American nuclear competitiveness.</toc-entry></toc></subsection></section><title id="H13D714F33ED84FC9942A7EC7BDB3FDC6"><enum>I</enum><header>Nuclear Regulatory Commission</header><subtitle id="HC06EF7E5795145E2B98338B2AAB251F2"><enum>A</enum><header>Efficiency, Performance, and Preparation for the Future</header><section id="H336E00E399F94582BA37142463F16764"><enum>101.</enum><header>NRC mission alignment</header><subsection id="H9242E6E6F0AC4FFC8D02EAD9835B02CB"><enum>(a)</enum><header>Mission of the Commission</header><paragraph id="H05D2A9AE4DD94DD481AB209AC00C7491"><enum>(1)</enum><header>Update</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Nuclear Regulatory Commission shall, while remaining consistent with the policies of the Atomic Energy Act of 1954 (including to provide reasonable assurance of adequate protection of the public health and safety, to promote the common defense and security, and to protect the environment), update the mission statement of the Commission to include that licensing and regulation of nuclear energy activities be conducted in a manner that is efficient and does not unnecessarily limit—</text><subparagraph id="HFC8DEFE613CC456A88168C96FE2D50C2"><enum>(A)</enum><text>the potential of nuclear energy to improve the general welfare; and</text></subparagraph><subparagraph id="H41AE079B5169451E9B3E743900D540F2"><enum>(B)</enum><text>the benefits of nuclear energy technology to society.</text></subparagraph></paragraph><paragraph id="H4D4D3BB700914972A16709047376DED6"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Upon completion of the update to the mission statement required under paragraph (1), the Nuclear Regulatory Commission shall submit to Congress a report that describes—</text><subparagraph id="H5378B684CEA34D519F6D2DCE37A5A0D4"><enum>(A)</enum><text>the updated mission statement; and</text></subparagraph><subparagraph id="H7D1B4B22F81A477FAA79510BA5829D0E"><enum>(B)</enum><text>the guidance that the Nuclear Regulatory Commission will provide to staff of the Nuclear Regulatory Commission to ensure effective performance of such mission.</text></subparagraph></paragraph></subsection><subsection id="H14C0D463DAB74CB294477B6E1B81EBBF"><enum>(b)</enum><header>Office of Nuclear Reactor Regulation</header><text>Section 203 of the Energy Reorganization Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5843">42 U.S.C. 5843</external-xref>) is amended—</text><paragraph id="H3635D0D23ABF4848AE8CB11FFE13EEA8"><enum>(1)</enum><text>in subsection (a), by striking <quote>(a) There</quote> and inserting the following:</text><quoted-block id="H43871988CF5B423D86CFE90BBB7CAF9F" style="OLC"><subsection id="HE7B0F776187F497BA8D723C31F486DED"><enum>(a)</enum><header>Establishment; and</after-quoted-block></quoted-block></paragraph><paragraph id="H2349580346194726919A99F8FF84074C"><enum>(4)</enum><text>by inserting after subsection (b) the following:</text><quoted-block id="H49F997161AFD482CAB8F777038BDA5B4" style="OLC"><subsection id="H3336E2C05CA74293BB3C1A78CF9786E2"><enum>(c)</enum><header>Licensing process</header><text>In carrying out the principal licensing and regulation functions under subsection (b)(1), the Director of Nuclear Reactor Regulation shall—</text><paragraph id="H661416D5C34041158F5BD2F0DE15B690"><enum>(1)</enum><text>establish techniques and guidance for evaluating applications for licenses for nuclear reactors to support efficient, timely, and predictable reviews of applications for such licenses to enable the safe and secure use of nuclear reactors; </text></paragraph><paragraph id="HC6CC27936D1D4168B8DD477F482AD3DB"><enum>(2)</enum><text>maintain the techniques and guidance established under paragraph (1) by periodically assessing and, if necessary, modifying such techniques and guidance; and</text></paragraph><paragraph id="H922DDF681A6646D39250AD777F4E3548" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">obtain approval from the Commission if establishment or modification of the techniques and guidance established under paragraph (1) or (2) involves policy formulation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H04DAE73BA03D42169D922FD72F83C19A"><enum>102.</enum><header>Nuclear licensing efficiency</header><subsection id="HC8BE955FB8F7410D90BA2B37A580CB5D"><enum>(a)</enum><header>Efficient licensing reviews</header><paragraph id="H599FBFA50E744786B00A69DB5EF534F6"><enum>(1)</enum><header>General</header><text display-inline="yes-display-inline">Section 181 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2231">42 U.S.C. 2231</external-xref>) is amended—</text><subparagraph id="H7D77A9FC669E4751B975722F88A3618B"><enum>(A)</enum><text>by striking <quote>The provisions of</quote> and inserting the following:</text><quoted-block style="OLC" id="HFF6495192C674CBD9EAF94149B655C71" display-inline="no-display-inline"><subsection id="HF320C0D2A3464447AA0EAB27C39E5157"><enum>(a)</enum><text display-inline="yes-display-inline">The provisions of</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H4046128D784E4206BABA91D313D4A212"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H1A78671AE4584ADDB3A21C8884F17514" display-inline="no-display-inline"><subsection id="HF51741815DB14A4E8F65C16DEDCF0FA7"><enum>(b)</enum><text display-inline="yes-display-inline">Consistent with the declaration in section 1, the Commission shall provide for efficient, timely, and predictable reviews and proceedings for the granting, suspending, revoking, or amending of any license or construction permit, or application to transfer control, and in any proceeding for the issuance or modification of rules and regulations dealing with the activities of licenses.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4489216C5E4F4785B4EF579D5CD3D902" commented="no"><enum>(2)</enum><header>Construction Permits and Operating Licenses</header><text display-inline="yes-display-inline">Section 185 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2235">42 U.S.C. 2235</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H03ADA73F1AEE4BBD9167DA36922A1354" style="OLC"><subsection id="H6D82778837FF491482AB62DAC027ADBF" commented="no"><enum>c.</enum><header>Application reviews for production and utilization facilities of an existing site</header><text display-inline="yes-display-inline">In reviewing an application for an early site permit, construction permit, operating license, or combined construction permit and operating license for a production facility or utilization facility located at the site of a production facility or utilization facility licensed by the Commission, the Commission shall, to the extent practicable, use information that was part of the licensing basis of the licensed production facility or utilization facility.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7D9CD085D6D54FF280728C56A650F790" commented="no"><enum>(b)</enum><header>Performance metrics and milestones</header><text>Section 102(c) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(c)</external-xref>) is amended—</text><paragraph id="H592628E84CE54FDA82E60B7A4478DDB9" commented="no"><enum>(1)</enum><text>in paragraph (3)—</text><subparagraph id="H82DEA439D3634A4D955456107E38498B" commented="no"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">180</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">90</header-in-text></quote>; and</text></subparagraph><subparagraph id="HA588D6CFA63F4026B041F4F2606B1190" commented="no"><enum>(B)</enum><text>by striking <quote>180</quote> and inserting <quote>90</quote>; and</text></subparagraph></paragraph><paragraph id="H705FC38437AB42F79BA9AD3F98AC9185" commented="no"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HDDD643F9C93B4801A65CFF6357BD4ED5" display-inline="no-display-inline"><paragraph id="H4B8D1C7D7B584CB7A0C3244537F06149" commented="no"><enum>(4)</enum><header>Periodic updates to metrics and schedules</header><subparagraph id="H80FC39C20BAE463D89644AF8B0C3209F" commented="no"><enum>(A)</enum><header>Review and assessment</header><text display-inline="yes-display-inline">Not less frequently than once every 3 years, the Commission shall review and assess, based on the licensing and regulatory activities of the Commission, the performance metrics and milestone schedules developed under paragraph (1).</text></subparagraph><subparagraph id="H51692EC543EE454E97ED400C17B83BDC" commented="no"><enum>(B)</enum><header>Revisions</header><text display-inline="yes-display-inline">After each review and assessment under subparagraph (A), the Commission shall revise, as appropriate, the performance metrics and milestone schedules developed under paragraph (1) to provide the most efficient performance metrics and milestone schedules reasonably achievable. </text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H933201E623FD4479BE0650ED9F65FFFB"><enum>(c)</enum><header>Clarification on fusion regulation</header><text>Section 103(a)(4) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>) is amended—</text><paragraph id="H7C3A4AF0A5FA47D1A863B8C4568588D9"><enum>(1)</enum><text>by striking <quote>Not later</quote> and inserting the following: </text><quoted-block style="OLC" id="H5CE5A98E51574A0F8507D9209617D6BA" display-inline="no-display-inline"><subparagraph id="HB5C4F3DB5A524E78971A8BE49E692477"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HADA56EB11E16465996AE3BEF8D18BF35"><enum>(2)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H63AFE4A158394BB7810AD6867659B2A8" display-inline="no-display-inline"><subparagraph id="H8CDCDC1A27FF4CDB8CB141FF36DBDD4E"><enum>(B)</enum><header>Exclusion of fusion reactors</header><text display-inline="yes-display-inline">Notwithstanding section 3(1), for purposes of subparagraph (A), the term <term>advanced nuclear reactor applicant</term> does not include an applicant for a license for a nuclear fusion reactor.