which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To expand the categories of forfeited property available to remediate harms to Ukraine from Russian aggression, and for other purposes.</official-title></form><legis-body id="H3F774DF712034B31B76D01FC539331F3" style="OLC"><section id="H5121BD7171CA4C5782B0E51069F42A4D" section-type="section-one"><enum>1.</enum><header>Expansion of forfeited property available to remediate harms to ukraine from russian aggression</header><subsection id="H1E90FC07B2654944923981A14AAA64AF"><enum>(a)</enum><header>In general</header><text>Section 1708 of the Additional Ukraine Supplemental Appropriations Act, 2023 (division M of <external-xref legal-doc="public-law" parsable-cite="pl/117/328">Public Law 117–328</external-xref>) is amended—</text><paragraph id="HCFBB3E3E944F42FC9925BF064C3FCFBE"><enum>(1)</enum><text>in subsection (a), by inserting <quote>from any forfeiture fund</quote> after <quote>The Attorney General may transfer</quote>; and</text></paragraph><paragraph id="HEEEB9CF10E81479CB695367E20AF678B"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H683AB4640FE4476B904ED090048C5795"><enum>(A)</enum><text>in paragraph (2), by striking <quote>which property belonged</quote> and all that follows and inserting the following: </text><quoted-block id="HB4D700CE43B541ADA7BD9F6CE07DA79C" style="OLC" display-inline="yes-display-inline"><text>which property—</text><subparagraph id="HD0413AA3FDEC4BFF98E44DF0E87459A0"><enum>(A)</enum><text>belonged to, was possessed by, or was controlled by a person the property or interests in property of which were blocked pursuant to any covered legal authority;</text></subparagraph><subparagraph id="HC8EB69D4FE664C9DAB332276DEAC12A8"><enum>(B)</enum><text>was involved in an act in violation of, or a conspiracy or scheme to violate or cause a violation of—</text><clause id="H6D61B0C586884953AE52452F20A0E81D"><enum>(i)</enum><text>any covered legal authority; or</text></clause><clause id="H872423504F6341918E66D6756967A27A"><enum>(ii)</enum><text>any restriction on the export, reexport, or in-country transfer of items imposed by the United States under the Export Administration Regulations, or any restriction on the export, reexport, or retransfer of defense articles under the International Traffic in Arms Regulations under subchapter M of chapter I of title 22, Code of Federal Regulations, with respect to—</text><subclause id="HCB64255EE9DD4AB88A95047627E78131"><enum>(I)</enum><text>the Russian Federation, Belarus, the Crimea region of Ukraine, or the so-called Donetsk and Luhansk People’s Republic regions of Ukraine;</text></subclause><subclause id="HEA78DA3723AB4DA3854EEA5E1703AF10"><enum>(II)</enum><text>any person in any such country or region on a restricted parties list; or</text></subclause><subclause id="H62AE621EB87D4DBDA8248B9ED5B48DFA"><enum>(III)</enum><text>any person located in any other country that has been added to a restricted parties list in connection with the malign conduct of the Russian Federation in Ukraine, including the annexation of the Crimea region of Ukraine in March 2014 and the invasion beginning in February 2022 of Ukraine, as substantially enabled by Belarus; or</text></subclause></clause></subparagraph><subparagraph id="HBFE5D9A9B97842C7B69908C4BECE55BB"><enum>(C)</enum><text>was involved in any related conspiracy, scheme, or other Federal offense arising from the actions of, or doing business with or acting on behalf of, the Russian Federation, Belarus, or the Crimea region of Ukraine, or the so-called Donetsk and Luhansk People’s Republic regions of Ukraine.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H3D9A134CC2B74178AA6CD2DFC7183C26"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block id="HA7ED2FE29FEB4EC6A8D49872252CE0C5" style="OLC"><paragraph id="H2FBA3074DD1D4DC5B0C075FD2B20EA8E"><enum>(3)</enum><text>The term <quote>covered legal authority</quote> means any license, order, regulation, or prohibition imposed by the United States under the authority provided by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) or any other provision of law, with respect to—</text><subparagraph id="H7DF0112ECF7E410B880DBBF616945C65"><enum>(A)</enum><text>the Russian Federation;</text></subparagraph><subparagraph id="H2C19CC46D5934C5F9D253892B68352A3"><enum>(B)</enum><text>the national emergency—</text><clause id="HBBDED32443254CF4B5397F8F5D80F3BD"><enum>(i)</enum><text>declared in Executive Order 13660 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of certain persons contributing to the situation in Ukraine);</text></clause><clause id="H99775F5D11B343A1801F9FCEC841BD31"><enum>(ii)</enum><text>expanded by—</text><subclause id="HEF29B762972E4E6D9D8EF3F0EDB6900A"><enum>(I)</enum><text>Executive Order 13661 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of additional persons contributing to the situation in Ukraine); and</text></subclause><subclause id="HCA8E708DFD774D9BB8FD4CE378AD994C"><enum>(II)</enum><text>Executive Order 13662 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of additional persons contributing to the situation in Ukraine); and</text></subclause></clause><clause id="H5F11A0A285A04127AFC0E9C112894D39"><enum>(iii)</enum><text>relied on for additional steps taken in Executive Order 13685 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property of certain persons and prohibiting certain transactions with respect to the Crimea region of Ukraine);</text></clause></subparagraph><subparagraph id="H5F33E88C8A044F349EBC38BC4E0F7F4A"><enum>(C)</enum><text>the national emergency, as it relates to the Russian Federation—</text><clause id="H57514926F2044F84B9CE73F555A088E9"><enum>(i)</enum><text>declared in Executive