Reauthorization of loan guarantees for Native Hawaiian housing.</toc-entry></toc></subsection><subsection id="HF9F8605F9ACD4DEE8B9AEBED676FAD71"><enum>(c)</enum><header>References</header><text>Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>).</text></subsection></section><section id="HC58ACE3734BC485B8C237ED0855B7A2F"><enum>2.</enum><header>Office of Native American Programs</header><subsection id="H01D603E5AC144BDDAE5BF37E96411C02"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 4 of the Department of Housing and Urban Development Act (<external-xref legal-doc="usc" parsable-cite="usc/42/3533">42 U.S.C. 3533</external-xref>) is amended—</text><paragraph commented="no" id="H99CC5835F3A347AEB2D85C80E3453655"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>7 Assistant Secretaries</quote> and inserting <quote>8 Assistant Secretaries</quote>; and</text></paragraph><paragraph id="H7FDFAC875DEB45AA8184B8A141B7ABAC"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HCA8B99DCC41C445AAB896B99BB1BCE7F" style="OLC"><subsection id="HD787D52EE6B04F309B1DCB4137FCE29D"><enum>(i)</enum><header>Office of Native American Programs</header><paragraph id="H6346F3D80BDD4C58AF5F6E47EB9FA58B"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established, in the Department, the Office of Native American Programs.</text></paragraph><paragraph id="H265D6760DEEC4F6A98E2BDC97E2BB46B"><enum>(2)</enum><header>Head</header><text display-inline="yes-display-inline">The head of the Office of Native American Programs shall be one of the Assistant Secretaries appointed pursuant to subsection (a)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="HEC91D6AA740F4996AA73623D26DC043E"><enum>(b)</enum><header>Pay rate</header><text>Section 5315 of title 5, United States Code is amended, in the item relating to Assistant Secretaries of Housing and Urban Development, by striking <quote>(8)</quote> and inserting <quote>(9)</quote>.</text></subsection></section><title id="H6B6E04A60F414FB79EEC1F928D46AB8A"><enum>I</enum><header>BLOCK GRANTS AND GRANT REQUIREMENTS</header><section id="HB584E6DF71F149189F8A553820D0C55A"><enum>101.</enum><header>Block grants</header><text display-inline="no-display-inline">Section 101 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>) is amended—</text><paragraph id="HBCD44348F097416286F12166C7B1F015"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by adding after the period at the end the following: <quote>The Secretary shall act upon a waiver request submitted under this subsection by a recipient within 60 days after receipt of such request.</quote>; and</text></paragraph><paragraph id="HFDA248011210470C8FBCF9ADCCCD7546"><enum>(2)</enum><text>in subsection (k), by striking <quote>1</quote> and inserting <quote>an</quote>.</text></paragraph></section><section id="H44AC80476AC6474C940DD160A202323F"><enum>102.</enum><header>Recommendations regarding exceptions to annual Indian housing plan requirement</header><text display-inline="no-display-inline">Not later than the expiration of the 120-day period beginning on the date of the enactment of this Act and after consultation with Indian tribes, tribally designated housing entities, and other interested parties, the Secretary of Housing and Urban Development shall submit to the Congress recommendations for standards and procedures for waiver of, or alternative requirements (which may include multi-year housing plans) for, the requirement under section 102(a) of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4112">25 U.S.C. 4112(a)</external-xref>) for annual submission of one-year housing plans for an Indian tribe. Such recommendations shall include a description of any legislative and regulatory changes necessary to implement such recommendations.</text></section><section id="H7E3608A1D7784E1A87E22B6C11EC26C7"><enum>103.</enum><header>Environmental review</header><text display-inline="no-display-inline">Section 105 (<external-xref legal-doc="usc" parsable-cite="usc/25/4115">25 U.S.C. 4115</external-xref>) is amended—</text><paragraph id="HA9AA098FD6714C978213F1C7F690112C"><enum>(1)</enum><text>in subsection (d)—</text><subparagraph id="H7B38F0E0D2914BA69B160343731E9CCB"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>may</quote> and inserting <quote>shall</quote>; and</text></subparagraph><subparagraph id="H5D8FB836B1424E02B670ACE7218B720C"><enum>(B)</enum><text>by adding after and below paragraph (4) the following:</text><quoted-block display-inline="no-display-inline" id="H260DD5DC0CBB4D419BD8ABEDF3CC4F28" style="OLC"><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">The Secretary shall act upon a waiver request submitted under this subsection by a recipient within 60 days after receipt of such request.