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA54D31392B1F4757AF8AB4FF7F04D7D5"><enum>(d)</enum><header>Technical correction</header><text>Section 104 c. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2134">42 U.S.C. 2134(c)</external-xref>) is amended—</text><paragraph id="H2133FA6B59BF49E6980B5BBFF851090E"><enum>(1)</enum><text>by striking the third sentence and inserting the following:</text><quoted-block id="H35AB6E7124B24A409F0A5F8449B0400C" style="OLC"><paragraph id="HD71261E594134D4292B128B34C3B942A"><enum>(3)</enum><header>Limitation on utilization facilities</header><text>The Commission may issue a license under this section for a utilization facility useful in the conduct of research and development activities of the types specified in section 31 if—</text><subparagraph id="H51A4BCC489B544A386D62CA80D5624F9"><enum>(A)</enum><text>not more than 75 percent of the annual costs to the licensee of owning and operating the facility are devoted to the sale, other than for research and development or education and training, of—</text><clause id="H61972F93C97C449D95D1403998BA22C5"><enum>(i)</enum><text>nonenergy services;</text></clause><clause id="H92E2E659FEC74F34BA2B3C51D3B9C879"><enum>(ii)</enum><text>energy; or</text></clause><clause id="H4F90DC83B1DF49F09E81B2B1DC2B6CAE"><enum>(iii)</enum><text>a combination of nonenergy services and energy; and</text></clause></subparagraph><subparagraph id="HA5B2D593C96D48AD89F2FE37C1A01A39"><enum>(B)</enum><text>not more than 50 percent of the annual costs to the licensee of owning and operating the facility are devoted to the sale of energy.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H55706C36FDD54B539A74ABF59FC874F1"><enum>(2)</enum><text>in the second sentence, by striking <quote>The Commission</quote> and inserting the following:</text><quoted-block id="H804403B62473408CA69E7C1B6F9CE8D4" style="OLC"><paragraph id="HB6B4805EEAA84BF9BA6812BA6353FE53"><enum>(2)</enum><header>Regulation</header><text>The Commission</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HBBBE7E40411743509E986FB20CCC998A"><enum>(3)</enum><text>by striking <quote><header-in-text level="subsection" style="traditional"><enum-in-header>c.</enum-in-header></header-in-text> The Commission</quote> and inserting the following:</text><quoted-block id="HAB9443F58BA34D7CAFD8AA479C14C460" style="OLC"><text display-inline="no-display-inline"><header-in-text level="subsection" style="traditional"><enum-in-header>c.</enum-in-header> Research and development activities.—</header-in-text></text><paragraph id="H03568DC10CF44C529F7FF11B029394DD"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), the Commission</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4F9DE9FB9D1F4446BA0C68E3F9CA5191"><enum>(e)</enum><header>Fusion machines</header><paragraph id="HD3280BB259FE434399567DAF5BF67C96"><enum>(1)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H87C3E260299C48448E3607F77F3EBA5D" display-inline="no-display-inline"><subsection id="H242CD149A766410883153A50277B005E"><enum>kk.</enum><header>Fusion machine</header><text display-inline="yes-display-inline">The term <term>fusion machine</term> means a particle accelerator that is capable of—</text><paragraph id="H5E0953B122C24C47BC1293A206FD67CF"><enum>(1)</enum><text display-inline="yes-display-inline">transforming atomic nuclei, through fusion processes, into other elements, isotopes, or particles; and</text></paragraph><paragraph id="HA74469C4666045B190B30D9C5549ED79"><enum>(2)</enum><text>directly capturing and using the resultant products, including particles, heat, and other electromagnetic radiation. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H49C4A4B89E734FA8955D03DF1A64F851" commented="no"><enum>(2)</enum><header>Technology-inclusive regulatory framework</header><subparagraph id="H78920A4747AC4BAABC8B04F7E213EAA0"><enum>(A)</enum><header>In general</header><text>Section 103(a) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note) is further amended—</text><clause id="H81AA9B067C7B4816A30DE8391D1798C8"><enum>(i)</enum><text>in paragraph (4), by adding at the end the following: </text><quoted-block style="OLC" id="HFFA3DE36473A495386AE768186A9C667" display-inline="no-display-inline"><subparagraph id="HE24D1F56FDF74133B5BBCB16EC177838"><enum>(C)</enum><header>Fusion machine applicants</header><text display-inline="yes-display-inline">Not later than December 31, 2027, the Commission shall complete a rulemaking to establish a technology-inclusive, regulatory framework for optional use by fusion machine applicants for new license applications. </text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H3231793D0D8A4C3AB3E6DF4DC9311C32" commented="no"><enum>(ii)</enum><text>in paragraph (5)(B)(ii), by inserting <quote>and fusion machine license applications</quote> after <quote>commercial advanced nuclear reactor license applications</quote>.</text></clause></subparagraph><subparagraph id="H53503EEAF3D14F919CDFB51D391B5C28"><enum>(B)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref> note) is amended by adding at the end the following: </text><quoted-block style="OLC" id="H284204223BE24065A36E704204FE52E7" display-inline="no-display-inline"><paragraph id="H1285F1899A614F899708DAACC4B87B8B"><enum>(21)</enum><header>Fusion machine</header><text display-inline="yes-display-inline">The term <term>fusion machine</term> has the meaning given such term in subsection kk. of section 11 of the Atomic Energy Act of 1954. </text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEBF021F1CD254104888050F42C702429"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Nuclear Regulatory Commission shall submit to Congress a report on—</text><subparagraph id="HA3164DF8CE9F4D45A1869B51E7282B63"><enum>(A)</enum><text display-inline="yes-display-inline">the results of a study, conducted in consultation with Agreement States (as defined in section 3 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref> note) and the private fusion sector, on risk- and performance-based, design-specific licensing frameworks for mass-manufactured fusion machines (as defined in subsection kk. of section 11 of the Atomic Energy Act of 1954, as added by this subsection), that includes evaluation of the Federal Aviation Administration’s design, manufacturing, and operations certification process for aircraft as a potential model for mass-manufactured fusion machine regulations; and</text></subparagraph><subparagraph id="HB8908109A1C44759924887005C0D504F" commented="no"><enum>(B)</enum><text>the estimated timeline for the Commission to issue consolidated guidance or regulations for licensing mass-manufactured fusion machines, taking into account the results of such study and the anticipated need for such guidance or regulations. </text></subparagraph></paragraph></subsection></section><section id="HFB372B87374F4A948207E2EFD6D9C4E9"><enum>103.</enum><header>Strengthening the NRC workforce</header><subsection id="H86BB5ED7CADE4034A492779AF51263A3"><enum>(a)</enum><header>Commission workforce</header><paragraph id="H560834F54D724AC0B38519F439674208"><enum>(1)</enum><header>General authority</header><text display-inline="yes-display-inline">The Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) is amended by inserting after section 161A the following:</text><quoted-block style="OLC" id="H02A4DF50722E4EC1B63342307651B814" display-inline="no-display-inline"><section id="H1CB2183FFE7F41C5A5E9C4536828223B"><enum>161B.</enum><header>Commission workforce</header><subsection id="HCB70F0470388437B90B439A925CE911D"><enum>(a)</enum><header>Direct hire authority</header><paragraph id="H88A9B8713A2C49ADB28884AE3919A563" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding section 161 d. of this Act and section 2(b) of Reorganization Plan No. 1 of 1980 (94 Stat. 3585; 5 U.S.C. app.), and without regard to any provision of title 5 (except sections 3303 and 3328), United States Code, governing appointments in the civil service, if the Chairman of the Nuclear Regulatory Commission (in this section referred to as the <quote>Chairman</quote>) issues or renews a certification that there is a severe shortage of candidates or a critical hiring need for covered positions to carry out the Nuclear Regulatory Commission’s (in this section referred to as the <quote>Commission</quote>) responsibilities and activities in a timely, efficient, and effective manner, the Chairman may, during any period when such a certification is in effect—</text><subparagraph id="HE255E59E2756442897904E512CF6C6FC" commented="no"><enum>(A)</enum><text>recruit and directly appoint highly qualified individuals into the excepted service for covered positions; and</text></subparagraph><subparagraph id="HC254E49CD8B74643A0CCBDC35F56BD71" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">establish in the excepted service term-limited covered positions and recruit and directly appoint highly qualified individuals into such term-limited covered positions, which may not exceed a term of 4 years. </text></subparagraph></paragraph><paragraph id="H6EFE2EE2013E4D14BE0AD827AAA5E944" commented="no"><enum>(2)</enum><header>Limitations</header><subparagraph id="H522E055F9F974F74AEEECF149A066DF9" commented="no"><enum>(A)</enum><header>Merit principles</header><text>To the maximum extent practicable, any action authorized pursuant to paragraph (1) shall be consistent with the merit principles of section 2301 of title 5, United States Code.