which was referred to the <committee-name committee-id="HBU00">Committee on the Budget</committee-name>, and in addition to the Committee on <committee-name committee-id="HRU00">Rules</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a commission on national debt and fiscal reforms.</official-title></form><legis-body id="H1BE00CA3B0754A6FAFA7440EE9B0F5D3" style="OLC"><section id="HDDA84B62567749C5A5451347E2562320" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Debt Commission Act of 2024</short-title></quote>.</text></section><section id="H7F670B079C4D4090991059CFAC2FD811"><enum>2.</enum><header>Establishment of a Debt Commission</header><subsection id="H45CC446F4F40425CBFDE8068E0DECA77"><enum>(a)</enum><header>Establishment of a debt commission</header><text>No later than 30 days after the date of enactment of this Act, there shall be established in Congress a Debt Commission.</text></subsection><subsection id="HD29456F0CF7E4C8D949E36DAFC5917DE"><enum>(b)</enum><header>Membership structure</header><text>The Debt Commission shall be composed of 16 members, of whom—</text><paragraph id="H90AE9C6A0EF644F880981E6F8DC30A87"><enum>(1)</enum><text>four members shall be appointed by the majority leader of the Senate from among the current Members of the Senate;</text></paragraph><paragraph id="H10585F7EF339476C8BE242197EC094C3"><enum>(2)</enum><text display-inline="yes-display-inline">four members shall be appointed by the minority leader of the Senate from among the current Members of the Senate;</text></paragraph><paragraph id="HE331B4F8325F4452A4DA6596D80DCDA0"><enum>(3)</enum><text display-inline="yes-display-inline">four members shall be appointed by the Speaker of the House of Representatives from among the current Members of the House of Representatives; and</text></paragraph><paragraph id="HB94C101E7E634832A899FD615E7C7C2E"><enum>(4)</enum><text display-inline="yes-display-inline">four members shall be appointed by the minority leader of the House of Representatives from among the current Members of the House of Representatives.</text></paragraph></subsection><subsection id="HED8708DA722148AFBB44D153D7468A0C"><enum>(c)</enum><header>Qualifications</header><text>Members appointed to the Debt Commission shall have significant depth of experience and expertise on fiscal issues.</text></subsection><subsection id="H941757B7D2674827A08D90C90A2316F1"><enum>(d)</enum><header>Vacancy</header><text>Any vacancy in the Debt Commission shall be filled in the same manner as the initial appointment under subsection (b).</text></subsection><subsection id="H6B18BF039BCA4612BC17A77750FD31C8"><enum>(e)</enum><header>Co-Chairs</header><text>From among the members appointed in subsection (b), the leadership of the Senate and House of Representatives of the same political party as the President shall designate 1 member, and the leadership of the Senate and House of Representatives of the opposite political party as the President, shall designate 1 member to serve as a co-chairs of the Debt Commission.</text></subsection><subsection id="HDC04564F97434EF886D2C4A813D1B431"><enum>(f)</enum><header>Staff director</header><text>The co-chairs of the Debt Commission, acting jointly, shall hire the staff director of the Debt Commission.</text></subsection><subsection id="HE14F2D4641C84D25AD96BB2949C745C7"><enum>(g)</enum><header>Staff compensation</header><text>The co-chairs of the Debt Commission may jointly appoint and fix the compensation of staff of the Debt Commission as the co-chairs determine necessary, in accordance with the guidelines, rules, and requirements relating to employees of the Senate.</text></subsection><subsection id="H1BA2D00577ED4A3EA625244DAF44B134"><enum>(h)</enum><header>Funding</header><text>Funding for the Debt Commission shall be derived in equal portions from—</text><paragraph id="HF6C58D5E55A1459FBD32597013B641F8"><enum>(1)</enum><text>the contingent fund of the Senate from the appropriations account <quote>Miscellaneous Items</quote>, subject to the rules and regulations of the Senate; and</text></paragraph><paragraph id="HDDEAFB8078C749ACAECEC4B7A4DA10F8"><enum>(2)</enum><text>the applicable accounts of the House of Representatives.