which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><action display="yes"><action-date date="20240206">February 6, 2024</action-date><action-desc>Reported with amendments, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction><action-instruction>For text of introduced bill, see copy of bill as introduced on January 17, 2024</action-instruction></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 404 of the Federal Water Pollution Control Act to codify certain regulatory provisions relating to nationwide permits for dredged or fill material, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" changed="added" style="OLC" committee-id="HPW00" reported-display-style="italic" id="HEAB846CDC8A940368A522DB602AEA135"><section id="H8D529B70B8D84478A86AF68BB1F1BFFE" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Creating Confidence in Clean Water Permitting Act</short-title></quote>.</text></section><section id="HA8C9342E85D14B96A3475E6E886866F0" section-type="subsequent-section"><enum>2.</enum><header>Water quality criteria development and transparency</header><subsection id="HD093EA6F4C9143CFABA5C20D955295BC"><enum>(a)</enum><header>Information and guidelines</header><text>Section 304(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1314">33 U.S.C. 1314(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H3AF7B7C1AEFE499CA613EFF85D8CA10A" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H5A334102F2F64DA4B1F034491AC62956"><enum>(10)</enum><header>Administrative procedure</header><text display-inline="yes-display-inline">After the date of enactment of this paragraph, the Administrator shall issue any new or revised water quality criteria under paragraph (1) or (9) by rule.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA2116BBA35E24046BFA0CC8E0EA1E538"><enum>(b)</enum><header>Administrative procedure and judicial review</header><text>Section 509(b)(1) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1369">33 U.S.C. 1369(b)(1)</external-xref>) is amended—</text><paragraph id="H851CB1BEF4F04599AFCAB98FE1AA10A2"><enum>(1)</enum><text>by striking <quote>section 402, and</quote> and inserting <quote>section 402,</quote>; and</text></paragraph><paragraph id="H5E98D1BAAF4E40BFB2DE7191F4E8FF85"><enum>(2)</enum><text>by inserting <quote>and (H) in issuing any criteria for water quality pursuant to section 304(a)(10),</quote> after <quote>strategy under section 304(l),</quote>.</text></paragraph></subsection></section><section id="H318DA96596DE47CA969D8987BF2F3A76" commented="no"><enum>3.</enum><header>Federal general permits</header><text display-inline="no-display-inline">Section 402(a) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC4DDC5834F06442FBDECCEFF8D60EFCF" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H550BAC1F9C7F40E4BB6DC36EDBB1CC6B" indent="up1" commented="no"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HDBABD515BF78428C94AE3F1CE63369BA"><enum>(A)</enum><text>The Administrator is authorized to issue general permits under this section for discharges of similar types from similar sources.</text></subparagraph><subparagraph id="H9DB6620A670640D283887DF7D036FAEF" indent="up1" commented="no"><enum>(B)</enum><text>The Administrator may require submission of a notice of intent to be covered under a general permit issued under this section, including additional information that the Administrator determines necessary. </text></subparagraph><subparagraph id="HCA8A9D747F1E44F6839047EB20819409" indent="up1" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">If a general permit issued under this section will expire and the Administrator decides not to issue a new general permit for discharges similar to those covered by the expiring general permit, the Administrator shall publish in the Federal Register a notice of such decision at least two years prior to the expiration of the general permit.</text></subparagraph><subparagraph id="H7BA2104DC6B8497D9CB36DE501A1C6F3" indent="up1" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">If a general permit issued under this section expires and the Administrator has not published a notice in accordance with subparagraph (C), until such time as the Administrator issues a new general permit for discharges similar to those covered by the expired general permit, the Administrator shall—</text><clause id="H6553B1DF9626414084CA5190FA559765" commented="no"><enum>(i)</enum><text>continue to apply the terms, conditions, and requirements of the expired general permit to any discharge that was covered by the expired general permit; and</text></clause><clause id="HD9B301713B4047A8948F2AF8738FE9A8" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">apply such terms, conditions, and requirements to any discharge that would have been covered by the expired general permit (in accordance with any relevant requirements for such coverage) if the discharge had occurred before such expiration.