R. 6829</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20240924">September 24, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend the Public Health Service Act to authorize and support the creation and dissemination of cardiomyopathy education, awareness, and risk assessment materials and resources to identify more at-risk families, to authorize research and surveillance activities relating to cardiomyopathy, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H5E9F9D8D9A734FA6B4B34DAEAE7792E8"><section id="H27CBDF136A1E41548D2D0B045ED4F042" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cardiomyopathy Health Education, Awareness, and Research, and AED Training in the Schools Act of 2024</short-title></quote> or the <quote><short-title>HEARTS Act of 2024</short-title></quote>. </text></section><section id="HFBC55246E50046E6ADD421A5484ADFFA"><enum>2.</enum><header>Cardiomyopathy health education, awareness, and research, and AED training in schools</header><subsection id="H4C0A06CC57C241478AC1B229B7D4EC93"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">The Public Health Service Act is amended by inserting after section 312 (<external-xref legal-doc="usc" parsable-cite="usc/42/244">42 U.S.C. 244</external-xref>) the following:</text><quoted-block style="OLC" id="HD158E32A85DB4CF09548A7C804424282" display-inline="no-display-inline"><section id="H4CC9DEBB4D55444290F3C09288D2F485"><enum>312A.</enum><header>Materials and resources to increase education and awareness of cardiomyopathy among school administrators, educators, and families</header><subsection id="H98D1E17B9E7F44DE8376FE5A7D360AB7"><enum>(a)</enum><header>Materials and resources</header><text>Not later than 18 months after the date of the enactment of the <short-title>HEARTS Act of 2024</short-title>, the Secretary, in consultation with the Director of the Centers for Disease Control and Prevention, shall develop public education materials and resources to be disseminated to school administrators, educators, school health professionals, coaches, families, guardians, caregivers, and other appropriate individuals. The materials and resources shall include—</text><paragraph id="HE8AF8A27441D4FE2B50325712CF3D2AD"><enum>(1)</enum><text display-inline="yes-display-inline">information on the signs, symptoms, and risk factors associated with high-risk cardiac conditions and genetic heart rhythm abnormalities that may cause sudden cardiac arrest in children, adolescents, and young adults, including—</text><subparagraph id="H5323E75AF0F84A43BB766B6228EEE6C4"><enum>(A)</enum><text>cardiomyopathy;</text></subparagraph><subparagraph id="H9C98BD27B24F4134900F7F0BCB01A562"><enum>(B)</enum><text>long QT syndrome, Brugada syndrome, catecholaminergic polymorphic ventricular tachycardia, short QT syndrome, and Wolff-Parkinson-White syndrome; and</text></subparagraph><subparagraph id="H4055D27BA96A4F028CAC4A3D99DC56D8"><enum>(C)</enum><text>other high-risk cardiac conditions, as determined by the Secretary;</text></subparagraph></paragraph><paragraph id="H9B9F0A14BDAD41E6861BB9CC7C3D8BEE"><enum>(2)</enum><text>guidelines regarding the placement of automated external defibrillators in schools, early childhood education programs, and child care centers;</text></paragraph><paragraph id="HB48A0027E136446BA663774DD8C2F73A"><enum>(3)</enum><text>training information on automated external defibrillators and cardiopulmonary resuscitation; and</text></paragraph><paragraph id="HBCC49A4212004219A54797F7064429A9"><enum>(4)</enum><text>recommendations for how schools, early childhood education programs, and child care centers can develop and implement a cardiac emergency response plan.</text></paragraph></subsection><subsection id="H4C9F17F060244597B6B6CB6FFC025D8D"><enum>(b)</enum><header>Dissemination of materials and resources</header><text>Not later than 30 months after the date of the enactment of the <short-title>HEARTS Act of 2024</short-title>, the Secretary shall disseminate the materials and resources developed under subsection (a) in accordance with the following:</text><paragraph id="HA773761DFE324902BE53D29873D277E3"><enum>(1)</enum><header>Distribution by State educational agencies</header><text>The Secretary shall make available such materials and resources to State educational agencies to distribute—</text><subparagraph