</text></paragraph></subsection><subsection id="H040027ED97FC4B60BC64C7D6BD153252"><enum>(i)</enum><header>Duties</header><text>The Debt Commission shall identify policies to—</text><paragraph id="H628E09B2A51D401E8AB6630A121BC251"><enum>(1)</enum><text>achieve a sustainable ratio of the public debt of the Federal Government to the gross domestic product of the United States, in the midterm, including changes to address growth, discretionary appropriations, direct spending, and revenues;</text></paragraph><paragraph id="HAC152633F23E41318BE7A6D11F6849BE"><enum>(2)</enum><text>improve the long-term solvency of Federal programs for which a Federal trust fund exists; and</text></paragraph><paragraph id="HF27FE4CA636E41BEA429E3C3ACBA33CA"><enum>(3)</enum><text>reform budget processes for enhancing the fiscal oversight function of Congress.</text></paragraph></subsection><subsection id="H02EDECE0EEC84D7C8869CC4F7CDC2186"><enum>(j)</enum><header>Powers of debt commission</header><paragraph id="H00F0EF495AE84DDFA6E0AF1E3946DDD6"><enum>(1)</enum><header>Hearings</header><subparagraph id="HB9BF68AA5B974CD4AC754370D7D24AA5"><enum>(A)</enum><header>Public hearings</header><text>The Debt Commission shall hold public hearings and require attendance of witnesses and production of books, papers, and documents as the Debt Commission considers advisable.</text></subparagraph><subparagraph id="H1EBB93A59F2841E09083815505FC966A"><enum>(B)</enum><header>Initial meeting</header><text>Not later than 30 days after the date described in subsection (a), the Debt Commission shall hold the first meeting.</text></subparagraph><subparagraph id="HF0DEA423538D4F59996D99A217FB00CE"><enum>(C)</enum><header>Agenda</header><text>For each meeting of the Debt Commission, the co-chairs of the Debt Commission shall provide an agenda to the members of the Debt Commission not later than 48 hours before the meeting.</text></subparagraph><subparagraph id="H7C66DCB0E7D54023885502DA5607E4C0"><enum>(D)</enum><header>Hearing announcement</header><text>The co-chairs of the Debt Commission shall make a public announcement of the date, place, time, and subject matter of any hearing to be conducted under this subsection not later than 7 days before the date of the hearing, unless the co-chairs determine that there is good cause to begin such hearing on an earlier date.</text></subparagraph></paragraph><paragraph id="HCF1413EE4F744DEF8E68973709DC0F1A"><enum>(2)</enum><header>Technical assistance</header><text>Upon written request of the co-chairs of the Debt Commission, the head of a Federal agency shall provide technical assistance to the Debt Commission in a timely manner in order for the Debt Commission to carry out the duties of the Debt Commission.</text></paragraph><paragraph id="H3C1F41E13D0F4C3FA27C3B85666834DC"><enum>(3)</enum><header>Task forces and working groups</header><text>The co-chairs may establish task forces and working groups to carry out the duties of the Debt Commission, which may include participation by outside experts.</text></paragraph><paragraph id="HF9E08B059B6C45C28F2EFFD5BD2921CA"><enum>(4)</enum><header>Congressional budget office estimates</header><text>The Director of the Congressional Budget Office shall, with respect to the legislative language of the Debt Commission under subsection (l)(1)(B), provide to the Debt Commission—</text><subparagraph id="H481F93C08D154017A2E2E7B6462B3C0E"><enum>(A)</enum><text>estimates of the legislative language in accordance with sections 308(a) and 201(f) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/639">2 U.S.C. 639(a)</external-xref> and 8 601(f)); and</text></subparagraph><subparagraph id="HABBACD1F47F449A98229EBC4B23CD550"><enum>(B)</enum><text>information on the budgetary effect of the legislative language on the long-term fiscal outlook.</text></subparagraph></paragraph></subsection><subsection id="H436117D13B2346499CF59593EEED7B13"><enum>(k)</enum><header>Consultations with Congress</header><paragraph id="H0F1617FD6F364222B8A6E5F8C224DBC0" commented="no"><enum>(1)</enum><header>Recommendations of Committees</header><text>Not later than 60 days after the date of enactment of this Act, each committee of the Senate and the House of Representatives may transmit to the Debt Commission any recommendations of the committee relating to changes in law to achieve the changes described in subsection (i).</text></paragraph><paragraph id="H1D5C7FC7D829499FBB9D38CB558F7D69" commented="no"><enum>(2)</enum><header>Consultation with Committees</header><text>The co-chairs shall consult with the chairman and ranking minority member of each relevant committee of the Senate and of the House of Representatives regarding the contents of the final report and legislative language under subsection (l).