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H6F03D19581A141DB895A8AC89F2CB0B9" section-type="subsequent-section"><enum>4.</enum><header>Confidence in clean water permits</header><subsection id="HB3E35535C76E47BA9024614397998736"><enum>(a)</enum><header>Compliance with permits</header><text>Section 402(k) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342(k)</external-xref>) is amended—</text><paragraph id="HB12A20C24DB049B6997D9231AE8E667B"><enum>(1)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(k) </enum-in-header></header-in-text>Compliance with</quote> and inserting the following:</text><quoted-block style="OLC" id="HA78E0567C3D24012888565B58ADBDF42" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H23B57D842B0E488C8A31B4E21D089079"><enum>(k)</enum><header>Compliance with permits</header><paragraph id="H3303D89091B8466F981FA89081D184CC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), compliance with</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H6D79B37E1F3D4B36A426E218CB94D680"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H5CD7E010A86541AA8BAD6F5D9B6EABAD" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H3AF6D4E9E65645CBB1BA73B08939CB90"><enum>(2)</enum><header>Scope</header><text display-inline="yes-display-inline">For purposes of paragraph (1), compliance with the conditions of a permit issued under this section shall be considered compliance with respect to a discharge of—</text><subparagraph id="H3E05056B79914AC0BD1D70AA7FBDF924"><enum>(A)</enum><text display-inline="yes-display-inline">any pollutant for which an effluent limitation is included in the permit; and</text></subparagraph><subparagraph id="H3F01627946F040BE977A62775EA3231D"><enum>(B)</enum><text display-inline="yes-display-inline">any pollutant for which an effluent limitation is not included in the permit that is—</text><clause id="H5F7355EF2B2849009C4557E8C42C2461"><enum>(i)</enum><text>specifically identified as controlled or monitored through indicator parameters in the permit, the fact sheet for the permit, or the administrative record relating to the permit;</text></clause><clause id="H55B53947D77646DBA9BB4847E90DFB01"><enum>(ii)</enum><text>specifically identified during the permit application process as present in discharges to which the permit will apply; or</text></clause><clause id="H64CB7905917E4597A82BC1AC439B11A2" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">whether or not specifically identified in the permit or during the permit application process—</text><subclause id="HBB0B0FA0CC1E405C867E9E9090FB774D" commented="no"><enum>(I)</enum><text>present in any waste streams or processes of the point source to which the permit applies, which waste streams or processes are specifically identified during the permit application process; or</text></subclause><subclause id="H45C886A7D3874488AC5B3AED21EBBA29" commented="no"><enum>(II)</enum><text display-inline="yes-display-inline">otherwise within the scope of any operations of the point source to which the permit applies, which scope of operations is specifically identified during the permit application process.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8E0D4CCF76244EAA9A5440D4601F317B"><enum>(b)</enum><header>Expression of water quality-based effluent limitations</header><text>Section 402 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1342">33 U.S.C. 1342</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H04205A34EC0540138B3AA5D3A5EB08DE" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HC125BF92C31F4FE1A736A41AA913392C"><enum>(t)</enum><header>Expression of water quality-based effluent limitations</header><text display-inline="yes-display-inline">If the Administrator (or a State, in the case of a permit program approved by the Administrator) determines that a water quality-based limitation on a discharge of a pollutant is necessary to include in a permit under this section in addition to any appropriate technology-based effluent limitations included in such permit, the Administrator (or the State) may include such water quality-based limitation in such permit only in the form of an effluent limitation that specifies—</text><paragraph id="HD908C36D0A3447E9A8EE2BFE7BABB559"><enum>(1)</enum><text>the pollutant to which it applies; and</text></paragraph><paragraph id="HF8592B4A638E43CFBEEA3685ABA7F5A9" commented="no"><enum>(2)</enum><text>the numerical limit on the discharge of such pollutant, or the precise waterbody conditions to be attained with respect to such pollutant, required to comply with the permit.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></subsection></section><section id="HAC578115CF1A4473860C301E5B01607A"><enum>5.