC9234C76B32EA43624BB93D1"><enum>(b)</enum><header>Rule of construction</header><text>Beginning on the date that the head of an Executive agency reinstates the telework policy under subsection (a), such policy shall apply in place of any other provision of a teleworking, collective bargaining, or other employment agreement of such Executive agency to the extent that such other provision conflicts with the policy so reinstated.</text></subsection><subsection id="HBEEB5D523B7F4CCFA9FEEBA1732CEFC0"><enum>(c)</enum><header>Removal</header><text>Notwithstanding any other provision of law, any employee of an Executive agency who does not comply with a reinstated telework policy under subsection (a) shall be removed from the civil service, and the position formerly occupied by such employee shall be eliminated.</text></subsection><subsection id="H08C11C2348634C1591FADFE0AF65E80C"><enum>(d)</enum><header>GAO study</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Comptroller General shall submit a report to Congress analyzing, with respect to any employee of Executive agencies who were teleworking during the COVID–19 pandemic—</text><paragraph id="HA8A12CD0ACB74E8E8600F62575C1D62F"><enum>(1)</enum><text>the rate of locality pay (if any) paid to such employee; and</text></paragraph><paragraph id="HF67E2148393F44CFBF0FA93CA34B9B9B"><enum>(2)</enum><text>the geographic location of the teleworking work site of the employee.</text></paragraph></subsection><subsection id="H94FFB5E9595D448CAA55DEA40CECFFD9"><enum>(e)</enum><header>Definitions</header><text>In this section—</text><paragraph id="HF32DC389039C41D08E490BDDC9311A0D"><enum>(1)</enum><text>the term <quote>Executive agency</quote> has the meaning given such term in section 105 of title 5, United States Code;</text></paragraph><paragraph id="H29134F99421C484CBCCE8140D2122751"><enum>(2)</enum><text>the term <quote>locality pay</quote> means locality pay under section 5304 or 5304a of such title; and </text></paragraph><paragraph id="H01F91A1541584B099FE30EBCD924788F"><enum>(3)</enum><text>the term <quote>telework</quote> and <quote>teleworking</quote> have the meaning given those terms in section 6501 of such title, and includes remote work.</text></paragraph></subsection></section></legis-body></bill>