</text></subparagraph><subparagraph id="HF06F636727F44058B9E98BDD77D9F108" commented="no"><enum>(B)</enum><header>Number</header><text display-inline="yes-display-inline">The number of highly qualified individuals serving in—</text><clause id="HACA1F570848B48E084A6E0767704B2F5" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">covered positions pursuant to paragraph (1)(A) may not exceed 210 at any one time; and</text></clause><clause id="HD7B4FE0969484A4CB79BA1E002DE9F57" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">term-limited covered positions pursuant to paragraph (1)(B) may not exceed 80 at any one time.</text></clause></subparagraph><subparagraph id="HCE4B8FFD802342CFB35CEA93002DF1F3" commented="no"><enum>(C)</enum><header>Compensation</header><text display-inline="yes-display-inline">The Chairman may not use authority under paragraph (1)(A) or paragraph (1)(B) to compensate individuals recruited and directly appointed into a covered position or a term-limited covered position at an annual rate of basic pay higher than the annual salary payable for level III of the Executive Schedule under section 5314 of title 5, United States Code. </text></subparagraph><subparagraph id="HA162B1F581A54BAABEA3D92960B5984F" commented="no"><enum>(D)</enum><header>Senior Executive Service position</header><text display-inline="yes-display-inline">The Chairman may not, under paragraph (1)(A) or paragraph (1)(B), appoint highly qualified individuals to any Senior Executive Service position, as defined in section 3132 of title 5, United States Code.</text></subparagraph></paragraph><paragraph id="H3FA64B6729994BF288E8C0E95F6853C8" commented="no"><enum>(3)</enum><header>Renewal</header><text display-inline="yes-display-inline">The Chairman may renew a certification issued or renewed under this subsection if the Chairman determines there is still a severe shortage of candidates or a critical hiring need for covered positions to carry out the Commission’s responsibilities and activities in a timely, efficient, and effective manner.</text></paragraph><paragraph id="H7AFF96B6EBEF49069074DD7FF69FF0E0"><enum>(4)</enum><header>Termination</header><text>A certification issued or renewed under this subsection shall terminate on the earlier of—</text><subparagraph id="H5B936E9868B34C4597EB5518938130ED"><enum>(A)</enum><text>the date that is 10 years after the certification is renewed or issued; or</text></subparagraph><subparagraph id="H7EE22567A4F54E30B6228ADC396C919C"><enum>(B)</enum><text display-inline="yes-display-inline">the date on which the Chairman determines there is no longer a severe shortage of candidates or a critical hiring need for covered positions to carry out the Commission’s responsibilities and activities in a timely, efficient, and effective manner.</text></subparagraph></paragraph><paragraph id="H89F76C522D284D9CB33CE85BECF58966" commented="no"><enum>(5)</enum><header>Level of positions</header><text display-inline="yes-display-inline">To the extent practicable, in carrying out paragraph (1) the Chairman shall recruit and directly appoint highly qualified individuals into the excepted service to entry, mid, and senior level covered positions, including term-limited covered positions.</text></paragraph></subsection><subsection id="H995C002137834A0E9DB5ABD737CEDB75" commented="no"><enum>(b)</enum><header>Addressing insufficient compensation of employees and other personnel of the Commission</header><paragraph id="H3E2409B18BDF4AABA2170938FE86C75E" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, if the Chairman issues or renews a certification that compensation for employees or other personnel of the Commission serving in a covered position is insufficient to retain or attract such employees and other personnel to allow the Commission to carry out the responsibilities and activities of the Commission in a timely, efficient, and effective manner, the Chairman may, during any period when such a certification is in effect, fix the compensation for such employees or other personnel serving in a covered position without regard to any provision of title 5, United States Code, governing General Schedule classification and pay rates.</text></paragraph><paragraph id="H7AA20978D48C448485B885F101D7018B" commented="no"><enum>(2)</enum><header>Certification requirements</header><text>A certification issued or renewed under this subsection shall—</text><subparagraph id="H93AF326A30464BBFA84B720F5A560EE2" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">apply to employees or other personnel who serve in covered positions;</text></subparagraph><subparagraph id="H427D5B8072024074990AC9DA06DF8FB8" commented="no"><enum>(B)</enum><text>terminate on the earlier of—</text><clause id="HFE01E9398CDA4EB892F5C300EA97FC36" commented="no"><enum>(i)</enum><text>the date that is 10 years after the certification is issued or renewed; or</text></clause><clause id="H5C379F11B65E4F0D982BB677BB4B0618" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Chairman determines that the use of the authority of the Chairman under this subsection to fix compensation for employees or other personnel serving in a covered position is no longer necessary to retain or attract such employees and other personnel to allow the Commission to carry out the Commission’s responsibilities and activities in a timely, efficient, and effective manner; and</text></clause></subparagraph><subparagraph id="HA3F695A2B8384495A1AE893935D586CE" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">be no broader than necessary to achieve the objective of retaining or attracting employees and other personnel serving in a covered position to allow the Commission to carry out the Commission’s responsibilities and activities in a timely, efficient, and effective manner.</text></subparagraph></paragraph><paragraph id="H8843199F2E404FBA9F4EFDC735F5B2FE" commented="no"><enum>(3)</enum><header>Renewal</header><text display-inline="yes-display-inline">The Chairman may renew a certification issued or renewed under this subsection if the Chairman determines that use of the authority of the Chairman under this subsection to fix compensation for employees or other personnel serving in a covered position is still necessary to retain or attract such employees or other personnel to allow the Commission to carry out the Commission’s responsibilities and activities in a timely, efficient, and effective manner.</text></paragraph><paragraph id="H751ED6708E5F413E96A93D1F1CBAAC50"><enum>(4)</enum><header>Applicability</header><text display-inline="yes-display-inline">The authority under this subsection to fix the compensation of employees or other personnel during any period when a certification issued or renewed under paragraph (1) is in effect shall apply with respect to an employee or other personnel serving in a covered position regardless of when the employee or other personnel was hired.</text></paragraph><paragraph id="H5EB065B014534952829492DC0206536C" commented="no"><enum>(5)</enum><header>Retention of level of fixed compensation</header><text display-inline="yes-display-inline">The termination of a certification issued or renewed under paragraph (1) shall not affect the compensation of an employee or other personnel serving in a covered position whose compensation was fixed by the Chairman in accordance with paragraph (1).</text></paragraph><paragraph id="H32C263F9AA3A46768B4E0FE53A3E436B" commented="no"><enum>(6)</enum><header>Limitation on compensation</header><text display-inline="yes-display-inline">The Chairman may not use the authority under paragraph (1) to fix the compensation of employees or other personnel at an annual rate of basic pay higher than the annual salary payable for level III of the Executive Schedule under section 5314 of title 5, United States Code.</text></paragraph><paragraph id="HDC1C887BEC534C57A2E2C74113F642BD" commented="no"><enum>(7)</enum><header>Experts and consultants</header><subparagraph id="H5B9576D858BC450CAF2F1FDD2EC37B8B" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the Chairman may—</text><clause id="H5DEC20EC34F5473E9EADE6963D202634" commented="no"><enum>(i)</enum><text>obtain the services of experts and consultants in accordance with section 3109 of title 5, United States Code;</text></clause><clause id="H52A8DF28B8F14B44987CD3082E9F295C" commented="no"><enum>(ii)</enum><text>compensate those experts and consultants for each day (including travel time) at rates not in excess of the rate of pay for level IV of the Executive Schedule under section 5315 of that title; and</text></clause><clause id="H43A1DB447F4D409DB1598355DE9E647E" commented="no"><enum>(iii)</enum><text>pay to the experts and consultants serving away from the homes or regular places of business of the experts and consultants travel expenses and per diem in lieu of subsistence at rates authorized by sections 5702 and 5703 of that title for persons in Government service employed intermittently.</text></clause></subparagraph><subparagraph id="H7243002F97194286AE004809F7B5131E" commented="no"><enum>(B)</enum><header>Limitations</header><text display-inline="yes-display-inline">The Chairman shall—</text><clause id="H18E9FDFAFC6C4046964274C3F6475F06" commented="no"><enum>(i)</enum><text>to the maximum extent practicable, limit the use of experts and consultants pursuant to subparagraph (A); and</text></clause><clause id="HBA3F6CFAB19344B5B5BA3A8B600BDE6E" commented="no"><enum>(ii)</enum><text>ensure that the employment contract of each expert and consultant employed pursuant to subparagraph (A) is subject to renewal not less frequently than annually.