</enum><header>Reducing permitting uncertainty</header><subsection id="H635E9B166F8E44B7BB9E81A3A23F777A"><enum>(a)</enum><header>In general</header><text>Section 404(c) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344(c)</external-xref>) is amended—</text><paragraph id="H54A303830ED34FC79C03C537BCDD8273"><enum>(1)</enum><text>by striking <quote>(c) The Administrator</quote> and inserting the following:</text><quoted-block style="OLC" id="HB243C2D9FAC64E03A268DAC838EEF440" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H587E2476A56A41D0A81476EE5C9F65C5"><enum>(c)</enum><header>Specification or use of defined area</header><paragraph id="H8A954686933A4B369D23986DD588CFA0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HD6DB589C4EB140FF8D1B54E71F4DD398"><enum>(2)</enum><text>in paragraph (1), as so designated, by inserting <quote>during the period described in paragraph (2) and</quote> before <quote>after notice and opportunity for public hearings</quote>; and</text></paragraph><paragraph id="HB9D3EF56A3DF42E385214D8BA63DEB4B"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H1AF1CE6A3BA64E069598C69995F961C6" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H6C5BB19F67754C2B98FBD78EF67F0574"><enum>(2)</enum><header>Period of prohibition</header><text display-inline="yes-display-inline">The period during which the Administrator may prohibit the specification (including the withdrawal of specification) of any defined area as a disposal site, or deny or restrict the use of any defined area for specification (including the withdrawal of specification) as a disposal site, under paragraph (1) shall—</text><subparagraph id="H31BBD2055BC146338D7D5C3400C00F7C"><enum>(A)</enum><text display-inline="yes-display-inline">begin on the date on which an applicant submits all the information required to complete an application for a permit under this section; and</text></subparagraph><subparagraph id="H5CB107F36B524946ADB158004443D35D"><enum>(B)</enum><text>end on the date on which the Secretary issues the permit.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFEA4BA89B88C4F679787109056F38A66" display-inline="no-display-inline"><enum>(b)</enum><header>Applicability</header><text>The amendments made by subsection (a) shall apply to a permit application submitted under section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) after the date of enactment of this Act.</text></subsection></section><section id="HD956478C838647D4890721FB7A512AE6" section-type="subsequent-section"><enum>6.</enum><header>Nationwide permitting improvement</header><subsection id="HEB7C0FE206534E5F96AA1BAF098664D5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 404(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended—</text><paragraph id="H29ADC7D4843D4789964CD48403775EF6"><enum>(1)</enum><text>by striking <quote>(e)(1) In carrying</quote> and inserting the following: </text><quoted-block style="OLC" id="H5ABBAA2060134D48B6DEE17C2E44792D" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="HE3AD874A2E6641DBAFA5DDF70AF5BB74"><enum>(e)</enum><header>General permits on State, regional, or nationwide basis</header><paragraph id="H12CBA0938492401BA58479ECC9604F13"><enum>(1)</enum><header>Permits authorized</header><text display-inline="yes-display-inline">In carrying</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H2F5FBE7E90C14387BB44576828F3FDFC"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H2D694CA57691410987CB1CCC084FD5CA"><enum>(A)</enum><text>by striking <quote>(2) No general</quote> and inserting the following: </text><quoted-block style="OLC" id="H0625AA849A8245649151807B3D19C62A" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H1C57488309EF49D6952773A05FE8AE60"><enum>(2)</enum><header>Term</header><text display-inline="yes-display-inline">No general</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H9883EB7233BF4435BCF69F829B79D9CE"><enum>(B)</enum><text>by striking <quote>five years</quote> and inserting <quote>ten years</quote>; and </text></subparagraph></paragraph><paragraph id="H80AFBE5EFADE41FAB2566B4FC8863B2F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HC0E1D90D69CB4A7C8E78E27985A8CD09" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><paragraph id="H54D19FC2A305429E8FC84643595F7B72"><enum>(3)</enum><header>Considerations</header><text display-inline="yes-display-inline">In determining the environmental effects of an activity under paragraph (1) or (2), the Secretary shall consider only the effects of any discharge of dredged or fill material resulting from such activity.</text></paragraph><paragraph id="H643D9745C3864F2B92521500877A5D31"><enum>(4)</enum><header>Nationwide permits for linear infrastructure projects</header><subparagraph id="HF79B434A45C84ADCBABC52E2445D0661"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, the Secretary shall maintain general permits on a nationwide basis for linear infrastructure projects that do not result in the loss of greater than 1/2-acre of waters of the United States for each single and complete project (as defined in section 330.2 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this paragraph)).