<section id="HB64572B413A742E18F7AB9F591BFE96F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Technology for Terror Act</short-title></quote>. </text></section> <section id="H2E789D2E3B46403CB052DC3AD71EA970"><enum>2.</enum><header>Application of foreign-direct product rules to Iran</header> <subsection id="H072642BB7DCC491E8455A6F20878235F"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 90 days after the date of the enactment of this Act, a foreign-produced item shall be subject to the Export Administration Regulations (pursuant to the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801 et seq.</external-xref>)) if the item—</text> 
<paragraph id="HB64C8993BA654C3C97ADE4E533E0B68B"><enum>(1)</enum><text>meets—</text> <subparagraph id="H3DDF6600595D43129813BDE90E27A898"><enum>(A)</enum><text>the product scope requirements described in subsection (b); and</text></subparagraph> 
<subparagraph id="H757767631DFD4D938E3961902E6A4613"><enum>(B)</enum><text>the destination scope requirements described in subsection (c); and</text></subparagraph></paragraph> <paragraph id="HC89D3090B9F64F0DB23642838132A864"><enum>(2)</enum><text>is exported, reexported, or in-country transferred to Iran from abroad or involves the Government of Iran.</text></paragraph></subsection> 
<subsection id="H254C9E507D534171A5CD14B8969E8531"><enum>(b)</enum><header>Product scope requirements</header><text>A foreign-produced item meets the product scope requirements of this subsection if the item—</text> <paragraph id="H0F1E58C358AF4C65825A994E56BB0B9B"><enum>(1)</enum><text>is a direct product of United States-origin technology or software subject to the Export Administration Regulations that is specified in a covered Export Control Classification Number or is identified in supplement no. 7 to part 746 of the Export Administration Regulations; or</text></paragraph> 
<paragraph id="H04528135E61E4F6D8FCE4DD3426767CC"><enum>(2)</enum><text>is produced by any plant or major component of a plant that is located outside the United States, if the plant or major component of a plant, whether made in the United States or a foreign country, itself is a direct product of United States-origin technology or software subject to the Export Administration Regulations that is specified in a covered Export Control Classification Number.</text></paragraph></subsection> <subsection id="HE63378739DE44F66BB449300AD2DF9DB"><enum>(c)</enum><header>Destination scope requirements</header><text>A foreign-produced item meets the destination scope requirements of this subsection if there is knowledge that the foreign-produced item is destined to Iran or will be incorporated into or used in the production or development of any part, component, or equipment subject to the Export Administration Regulations and produced in or destined to Iran.</text></subsection> 
<subsection id="H036BF91DBEE846AB808736AC5F98715D"><enum>(d)</enum><header>License requirements</header> 
<paragraph id="H8137511C4F3347388F65BD608E8ED3E4"><enum>(1)</enum><header>In general</header><text>A license shall be required to export, reexport, or in-country transfer a foreign-produced item from abroad that meets the product scope requirements described in subsection (b) and the destination scope requirements described in subsection (c) and is subject to the Export Administration Regulations pursuant to this section.</text></paragraph> <paragraph id="H1922DE58748945DA961802722321AE6B"><enum>(2)</enum><header>Exceptions</header><text>The license requirements of paragraph (1) shall not apply to—</text> 
<subparagraph id="H68A49A0791A44EEBAC3504F41A2E1EAF"><enum>(A)</enum><text>food, medicine, or medical devices that are—</text> <clause id="H8565A0D7DFE44466B8217C4C0D6CEE46"><enum>(i)</enum><text>designated as EAR99; or</text></clause> 
<clause id="H2F4FA94BD25A4C15AE38ED8C55202484"><enum>(ii)</enum><text>not designated under or listed on the Commerce Control List; or</text></clause></subparagraph> <subparagraph id="HA8756DBC575C4DA9BA5BABD61B694DB7"><enum>(B)</enum><text>services, software, or hardware (other than services, software, or hardware for end-users owned or controlled by the Government of Iran) that are—</text> 
<clause id="HD0C4D5C4172A4FCA8E8B4B87BBA07487"><enum>(i)</enum><text>necessarily and ordinarily incident to communications; or</text></clause> <clause id="HA883CE4A93454A4081BF3DE05E5B45CE"><enum>(ii)</enum><text>designated as—</text> 
<subclause id="H01623848BB904F84878296D37B9CE862"><enum>(I)</enum><text>EAR99; or</text></subclause> <subclause id="HA1F3D7954C4A43FC87C2428CE0093EDB"><enum>(II)</enum><text>Export Control Classification Number 5A992.c or 5D992.c, and classified in accordance with section 740.17 of title 15 Code of Federal Regulations; and</text></subclause></clause> 
<clause id="HE2A1A73A55CB496C87EAED5F05027779"><enum>(iii)</enum><text>subject to a general license issued by the Department of Commerce or Department of Treasury.</text></clause></subparagraph></paragraph></subsection> <subsection id="HF296272B861B43248D9E1C3FE42D2857"><enum>(e)</enum><header>National interest waiver</header><text>The Secretary of Commerce may waive the requirements imposed under this section if the Secretary—</text> 
<paragraph id="HBC701D64C535477D85A02B2D6D518CD6"><enum>(1)</enum><text>determines that the waiver is in the national interests of the United States; and</text></paragraph> <paragraph id="H2518D769467E4640A27FA76B82689877"><enum>(2)</enum><text>submits to the Committee on Foreign Affairs of the House of Representatives and the Committee on Banking, Housing, and Urban Affairs of the Senate a report explaining which requirements are being waived and the reasons for the waiver.</text></paragraph></subsection> 
<subsection id="H3FA0C448626C43B9834118E59553596D"><enum>(f)</enum><header>Sunset</header><text>The authority provided under this section shall terminate on the date that is 7 years after the date of the enactment of this Act.</text></subsection> <subsection id="H8A9844A5060544B3951344E18A8EB741"><enum>(g)</enum><header>Definitions</header><text>In this section—</text> 
<paragraph id="HA6E4ECD27D514A5EBAE5A22A1089FA10"><enum>(1)</enum><text>the term <term>Commerce Control List</term> means the list maintained pursuant to part 744 of the Export Administration Regulations;</text></paragraph> <paragraph id="H9A458EB79A7840B28EDD058E903344D2"><enum>(2)</enum><text>the term <term>covered Export Control Classification Number</term> means an Export Control Classification Number in product group D or E of Category 3, 4, 5, 6, 7, 8, or 9 of the Commerce Control List;</text></paragraph> 
<paragraph id="H47974BE24EB44D74B1763A00AE7EC4A2"><enum>(3)</enum><text>the terms <term>Export Administration Regulations</term>, <term>export</term>, <term>reexport</term>, and <term>in-country transfer</term> have the meanings given those terms in section 1742 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref>); and</text></paragraph> <paragraph id="H7A81C5D654A446CCBE722078FF2DF78C"><enum>(4)</enum><text>the terms <term>direct product</term>, <term>technology</term>, <term>software</term>, <term>major component</term>, <term>knowledge</term>, <term>production</term>, <term>development</term>, <term>part</term>, <term>component</term>, <term>equipment</term>, and <term>government end users</term> have the meanings given those terms in section 734.9 or part 772 of the Export Administration Regulations, as the case may be.</text></paragraph></subsection></section>
