which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend section 404 of the Federal Water Pollution Control Act to codify certain regulatory provisions relating to nationwide permits for dredged or fill material, and for other purposes.</official-title></form><legis-body id="H9501173BE4814D63A0C7BF088076554F" style="OLC"><section id="HA53AE1DF32A94F3FBFECCFEBC7EF34ED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Nationwide Permitting Improvement Act</short-title></quote>.</text></section><section id="H09012C0CD5E348F299A88026DC1E4A0F" section-type="subsequent-section"><enum>2.</enum><header>Permits for dredged or fill material</header><subsection id="HF1F40B52ECC3426386821DFB45D1D331"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 404(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>) is amended—</text><paragraph id="H7554A1777F66455CBCA281FCF7124EB4"><enum>(1)</enum><text>by striking <quote>(e)(1) In carrying</quote> and inserting the following: </text><quoted-block style="OLC" id="HAC7D64F13453462D82A9BFC6961F9A5A" display-inline="no-display-inline"><subsection id="H521A1B9C9A9C40A9B8149B0E794B0BE5"><enum>(e)</enum><header>General permits on State, regional, or nationwide basis</header><paragraph id="H6CD58C7CDE0A42778A439AE0FF643CD9"><enum>(1)</enum><header>Permits authorized</header><text display-inline="yes-display-inline">In carrying</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HC4093C8429C84D10AD190A17919088D4"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="HCFBA1216E689436391C316679D02EC79"><enum>(A)</enum><text>by striking <quote>(2) No general</quote> and inserting the following: </text><quoted-block style="OLC" id="H0A33FDC7B17B4EC78AD185C44A85C491" display-inline="no-display-inline"><paragraph id="HDD7365DA967C4D41B6A7FE0B41A25BC5"><enum>(2)</enum><header>Term</header><text display-inline="yes-display-inline">No general</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H8DE601D9C0C04918A85954AF30A5C8F7"><enum>(B)</enum><text>by striking <quote>five years</quote> and inserting <quote>ten years</quote>; and </text></subparagraph></paragraph><paragraph id="HF354F68909364C4DBBC0E76303CE4F6F"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H354EF46FD8B54465ADC0F45A3D420898" display-inline="no-display-inline"><paragraph id="HF59B20D4F06A44A78B9D5F4DD2F2C8C1"><enum>(3)</enum><header>Considerations</header><text display-inline="yes-display-inline">In determining the environmental effects of an activity under paragraph (1) or (2), the Secretary shall consider only the effects of any discharge of dredged or fill material resulting from such activity.</text></paragraph><paragraph id="HC78C98856E4A4DAE987598A2909E1542"><enum>(4)</enum><header>Nationwide permits for linear infrastructure projects</header><subparagraph id="H0BC3C8D1F9024CEBA80C4D145050138E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this section, the Secretary shall maintain a general permit on a nationwide basis for linear infrastructure projects that do not result in the loss of greater than <fraction>1/2</fraction>-acre of waters of the United States for each single and complete project (as defined in section 330.2 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this paragraph)).</text></subparagraph><subparagraph id="H271F120774E04F689C4215C322DF2C08"><enum>(B)</enum><header>Definition of linear infrastructure project</header><text display-inline="yes-display-inline">In this paragraph, the term <quote>linear infrastructure project</quote> means a project to carry out any activity required for the construction, expansion, maintenance, modification, or removal of infrastructure and associated facility for the transmission from a point of origin to a terminal point of communications or electricity or the transportation from a point of origin to a terminal point of people, water, wastewater, carbon dioxide, or fuel or hydrocarbons (in the form of a liquid, liquescent, gaseous, or slurry substance or supercritical fluid), including oil and gas pipeline facilities.</text></subparagraph></paragraph><paragraph id="H92B2CC00CF2C4966B8AFA28FC1D1A582"><enum>(5)</enum><header>Reissuance of nationwide permits</header><text display-inline="yes-display-inline">In determining whether to reissue a general permit issued under this subsection on a nationwide basis—</text><subparagraph id="HCC9F3BE34B3F4B789C3D0949433D7E88"><enum>(A)</enum><text>no consultation with an applicable State pursuant to section 6(a) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1535">16 U.S.C. 1535(a)</external-xref>) is required;</text></subparagraph><subparagraph id="HD5FFA51FB0794A859DCC7331D8907981"><enum>(B)</enum><text>no consultation with a Federal agency pursuant to section 7(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536(a)(2)</external-xref>) is required; and</text></subparagraph><subparagraph id="H18D96EF94F9C4C3C944889188E3379C0"><enum>(C)</enum><text display-inline="yes-display-inline">the requirements of section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) shall be satisfied by preparing an environmental assessment with respect to such general permit.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7CEDD984A2F045CFB94187698E810359"><enum>(b)</enum><header>Administration of nationwide permit program</header><text display-inline="yes-display-inline">In carrying out section 404(e) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>), the Secretary of the Army, acting through the Chief of Engineers, may not finalize or implement any modification to—</text><paragraph id="H30BDF8800B6B493AA41AC428415AFDA6"><enum>(1)</enum><text display-inline="yes-display-inline">general condition 15 (relating to single and complete projects), as included in the final rule titled <quote>Reissuance and Modification of Nationwide Permits</quote> and published on January 13, 2021, by the Department of the Army, Corps of Engineers (86 Fed. Reg. 2868); </text></paragraph><paragraph id="H7FF68F40860747D58170553768602BB8"><enum>(2)</enum><text>the definition of single and complete linear project, as included in such final rule (86 Fed. Reg. 2877); or</text></paragraph><paragraph id="HAEC9A62FF8F64C1299F5C68BD310AD11"><enum>(3)</enum><text display-inline="yes-display-inline">the definition of single and complete project, as included in section 330.2 of title 33, Code of Federal Regulations (as in effect on the date of enactment of this Act).</text></paragraph></subsection></section></legis-body></bill>