</text></subparagraph><subparagraph id="H138A2931960D479E8FB630C77BD36C1E"><enum>(B)</enum><header>Definition of linear infrastructure project</header><text display-inline="yes-display-inline">In this paragraph, the term <term>linear infrastructure project</term> means a project to carry out any activity required for the construction, expansion, maintenance, modification, or removal of infrastructure and associated facility for the transmission from a point of origin to a terminal point of communications or electricity or the transportation from a point of origin to a terminal point of people, water, wastewater, carbon dioxide, or fuel or hydrocarbons (in the form of a liquid, liquescent, gaseous, or slurry substance or supercritical fluid), including oil and gas pipeline facilities.</text></subparagraph></paragraph><paragraph id="H729994B897A14758AF3816BC7CFAF8C6"><enum>(5)</enum><header>Reissuance of nationwide permits</header><text display-inline="yes-display-inline">In determining whether to reissue a general permit issued under this subsection on a nationwide basis—</text><subparagraph id="HAB59474E2975423EA633D6BC3A718F96"><enum>(A)</enum><text>no consultation with an applicable State pursuant to section 6(a) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1535">16 U.S.C. 1535(a)</external-xref>) is required;</text></subparagraph><subparagraph id="HA586B825CDCF495EA539D4AACAD42EF0"><enum>(B)</enum><text>no consultation with a Federal agency pursuant to section 7(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) is required; and</text></subparagraph><subparagraph id="H4ACC8366E9714DB59EA1FEB640F549D3"><enum>(C)</enum><text display-inline="yes-display-inline">the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) shall be satisfied by preparing an environmental assessment with respect to such general permit.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB0EC58E8F19B464A9B7E4A537DE1EB39"><enum>(b)</enum><header>Administration of nationwide permit program</header><text display-inline="yes-display-inline">In carrying out section 404(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>), the Secretary of the Army, acting through the Chief of Engineers, may not finalize or implement any modification to—</text><paragraph id="HAA132428805D4C948719B2DA46829D8A"><enum>(1)</enum><text display-inline="yes-display-inline">general condition 15 (relating to single and complete projects), as included in the final rule titled <quote>Reissuance and Modification of Nationwide Permits</quote> and published on January 13, 2021, by the Department of the Army, Corps of Engineers (86 Fed. Reg. 2868); </text></paragraph><paragraph id="HDC68DBFD5A564CFCBFAB601DC09A55E2"><enum>(2)</enum><text>the definition of single and complete linear project, as included in such final rule (86 Fed. Reg. 2877); or</text></paragraph><paragraph id="H640D4044D6C24B15AAA58B3220144CA8"><enum>(3)</enum><text display-inline="yes-display-inline">the definition of single and complete project, as included in section 330.2 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph></subsection></section><section id="H543BCD92869F4F9C9F840A1A68527D67" section-type="subsequent-section"><enum>7.</enum><header>Judicial review timeline clarity</header><text display-inline="no-display-inline">Section 404 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended—</text><paragraph id="H27BF49BE1D574C0A86D02E903B99ADC2"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (t) as subsection (u);</text></paragraph><paragraph id="H30732A3175094B1BAADE1D68FB22B867"><enum>(2)</enum><text>in subsection (u), as so redesignated, by striking <quote>Nothing in the section</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Savings provision.—</header-in-text>Nothing in this section</quote>; and </text></paragraph><paragraph id="H2EACC4E37A714E868E7CEDF47555663C"><enum>(3)</enum><text>by inserting after subsection (s) the following:</text><quoted-block style="OLC" id="H872D18B3DD164FFC886A7D0C8EDAD515" display-inline="no-display-inline" changed="added" reported-display-style="italic" committee-id="HPW00"><subsection id="H0956FFB622234A0E893B2EEC0C65DD10"><enum>(t)</enum><header>Judicial review</header><paragraph id="H7F172522BA2C4A42ADC1E47F9E76BD40"><enum>(1)</enum><header>Statute of limitations</header><subparagraph id="HD586416B6E41402AA673974F10E2753D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any applicable provision of law relating to statutes of limitations, an action seeking judicial review of—</text><clause id="H8FB2241C6FC74FF7B265CF1406D30316"><enum>(i)</enum><text>an individual or general permit issued under this section shall be filed not later than the date that is 60 days after the date on which the permit was issued; and</text></clause><clause id="H95308D790AF24129A0148ADB55244672"><enum>(ii)</enum><text display-inline="yes-display-inline">verification that an activity is authorized by a general permit issued under this section shall be filed not later than the date that is 60 days after the date on which such verification was issued. </text></clause></subparagraph><subparagraph id="HE5841C82B61D43D0BC13A09F7DF63699"><enum>(B)</enum><header>Savings provision</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) may be construed to authorize an action seeking judicial review of the structure of, or authorization for, a State permit program approved pursuant to this section.