</quoted-block-continuation-text><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H5A6F2595B9D941129272FE26165125CF"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="H099BC2AE39654DFBA0E7FE46F8F3244F" style="OLC"><subsection id="HD34A8A466D8C4383B3B2D3B954F095D1"><enum>(e)</enum><header>Consolidation of environmental review requirements</header><text display-inline="yes-display-inline">If a recipient is using one or more sources of Federal funds in addition to grant amounts under this Act in carrying out a project that qualifies as an affordable housing activity under section 202, such other sources of Federal funds do not exceed 49 percent of the total cost of the project, and the recipient’s tribe has assumed all of the responsibilities for environmental review, decisionmaking, and action pursuant to this section, the tribe’s compliance with the review requirements under this section and the National Environmental Policy Act of 1969 with regard to such project shall be deemed to fully comply with and discharge any applicable environmental review requirements that might apply to Federal agencies with respect to the use of such additional Federal funding sources for that project.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE12A4FCF5DD84B1D927969C33B76C006"><enum>104.</enum><header>Deadline for action on request for approval regarding exceeding TDC maximum cost for project</header><subsection id="HEB3C6DCF70E745468ECB001C881662ED"><enum>(a)</enum><header>Approval</header><text display-inline="yes-display-inline">Section 103 (<external-xref legal-doc="usc" parsable-cite="usc/25/4113">25 U.S.C. 4113</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HA36D232EC35249C1A92A870E5EA123D2" style="OLC"><subsection id="H206B923411914AD49EF5F871A0D1DE6C"><enum>(f)</enum><header>Deadline for action on request To exceed TDC maximum</header><text display-inline="yes-display-inline">A request for approval by the Secretary of Housing and Urban Development to exceed by more than 10 percent the total development cost maximum cost for a project shall be approved or denied during the 60-day period that begins on the date that the Secretary receives the request.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H899ADE86187742C59EC126D8DB5FA6DB"><enum>(b)</enum><header>Definition</header><text>Section 4 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>) is amended—</text><paragraph id="HE78FF667564C42F58EFE61089952D031"><enum>(1)</enum><text>by redesignating paragraph (22) as paragraph (23); and</text></paragraph><paragraph id="H4CC01A0572CD4D59B135EF1A8437CAA0"><enum>(2)</enum><text>by inserting after paragraph (21) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HE186A2AB523041ADA824E6DC35DC4A70" style="OLC"><paragraph id="HF77D23F5AFAE4C418EBF84098EE227D5"><enum>(22)</enum><header>Total development cost</header><text display-inline="yes-display-inline">The term <quote>total development cost</quote> means, with respect to a housing project, the sum of all costs for the project, including all undertakings necessary for administration, planning, site acquisition, demolition, construction or equipment and financing (including payment of carrying charges), and for otherwise carrying out the development of the project, excluding off-site water and sewer. The total development cost amounts shall be based on a moderately designed house and determined by averaging the current construction costs as listed in not less than two nationally recognized residential construction cost indices.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title><title id="HEC8774940CA6462DBCDA76C85F7DA322"><enum>II</enum><header>AFFORDABLE HOUSING ACTIVITIES</header><section id="HF47A4251AB864B37BA709111A8F94D3C"><enum>201.</enum><header>National objectives and eligible families</header><text display-inline="no-display-inline">The second paragraph (6) of section 201(b) (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131(b)(6)</external-xref>; relating to exemption) is amended—</text><paragraph id="H79143E5EA60544AE9F654CEC16AE0642"><enum>(1)</enum><text>by striking <quote>1964 and</quote> and inserting <quote>1964,</quote>; and</text></paragraph><paragraph id="H742AEC543E4F4AFA99FCBB7F07A0B3DE"><enum>(2)</enum><text>by inserting after <quote>1968</quote> the following: <quote>, and section 3 of the Housing and Urban Development Act of 1968</quote>.</text></paragraph></section><section id="H9ED548F6B0434508B8540CE84658C54E"><enum>202.</enum><header>Homeownership or lease-to-own low-income requirement and income targeting</header><text display-inline="no-display-inline">Section 205 (<external-xref legal-doc="usc" parsable-cite="usc/25/4135">25 U.S.C. 4135</external-xref>) is amended—</text><paragraph id="HA09F857AD4694C8F89B867A35A474456"><enum>(1)</enum><text>in subsection (a)(1)—</text><subparagraph id="HE373406800B74A8AAAD09987EB146E92"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>and</quote> at the end; and</text></subparagraph><subparagraph id="H90F93892CC5B47459EB62E234EE81846"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H179488DB8B6348059B1AEE05756D9886" style="OLC"><subparagraph id="HBD72CD8AF2FB40DEB2EE2EA4F7689940"><enum>(E)</enum><text display-inline="yes-display-inline">notwithstanding any other provision of this paragraph, in the case of rental housing that is made available to a current rental family for conversion to a homebuyer or a