R. 6591</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>February 29, 2024</action-date><action-desc>Received; read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend section 8(a) of the Small Business Act to require the Administrator of the Small Business Administration to regularly reassess the asset and net worth thresholds for qualifying as an economically disadvantaged individual, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H7D0C5D8BF9704645AB9E9D9FEB8703A6"><section id="H22C1F039BE304B13A9FD125CBA7599D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Encouraging Success Act</short-title></quote>.</text></section><section id="HCFB4566B9D9A4AC6BFE373A2B6CDFCA0"><enum>2.</enum><header>Regular reassessment of the thresholds for economically disadvantaged individuals</header><subsection id="H9EBABF4429FD474FAB3AEE2382ECB4CC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 8(a)(6) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)(6)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H175B1B131C784D5A878DCE8D995E8FE7" display-inline="no-display-inline"><subparagraph id="HF51985FE12B449D9BAB13D5EE64B54E1" indent="up2"><enum>(F)</enum><clause commented="no" display-inline="yes-display-inline" id="H40F680C83CDB45559474EE47B7456A65"><enum>(i)</enum><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this subparagraph, and not less frequently than every 4 years thereafter, the Administrator shall assess and, if appropriate, revise the maximum value of asset and the maximum net worth an individual may have to qualify as an economically disadvantaged individual under subparagraph (A) to account for changes in the economy, including inflation and other factors as determined appropriate by the Administrator.</text></clause><clause id="H60039F000E6A4005BF21463A12763940" indent="down1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Administrator shall make each covered revision by issuing a rule after an opportunity for public notice and comment.</text></clause><clause id="H16ACB3D00F194797BD8BC797AB24E817" indent="down1"><enum>(iii)</enum><text display-inline="yes-display-inline">To the extent practicable, the Administrator shall coordinate the activities carried out under clause (i) with the activities required under section 1344(a)(2) of the Small Business Jobs Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref> note).</text></clause><clause id="H6982222D27634A8499CC10186CF3DD30" indent="down1"><enum>(iv)</enum><text display-inline="yes-display-inline">In this subparagraph, the term <quote>covered revision</quote> means a revision described in clause (i) that the Administrator determines is appropriate pursuant to an assessment under such clause.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD55E807D13764D819AD581BB1FEDE23F"><enum>(b)</enum><header>Compliance with Cutgo</header><text display-inline="yes-display-inline">No additional amounts are authorized to be appropriated to carry out this Act or the amendments made by this Act.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20240228" chamber="House">Passed the House of Representatives February 28, 2024.</attestation-date><attestor display="yes">Kevin F.