Order 13694 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking the property of certain persons engaging in significant malicious cyber-enabled activities); and</text></clause><clause id="H41B6EF5BC27C4D4CA93E1351F7A6F7B0"><enum>(ii)</enum><text>relied on for additional steps taken in Executive Order 13757 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to taking additional steps to address the national emergency with respect to significant malicious cyber-enabled activities);</text></clause></subparagraph><subparagraph id="HD5279F4A83184697ABFA3A38954566EE"><enum>(D)</enum><text>the national emergency—</text><clause id="HCAF7380D779545A9B25B2FB2FC7DDC17"><enum>(i)</enum><text>declared in Executive Order 14024 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to blocking property with respect to specified harmful foreign activities of the Government of the Russian Federation);</text></clause><clause id="HCE2729DB6676421ABCCFBECA12DCBF84"><enum>(ii)</enum><text>expanded by Executive Order 14066 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to prohibiting certain imports and new investments with respect to continued Russian Federation efforts to undermine the sovereignty and territorial integrity of Ukraine); and</text></clause><clause id="HC6B94917E471415E80C34245F5570617"><enum>(iii)</enum><text>relied on for additional steps taken in—</text><subclause id="H1D813CBBB2D741949C5BF81534DB5EEF"><enum>(I)</enum><text>Executive Order 14039 (<external-xref legal-doc="usc" parsable-cite="usc/22/9526">22 U.S.C. 9526</external-xref> note; relating to blocking property with respect to certain Russian energy export pipelines);</text></subclause><subclause id="HC0CEC22F06684C8FBCB0915A6259B85F"><enum>(II)</enum><text>Executive Order 14068 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to prohibiting certain imports, exports, and new investment with respect to continued Russian Federation aggression); and</text></subclause><subclause id="HCEA13B8255F14F6BA737CC701BE141D0"><enum>(III)</enum><text>Executive Order 14071 (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701</external-xref> note; relating to prohibiting new investment in and certain services to the Russian Federation in response to continued Russian Federation aggression); and</text></subclause></clause><clause id="HCBBB54F5052D4CC2A28EE281104AB6E0"><enum>(iv)</enum><text>which may be expanded or relied on in future Executive orders; or</text></clause></subparagraph><subparagraph id="H469E8DD03E164BA5BDCC515AA82C0EA0"><enum>(E)</enum><text>actions or policies that undermine the democratic processes and institutions in Ukraine or threaten the peace, security, stability, sovereignty, or territorial integrity of Ukraine.</text></subparagraph></paragraph><paragraph id="HFC13D48D5CEC49F7B8C8078AE6AE8C2D"><enum>(4)</enum><text>The term <quote>Export Administration Regulations</quote> has the meaning given that term in section 1742 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref>).</text></paragraph><paragraph id="HC378386054AF41AD95C3807CE6574CBC"><enum>(5)</enum><text>The term <quote>restricted parties list</quote> means any of the following lists maintained by the Bureau of Industry and Security:</text><subparagraph id="H2C625993D17A40B0B4B2EB3DD699ECD5"><enum>(A)</enum><text>The Entity List set forth in Supplement No. 4 to part 744 of the Export Administration Regulations.</text></subparagraph><subparagraph id="HC090E2798A0D44E09DD749CD8AEB0DF1"><enum>(B)</enum><text>The Denied Persons List maintained pursuant to section 764.3(a)(2) of the Export Administration Regulations.</text></subparagraph><subparagraph id="H17A866B6F1614C7DBE349A5CD472EE29"><enum>(C)</enum><text>The Unverified List set forth in Supplement No. 6 to part 744 of the Export Administration Regulations.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HE706BECA0CBE4838A5571B2D76BCFB70"><enum>(b)</enum><header>Semiannual reports</header><text>Such section is further amended—</text><paragraph id="HAACE2DD570854422940C17C2934BA9F4"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="H30E1DB78F7714FD5A90AB583D4082EE8"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block id="HD3267F9575234E5FB2637F6EEE9DC0DD" style="OLC"><subsection id="H1DEE2E30E4874808983FA6A4F9877F11"><enum>(c)</enum><text>Not later than 180 days after the date of the enactment of this Act, and every 180 days thereafter, the Secretary of State, in consultation with the Attorney General and the Secretary of the Treasury, shall submit to the appropriate congressional committees a report on progress made in remediating the harms of Russian aggression toward Ukraine as a result of transfers made under subsection (a).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H914CB55082C9463E9DF92493FDD3367B"><enum>(c)</enum><header>Plan required</header><paragraph id="HF7E84987EE774B8AB1597E817AC4C900"><enum>(1)</enum><header>In general</header><text>Not later than 30 days after the date of the enactment of this Act, the Attorney General, in consultation with the Secretary of the Treasury and the Secretary of State, shall submit to the appropriate congressional committees a plan for using the authority provided by section 1708 of the Additional Ukraine Supplemental Appropriations Act, 2023, as amended by this section.</text></paragraph><paragraph id="H364D091A5E304774B6157DE106CA23BD"><enum>(2)</enum><header>Appropriate congressional committees defined</header><text>In this section, the term <quote>appropriate congressional committees</quote> has the meaning given that term by section 1708 of the Additional Ukraine Supplemental Appropriations Act, 2023, as amended by this section.</text></paragraph></subsection></section></legis-body></bill>