lease-purchase unit, that the current rental family can purchase through a contract of sale, lease-purchase agreement, or any other sales agreement, is made available for purchase only by the current rental family, if the rental family was a low-income family at the time of their initial occupancy of such unit; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H9DB213BD42724016BA2A7148C005F780"><enum>(2)</enum><text>in subsection (c), by adding after the period at the end the following: <quote>The provisions of such paragraph regarding binding commitments for the remaining useful life of the property shall not apply to improvements of privately owned homes if the cost of such improvements do not exceed 10 percent of the maximum total development cost for such home.</quote>.</text></paragraph></section><section id="HD1A8237B31C94183AF6BAEF23DEAE657"><enum>203.</enum><header>Lease requirements and tenant selection</header><text display-inline="no-display-inline">Section 207 (<external-xref legal-doc="usc" parsable-cite="usc/25/4137">25 U.S.C. 4137</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block id="H9D0302D1BCF54413BF327B0C8CBD4BDD" style="OLC"><subsection id="H387651947EF24575B0E7EBA9B8C2FADA"><enum>(c)</enum><header>Notice of termination</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the owner or manager of rental housing that is assisted in part with amounts provided under this Act and in part with one or more other sources of Federal funds shall only utilize leases that require a notice period for the termination of the lease pursuant to subsection (a)(3).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HC54E9BF70CBF4622BD512FB0001B8402"><enum>204.</enum><header>Tribal coordination of agency funding</header><subsection id="HE219D229B89548469603D963C61E0F92"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Subtitle A of title II (<external-xref legal-doc="usc" parsable-cite="usc/25/4131">25 U.S.C. 4131 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H37EB8EF92E184B7D8B041BCF566F5D3A" style="OLC"><section id="H18235C3D57A144A8B629F98F6E73E069"><enum>211.</enum><header>IHS sanitation facilities construction</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, a recipient authorized to receive funding under this Act may, in its discretion, use funding from the Indian Health Service of the Department of Health and Human Services for construction of sanitation facilities for housing construction and renovation projects that are funded in part by funds provided under this Act.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HEEF9F1149BE348C592139588BC7226F7"><enum>(b)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) is amended by inserting after the item relating to section 210 the following new item:</text><quoted-block display-inline="no-display-inline" id="HFFCE296EEDAC4ADF90E7874994F6FF73" style="OLC"><toc regeneration="no-regeneration"><toc-entry bold="off" level="section">Sec. 211. and</text></paragraph><paragraph id="H3052A4BF82FB46918936D38AC200C8EC"><enum>(5)</enum><text>$820,000,000 for fiscal year 2029.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section display-inline="no-display-inline" id="HE3A28C16B1C7424A9DEF81A844BB7484"><enum>302.</enum><header>Effect of undisbursed block grant amounts on annual allocations</header><subsection id="H17D49B9C8AC84387B1AE47F590326E21"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Title III (<external-xref legal-doc="usc" parsable-cite="usc/25/4151">25 U.S.C. 4151 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="HDF7CE2E97EA346DEB0CD302167FE261C" style="OLC"><section id="HEEBB271BD3E14AB7BFBE30E816DF7C94"><enum>303.</enum><header>Effect of undisbursed grant amounts on annual allocations</header><subsection id="HBFE704AF9494441E9E4D0BD7913AF2A2"><enum>(a)</enum><header>Notification of obligated, undisbursed grant amounts</header><text display-inline="yes-display-inline">Subject to subsection (d) of this section, if on October 1, 2025, or on any October 1 thereafter, the total amount of undisbursed block grants for a recipient in the line of credit control system (or a successor system) of the Department of Housing and Urban Development is greater than the sum of the initial allocations for the previous 3 fiscal years, the Secretary shall—</text><paragraph id="H4C1618F1551A441887F16FDA59AC6244"><enum>(1)</enum><text>before October 31 of such year, notify the Indian tribe allocated the grant amounts and any tribally designated housing entity for the tribe of the undisbursed funds; and</text></paragraph><paragraph id="H4EEAE3988BB743AAACD4B26D5300EDE2"><enum>(2)</enum><text display-inline="yes-display-inline">require the recipient for the tribe to, not later than 30 days after the Secretary provides notification pursuant to paragraph (1)—</text><subparagraph id="H4D60C090CA054D84ACC1C017ED990B41"><enum>(A)</enum><text display-inline="yes-display-inline">notify the Secretary in writing of the reasons why the recipient has not requested the disbursement of such amounts; and</text></subparagraph><subparagraph id="HB1369516B7604F50A8354E6B5FB815A0"><enum>(B)</enum><text display-inline="yes-display-inline">demonstrate to the satisfaction of the Secretary that the recipient has the capacity to spend Federal funds in an effective manner, which demonstration may include evidence of the timely expenditure of amounts previously distributed under this Act to the recipient.