<official-title display="yes">To require institutions of higher education to disseminate information on the rights of, and accommodations and resources for, pregnant students, and for other purposes.</official-title>

<section id="HF83F3EAE8DD449C99164768D44194B52" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pregnant Students’ Rights Act</short-title></quote>.</text></section> <section id="H9170E98C84F94497A218A0555E97DD01"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="HBE7A54035C514B48AB5BDA0C321899C9"><enum>(1)</enum><text display-inline="yes-display-inline">Female students enrolled at institutions of higher education and experiencing an unplanned pregnancy may face pressure that their only option is to receive an abortion or risk academic failure. </text></paragraph> <paragraph id="HEA375AC9F9A8414CA58FCB85988F8130"><enum>(2)</enum><text display-inline="yes-display-inline">Almost 30 percent of all abortions in the United States are performed on women of college age, between the ages of 20 and 24, according to a 2021 report by the Centers for Disease Control and Prevention.</text></paragraph>
<paragraph id="HDDB88370FE8C49E19CEACB85E4BA2F8E"><enum>(3)</enum><text display-inline="yes-display-inline">Scientific evidence and personal testimonies document that women who have abortions can be at risk of mental health issues. Studies show that after an abortion, women are 34 percent more likely to develop anxiety disorders, 37 percent more likely to develop depression, 110 percent more likely to rely on alcohol use or abuse, 115 percent more likely to develop suicidal behavior, and 220 percent more likely to take on marijuana use or abuse. As many as 60 percent of women having an abortion experience some level of emotional distress afterwards, with 30 percent being classified as severe distress. Potential complications of abortions include heavy or persistent bleeding, damage to cervix, abdominal pain or cramping, scarring of uterine lining, breast cancer, future premature births or miscarriages, infection or sepsis, placenta previa, perforation of uterus, damage to other organs, and even death.</text></paragraph> <paragraph id="HA6FAE6CD18824AE5B44183D7A56949BB"><enum>(4)</enum><text display-inline="yes-display-inline">A significant proportion of abortions in the United States are performed on women of college age who may be unaware of their rights to accommodation and prohibitions against discrimination due to pregnancy under title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) or deprived of information about abortion alternatives.</text></paragraph>
<paragraph id="H5F91CECFA3E74D63AA92A423F26240A9"><enum>(5)</enum><text display-inline="yes-display-inline">Additionally, women on college campuses may fear institutional reprisal, loss of athletic scholarship, and possible negative impact on academic opportunities during the pregnancy and after childbirth. </text></paragraph> <paragraph id="H0E8CEAD7315A41A7959504068385FC41"><enum>(6)</enum><text display-inline="yes-display-inline">An academic disparity exists because of the lack of resources, support, and notifications available for female college students who do not wish to receive an abortion or who carry their unborn babies to term.</text></paragraph></section>
<section id="HAD68819BEDDA43E9AD689A787163872B"><enum>3.</enum><header>Notice of pregnant student rights, accommodations, and resources</header><text display-inline="no-display-inline">Section 485 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092</external-xref>) is amended by adding at the end the following: </text> <quoted-block style="OLC" id="H5682B46B65A240DCBB2C7EBB4DDCD7D1" display-inline="no-display-inline"> <subsection id="H49AE9EC31D4B4D738F3D01D0C6B6C485"><enum>(n)</enum><header>Pregnant Students’ Rights, Accommodations, and Resources</header> <paragraph id="HAB6E9D99E2AF4011A6EB9ACE7A6D29AC"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each institution of higher education participating in any program under this title shall carry out the information dissemination activities described in <internal-xref idref="H9F5C9A8F1DBC450EA421F68AE571D879" legis-path="(n)(2)">paragraph (3)</internal-xref> for prospective and enrolled students (including those attending or planning to attend less than full time) regarding the information described in <internal-xref idref="H9F5C9A8F1DBC450EA421F68AE571D879" legis-path="(n)(2)">paragraph (2)</internal-xref> on the rights to, and resources (including protections and accommodations) for, pregnant students to carry a baby to term and students who may become pregnant while enrolled at such institution of higher education to carry a baby to term.</text></paragraph>
<paragraph id="H9F5C9A8F1DBC450EA421F68AE571D879"><enum>(2)</enum><header>Information content</header><text display-inline="yes-display-inline">The information described in this paragraph is the following:</text> <subparagraph id="HA046F457BAED4F3D8B8D7D7880BF3AD5"><enum>(A)</enum><text display-inline="yes-display-inline">A list of resources on campus and in the community that exist to help a pregnant student in carrying the baby to term and caring for the baby after birth.</text></subparagraph>
<subparagraph id="HA8EF7397B010465F9418BE0185EF5110"><enum>(B)</enum><text display-inline="yes-display-inline">Information about the accommodations available to help a pregnant student carry the baby to term and parent the baby after birth.</text></subparagraph> <subparagraph id="H2D2ECBC8248446CCB5DE08A5FA5FE7AF"><enum>(C)</enum><text display-inline="yes-display-inline">Information on how to file a complaint with—</text>
<clause id="H579F5C4BFAB34C24BF1BBEBA31A0F79A"><enum>(i)</enum><text display-inline="yes-display-inline">the Department of Education, if a student believes there was a violation by the institution of title IX of the Education Amendments of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/20/1681">20 U.S.C. 1681 et seq.</external-xref>) on account of such student’s determination to carry a baby to term; and</text></clause> <clause id="H91D763F371704EEF89BD5811AC8ECD42"><enum>(ii)</enum><text display-inline="yes-display-inline">the institution, if a student believes the student has been discriminated against in violation of such title IX on account of the student’s determination to carry a baby to term.</text></clause></subparagraph></paragraph>
<paragraph id="HA168A5B9FF574D48986F2760D7C6D667"><enum>(3)</enum><header>Information dissemination activities</header><text>The information dissemination activities described in this paragraph shall include—</text> <subparagraph id="HE48477AC78114BA181B2F450B6F83F9F" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an email to each enrolled student at the start of each period of study during an academic year; and</text></subparagraph>
<subparagraph id="HA3B85898B42B4E51A46C5911FC17D032"><enum>(B)</enum><text display-inline="yes-display-inline">the provision of information—</text> <clause id="H066BC57144E040BD9B5EEABF1B289EE4"><enum>(i)</enum><text>in student handbooks, if any;</text></clause>
<clause id="H5B092D24882B417DA1FE1B715EF5473A"><enum>(ii)</enum><text>at each orientation for enrolled students;</text></clause> <clause id="HB68ED9C7E8B542979D0F695A0221B0AF"><enum>(iii)</enum><text>at student health or counseling centers, if any; and</text></clause>
<clause id="H9F25B3D75486404484CF5516A06BE0BC"><enum>(iv)</enum><text>on the publicly available website of the institution of higher education.</text></clause></subparagraph></paragraph> <paragraph id="H37D978A54FB040EA9644A6F3E219BD49"><enum>(4)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed to authorize the Secretary to require the dissemination of additional information, or establish additional rights, beyond the information and rights included in this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