id="H82B8BD88FB6747458CBD747F57714A35"><enum>(A)</enum><text>to school administrators, educators, school health professionals, coaches, families, guardians, caregivers, and other appropriate individuals, the information developed under subsection (a)(1);</text></subparagraph><subparagraph commented="no" id="HF941E5E44C4C46D397273EF48C8136A1"><enum>(B)</enum><text display-inline="yes-display-inline">to parents, guardians, or other caregivers, the cardiomyopathy risk assessment developed pursuant to section 312B(b)(1); and</text></subparagraph><subparagraph commented="no" id="H53B195D7592847E58F1DD1B586262660"><enum>(C)</enum><text>to school administrators, educators, school health professionals, and coaches—</text><clause commented="no" id="H57C4ACBEC1DA484485A4471BD89FF89C"><enum>(i)</enum><text>the guidelines described in subsection (a)(2);</text></clause><clause commented="no" id="H40FE77B536A14D1F872B645B8924A8D4"><enum>(ii)</enum><text>the training information described in subsection (a)(3); and</text></clause><clause commented="no" id="HFA3EA8ABC13840FBAD4B3247BB8B796D"><enum>(iii)</enum><text>the recommendations described in subsection (a)(4).</text></clause></subparagraph></paragraph><paragraph id="HAEAE1BBD42EC4F05A4D46295632A7656"><enum>(2)</enum><header>Dissemination to health departments and professionals</header><text>The Secretary shall make available the materials and resources developed under subsection (a) to State and local health departments, pediatricians, hospitals, and other health professionals, such as nurses and first responders.</text></paragraph><paragraph id="HAC5DB06555664177BCA38152B349DFAD"><enum>(3)</enum><header>Posting on website</header><subparagraph id="H3F0177B97B554B618AD1409C48CE6232"><enum>(A)</enum><header>CDC</header><clause id="H02D1026B60C94F029EC248E6868973BC"><enum>(i)</enum><header>In general</header><text>The Secretary, through the Director, shall post the materials and resources developed under subsection (a) on the public Internet website of the Centers for Disease Control and Prevention.</text></clause><clause id="HE34B952BE8B54EA3B1C777ED0A00D2D5"><enum>(ii)</enum><header>Additional information</header><text>The Director is encouraged to maintain on such public Internet website such additional information regarding cardiomyopathy as deemed appropriate by the Director.</text></clause></subparagraph><subparagraph id="H34504B0A52614D9688FDE59F1D0F88AB"><enum>(B)</enum><header>State educational agencies</header><text>State educational agencies are encouraged to create public Internet webpages dedicated to cardiomyopathy and post the materials and resources developed under subsection (a) on such webpages.</text></subparagraph></paragraph></subsection><subsection id="H16E781E693E3496AB31696AAE524DD5B"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0F802CDCF55F43F9A7615257BABDEFE0"><enum>(1)</enum><text>The term <term>cardiomyopathy</term> means a heart disease that affects the heart’s muscle (myocardium)—</text><subparagraph id="HA3FD22076DE0465695484CF644CAEE44"><enum>(A)</enum><text>the symptoms of which may vary from case to case, including—</text><clause id="H5019997DC3A840B5AFC1C398E336C6D1"><enum>(i)</enum><text>cases in which no symptoms are present (asymptomatic); and</text></clause><clause id="HE9B642449D6B4307BA474BCCEAEC241F"><enum>(ii)</enum><text>cases in which there are symptoms of a progressive condition that may result from an impaired ability of the heart to pump blood, such as fatigue, irregular heartbeats (arrhythmia), heart failure, and, potentially, sudden cardiac death; and</text></clause></subparagraph><subparagraph id="HB4B631C4FE444FEF90DB343DE67C0F50"><enum>(B)</enum><text>the recognized types of which include dilated, hypertrophic, restrictive, arrhythmogenic right ventricular dysplasia, and left ventricular non-compaction.</text></subparagraph></paragraph><paragraph id="HD1C20B0A209D49D5B4770E1EB19C2AF4"><enum>(2)</enum><text>The term <quote>Director</quote> means the Director of the Centers for Disease Control and Prevention. </text></paragraph><paragraph id="HCBB71FBDC60D46A28E7C3421BE120D3D"><enum>(3)</enum><text display-inline="yes-display-inline">The terms <term>early childhood education program</term>, <term>elementary school</term>, and <term>secondary school</term> have the meanings given to those terms in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph commented="no" id="H0165F087743847B4B625E98979D8E3ED"><enum>(4)</enum><text>The term <term>school administrator</term> means a principal, director, manager, or other supervisor or leader within an elementary school, secondary school, State-based early childhood education program, or child care center.