</text></subparagraph></paragraph></subsection><subsection id="HE599349D51404FD9AD65A06F47A0C41C"><enum>(b)</enum><header>Allocation amount</header><text display-inline="yes-display-inline">Notwithstanding sections 301 and 302, the allocation for such fiscal year for a recipient described in subsection (a) shall be the amount initially calculated according to the formula minus the difference between the recipient’s total amount of undisbursed block grants in the Department’s line of credit control system on such January 1 and three times the initial formula amount for such fiscal year.</text></subsection><subsection id="H31191202EFED4B49A26F3C4CD85FE2D2"><enum>(c)</enum><header>Reallocation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, any grant amounts not allocated to a recipient pursuant to subsection (b) shall be allocated under the need component of the formula proportionately amount all other Indian tribes not subject to such an adjustment.</text></subsection><subsection id="H5E29601D73054672A14D7DE0BBAD3288"><enum>(d)</enum><header>Inapplicability</header><text>Subsections (a) and (b) shall not apply to an Indian tribe with respect to any fiscal year for which the amount allocated for the tribe for block grants under this Act is less than $5,000,000.</text></subsection><subsection id="H53FEF75F2FDB4088A9354E1AFBDB958D"><enum>(e)</enum><header>Effectiveness</header><text>This section shall not require the issuance of any regulation to take effect and shall not be construed to confer hearing rights under this or any other section of this Act.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5E5DAFA87DF741BDB0C1908E60FAF3CC"><enum>(b)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) is amended by inserting after the item relating to section 302 the following new item:</text><quoted-block display-inline="no-display-inline" id="HEFFBC7C7C10B45E5A0B1C20653C5C93A" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 303. Native American veterans</header><text display-inline="no-display-inline">Paragraph (19) of section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)(19)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H361CD2D45D8D4758A89EC16ACE696DC5"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subparagraph:</text><subclause commented="no" display-inline="no-display-inline" id="HEF384FE98E3C4086A297A0CF86D67DAC"><enum>(I)</enum><header display-inline="yes-display-inline">Eligible Indian veteran</header><text display-inline="yes-display-inline">The term <term>eligible Indian veteran</term> means an Indian veteran who is—</text><item commented="no" display-inline="no-display-inline" id="HA5D1A141427F4BB6812301401F11363C"><enum>(aa)</enum><text display-inline="yes-display-inline">homeless or at risk of homelessness; and</text></item><item commented="no" display-inline="no-display-inline" id="H1BE9E085075A416597A8406DD1A18ED2"><enum>(bb)</enum><text display-inline="yes-display-inline">living—</text><subitem commented="no" display-inline="no-display-inline" id="H2A58405826BE496E8F83FDEB24D8BE89"><enum>(AA)</enum><text display-inline="yes-display-inline">on or near a reservation; or</text></subitem><subitem commented="no" display-inline="no-display-inline" id="HAC02AAEE332F4390BD52C21F4955343F"><enum>(BB)</enum><text display-inline="yes-display-inline">in or near any other Indian area.</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="HA9D3DDCA09D14C249DB95410168EDBFE"><enum>(II)</enum><header display-inline="yes-display-inline">Eligible recipient</header><text display-inline="yes-display-inline">The term <term>eligible recipient</term> means a recipient eligible to receive a grant under section 101 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4111">25 U.S.C. 4111</external-xref>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0AA2340E8CEF4168BC906F3C18F14364"><enum>(III)</enum><header display-inline="yes-display-inline">Indian; Indian area</header><text display-inline="yes-display-inline">The terms <term>Indian</term> and <term>Indian area</term> have the meanings given such terms in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD69B1920FEB2456E9F854D4B29B8C34B"><enum>(IV)</enum><header display-inline="yes-display-inline">Indian veteran</header><text display-inline="yes-display-inline">The term <term>Indian veteran</term> means an Indian who is a veteran.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H51DE3A245A5A46C0A1F05597FCB63054"><enum>(V)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>Program</term> means the Tribal HUD–VASH program carried out under clause (ii).