R. 6942</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240110">January 10, 2024</action-date><action-desc><sponsor name-id="R000103">Mr. Rosendale</sponsor> (for himself, <cosponsor name-id="H001052">Mr. Harris</cosponsor>, <cosponsor name-id="B000825">Ms. Boebert</cosponsor>, <cosponsor name-id="G000595">Mr. Good of Virginia</cosponsor>, <cosponsor name-id="B001316">Mr. Burlison</cosponsor>, <cosponsor name-id="B001302">Mr. Biggs</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="F000478">Mr. Fry</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="C001129">Mr. Collins</cosponsor>, and <cosponsor name-id="W000795">Mr. Wilson of South Carolina</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent congressional reapportionment distortions by requiring that, in the questionnaires used in the taking of any decennial census of population, a checkbox or other similar option be included for respondents to indicate citizenship status or lawful presence in the United States.</official-title></form><legis-body id="H2D6E5F3655D84ECE80B2B504FE878ABC" style="OLC"><section id="H026BF847C6964C74A504CFE5D3A0E907" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Count Only Citizens Act</short-title></quote>.</text></section><section id="HDBA63027347141E187BF9DE93979D59F" section-type="subsequent-section"><enum>2.</enum><header>Citizenship or lawful presence status on census questionnaires</header><text display-inline="no-display-inline">In conducting the 2030 decennial census and every decennial census thereafter, the Secretary of Commerce shall include, in any questionnaire distributed or otherwise used for the purpose of determining the total population by States, a checkbox or other similar option for respondents to indicate citizenship status or lawful presence in the United States.</text></section><section id="HC9C811AF94104F999BDC761753803357" section-type="subsequent-section"><enum>3.</enum><header>Prevention of congressional reapportionment distortions</header><subsection id="H8FAE58486CFC44DAB2A8B6A28E817BF6"><enum>(a)</enum><header>Adjustments To prevent distortions</header><text>Section 141 of title 13, United States Code, is amended—</text><paragraph id="H0E6C21F8993B4425B2084C9707497D02"><enum>(1)</enum><text>by redesignating subsection (g) as subsection (h); and</text></paragraph><paragraph id="HC388289D2485486E976A0F7E8E0E9245"><enum>(2)</enum><text>by inserting after subsection (f) the following:</text><quoted-block display-inline="no-display-inline" id="H9694F8582BCD4560ABCFDA8782828CE0" style="OLC"><subsection id="H725651723BD141899E055CEE528FCD16"><enum>(g)</enum><text>The Secretary shall make such adjustments in total population figures as may be necessary, using such methods and procedures as the Secretary determines feasible and appropriate, in order that those who are not United States citizens or are not lawfully present in the United States are not counted in tabulating population under subsection (b) for the purposes of apportionment of Representatives in Congress among the several States. Nothing in this subsection shall be construed to supersede section 195 of this title.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H41DE75DD02DD47BF9DEDBFF543D15698"><enum>(b)</enum><header>Conforming amendment</header><text>Section 22(a) of the Act entitled <quote>An Act To provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, of June 18, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a(a)</external-xref>), is amended by striking <quote>as ascertained under the seventeenth and each subsequent decennial census of the population</quote> and inserting <quote>as ascertained and reported under section 141 of title 13, United States Code, for each decennial census of population</quote>.</text></subsection></section></legis-body></bill>