</text></paragraph><paragraph id="H29C0EBA099604172B21807EEF88A6B91"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>school health professional</term> means a health professional serving at an elementary school, secondary school, State-based early childhood education program, or child care center.</text></paragraph></subsection></section><section id="HD32E103F68FE49F28795E435BAD04F92"><enum>312B.</enum><header>Activities relating to cardiomyopathy</header><subsection id="H44885315981846659772F7C37DE4B090"><enum>(a)</enum><header>Report on CDC national cardiomyopathy activities</header><paragraph commented="no" id="H1B9982BAD74045B8AEE8903861AA8BC7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of the <short-title>HEARTS Act of 2024</short-title>, the Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall submit to Congress a report on findings generated from existing activities conducted by the Centers for Disease Control and Prevention to improve the understanding of the prevalence and epidemiology of cardiomyopathy across the lifespan, from birth to adulthood, with particular interest in the following:</text><subparagraph commented="no" id="HFA5CB5EE933F4BB6BB6DC1B9EA17FFEA"><enum>(A)</enum><text>The natural history of individuals with cardiomyopathy, in both the pediatric and adult population.</text></subparagraph><subparagraph commented="no" id="HEE9B016D11EA4309980AD45DBED85E3F"><enum>(B)</enum><text>Estimates of cardiomyopathy-related emergency department visits and hospitalizations, in both the pediatric and adult population.</text></subparagraph></paragraph><paragraph id="HE68B08DF852B4EEDA00D6D16AADB8B29"><enum>(2)</enum><header>Public access</header><text display-inline="yes-display-inline">Subject to paragraph (3), the report submitted under this subsection shall be made available to the public.</text></paragraph><paragraph id="HA526B232160E4824BDF91ABBA2FB15C1"><enum>(3)</enum><header>Privacy protections</header><text display-inline="yes-display-inline">The Secretary shall ensure that this subsection is carried out in a manner that complies with all applicable privacy laws under Federal and State law.</text></paragraph></subsection><subsection id="H657BA821CD3E4A57BE1BBDA1B7404864"><enum>(b)</enum><header>Improving risk assessments for individuals with cardiomyopathy</header><paragraph commented="no" id="HE8AFA8A4D3214B429442F680451BCAEA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop and make publicly available a cardiomyopathy risk assessment for health care providers and individuals. Such risk assessment shall, at a minimum, include the following:</text><subparagraph commented="no" id="H14F04C31D9A24A68BF82CCB1A8EB8E74"><enum>(A)</enum><text>Background information on the prevalence, incidence, and health impact of cardiomyopathy, including all forms of cardiomyopathy and their effects on pediatric, adolescent, and adult individuals.</text></subparagraph><subparagraph commented="no" id="H17081746F0874D148D72EC7B03523D46"><enum>(B)</enum><text display-inline="yes-display-inline">A worksheet with variables and conditions for an individual or health care provider to use in assessing whether an individual is at risk for cardiomyopathy.</text></subparagraph><subparagraph commented="no" id="H7407148F1A414655AB0F284DB74CF061"><enum>(C)</enum><text>A worksheet with variables and stages of progression for an individual or health care provider to use in assessing whether and to what extent cardiomyopathy has progressed in an individual.</text></subparagraph><subparagraph commented="no" id="HC67189EB469A4DF49BA5299BE4C25837"><enum>(D)</enum><text>Guidelines on cardiomyopathy screenings for individuals who are at risk for, or have a family history of, cardiomyopathy.