</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF05A3647B53347668ECD5FB66FAD568B"><enum>(VI)</enum><header display-inline="yes-display-inline">Tribal organization</header><text display-inline="yes-display-inline">The term <term>tribal organization</term> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC1045285378C44949CFEFAA8F9445F64"><enum>(ii)</enum><header display-inline="yes-display-inline">Program specifications</header><text display-inline="yes-display-inline">The Secretary shall use not less than 5 percent of the amounts made available for rental assistance under this paragraph to carry out a rental assistance and supported housing program, to be known as the Tribal HUD–VASH program, in conjunction with the Secretary of Veterans Affairs, by awarding grants for the benefit of eligible Indian veterans.</text></clause><clause commented="no" display-inline="no-display-inline" id="H516155DA79A84288A3DF3D4379A26A18"><enum>(iii)</enum><header display-inline="yes-display-inline">Model</header><subclause commented="no" display-inline="no-display-inline" id="H69B419F3DC734A94A72B292D6E904DE4"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subclause (II), the Secretary shall model the Program on the rental assistance and supported housing program authorized under subparagraph (A) and applicable appropriations Acts, including administration in conjunction with the Secretary of Veterans Affairs.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2F217179EEE14E41A87DA30816CB3E65"><enum>(II)</enum><header display-inline="yes-display-inline">Exceptions</header><item commented="no" display-inline="no-display-inline" id="HA524289D1EEF47B3949D52982265E8D6"><enum>(aa)</enum><header display-inline="yes-display-inline">Secretary of Housing and Urban Development</header><text display-inline="yes-display-inline">After consultation with Indian tribes, eligible recipients, and any other appropriate tribal organizations, the Secretary may make necessary and appropriate modifications to facilitate the use of the Program by eligible recipients to serve eligible Indian veterans.</text></item><item commented="no" display-inline="no-display-inline" id="HD69B1E8256B44E07A9C1724FEBDF998E"><enum>(bb)</enum><header display-inline="yes-display-inline">Secretary of Veterans Affairs</header><text display-inline="yes-display-inline">After consultation with Indian tribes, eligible recipients, and any other appropriate tribal organizations, the Secretary of Veterans Affairs may make necessary and appropriate modifications to facilitate the use of the Program by eligible recipients to serve eligible Indian veterans.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H6C00A56FE63E406097E7F72ADAEDE6F3"><enum>(iv)</enum><header display-inline="yes-display-inline">Eligible recipients</header><text display-inline="yes-display-inline">The Secretary shall make amounts for rental assistance and associated administrative costs under the Program available in the form of grants to eligible recipients.</text></clause><clause commented="no" display-inline="no-display-inline" id="HFD221A0E8DAC46F280A76114A6D17835"><enum>(v)</enum><header display-inline="yes-display-inline">Funding criteria</header><text display-inline="yes-display-inline">The Secretary shall award grants under the Program based on—</text><subclause commented="no" display-inline="no-display-inline" id="HF1E98D107D69485390F100A431091F7F"><enum>(I)</enum><text display-inline="yes-display-inline">need;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0DE2E36B96AF4DF0B714827D7BEC0C87"><enum>(II)</enum><text display-inline="yes-display-inline">administrative capacity; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD51070F826A74F1E9200F49AFCDDCA64"><enum>(III)</enum><text display-inline="yes-display-inline">any other funding criteria established by the Secretary in a notice published in the Federal Register after consulting with the Secretary of Veterans Affairs.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H777DC4247BB64CCB8A146DE81A8DF152"><enum>(vi)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Grants awarded under the Program shall be administered in accordance with the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4101">25 U.S.C. 4101 et seq.</external-xref>), except that recipients shall—</text><subclause commented="no" display-inline="no-display-inline" id="H1C26251AA853412B87D3D4E5F4411568"><enum>(I)</enum><text display-inline="yes-display-inline">submit to the Secretary, in a manner prescribed by the Secretary, reports on the utilization of rental assistance provided under the Program; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H089E958ACB8C46DDBDFEBB0968602662"><enum>(II)</enum><text display-inline="yes-display-inline">provide to the Secretary information specified by the Secretary to assess the effectiveness of the Program in serving eligible Indian veterans.