</text></paragraph><paragraph id="H83851EBE4A304A3D90D409FB67492DFC"><enum>(3)</enum><header>Requirements for consultation</header><text>The consultation required under paragraph (2) shall provide the opportunity for the chairman and ranking member of each relevant committee of the Senate or of the House of Representatives to provide—</text><subparagraph id="H2E99DD7B34C845AC9150FB29236F386C"><enum>(A)</enum><text>recommendations for alternative means of addressing the recommendations contained in the Debt Commission report; and</text></subparagraph><subparagraph id="HECD3C6375C9F4B5EBBBCD5CFC6589E1E"><enum>(B)</enum><text>recommendations regarding which recommendations contained in the Debt Commission report should not be addressed in the proposed report.</text></subparagraph></paragraph><paragraph id="H0AF106F01FCF436E806985CA470DDA94"><enum>(4)</enum><header>Supplemental views</header><text>The Chair and Ranking Member of each relevant committee can submit supplemental views to include in the final report under subsection (l).</text></paragraph></subsection><subsection id="HAFD51CAF2C2845BCB21C70CB7CF218E2"><enum>(l)</enum><header>Final report, recommendations, and legislative language</header><paragraph id="H158429E5F50041DCB03EB19644DFF0DB" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On November 15, 2024, or thereafter, but not later than 30 days before the date specified in section 401(a) of division D of the Fiscal Responsibility Act of 2023 (<external-xref legal-doc="public-law" parsable-cite="pl/118/5">Public Law 118–5</external-xref>), the Debt Commission shall meet to consider, and vote on—</text><subparagraph id="H38E7D2FFB7B4478E87567965270C2EEE" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">a final report that contains a detailed statement of the findings, conclusions, and recommendations required under subsection (i); and</text></subparagraph><subparagraph id="HCDD9957D0A4440E8A9E8877A27034ECA" commented="no"><enum>(B)</enum><text>legislative language to carry out the recommendations of the Debt Commission in the report described in subparagraph (A), which shall include a statement of the economic and budgetary effects of the recommendations by the Congressional Budget Office.</text></subparagraph></paragraph><paragraph id="HD603CB6F959343FF88D26F4BF23E9B7A"><enum>(2)</enum><header>Approval of report and legislative language</header><text>A final report and legislative language of the Debt Commission under paragraph (1) shall require a separate vote and the approval of a majority of the members of the Debt Commission, provided that such majority shall be required to include not less than 4 members of the Debt Commission appointed by members of the Republican Party and 4 members appointed by members of the Democratic Party.</text></paragraph><paragraph id="H16DD6C4F618244CDB503B359D6143DAD"><enum>(3)</enum><header>Additional views</header><text>A member of the Debt Commission who gives notice of an intention to file supplemental, minority, or additional views at the time of the final Debt Commission vote on the approval of the report and legislative language shall be entitled to 3 days to file those views in writing with the staff director of the Debt Commission to include in the final report.</text></paragraph><paragraph id="HAB4698D3CEC94A4F87375F5FCE93FFB0"><enum>(4)</enum><header>Report and legislative language to be made public</header><text display-inline="yes-display-inline">Upon the approval or disapproval of a report and legislative language under paragraph (1) by the Debt Commission, the Debt Commission shall promptly, and not more than 24 hours after the approval or disapproval or, if timely notice is given under paragraph (3), not more than 24 hours after additional views are filed under such paragraph (3), make the report, the legislative language, and a record of the vote on the report and legislative language available to the public.