</text></subparagraph></paragraph><paragraph id="H4DB1499298794D1E95CF70068482FA36" commented="no"><enum>(2)</enum><header>Limitation on commencement of certain actions</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no action described in paragraph (1)(A) may be commenced unless the action—</text><subparagraph id="H6027A0DD214F4659A5D975297C0DE636" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">is filed by a party that submitted a comment, during the public comment period for the administrative proceedings related to the applicable action described in such paragraph, which comment was sufficiently detailed to put the Secretary or the State, as applicable, on notice of the issue upon which the party seeks judicial review; and</text></subparagraph><subparagraph id="HD76C0937091F4E6FA82D920AED8610D0" commented="no"><enum>(B)</enum><text>is related to such comment.</text></subparagraph></paragraph><paragraph id="H848ED5C16170464F90497CA94DBA14E4"><enum>(3)</enum><header>Remedy</header><text display-inline="yes-display-inline">If a court determines that the Secretary or the State, as applicable, did not comply with the requirements of this section in issuing an individual or general permit under this section, or in verifying that an activity is authorized by a general permit issued under this section, as applicable—</text><subparagraph id="HE0D7213E57D14986BB172918247FC2E9"><enum>(A)</enum><text>the court shall remand the matter to the Secretary or the State, as applicable, for further proceedings consistent with the court’s determination; </text></subparagraph><subparagraph id="HAC79FD2CEA6746B188F00F8517346AAC"><enum>(B)</enum><text display-inline="yes-display-inline">with respect to a determination regarding the issuance of an individual or general permit under this section, the court may not vacate, revoke, enjoin, or otherwise limit the permit, unless the court finds that activities authorized under the permit would present an imminent and substantial danger to human health or the environment for which there is no other equitable remedy available under the law; and</text></subparagraph><subparagraph id="HADA49E90C105435A96BCBCDB3EB868F0" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">with respect to a determination regarding a verification that an activity is authorized by a general permit issued under this section, the court may not enjoin the activity, unless the court finds that the activity would present an imminent and substantial danger to human health or the environment for which there is no other equitable remedy available under the law. </text></subparagraph></paragraph><paragraph id="H420E47C5925B4424874017A22C83D50E"><enum>(4)</enum><header>Timeline to act on court order</header><text>If a court remands a matter under paragraph (2), the court shall set and enforce a reasonable schedule and deadline, which may not exceed 180 days from the date on which the court remands such matter, except as otherwise required by law, for the Secretary or the State, as applicable, to take such actions as the court may order.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></section><section id="H4242404B3D3843F084BC7CBE726E32A2" commented="no"><enum>8.</enum><header>Implementation guidance</header><subsection id="HAF3E84136C1540849078BB82797B06F5" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency and the Secretary of the Army, acting through the Chief of Engineers, shall begin a process to issue guidance on the implementation of the final rule published on September 8, 2023, by the Department of the Army, Corps of Engineers, Department of Defense and the Environmental Protection Agency and titled <quote>Revised Definition of <quote>Waters of the United States</quote>; Conforming</quote> (88 Fed. Reg. 61964).</text></subsection><subsection id="H5AE4A6899F6C487C838BB6BDF74A6F0E" commented="no"><enum>(b)</enum><header>Public comment</header><text>In issuing the guidance required under subsection (a), the Administrator and the Secretary shall—</text><paragraph id="H113954A342D14F9091089CE2268D683B" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">prior to such issuance, solicit comments from the public on such guidance; and</text></paragraph><paragraph id="H89C0C5CDDF9943CA8E31C33DF1A6E737" commented="no"><enum>(2)</enum><text>ensure that such comments and any responses to such comments are made publicly available.</text></paragraph></subsection><subsection id="H0DF240D1FA57475897600E818BDFE0EB" commented="no"><enum>(c)</enum><header>Compliance</header><text display-inline="yes-display-inline">Any guidance issued pursuant to this section shall comply with the decision of the Supreme Court in <italic>Sackett v.