</text></clause></subparagraph></paragraph></subsection><subsection id="H2C98C6B1418C4E2B899A6D460953EA55"><enum>(c)</enum><header>Additional compensation authority</header><paragraph id="HB99D708641414031AA44928745527734" commented="no"><enum>(1)</enum><header>For new employees</header><text display-inline="yes-display-inline">The Chairman may pay a person recruited and directly appointed under subsection (a) a 1-time hiring bonus in an amount not to exceed $25,000.</text></paragraph><paragraph id="H73BBDC6AA5EC4B339EFF2FF9FD33566C"><enum>(2)</enum><header>For existing employees</header><subparagraph id="HA0EAF6BA2EBF4CE68C1106D4EF3D0506"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), an employee or other personnel who the Chairman determines exhibited exceptional performance in a fiscal year may be paid a performance bonus in an amount not to exceed the least of—</text><clause id="H49B4CF37F13243428F654F1B022F563D"><enum>(i)</enum><text>$25,000; and</text></clause><clause id="HD78BE794923A4DF5810ABD7CEF41C8BB"><enum>(ii)</enum><text>the amount of the limitation that is applicable for a calendar year under section 5307(a)(1) of title 5, United States Code.</text></clause></subparagraph><subparagraph id="H04CBE3F13A174C2AB2943B6AD259E96A" commented="no"><enum>(B)</enum><header>Limitations</header><clause id="HEB5AB59C53FA455CB297CFB5F69A5A9B" commented="no"><enum>(i)</enum><header>Subsequent bonuses</header><text>Any person who receives a performance bonus under subparagraph (A) may not receive another performance bonus under that subparagraph for a period of 5 years thereafter.</text></clause><clause id="H328BD18B2034493688636548240A428B" commented="no"><enum>(ii)</enum><header>Hiring bonuses</header><text display-inline="yes-display-inline">Any person who receives a 1-time hiring bonus under paragraph (1) may not receive a performance bonus under subparagraph (A) unless more than one year has elapsed since the payment of such 1-time hiring bonus.</text></clause></subparagraph></paragraph></subsection><subsection id="H1854B8A84D764021A917D8B229C4D4CA" commented="no"><enum>(d)</enum><header>Implementation plan and report</header><paragraph id="H748241CE5C5B41F8AEF6FD84A2F795BD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this section, the Chairman shall develop and implement a plan to carry out this section. Before implementing such plan, the Chairman shall submit to the Committee on Energy and Commerce of the House of Representatives, the Committee on Environment and Public Works of the Senate, and the Office of Personnel Management a report on the details of the plan.</text></paragraph><paragraph id="HDFF30F0B592F40CD9361C5B2B4E822D8"><enum>(2)</enum><header>Report content</header><text>The report submitted under paragraph (1) shall include—</text><subparagraph id="H22B12F71DC1149749EB2BD35DBCBD7C6"><enum>(A)</enum><text>evidence and supporting documentation justifying the plan; and</text></subparagraph><subparagraph id="HC9A4FB12665B4FA6AAEB667F6E6719DF"><enum>(B)</enum><text>budgeting projections on costs and benefits resulting from the plan.</text></subparagraph></paragraph><paragraph id="H0F628ED31050430E8A35C89A2CDF3849"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">The Chairman may consult with the Office of Personnel Management, the Office of Management and Budget, and the Comptroller General of the United States in developing the plan under paragraph (1).</text></paragraph></subsection><subsection id="H25224F8B1E924527AD907D494DDE810E" commented="no"><enum>(e)</enum><header>Delegation</header><text display-inline="yes-display-inline">The Chairman shall delegate, subject to the direction and supervision of the Chairman, the authority provided by subsections (a), (b), and (c) to the Executive Director for Operations of the Commission.</text></subsection><subsection id="HED7C197966084CD3A705AEF55EF8831D" commented="no"><enum>(f)</enum><header>Information on hiring, vacancies, and compensation</header><paragraph id="HB5E180B3818E4B59A4B9E6229E878675" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission shall include in its budget materials submitted in support of the budget of the President (submitted to Congress pursuant to section 1105 of title 31, United States Code), for each fiscal year beginning after the date of enactment of this section, information relating to hiring, vacancies, and compensation at the Commission. </text></paragraph><paragraph id="H9B12EC19C6DF4877B0DC1D5A7FC26A42" commented="no"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The information described in paragraph (1) shall include—</text><subparagraph id="H02D7923EFC5F4A4D93F5896422FFE3D3" commented="no"><enum>(A)</enum><text>an analysis of any trends with respect to hiring, vacancies, and compensation at the Commission;</text></subparagraph><subparagraph id="HC74084D59DFB4FA99359C73B12412E35" commented="no"><enum>(B)</enum><text>a description of the efforts to retain and attract employees or other personnel to serve in covered positions at the Commission;</text></subparagraph><subparagraph id="HB654E8E6CCC74FF8A63BD45F7AA2FE2D" commented="no"><enum>(C)</enum><text>information that describes—</text><clause id="HB947F70BB75C475D9DA17F2762344138" commented="no"><enum>(i)</enum><text>if a certification under subsection (a) was in effect at any point in the previous year, how the authority provided by that subsection is being used to address the hiring needs of the Commission;</text></clause><clause id="HE0515DFE7AC74C649B07C3A94888604F" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of highly qualified individuals serving in—</text><subclause id="HAAD54749CFE7495690A582DE89CCE716" commented="no"><enum>(I)</enum><text>covered positions pursuant to subsection (a)(1)(A); and</text></subclause><subclause id="HD9924C4D2ECA48E58FEEBC261F93BD19" commented="no"><enum>(II)</enum><text>term-limited covered positions pursuant to subsection (a)(1)(B);</text></subclause></clause><clause id="H1374C1ADA0734B929F77FD9DE4AD4E51" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">if a certification under subsection (b) was in effect at any point in the previous year, how the authority provided by that subsection is being used to address the hiring or retention needs of the Commission;</text></clause><clause id="HC14B7D7CAA6F4F04AE6CD61C2025018F" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">the total number of employees or other personnel serving in a covered position that have their compensation fixed pursuant to subsection (b);</text></clause><clause id="H978DDF89D238463CB8C853C2102B4BAC" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">if a certification under subsection (a) or (b) was terminated or was not in effect at any point in the previous year, why such a certification was terminated or was not in effect;</text></clause><clause id="H10B0C2FA943F431A9366A4A2B401D6B0" commented="no"><enum>(vi)</enum><text>the attrition levels with respect to term-limited covered positions appointed under subsection (a)(1)(B), including the number of individuals leaving a term-limited covered position before completion of the applicable term of service and the average length of service for such individuals as a percentage of the applicable term of service; and</text></clause><clause id="HF389FDD24964427D9C235988B5199C53" commented="no"><enum>(vii)</enum><text>the number of experts and consultants retained under subsection (b)(7); and</text></clause></subparagraph><subparagraph id="H0FB7FAABCFB4453F804487033F599BE0" commented="no"><enum>(D)</enum><text>an assessment of—</text><clause id="H45D8D4F6FC8B495FBF9F0282320CE0F8" commented="no"><enum>(i)</enum><text>the current critical workforce needs of the Commission and any critical workforce needs that the Commission anticipates in the next five years; and</text></clause><clause id="HC93C7E4B6D5A44498E8ABE082708CD2A" commented="no"><enum>(ii)</enum><text>additional skillsets that are or likely will be needed for the Commission to fulfill the licensing and oversight responsibilities of the Commission.</text></clause></subparagraph></paragraph></subsection><subsection id="H9B1335BBB808433F8696EBF8F54A92DC"><enum>(g)</enum><header>Covered position</header><text>In this section, the term <term>covered position</term> means a position in which an employee or other personnel is responsible for conducting work of a scientific, technical, engineering, mathematical, legal, managerial, or otherwise highly specialized or skilled nature.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HAD0E3A4198734A7382F1BAF6980556EF"><enum>(2)</enum><header>Table of contents</header><text display-inline="yes-display-inline">The table of contents of the Atomic Energy Act of 1954 is amended by inserting after the item relating to section 161 the following:</text><quoted-block style="OLC" id="H6D59B396662B4320BA6EB8033E43DEF8" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 161A. Use of firearms by security personnel.</toc-entry><toc-entry level="section">Sec. 161B. Commission workforce.