</text></paragraph><paragraph id="H529E9A23A30B49F8A8DA8CD6387FDB2D"><enum>(5)</enum><header>Submission of report and legislative language</header><text display-inline="yes-display-inline">If a report or legislative language are approved by the Debt Commission under paragraph (1), not later than 3 days after the date on which the report or legislative language are made available to the public under paragraph (4), the Debt Commission shall submit the report or legislative language to the President, the Vice President, the Speaker of the House of Representatives, and the majority and minority leaders of each House of Congress.</text></paragraph></subsection><subsection id="H7DA30F75A7E143A19C01E0D1F46E840F"><enum>(m)</enum><header>Termination</header><text>The Debt Commission shall terminate on the date that is 30 days after the date the Debt Commission submits the final report under subsection (l) or December 31, 2024, whichever is earlier.</text></subsection></section><section id="H46D8817AB27E41B4A8FDBA99108E45B3"><enum>3.</enum><header>Expedited Consideration of Debt Commission Bills</header><subsection id="H9D6B37B75F674C48850FF6E8F4633C4B" commented="no"><enum>(a)</enum><header>Qualifying legislation</header><paragraph id="H4EB8FABF0F484AE8950EC22C82057D85" commented="no"><enum>(1)</enum><header>In general</header><text>Only a Debt Commission bill shall be entitled to expedited consideration under this section.</text></paragraph><paragraph id="H3DD01B3B9A49468A9DC386411DBF0CBB" commented="no"><enum>(2)</enum><header>Debt Commission bill defined</header><text>In this section, the term <term>Debt Commission bill</term> means a bill consisting solely of legislative language that the Debt Commission approves and submits under section 2(l)(5). </text></paragraph></subsection><subsection id="H308D7F9631FF4DABBC89F616211ED5D1"><enum>(b)</enum><header>Consideration in the house of representatives</header><paragraph id="H5505C9F545174FB4BB94CE503886B247" commented="no"><enum>(1)</enum><header>Introduction</header><text>If the Debt Commission approves and submits legislative language under paragraphs (1) and (5), respectively, of section 2(l), the Debt Commission bill consisting solely of that legislative language shall be introduced in the House of Representatives (by request)—</text><subparagraph id="H4991BA9F3BB14F759FA34A9F151589B9" commented="no"><enum>(A)</enum><text>by the majority leader of the House of Representatives, or by a Member of the House of Representatives designated by the majority leader of the House of Representatives, on the third legislative day after the date the Debt Commission approves and submits such legislative language; or</text></subparagraph><subparagraph id="H92026A1918354DD187A3A3377CD010BB" commented="no"><enum>(B)</enum><text>if the Debt Commission bill is not introduced under subparagraph (A), by any Member of the House of Representatives on any legislative day beginning on the legislative day after the legislative day described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HCD1C5871C2914F68BA48279334A235B6"><enum>(2)</enum><header>Referral and reporting</header><text>Any committee of the House of Representatives to which a Debt Commission bill is referred shall report the Debt Commission bill to the House of Representatives without amendment not later than 5 legislative days after the date on which the Debt Commission bill was so referred. If any committee of the House of Representatives to which a Debt Commission bill is referred fails to report the Debt Commission bill within that period, that committee shall be automatically discharged from consideration of the Debt Commission bill, and the Debt Commission bill shall be placed on the appropriate calendar.</text></paragraph><paragraph id="H061699E9F7B94286900BE7F3284E33ED"><enum>(3)</enum><header>Proceeding to consideration</header><text>After the last committee authorized to consider a Debt Commission bill reports it to the House of Representatives or has been discharged from its consideration, it shall be in order to move to proceed to consider the Debt Commission bill in the House of Representatives. Such a motion shall not be in order after the House of Representatives has disposed of a motion to proceed with respect to the Debt Commission bill. The previous question shall be considered as ordered on the motion to its adoption without intervening motion.</text></paragraph><paragraph id="HE8CC8681067F421C8FA72F176A5C4FF3"><enum>(4)</enum><header>Consideration</header><text>The Debt Commission bill shall be considered as read. All points of order against the Debt Commission bill and against its consideration are waived. The previous question shall be considered as ordered on the Debt Commission bill to its passage without intervening motion except 2 hours of debate equally divided and controlled by the proponent and an opponent.