</text></subparagraph></paragraph><paragraph id="H50FE0AA3A8454B47AA0C793CC151707F"><enum>(2)</enum><header>Stakeholder Input</header><text>In carrying out paragraph (1), the Director of the Centers for Disease Control and Prevention shall seek input from external stakeholders including—</text><subparagraph id="H72281A9F9892418C86B14E0081F88A77"><enum>(A)</enum><text>representatives from national patient advocacy organizations expert in all forms of cardiomyopathy;</text></subparagraph><subparagraph id="HDA5C4B928E8F4F17A309058AC32C8C21"><enum>(B)</enum><text>representatives from medical professional societies that specialize in the care of adults and pediatrics with cardiomyopathy; and</text></subparagraph><subparagraph id="H02B454E897A34C1EAF88D3600D138728"><enum>(C)</enum><text>representatives from other relevant Federal agencies.</text></subparagraph></paragraph></subsection><subsection id="H9F16A827DA8C4B86BC62202CF8371E54"><enum>(c)</enum><header>Definition</header><text>In this section, the term <quote>cardiomyopathy</quote> has the meaning given to such term in section 312A.</text></subsection></section><section id="H90B2AFE9139942D3A8AFE54B78CF0B7E" commented="no"><enum>312C.</enum><header>Cardiomyopathy research</header><subsection id="H161139E5875A4FC3B8A31BB92262F759" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Director of the National Institutes of Health, may expand and coordinate research and related activities of the National Institutes of Health with respect to cardiomyopathy, which may include research with respect to—</text><paragraph commented="no" id="HA6F705259EA14C7190B16EB2D087AF2E"><enum>(1)</enum><text>causation of cardiomyopathy, including genetic causes and molecular biomarkers;</text></paragraph><paragraph commented="no" id="H3789C5BE047840E8AF19DDBF2C011FDC"><enum>(2)</enum><text>long-term health outcomes in individuals with cardiomyopathy, including infants, children, teenagers, adults, and elderly individuals; and</text></paragraph><paragraph commented="no" id="HA2DEF3F3FF1B40EDAB405816CC60FC45"><enum>(3)</enum><text>studies using longitudinal data and retrospective analysis to identify effective treatments and outcomes for individuals with cardiomyopathy.</text></paragraph></subsection><subsection id="HE01CE4E650CD46C9BD7843C91D686236"><enum>(b)</enum><header>Nonduplication</header><text display-inline="yes-display-inline">The Secretary shall ensure that any research and activities related to cardiomyopathy under this section do not unnecessarily duplicate activities, programs, or efforts of other agencies and offices within the Department of Health and Human Services.</text></subsection><subsection id="HE501AF1993FC4501AE6EEABB49B7203C" commented="no"><enum>(c)</enum><header>NIH report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of the <short-title>HEARTS Act of 2024</short-title>, the Secretary, in consultation with the Director of the National Institutes of Health, shall submit to Congress a report—</text><paragraph id="HC150A914063C408986019ED34A8A9272" commented="no"><enum>(1)</enum><text>outlining the ongoing research efforts of the National Institutes of Health regarding cardiomyopathy; and</text></paragraph><paragraph id="HC70C134C4C894510BBBD39D7400843A0" commented="no"><enum>(2)</enum><text>identifying—</text><subparagraph id="H30DE15D264104A3EB8D1B8FE14630796" commented="no"><enum>(A)</enum><text>a research agenda regarding adult forms of cardiomyopathy;</text></subparagraph><subparagraph id="HC418C0CAD9144EFAA212934F8A2EFC26" commented="no"><enum>(B)</enum><text>plans for researching cardiomyopathy affecting the pediatric population; and</text></subparagraph><subparagraph id="HF4B1028D3CEB4E58B2227ABF0C8A823B" commented="no"><enum>(C)</enum><text>the areas of greatest need for such research.</text></subparagraph></paragraph></subsection><subsection id="H4DB47FD24D5C448C8506D2C4F99C7A6C" commented="no"><enum>(d)</enum><header>Cardiomyopathy defined</header><text display-inline="yes-display-inline">In this section, the term <term>cardiomyopathy</term> has the meaning given to such term in section 312A.</text></subsection></section><section id="HED05B3F809364227A7351D7B4C8D0619"><enum>312D.</enum><header>Promoting student access to AEDs and CPR</header><subsection id="H5C86E6461F6049ABA0D4075C542A0BD5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may award grants to eligible entities to develop and implement a comprehensive program to promote student access to automated external defibrillators (in this section referred to as <quote>AEDs</quote>) and cardiopulmonary resuscitation (in this section referred to as <quote>CPR</quote>) in public elementary schools and secondary schools.