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H807F249BF5DC4ED28938539B1226238D" commented="no"><enum>(b)</enum><header>Government Accountability Office report</header><text>Not later than September 30, 2032, the Comptroller General of the United States shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report that—</text><paragraph id="HEFB628C256994404BF1FD9C40FCE6D5D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">evaluates the extent to which the authorities provided under subsections (a), (b), and (c) of section 161B of the Atomic Energy Act of 1954 (as added by this Act) have been utilized;</text></paragraph><paragraph id="H12CFD6DCF461473F8CAAEA82DEAB455E" commented="no"><enum>(2)</enum><text>describes the role in which the highly qualified individuals recruited and directly appointed pursuant to section 161B(a) of the Atomic Energy Act of 1954 (as added by this Act) have been utilized to support the licensing of advanced nuclear reactors;</text></paragraph><paragraph id="H0EADB57F4B7B4E36BCEEAA3DBAA3FD75" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">assesses the effectiveness of the authorities provided under subsections (a), (b), and (c) of section 161B of the Atomic Energy Act of 1954 (as added by this Act) in helping the Nuclear Regulatory Commission fulfill its mission;</text></paragraph><paragraph id="H1030B4CC7823475797D0930AEF1E6DBA" commented="no"><enum>(4)</enum><text>makes recommendations to improve the Nuclear Regulatory Commission’s strategic workforce management; and</text></paragraph><paragraph id="H0C7B14D5E22C47BE874D00D80216F8B5" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">makes recommendations with respect to whether Congress should enhance, modify, or discontinue the authorities provided under subsections (a), (b), and (c) of section 161B of the Atomic Energy Act of 1954 (as added by this Act).</text></paragraph></subsection><subsection id="HF75544B4C7154954894C3C65A961879D" commented="no"><enum>(c)</enum><header>Annual Solicitation for Nuclear Regulator Apprenticeship Network Applications</header><text>The Nuclear Regulatory Commission, on an annual basis, shall solicit applications for the Nuclear Regulator Apprenticeship Network.</text></subsection></section></subtitle><subtitle id="H9F39584629CE4081BBC1194C685A7D16"><enum>B</enum><header>Fee Reduction</header><section id="H600FFE5E5BCF496EA4732A6CDA3E412F"><enum>111.</enum><header>Advanced reactor fee reduction</header><subsection id="H5D3D6EF52AB64444B8C2E117F3537704" commented="no"><enum>(a)</enum><header>Definitions</header><text>Section 3 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. of value</header><text>Section 102(b) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(b)</external-xref>) is amended by striking paragraph (2) and inserting the following:</text><quoted-block id="H507A28EEEDAC43ACB1D3BCA0E96E04EF" style="OLC"><paragraph id="H6868E7EF63684C6481FE6480D5FF7259"><enum>(2)</enum><header>Fees for service or thing of value</header><subparagraph id="H50A56530890648049F41097544961885"><enum>(A)</enum><header>In general</header><text>In accordance with section 9701 of title 31, United States Code, the Commission shall assess and collect fees from any person who receives a service or thing of value from the Commission to cover the costs to the Commission of providing the service or thing of value.</text></subparagraph><subparagraph id="H99DC9A16D5E941C0AB971875CF9FB239" commented="no"><enum>(B)</enum><header>Advanced nuclear reactor applicants</header><text display-inline="yes-display-inline">The professional hourly rate charged for fees assessed and collected from an advanced nuclear reactor applicant under this paragraph relating to the review of a submitted application for an advanced nuclear reactor may not—</text><clause id="H288286A5078446519E53681EF6BF562C"><enum>(i)</enum><text>exceed the professional hourly rate for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program; and</text></clause><clause id="H71CEA2B83C984AF7A32EE20B469DD37C"><enum>(ii)</enum><text display-inline="yes-display-inline">include the costs of mission-indirect program support and agency support.</text></clause></subparagraph><subparagraph id="HCF8C548701EB485FB77C8D8B114F59EE" commented="no"><enum>(C)</enum><header>Advanced nuclear reactor preapplicants</header><text display-inline="yes-display-inline">The professional hourly rate charged for fees assessed and collected from an advanced nuclear reactor preapplicant under this paragraph relating to the review of submitted materials as described in the licensing project plan of such advanced nuclear reactor preapplicant may not—</text><clause id="HD727267D04A24BB1BD9E234D445E07D8"><enum>(i)</enum><text>exceed the professional hourly rate for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program; and</text></clause><clause id="H391E11C9350E4424ADACF1EE87BD2A69"><enum>(ii)</enum><text display-inline="yes-display-inline">include the costs of mission-indirect program support and agency support.</text></clause></subparagraph><subparagraph id="H7B062E6901B44C6F8DC242C471075C71"><enum>(D)</enum><header>Calculation of hourly rate</header><text display-inline="yes-display-inline">In this paragraph, the professional hourly rate for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program equals the quotient obtained by dividing—</text><clause id="HF897234840F24BFF8D13AD1A692BEEB0" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the full-time equivalent rate (within the meaning of the document of the Commission entitled <quote>FY 2023 Final Fee Rule Work Papers</quote> (or a successor document)) for mission-direct program salaries and benefits of the Nuclear Reactor Safety Program (as determined by the Commission) for a fiscal year; by</text></clause><clause id="HA8C4245AE2C64AFEAB355DC2559ED061" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the productive hours assumption for that fiscal year, determined in accordance with the formula established in the document referred to in clause (i) (or a successor document).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H392AECD1A0F44968A08F4244C4D1E7E2"><enum>(d)</enum><header>Sunset</header><text>Section 102(f) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(f)</external-xref>) is amended to read as follows:</text><quoted-block id="H1956FF3D15FB4F1E83493A979D383047" style="OLC"><subsection id="H5A8BC396D91F4E7BB029E72C25756162"><enum>(f)</enum><header>Cessation of effectiveness</header><text>Paragraphs (1)(B)(v) and (2)(C) of subsection (b) shall cease to be effective on September 30, 2029.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H19BE6562C45A44C78A212B342A18675C" commented="no"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on October 1, 2024.</text></subsection></section><section id="H5978313006C54E07B3F0458EB3EFB2B8"><enum>112.</enum><header>Advanced nuclear reactor prize</header><text display-inline="no-display-inline">Section 103 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>; 132 Stat. 5571) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H96D75226A4D0437A9460B43A75177438"><subsection id="H598D0D7C271F42FDA0DD146BB29B9266"><enum>(f)</enum><header>Prizes for advanced nuclear reactor licensing</header><paragraph id="H3E8396F73AF842D9B486FF906E27157D"><enum>(1)</enum><header>Definition of eligible entity</header><text>In this subsection, the term <term>eligible entity</term> means—</text><subparagraph id="H84747F8EC86540A2BABFAFCFBDAE39A7" commented="no"><enum>(A)</enum><text>a non-Federal entity; and</text></subparagraph><subparagraph id="H38EEBABBCC83476EB07D539421E06E57"><enum>(B)</enum><text>the Tennessee Valley Authority.</text></subparagraph></paragraph><paragraph id="HB97C0241A2594D4284D0BFFBA35638C3"><enum>(2)</enum><header>Prize for advanced nuclear reactor licensing</header><subparagraph id="HB1AC7BE557FB415A8CC79FF841BAAD27"><enum>(A)</enum><header>In general</header><text>Notwithstanding section 169 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2209">42 U.S.C. 2209</external-xref>) and subject to the availability of appropriations, the Secretary is authorized to make, with respect to each award category described in subparagraph (C), an award in an amount described in subparagraph (B) to the first eligible entity—</text><clause id="H53D87806133F4EE6A1FB90ABE7FEAABA" commented="no"><enum>(i)</enum><text>to which the Commission issues an operating license for an advanced nuclear reactor under part 50 of title 10, Code of Federal Regulations (or successor regulations), for which an application has not been approved by the Commission as of the date of enactment of this subsection; or</text></clause><clause id="HA59B271D50004E0EAEE06EC055A6C6C0" commented="no"><enum>(ii)</enum><text>for which the Commission makes a finding described in section 52.103(g) of title 10, Code of Federal Regulations (or successor regulations), with respect to a combined license for an advanced nuclear reactor—</text><subclause id="H110901415B9340118BA137D242F45167" commented="no"><enum>(I)</enum><text>that is issued under subpart C of part 52 of that title (or successor regulations); and </text></subclause><subclause id="H36F609867BB0486090A4F7FE230D6287" commented="no"><enum>(II)</enum><text>for which an application has not been approved by the Commission as of the date of enactment of this subsection.</text></subclause></clause></subparagraph><subparagraph id="HC702B1AD46264BE1A55B3FD642DA6D95" commented="no"><enum>(B)</enum><header>Amount of award</header><text>Subject to paragraph (3), an award under subparagraph (A) shall be in an amount equal to the total amount assessed by the Commission and collected under section 102(b)(2) from the eligible entity receiving the award for costs relating to the issuance of the license described in that subparagraph, including, as applicable, costs relating to the issuance of an associated construction permit described in section 50.23 of title 10, Code of Federal Regulations (or successor regulations), or early site permit (as defined in section 52.1 of that title (or successor regulations)).