</text></paragraph><paragraph id="H20F3D911C5C544B98F5A29EC85AE3BBF"><enum>(5)</enum><header>Vote on passage</header><text>The vote on passage of the Debt Commission bill shall occur pursuant to the constraints under clause 8 of rule XX of the Rules of the House of Representatives.</text></paragraph></subsection><subsection id="HFA58FCB8CF6547B389A1A03ABD88CD9F"><enum>(c)</enum><header>Expedited procedure in the Senate</header><paragraph id="HFE518984298744CB8FAEDED8EF85ECD8" commented="no"><enum>(1)</enum><header>Introduction in the senate</header><text>If the Debt Commission approves and submits legislative language under paragraphs (1) and (5), respectively, of section 2(l)), a Debt Commission bill consisting solely of that legislative language may be introduced in the Senate (by request)—</text><subparagraph id="HD066B69E96AF4220B6F1CE34F9FB2BD0" commented="no"><enum>(A)</enum><text>by the majority leader of the Senate, or by a Member of the Senate designated by the majority leader of the Senate, on the next day on which the Senate is in session; or</text></subparagraph><subparagraph id="H6D0F1893FF274AD5B76B2915739EEC87" commented="no"><enum>(B)</enum><text>if the Debt Commission bill is not introduced under subparagraph (A), by any Member of the Senate on any day on which the Senate is in session beginning on the day after the day described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="HC0F5569D49E34AC295A81B1458243A53"><enum>(2)</enum><header>Committee consideration</header><text>A Debt Commission bill introduced in the Senate under paragraph (1) shall be jointly referred to the committee or committees of jurisdiction, which committees shall report the Debt Commission bill without any revision and with a favorable recommendation, an unfavorable recommendation, or without recommendation, not later than 5 session days after the date on which the Debt Commission bill was so referred. If any committee to which a Debt Commission bill is referred fails to report the Debt Commission bill within that period, that committee shall be automatically discharged from consideration of the Debt Commission bill, and the Debt Commission bill shall be placed on the appropriate calendar.</text></paragraph><paragraph id="H074A3895218B4D03B51D0C442F767DA1"><enum>(3)</enum><header>Proceeding</header><text>Notwithstanding rule XXII of the Standing Rules of the Senate, it is in order, not later than 2 days of session after the date on which a Debt Commission bill is reported or discharged from all committees to which the Debt Commission bill was referred, for the majority leader of the Senate or the designee of the majority leader to move to proceed to the consideration of the Debt Commission bill. It shall also be in order for any Member of the Senate to move to proceed to the consideration of the Debt Commission bill at any time after the conclusion of such 2-day period. A motion to proceed is in order even though a previous motion to the same effect has been disagreed to. All points of order against the motion to proceed to the Debt Commission bill are waived. The motion to proceed is not debatable. The motion is not subject to a motion to postpone. A motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order. If a motion to proceed to the consideration of the Debt Commission bill is agreed to, the Debt Commission bill shall remain the unfinished business until disposed of. All points of order against a Debt Commission bill and against consideration of the Debt Commission bill are waived.</text></paragraph><paragraph id="H8C5A3D4BCB5A4DF18BDA198BF3C655B7"><enum>(4)</enum><header>No amendments</header><text>An amendment to a Debt Commission bill, or a motion to postpone, or a motion to proceed to the consideration of other business, or a motion to recommit the Debt Commission bill, is not in order.</text></paragraph><paragraph id="HDC961EB627584AB48020FFF41167E1A3"><enum>(5)</enum><header>Rulings of the chair on procedure</header><text>Appeals from the decisions of the Chair relating to the application of the rules of the Senate, as the case may be, to the procedure relating to a Debt Commission bill shall be decided without debate.