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC59B39791DBE46D58F32FE46B459F241"><enum>(vii)</enum><header display-inline="yes-display-inline">Consultation</header><subclause commented="no" display-inline="no-display-inline" id="HDA2200BB816349AC9BE7E3F00C564521"><enum>(I)</enum><header display-inline="yes-display-inline">Grant recipients; tribal organizations</header><text display-inline="yes-display-inline">The Secretary, in coordination with the Secretary of Veterans Affairs, shall consult with eligible recipients and any other appropriate tribal organization on the design of the Program to ensure the effective delivery of rental assistance and supportive services to eligible Indian veterans under the Program.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB03177D244294CC3A635259189183DDB"><enum>(II)</enum><header display-inline="yes-display-inline">Indian Health Service</header><text display-inline="yes-display-inline">The Director of the Indian Health Service shall provide any assistance requested by the Secretary or the Secretary of Veterans Affairs in carrying out the Program.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H3A80E39C6D7A4CB7A3EA94924CD73D11"><enum>(viii)</enum><header display-inline="yes-display-inline">Waiver</header><subclause commented="no" display-inline="no-display-inline" id="H36F1934E3F3046A2BC8B591288769E8B"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subclause (II), the Secretary may waive or specify alternative requirements for any provision of law (including regulations) that the Secretary administers in connection with the use of rental assistance made available under the Program if the Secretary finds that the waiver or alternative requirement is necessary for the effective delivery and administration of rental assistance under the Program to eligible Indian veterans.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0D40388DEF214D7EA316B673F258A601"><enum>(II)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">The Secretary may not waive or specify alternative requirements under subclause (I) for any provision of law (including regulations) relating to labor standards or the environment.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H1E8A8660FE9041F0BCA1FF74E7BD01D5"><enum>(ix)</enum><header display-inline="yes-display-inline">Renewal grants</header><text display-inline="yes-display-inline">The Secretary may—</text><subclause commented="no" display-inline="no-display-inline" id="HF722F0CABFB94895ABEEC5BFCF154621"><enum>(I)</enum><text display-inline="yes-display-inline">set aside, from amounts made available for tenant-based rental assistance under this subsection and without regard to the amounts used for new grants under clause (ii), such amounts as may be necessary to award renewal grants to eligible recipients that received a grant under the Program in a previous year; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H027824B9FDF0472386A39F83A3724006"><enum>(II)</enum><text display-inline="yes-display-inline">specify criteria that an eligible recipient must satisfy to receive a renewal grant under subclause (I), including providing data on how the eligible recipient used the amounts of any grant previously received under the Program.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC8967108E3D14ADF99BD32C5699955B4"><enum>(x)</enum><header display-inline="yes-display-inline">Reporting</header><subclause commented="no" display-inline="no-display-inline" id="H022B9C71377F44E2B1CC6B328D3F6354"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this subparagraph, and every 5 years thereafter, the Secretary, in coordination with the Secretary of Veterans Affairs and the Director of the Indian Health Service, shall—</text><item commented="no" display-inline="no-display-inline" id="H609E59E0B4464F3EBF9FB6CACF3F5938"><enum>(aa)</enum><text display-inline="yes-display-inline">conduct a review of the implementation of the Program, including any factors that may have limited its success; and</text></item><item commented="no" display-inline="no-display-inline" id="HAE45F8F008E24C0AA6A034B1E7BA8CD2"><enum>(bb)</enum><text display-inline="yes-display-inline">submit a report describing the results of the review under item (aa) to—</text><subitem commented="no" display-inline="no-display-inline" id="HE9AA813C4CD54903998056B2E8246BD0"><enum>(AA)</enum><text display-inline="yes-display-inline">the Committee on Indian Affairs, the Committee on Banking, Housing, and Urban Affairs, the Committee on Veterans' Affairs, and the Committee on Appropriations of the Senate; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H579CD1C0992E43288A1998D0C091C320"><enum>(BB)</enum><text display-inline="yes-display-inline">the Subcommittee on Indian, Insular and Alaska Native Affairs of the Committee on Natural Resources, the Committee on Financial Services, the Committee on Veterans' Affairs, and the Committee on Appropriations of the House of Representatives.