</text></subparagraph><subparagraph id="HE5BA251C61CD46FBB569A432A744AB77"><enum>(C)</enum><header>Award categories</header><text>An award under subparagraph (A) may be made for—</text><clause id="H1587DD42F87846B3AB6C5386357D46A5" commented="no"><enum>(i)</enum><text>the first advanced nuclear reactor for which the Commission—</text><subclause id="H2BC7D19096284861AC665D1D294BCB3B" commented="no"><enum>(I)</enum><text>issues a license in accordance with clause (i) of subparagraph (A); or</text></subclause><subclause id="H094E0FCC14E84266816374A07C78284C" commented="no"><enum>(II)</enum><text>makes a finding in accordance with clause (ii) of that subparagraph;</text></subclause></clause><clause id="HBD9EEB5FFDB64EBB94FF435484B7D591"><enum>(ii)</enum><text>an advanced nuclear reactor that—</text><subclause id="H158E549C016F4D6688629EA4AC0708C6"><enum>(I)</enum><text>uses isotopes derived from spent nuclear fuel (as defined in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>)) or depleted uranium as fuel for the advanced nuclear reactor; and</text></subclause><subclause id="HE7A2709EEBBB48809B30F6353BF96C76" commented="no"><enum>(II)</enum><text>is the first advanced nuclear reactor described in subclause (I) for which the Commission—</text><item id="HCEB8615D587946B1BCCF6D8B633E9A99" commented="no"><enum>(aa)</enum><text>issues a license in accordance with clause (i) of subparagraph (A); or</text></item><item id="HECABFDFA628A4EBEBE17F59B6BEB0667" commented="no"><enum>(bb)</enum><text>makes a finding in accordance with clause (ii) of that subparagraph;</text></item></subclause></clause><clause id="H693E5CE84C254BB1B6705E9C405A6F83"><enum>(iii)</enum><text>an advanced nuclear reactor that—</text><subclause id="HEFE79C3F06CF4206A7FFE66B6E7DE179"><enum>(I)</enum><text>is a nuclear integrated energy system—</text><item id="HC04C2DDE092A4C30A602EAEA42AC5A59"><enum>(aa)</enum><text>that is composed of 2 or more co-located or jointly operated subsystems of energy generation, energy storage, or other technologies;</text></item><item id="HEAF2A08038184A62A6563F44F0E1F467"><enum>(bb)</enum><text>in which not fewer than 1 subsystem described in item (aa) is a nuclear energy system; and</text></item><item id="H47BB78DA023D41999488CF571C60713C"><enum>(cc)</enum><text>the purpose of which is—</text><subitem id="H65A909AC031440118393DB101D7C874C"><enum>(AA)</enum><text>to reduce greenhouse gas emissions in both the power and nonpower sectors; and</text></subitem><subitem id="H94B4610EE62F4A8884E840163462EFC0"><enum>(BB)</enum><text>to maximize energy production and efficiency; and</text></subitem></item></subclause><subclause id="H822C5B1CCB1343B1A76944548AC5D772" commented="no"><enum>(II)</enum><text>is the first advanced nuclear reactor described in subclause (I) for which the Commission—</text><item id="H7375423501604F49AC215222BF4CAA7F" commented="no"><enum>(aa)</enum><text>issues a license in accordance with clause (i) of subparagraph (A); or</text></item><item id="H05929FE0F17E4A8A94CAB7A4E94B45F7" commented="no"><enum>(bb)</enum><text>makes a finding in accordance with clause (ii) of that subparagraph; </text></item></subclause></clause><clause id="HFE1B98BDC6754ACDAC4FF3CCFE2A0C54"><enum>(iv)</enum><text>an advanced reactor that—</text><subclause id="H7FE5BA88C5AE4220A41615268D3BEA4D"><enum>(I)</enum><text>operates flexibly to generate electricity or high temperature process heat for nonelectric applications; and</text></subclause><subclause id="HB617E2EE74BA41AF83C6D925557EF1D8" commented="no"><enum>(II)</enum><text>is the first advanced nuclear reactor described in subclause (I) for which the Commission—</text><item id="H94D82771EAB94926BC564CB5C7F8EB87" commented="no"><enum>(aa)</enum><text>issues a license in accordance with clause (i) of subparagraph (A); or</text></item><item id="H63C7E147D63A44A4A6B08868902C996C" commented="no"><enum>(bb)</enum><text>makes a finding in accordance with clause (ii) of that subparagraph; and</text></item></subclause></clause><clause id="H8933E09CC2D8402E907A5A5117EBA964"><enum>(v)</enum><text>the first advanced nuclear reactor for which the Commission grants approval to load nuclear fuel pursuant to the technology-inclusive regulatory framework established under subsection (a)(4).</text></clause></subparagraph></paragraph><paragraph id="H853C3D3569314C3D8F78A65BFA5F20C7"><enum>(3)</enum><header>Federal funding limitation</header><subparagraph id="H58F78545BECD4EAE97A4AF86B81EEE58"><enum>(A)</enum><header>Exclusion of TVA funds</header><text display-inline="yes-display-inline">In this paragraph, the term <term>Federal funds</term> does not include funds received under the power program of the Tennessee Valley Authority established pursuant to the Tennessee Valley Authority Act of 1933 (<external-xref legal-doc="usc" parsable-cite="usc/16/831">16 U.S.C. 831 et seq.</external-xref>).</text></subparagraph><subparagraph id="HCD44902A20BE4E158661CB37E0426ACD"><enum>(B)</enum><header>Limitation on amounts expended</header><text display-inline="yes-display-inline">An award under this subsection shall not exceed the total amount expended (excluding any expenditures made with Federal funds received for the applicable project and an amount equal to the minimum cost-share required under section 988 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16352">42 U.S.C. 16352</external-xref>)) by the eligible entity receiving the award for licensing costs relating to the project for which the award is made.</text></subparagraph><subparagraph id="HDEA0ACD916344D97932FB1A3EC0D1986"><enum>(C)</enum><header>Repayments and dividends not required</header><text>Notwithstanding section 9104(a)(4) of title 31, United States Code, or any other provision of law, an eligible entity that received an award under this subsection shall not be required—</text><clause id="H519E8C9878694068A8D9BF7B539BC222"><enum>(i)</enum><text>to repay that award or any part of that award; or</text></clause><clause id="H0C43558BD07543C3A01387918716F42C"><enum>(ii)</enum><text>to pay a dividend, interest, or other similar payment based on the sum of that award.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle><subtitle id="H70F3A7D5982646D09DA2490D55AF7340"><enum>C</enum><header>Siting, Licensing, and Oversight Reviews</header><section id="H2D21F24A687F464498411166433D3C0C"><enum>121.</enum><header>Modernization of nuclear reactor environmental reviews</header><subsection id="HC9B221FC9826438697F8928A93979927" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Nuclear Regulatory Commission (in this section referred to as the <quote>Commission</quote>) shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the efforts of the Commission to facilitate efficient, timely, and predictable environmental reviews of nuclear reactor applications, including through expanded use of categorical exclusions, environmental assessments, and generic environmental impact statements. </text></subsection><subsection id="HB3BC52D662FD490D8581933C5D154926"><enum>(b)</enum><header>Report</header><text>In completing the report under subsection (a), the Commission shall—</text><paragraph id="HA16D52DEBE834DA4B5BC61E9B3BFCEF4"><enum>(1)</enum><text display-inline="yes-display-inline">describe the actions the Commission will take to implement the amendments to the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) made by section 321 of the Fiscal Responsibility Act of 2023;</text></paragraph><paragraph id="H25B3233330284E04A1D8C5056B5AF424"><enum>(2)</enum><text>consider—</text><subparagraph id="H735DDCFEB0A44E838E18E11C055342FC" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">using through adoption, incorporation by reference, or other appropriate means, categorical exclusions, environmental assessments, and environmental impact statements prepared by other Federal agencies to streamline environmental reviews of nuclear reactor applications by the Commission;</text></subparagraph><subparagraph id="H7A277C4BEDE04003A80977B9AF675C9E" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">using categorical exclusions, environmental assessments, and environmental impact statements prepared by the Commission to streamline environmental reviews of nuclear reactor applications by the Commission;</text></subparagraph><subparagraph id="HE03AB59C653E40C3AAABC006F856375D" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">using mitigated findings of no significant impact in environmental reviews of nuclear reactor applications by the Commission to reduce the impact of a proposed action to a level that is not significant;</text></subparagraph><subparagraph id="H0CD1DD82C22D4FD48039EBB7EAFA8D21" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">the extent to which the Commission may rely on prior studies or analyses prepared by Federal, State, and local governmental permitting agencies to streamline environmental reviews of nuclear reactor applications by the Commission;</text></subparagraph><subparagraph id="HD30315CE692F47F89A7264B14233ACCA"><enum>(E)</enum><text display-inline="yes-display-inline">opportunities to coordinate the development of environmental assessments and environmental impact statements with other Federal agencies to avoid duplicative environmental reviews and to streamline environmental reviews of nuclear reactor applications by the Commission;</text></subparagraph><subparagraph id="HAE5AA941ADA24888AF965F9E0D107935" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">opportunities to streamline formal and informal consultations and coordination with other Federal, State, and local governmental permitting agencies during environmental reviews of nuclear reactor applications by the Commission;</text></subparagraph><subparagraph id="HDE38F95B60B8481D9854BDC2CD649A34" commented="no"><enum>(G)</enum><text display-inline="yes-display-inline">opportunities to streamline the Commission’s analyses of