</text></subsection><subsection id="H9027FA1D3D5344F4B1785288F66610F3"><enum>(b)</enum><header>Use of funds</header><text>An eligible entity receiving a grant under subsection (a) may use funds received through such grant to carry out any of the following activities:</text><paragraph id="HC9E8793577C14658848CADFE91FA7B67"><enum>(1)</enum><text display-inline="yes-display-inline">Developing and providing comprehensive materials to establish AED and CPR programs in public elementary schools and secondary schools.</text></paragraph><paragraph id="H1681639C19E241EAA22D791D64C3FD15"><enum>(2)</enum><text>Providing support for CPR and AED training programs in such schools for students, staff, and related sports volunteers.</text></paragraph><paragraph id="H7590F428A9974481A1400DAC20403D26"><enum>(3)</enum><text>Providing support for developing a cardiac emergency response plan within such schools.</text></paragraph><paragraph id="H0837AA2ECBB744C491E12504EDBD609F"><enum>(4)</enum><text>Purchasing AEDs that have been approved under section 515 of the Federal Food, Drug, and Cosmetic Act, cleared under section 510(k) of such Act, or classified under section 513(f)(2) of such Act.</text></paragraph><paragraph id="HC2BEFCB485044DA1A7D4A2AFE9D75254"><enum>(5)</enum><text>Purchasing necessary AED batteries and performing necessary AED maintenance (such as by replacing AED pads) in accordance with the labeling of the AED involved.</text></paragraph><paragraph id="HD8BD4C9540B145A0AA476FF223964A06"><enum>(6)</enum><text>Replacing old and outdated AED and CPR equipment, machinery, and educational materials.</text></paragraph></subsection><subsection id="H46F309AF3E6649FCBB5BADD82C4212BB"><enum>(c)</enum><header>Eligibility; application</header><text>To be eligible for a grant under subsection (a), an entity shall—</text><paragraph id="H02DF8D4BE60249A8B088A2B8C76C06FD"><enum>(1)</enum><text>be a local educational agency (including a public charter school operating as a local educational agency under State law), in consultation with a qualified health care entity; and</text></paragraph><paragraph id="H3BA9736856254750AFAB14AE99738220"><enum>(2)</enum><text>submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may reasonably require.</text></paragraph></subsection><subsection id="H9B2DFB3AC4C2461EA4C113C505AD895B"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HFD58CACC2CDC4B48AC83BDB6C344FD52"><enum>(1)</enum><header>ESEA terms</header><text>The terms <quote>elementary school</quote>, <quote>local educational agency</quote>, and <quote>secondary school</quote> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph><paragraph id="H619056C5099043078CA37EE45723F4CA" commented="no"><enum>(2)</enum><header>Qualified health care entity</header><text display-inline="yes-display-inline">The term <quote>qualified health care entity</quote> means a health care entity that—</text><subparagraph id="HC48C1D9F3A744A528A4B4C83953407AE" commented="no"><enum>(A)</enum><text>is—</text><clause id="H3A75E15F30BB46F686B3FF32EF6BC113" commented="no"><enum>(i)</enum><text>a public entity; or</text></clause><clause id="H8207DA23461C4B0A905170AE4879B14F" commented="no"><enum>(ii)</enum><text>an organization that is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code;</text></clause></subparagraph><subparagraph id="HC724F9D48B4A4CCE99CBFCB018138453" commented="no"><enum>(B)</enum><text>demonstrates an ability to develop, train, and implement a comprehensive program to promote student access to defibrillation in public elementary and secondary schools; and</text></subparagraph><subparagraph id="HFA063CFB58414A1C9218B90F83F859DD" commented="no"><enum>(C)</enum><text>is qualified in providing technical assistance in AED and CPR training.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H261A26F5029643E9BDD8B39343F72F17"><enum>(b)</enum><header>No additional funds</header><text>No additional funds are authorized to be appropriated to carry out sections 312A, 312B, 312C, and 312D of the Public Health Service Act, as inserted by subsection (a).</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240923" chamber="House">Passed the House of Representatives September 23, 2024.</attestation-date><attestor display="yes">Kevin F.