</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H22B461BAF2444756966408BC5BBE1ACD"><enum>(II)</enum><header display-inline="yes-display-inline">Analysis of housing stock limitation</header><text display-inline="yes-display-inline">The Secretary shall include in the initial report submitted under subclause (I) a description of—</text><item commented="no" display-inline="no-display-inline" id="H8890DA6159FC4E1EBB2A41A204DE45BD"><enum>(aa)</enum><text display-inline="yes-display-inline">any regulations governing the use of formula current assisted stock (as defined in section 1000.314 of title 24, Code of Federal Regulations (or any successor regulation)) within the Program;</text></item><item commented="no" display-inline="no-display-inline" id="H2555327A7827480CBB2F01C2F7E6A92A"><enum>(bb)</enum><text display-inline="yes-display-inline">the number of recipients of grants under the Program that have reported the regulations described in item (aa) as a barrier to implementation of the Program; and</text></item><item commented="no" display-inline="no-display-inline" id="HFEA4300A2C2642218365B2F1FB1ACACF"><enum>(cc)</enum><text display-inline="yes-display-inline">Paragraph (1) of section 184(h) of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a(h)(1)) is amended—</text><subparagraph id="HE6F500BF8FC44903A6540A2FE8525CF2"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph(A)(i), by inserting <quote>, including in a tribal court having jurisdiction,</quote> after <quote>notice of such action to the Secretary)</quote>; and</text></subparagraph><subparagraph id="HC8A470E8B06F4D508312B2136CF1F1C3"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting before the period at the end the following: <quote>, which may include initiating foreclosure proceedings in the tribal court having jurisdiction, but if the tribal court does not hold proceedings on a foreclosure complaint within the period provided under applicable law or within 90 days of service of the foreclosure complaint (whichever is longer), the Secretary may voluntarily dismiss the tribal court action and proceed to file in another court of competent jurisdiction</quote>.</text></subparagraph></paragraph><paragraph id="HF9D035B9CF22417E9BEA2C49B0CBB1CA"><enum>(2)</enum><header>Contract attorneys</header><text display-inline="yes-display-inline">Clause (i) of section 184(h)(1)(A) of the Housing and Community Development Act of 1992 (12 U.S.C. 1715z–13a(h)(1)), as amended by subsection (b) of this section, is further amended by adding at the end the following: <quote>The Attorney General may contract for and use the services of private attorneys in handling such foreclosure proceedings if the Attorney General determines use of such attorneys will facilitate competent and cost-effective representation.</quote>.</text></paragraph></subsection></section><section display-inline="no-display-inline" id="H1CFF5A27C6B14F438A12861B00B6A1DA" section-type="subsequent-section"><enum>503.</enum><header>Set-aside of USDA rural housing funding for Indian tribes</header><text display-inline="no-display-inline">Section 509 of the Housing Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/42/1479">42 U.S.C. 1479</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H3C49AE04CDA64FAE938A800484B501C7" style="OLC"><subsection id="H41512D3C83CA4867BB233B367BF7DACA"><enum>(g)</enum><header>Set-Aside for Indian tribes</header><text display-inline="yes-display-inline">For each fiscal year, the Secretary shall set aside and reserve for assistance for Indian tribes (as such term is defined in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)) an amount equal to 5.0 percent in each fiscal year of the aggregate amount of lending authority, budget authority, or guarantee authority, as appropriate, made available for such fiscal year for assistance under each of sections 502, 504, 515, 533, and 538 and of the aggregate amount made available to the Rural Utilities Service to carry out programs or activities. The procedure under this section for reserving amounts shall also provide that any assistance set aside in any fiscal year for Indian tribes that has not been expended by a reasonable date established by the Secretary shall be made available and allocated under the laws and regulations relating to such assistance, notwithstanding this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H939DC5B5D0A2415C8A84995CA0667485"><enum>504.</enum><header>Indian tribe eligibility for HUD housing counseling</header><text display-inline="no-display-inline">Paragraph (4) of section 106(a) of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701x">12 U.S.C. 1701x(a)(4)</external-xref>) is amended—</text><paragraph id="H135A61C284F243428C3510EB6DCE8570"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="H403E07A6064349AA93C82CC0D764F554"><enum>(A)</enum><text>by striking <quote>and</quote> and inserting a comma; and</text></subparagraph><subparagraph id="H1A4A69CD882B4203ABD41950EB336E24"><enum>(B)</enum><text>by inserting before the period at the end the following: <quote>, Indian tribes, and tribally designated housing entities. For purposes of this paragraph, the terms <quote>Indian tribe</quote> and <quote>tribally designated housing entity</quote> shall have the same meanings given such terms in section 4 of the Native American Housing Assistance and Self-Determination Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/25/4103">25 U.S.C. 4103</external-xref>)</quote>; and</text></subparagraph></paragraph><paragraph id="HE50A3B8CBD6A42D680EDD9A620B41350"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by inserting <quote>, Indian tribes, and tribally designated housing entities</quote> after <quote>organizations)</quote>.