alternatives, including the Commission’s analysis of alternative sites, in environmental reviews of nuclear reactor applications by the Commission;</text></subparagraph><subparagraph id="H6B4BE188B2EC45CF9126C693D28F6FAB"><enum>(H)</enum><text>establishing new categorical exclusions that could be applied to actions relating to new nuclear reactors applications;</text></subparagraph><subparagraph id="H65B0931105A94A0C9CAC6C6D3605C551" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">amending section 51.20(b) of title 10, Code of Federal Regulations, to allow the Commission to determine on a case-specific basis whether an environmental assessment (rather than an environmental impact statement or supplemental environmental impact statement) is appropriate for a particular nuclear reactor application, including in proceedings in which the Commission relies upon a generic environmental impact statement for advanced nuclear reactors;</text></subparagraph><subparagraph id="H0238E32DFCEC4997A81F2B4D17709592" commented="no"><enum>(J)</enum><text>authorizing the use of an applicant’s environmental impact statement as the Commission’s draft environmental impact statement, consistent with section 107(f) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4336a">42 U.S.C. 4336a(f)</external-xref>);</text></subparagraph><subparagraph id="H3B12559565DD403082B358A0ADB3D61F" commented="no"><enum>(K)</enum><text display-inline="yes-display-inline">opportunities to adopt online and digital technologies, including technologies that would allow applicants and cooperating agencies to upload documents and coordinate with the Commission to edit documents in real time, that would streamline communications between—</text><clause id="H7A0EB532F97E4FB39A4762AFA917DF0F" commented="no"><enum>(i)</enum><text>the Commission and applicants; and</text></clause><clause id="H80AB310AA5D3491DB350B4BF2E47EAA8" commented="no"><enum>(ii)</enum><text>the Commission and other relevant cooperating agencies;</text></clause></subparagraph><subparagraph id="H49E5696CFD074899B1BD4BED9769D06C" commented="no"><enum>(L)</enum><text display-inline="yes-display-inline"> in addition to implementing measures under subsection (c), potential revisions to part 51 of title 10, Code of Federal Regulations, and relevant Commission guidance documents, to—</text><clause id="H17DE5221E4B344B0B9AB55EBD459AD06" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">facilitate efficient, timely, and predictable environmental reviews of nuclear reactor applications;</text></clause><clause id="H85D147F30F334349AF6993C299E9A81F" commented="no"><enum>(ii)</enum><text>assist decision-making about relevant environmental issues;</text></clause><clause id="H839C38B551334B759597FADB37BDD20B" commented="no"><enum>(iii)</enum><text>maintain openness with the public;</text></clause><clause id="HF8E6F82ECFD2489B99BCEA779EC38C38" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">meet obligations under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>); and</text></clause><clause id="H6596C87D5DF046C58AE98FBF8BA320F2" commented="no"><enum>(v)</enum><text>reduce burdens on licensees, applicants, and the Commission; and</text></clause></subparagraph></paragraph><paragraph id="HFB655DD379F54A3780FD63B3802D3F7D"><enum>(3)</enum><text>include a schedule for promulgating the rule required under subsection (c).</text></paragraph></subsection><subsection id="H735D4ED1566E40B7BF559116AD30E4E7" commented="no"><enum>(c)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 2 years after the submission of the report under subsection (a), the Commission shall promulgate a final rule implementing, to the maximum extent practicable, measures considered by the Commission under subsection (b)(2) that are necessary to streamline the Commission’s review of nuclear reactor applications.</text></subsection></section><section id="HE6B6AB7A900547149765557030A5D920"><enum>122.</enum><header>Nuclear for Brownfield sites</header><subsection id="H25E2F96C843B430AA156A13D13FED00F"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H2F653A9C1BBB456495244BF15288F919"><enum>(1)</enum><header>Brownfield site</header><text>The term <term>brownfield site</term> has the meaning given the term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph><paragraph id="H40371BAE374E4BD68B2BE19C2B97FB2B"><enum>(2)</enum><header>Commission</header><text>The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></paragraph><paragraph id="H43C6BDC14CC845318622735E53EE21E5" commented="no"><enum>(3)</enum><header>Covered site</header><text>The term <term>covered site</term> means a brownfield site, a retired fossil fuel site, or a site that is both a retired fossil fuel site and a brownfield site. </text></paragraph><paragraph id="H94C2077AA38E4B979FCBE8C6DFB92DA2"><enum>(4)</enum><header>Production facility</header><text>The term <term>production facility</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text></paragraph><paragraph id="H9FC9D862B8584D2B900E57D162671555"><enum>(5)</enum><header>Retired fossil fuel site</header><text>The term <term>retired fossil fuel site</term> means the site of 1 or more fossil fuel electric generation facilities that are retired or scheduled to retire, including multiunit facilities that are partially shut down.</text></paragraph><paragraph id="H72C0787F836C42E99BC812F0137B323F"><enum>(6)</enum><header>Utilization facility</header><text>The term <term>utilization facility</term> has the meaning given the term in section 11 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2014">42 U.S.C. 2014</external-xref>).</text></paragraph></subsection><subsection id="HE84168A7C90E420F8BC3030CF6096FBB"><enum>(b)</enum><header>Identification of regulatory issues</header><paragraph id="HE8E36C164537401787727309FE97B9FB" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall evaluate the extent to which modification of regulations, guidance, or policy is needed to enable efficient, timely, and predictable licensing reviews for, and to support the oversight of, production facilities or utilization facilities at covered sites.</text></paragraph><paragraph id="HC0C10CF866A24432A14BDC9AD85954A0" display-inline="no-display-inline" commented="no"><enum>(2)</enum><header>Requirement</header><text>In carrying out paragraph (1), the Commission shall consider how licensing reviews for production facilities or utilization facilities at covered sites may be expedited by—</text><subparagraph id="H8EF5309367E2474EADCC315DD38DA5B1" commented="no"><enum>(A)</enum><text>siting and operating a production facility or a utilization facility at or near existing site infrastructure to support the reuse of such infrastructure, including—</text><clause id="HEB4CD04F275746AAA0CED9046E9192CC" commented="no"><enum>(i)</enum><text>electric switchyard components and transmission infrastructure;</text></clause><clause id="H08C40CFA56064EEC9AA2173B36FA40C2" commented="no"><enum>(ii)</enum><text>heat-sink components;</text></clause><clause id="HA1FEEC4728A6437CAF3963E9590B5EC2" commented="no"><enum>(iii)</enum><text>steam cycle components;</text></clause><clause id="H9F966A61E2A5477DBC678B52D0D2737C" commented="no"><enum>(iv)</enum><text>roads;</text></clause><clause id="HFC58875B9BCF47B8982B109BBAF3BCEB" commented="no"><enum>(v)</enum><text>railroad access; and</text></clause><clause id="H5886C88943CB4B2DA79F69B785A54B97" commented="no"><enum>(vi)</enum><text>water availability; </text></clause></subparagraph><subparagraph id="HBF3B241069094D5E8B447A214149D217" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>using early site permits;</text></subparagraph><subparagraph id="H1443C1D2CF4E439F93D5781D51C11A25" commented="no"><enum>(C)</enum><text>using plant parameter envelopes or similar standardized site parameters on a portion of a larger site; and</text></subparagraph><subparagraph id="HB82DC7F5D5A8462AB08359A31692797A" commented="no"><enum>(D)</enum><text>using a standardized application for similar sites.</text></subparagraph></paragraph><paragraph id="HF61CEB12DAAF48EE8897F169054310B0"><enum>(3)</enum><header>Report</header><text>Not later than 14 months after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report describing any regulations, guidance, and policies evaluated under paragraph (1).</text></paragraph></subsection><subsection id="H7454B70671C14A34A61903DBC383F247"><enum>(c)</enum><header>Licensing</header><paragraph id="H604DF2AB981E4B0B83FA045371A3E8D0" commented="no"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Commission shall, based on the evaluation under subsection (b)—</text><subparagraph id="H3C3B67B5E7C34D02BE506E0632CDAD47" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">develop and implement strategies to enable efficient, timely, and predictable licensing reviews for, and to support the oversight of, production facilities or utilization facilities at covered sites; and</text></subparagraph><subparagraph id="HCB72CF28810448DDB0F7DA6D10EB7443" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">initiate a rulemaking to enable efficient, timely, and predictable licensing reviews for, and to support the oversight of, production facilities or utilization facilities at covered sites.