</text></paragraph></subsection><subsection id="H908F862E660C4F2D9D30C2084AA86DAA"><enum>(d)</enum><header>Amendment</header><text>A Debt Commission bill shall not be subject to amendment in either the Senate or the House of Representatives.</text></subsection><subsection id="H1116B80F6A1743328DF439633E0AC6CA"><enum>(e)</enum><header>Consideration by the other house</header><paragraph id="H0B04AE224195407A8AB9BEFE195A5E8C"><enum>(1)</enum><header>In general</header><text>If, before passing a Debt Commission bill, a House receives from the other House a Debt Commission bill consisting of legislative language approved by the same Debt Commission as the Debt Commission bill in the receiving House—</text><subparagraph id="H704D47FA2969476B9154C14004A9FCEC"><enum>(A)</enum><text>the Debt Commission bill of the other House shall not be referred to a committee; and</text></subparagraph><subparagraph id="H22B448E5C2B44E1E8095885417F60C99"><enum>(B)</enum><text>the procedure in the receiving House shall be the same as if no Debt Commission bill had been received from the other House until the vote on passage, when the Debt Commission bill received from the other House shall supplant the Debt Commission bill of the receiving House.</text></subparagraph></paragraph><paragraph id="HB913470ADFE946ADB923AA5CA2F7F570"><enum>(2)</enum><header>Revenue measures</header><text>This subsection shall not apply to the House of Representatives if a Debt Commission bill received from the Senate is a revenue measure.</text></paragraph></subsection><subsection id="HB50DB707F83F49EE9A09ACE4D482A372"><enum>(f)</enum><header>Rules To coordinate action with other house</header><paragraph id="H2F24C991899D4837BA8347D6BFB259D9"><enum>(1)</enum><header>Treatment of debt commission bill of other house</header><text>If a Debt Commission bill is not introduced in the Senate or the Senate fails to consider a Debt Commission bill under this section, the Debt Commission bill of the House of Representatives consisting of legislative language approved by the same Debt Commission as the Debt Commission bill in the Senate shall be entitled to expedited floor procedures under this section.</text></paragraph><paragraph id="HC4C2B470273D41BAAA2A51DF7AF6A96E"><enum>(2)</enum><header>Treatment of companion measures in the senate</header><text>If, following passage of a Debt Commission bill in the Senate, the Senate then receives from the House of Representatives a Debt Commission bill approved by the same Debt Commission and consisting of the same legislative language as the Senate-passed Debt Commission bill, the House-passed Debt Commission bill shall not be debatable. The vote on passage of the Debt Commission bill in the Senate shall be considered to be the vote on passage of the Debt Commission bill received from the House of Representatives.</text></paragraph><paragraph id="H040CF4A764274C99812828518A060631"><enum>(3)</enum><header>Vetoes</header><text>If the President vetoes a Debt Commission bill, consideration of a veto message in the Senate under this paragraph shall be 10 hours equally divided between the majority and minority leaders of the Senate or the designees of the majority and minority leaders of the Senate.</text></paragraph></subsection></section><section id="HDDC57A91FFE3426090B8E113B4F9BE6A"><enum>4.</enum><header>Rulemaking</header><text display-inline="no-display-inline">The provisions of this Act are enacted by Congress—</text><paragraph id="HA1F6AB7C35C34FAD9F971476848BB8DF"><enum>(1)</enum><text>as an exercise of the rulemaking power of the Senate and the House of Representatives, respectively, and, as such, the provisions—</text><subparagraph id="HE5B4968ED2974F03A51B1D230908A39D"><enum>(A)</enum><text>shall be considered as part of the rules of each House, respectively, or of that House to which they specifically apply; and</text></subparagraph><subparagraph id="H498036DECB464D11B16846A4FF0284B1"><enum>(B)</enum><text>shall supersede other rules only to the extent that they are inconsistent therewith; and</text></subparagraph></paragraph><paragraph id="HC39D86470E744EF792946466236A35B2"><enum>(2)</enum><text>with full recognition of the constitutional right of either House to change such rules (so far as relating to such House) at any time, in the same manner, and to the same extent as in the case of any other rule of such House.</text></paragraph></section></legis-body></bill>