</text></paragraph></section><section id="H6E2F88AA19D243C68A40AF3E22F496E9" section-type="subsequent-section"><enum>505.</enum><header>Competitive grants</header><text display-inline="no-display-inline">Title VII (<external-xref legal-doc="usc" parsable-cite="usc/25/4211">25 U.S.C. 4211 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="H2100F4FD91E9437B9B75583744760457"><section id="H426F5F6262AC48B7BC3EF3192C40CAEE"><enum>706.</enum><header>Competitive grants</header><subsection id="HAD337814D768417D94589FD38221D461"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline">To the extent amounts are made available pursuant to subsection (d), the Secretary shall make grants under this section, pursuant to a competition for such grants, to eligible recipients of block grants under title I that apply for grants under this section for use only for carrying out eligible affordable housing activities under section 202 (<external-xref legal-doc="usc" parsable-cite="usc/25/4132">25 U.S.C. 4132</external-xref>).</text></subsection><subsection id="HD8902013F08E40BEBB87035E4CD70013"><enum>(b)</enum><header>Priority; considerations</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary shall—</text><paragraph id="HD119B8B37CFE4C849829FE31C5D7AF39"><enum>(1)</enum><text display-inline="yes-display-inline">give priority to projects for construction, and related necessary infrastructure, that will increase the inventory of affordable housing;</text></paragraph><paragraph id="HAB83696293094B7BA1D883B31BE51CAA"><enum>(2)</enum><text display-inline="yes-display-inline">encourage housing rehabilitation projects that will increase the useful life of existing affordable housing dwelling units and alleviate substandard housing conditions;</text></paragraph><paragraph id="HADD7ECC632FE4C73986960335F1000E3"><enum>(3)</enum><text display-inline="yes-display-inline">encourage necessary affordable housing-related infrastructure projects that will enable future construction or rehabilitation; and</text></paragraph><paragraph id="H18931EEBF6F94F779109A74E777AFAF9"><enum>(4)</enum><text>consider need and administrative capacity of applicants.</text></paragraph></subsection><subsection id="HE150D1F3718C49C789AD4D7BA4F2FA40"><enum>(c)</enum><header>Administrative costs</header><text>Of any amounts made available pursuant to subsection (d) for any fiscal year, not more than 1 percent may be used by the Secretary for necessary costs of administering and overseeing the obligation and expenditure of amounts made available for grants under this section.</text></subsection><subsection id="HF979A709C887459D9ADC39CC4A6D6146"><enum>(d)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for grants under this section—</text><paragraph id="H7AA3891BB0F04F3DA797AB91EFC99CEE"><enum>(1)</enum><text display-inline="yes-display-inline">$100,000,000 for fiscal year 2025;</text></paragraph><paragraph id="HF8591986F3694B34A9C167A57513BB23"><enum>(2)</enum><text>$105,000,000 for fiscal year 2026;</text></paragraph><paragraph id="HC6785416CCC341E68A0813DA4049782C"><enum>(3)</enum><text>$110,000,000 for fiscal year 2027;</text></paragraph><paragraph id="H31DFBECB802142DB818108A62E889C2A"><enum>(4)</enum><text>$115,000,000 for fiscal year 2028; and</text></paragraph><paragraph id="HD852CB18D1684B569634B199017F47DE"><enum>(2)</enum><text>by striking <quote>50 years</quote> each place such term appears and inserting <quote>99 years</quote>.</text></paragraph></section><section id="HC2AAA9ABEF0B4811B9AA11EFEE003B5A" section-type="subsequent-section"><enum>603.</enum><header>Exemption for Indian tribes from national flood insurance program participation requirement</header><text display-inline="no-display-inline">Paragraph (3) of section 3(a) of the Flood Disaster Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4003">42 U.S.C. 4003(a)(3)</external-xref>) is amended by inserting before the semicolon at the end the following: <quote>or for any Indian tribe that has in effect a plan for mitigating damage resulting from flooding that has been approved by the tribal government for the tribe</quote>.</text></section><section id="H1E69077C02FE460C979C86C856B96774" commented="no"><enum>604.</enum><header>Compliance with treaty obligations</header><text display-inline="no-display-inline">The Secretary of Housing and Urban Development shall withhold all or partial funds to a tribe or tribal entity under this Act if, after consultation with the Secretary of the Interior and the tribe, the Secretary determines prior to disbursement that the tribe is not in compliance with obligations under its 1866 treaty with the United States as it relates to the inclusion of persons who are lineal descendants of Freedmen as having the rights of the citizens of such tribes, unless a Federal court has issued a final order that determines the treaty obligations with respect to including Freedmen as citizens.