</text></subparagraph></paragraph><paragraph id="HA8BD0CA6ECF1444A8EE286FEB4E3AD81"><enum>(2)</enum><header>Requirements</header><text>In carrying out paragraph (1), consistent with the mission of the Commission, the Commission shall consider matters relating to—</text><subparagraph id="HC96CB664A2CC4D2CAADA7DF022F37A85"><enum>(A)</enum><text>the use of existing site infrastructure;</text></subparagraph><subparagraph id="H5630B51A27AE4970983D066EC5F0AF0A"><enum>(B)</enum><text>existing emergency preparedness organizations and planning;</text></subparagraph><subparagraph id="HC33B1E62CDFE49D7B71915C1BD4E0AAF"><enum>(C)</enum><text>the availability of historical site-specific environmental data;</text></subparagraph><subparagraph id="HA8D2D4EE20034EE3B83A82E836CB5BDF"><enum>(D)</enum><text>previously completed environmental reviews required by the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph id="H5C2CEF4D052040428DDB8617E572C7FE"><enum>(E)</enum><text>activities associated with the potential decommissioning of facilities or decontamination and remediation at covered sites; and</text></subparagraph><subparagraph id="H9C1C81EAAE504E53B7ECE4BC7F291FC7"><enum>(F)</enum><text>community engagement and historical experience with energy production.</text></subparagraph></paragraph></subsection><subsection id="H92A1F69A51C34EF885B09ACA89F75D43"><enum>(d)</enum><header>Report</header><text>Not later than 3 years after the date of enactment of this Act, the Commission shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report describing the actions taken by the Commission under subsection (c)(1).</text></subsection></section><section id="H616B150FC502411F817DF8D1D6A6C2C7"><enum>123.</enum><header>Advancement of nuclear regulatory oversight</header><subsection id="HA90C5D4F13E34A68ADA8811F4744DBB1"><enum>(a)</enum><header>Implementing lessons learned from the COVID–19 health emergency</header><paragraph id="H3D619E95D5E14C81B15E6F6B56DBC4F2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commission shall submit to the appropriate committees of Congress a report on actions taken by the Commission during the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to COVID–19.</text></paragraph><paragraph id="HEC3DDBEC834C42BE87ADB19A279A5802"><enum>(2)</enum><header>Contents</header><text>The report submitted under paragraph (1) shall—</text><subparagraph id="H567BCD6F239D499E933152674DB6D264"><enum>(A)</enum><text display-inline="yes-display-inline">identify any processes, procedures, and other regulatory policies that the Commission revised or temporarily suspended during the public health emergency described in paragraph (1);</text></subparagraph><subparagraph id="H26B80241636E44C7AEE2CCF47DE2413A"><enum>(B)</enum><text display-inline="yes-display-inline">examine how any revision or temporary suspension of a process, procedure, or other regulatory policy identified under subparagraph (A) affected the ability of the Commission to license and regulate the civilian use of radioactive materials in the United States to protect public health and safety, promote the common defense and security, and protect the environment;</text></subparagraph><subparagraph id="H2D6E1A58ABC14412AF6DBEAD4992DD17"><enum>(C)</enum><text>discuss lessons learned from the matters described in subparagraph (B);</text></subparagraph><subparagraph id="H4DDAA75131B946809A6494B17385A4F8"><enum>(D)</enum><text display-inline="yes-display-inline">list actions that the Commission has taken or will take to incorporate into the licensing and oversight activities of the Commission, without compromising the mission of the Commission, the lessons described in subparagraph (C); and</text></subparagraph><subparagraph id="H2D53C6F2B8F94B8380CAC0CB0CF13AC0"><enum>(E)</enum><text>describe when the actions listed under subparagraph (D) were implemented or may be implemented.</text></subparagraph></paragraph></subsection><subsection id="HA77B912F730343C2818439028AFBE806"><enum>(b)</enum><header>Advancing efficient, risk-informed oversight and inspections</header><paragraph id="HF11E8FDBC8394E91A4698FE4559EA476" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Commission shall develop and submit to the appropriate committees of Congress a report that identifies specific improvements to the nuclear reactor and materials oversight and inspection programs carried out pursuant to the Atomic Energy Act of 1954 that the Commission may implement to maximize the efficiency of such programs through, where appropriate, the use of risk-informed, performance-based procedures, expanded incorporation of information technologies, and staff training.</text></paragraph><paragraph id="HEFFBEF4446784517AC855D8FBAC5C925"><enum>(2)</enum><header>Stakeholder input</header><text display-inline="yes-display-inline">In developing the report under paragraph (1), the Commission shall, as appropriate, seek input from—</text><subparagraph id="H5DAC56D7D0B64775A3AFA0201443334D"><enum>(A)</enum><text>the Secretary of Energy;</text></subparagraph><subparagraph id="HC4897037D6F648DEBF1BE75A675FFFF9"><enum>(B)</enum><text>the National Laboratories;</text></subparagraph><subparagraph id="HBAD7E6A8EFE844ADB6D3B953EC4D04D7"><enum>(C)</enum><text>the nuclear energy industry; and</text></subparagraph><subparagraph id="H085DB72F71C74E28A7F43DDDDA2C86B8"><enum>(D)</enum><text>nongovernmental organizations that are related to nuclear energy.</text></subparagraph></paragraph><paragraph id="H14990CF004A046C9B8AFF924EADD3BAD"><enum>(3)</enum><header>Contents</header><text display-inline="yes-display-inline">The report submitted under paragraph (1) shall—</text><subparagraph id="H3BA57E6141E64F65A61818DA8B644896" commented="no"><enum>(A)</enum><text>assess specific elements of oversight and inspections that may be modified by the use of technology, improved planning, and continually updated risk-informed, performance-based assessment, including—</text><clause id="H589CCF845E744EAB9FFF99F9A6F67647" commented="no"><enum>(i)</enum><text>use of travel resources;</text></clause><clause id="H8BAA4A892C4945878F22A9A9271F350D" commented="no"><enum>(ii)</enum><text>planning and preparation for inspections, including entrance and exit meetings with licensees;</text></clause><clause id="H19557126A63840FCA1D2B43F492139E5" commented="no"><enum>(iii)</enum><text>document collection and preparation, including consideration of whether nuclear reactor data are accessible prior to onsite visits or requests to the licensee and that document requests are timely and within the scope of inspections;</text></clause><clause id="HD84C7DC6A6DA468CBDE8824B1265DBEB"><enum>(iv)</enum><text>the cross-cutting issues program; and</text></clause><clause id="H72DF880D30EF43E4826FF23CF05B102E" commented="no"><enum>(v)</enum><text>the scope of event reporting required by licensees to ensure decisions are risk-informed;</text></clause></subparagraph><subparagraph id="H51D05C3470D6422998AE731BC2622DBD" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>identify and assess measures to improve oversight and inspections, including—</text><clause id="HE68F04CBD2D04FB7866BB6BC4A025470" commented="no"><enum>(i)</enum><text>elimination of areas of duplicative or otherwise unnecessary activities;</text></clause><clause id="HFF5B6E9AAE204184B176BD91E86A0C27" commented="no"><enum>(ii)</enum><text>increased use of templates in documenting inspection results; and</text></clause><clause id="HDE12F99DA6C741A18FF183098E0EFC6B" commented="no"><enum>(iii)</enum><text>periodic training of Commission staff and leadership on the application of risk-informed criteria for—</text><subclause id="H30AC0DB8762E4452BEE36D67CF61D305" commented="no"><enum>(I)</enum><text>inspection planning and assessments; </text></subclause><subclause id="H44A35E02079E4B468FEFB343670E5959" commented="no"><enum>(II)</enum><text>agency decision making processes on the application of regulations and guidance; and</text></subclause><subclause id="H80922606FFDF4BDB865D6F412FA1BA24" commented="no"><enum>(III)</enum><text>the application of the Commission’s standard of reasonable assurance of adequate protection;</text></subclause></clause></subparagraph><subparagraph id="H66DBF375F3004CB6995EC726EDB1C4E7" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">assess measures to advance risk-informed procedures, including—</text><clause id="HB248E6B02E5E4135B325241287F7C806" commented="no"><enum>(i)</enum><text>increased use of inspection approaches that balance the level of resources commensurate with safety significance;</text></clause><clause id="H7079621A49EC4D9C8736ECE8F5224F0D" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">increased review of the use of inspection program resources based on licensee performance; </text></clause><clause id="HA71E44B049024644868A7659C212AE8A" commented="no"><enum>(iii)</enum><text>expansion of modern information technology, including artificial intelligence and machine learning to risk inform oversight and inspection decisions; and</text></clause><clause id="H6E576C624E4A4EFA9867670E40CEA881" commented="no"><enum>(iv)</enum><text display-inline="yes-display-inline">updating the Differing Professional Views or Opinions process to ensure any impacts on agency decisions and schedules are commensurate with the safety significance of the differing opinion;</text></clause></subparagraph><subparagraph id="HDC8AA9E6A2064136850C5879FBF91CDB" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">assess the ability of the Commission, consistent with its obligations to provide reasonable assurance of adequate protection of health and safety pursuant to the Atomic Energy Act of 1954, to enable licensee innovations that may advance nuclear reactor operational efficiency and safety, including the criteria of the Commission for timely acceptance of licensee adoption of advanced technologies, including digital technologies;</text></subparagraph><subparagraph id="H3DC0138036F34E84BAD6491CACA94270"><enum>(E)</enum><text>identify recommendations resulting from the assessments described in subparagraphs (A) through (D);</text></subparagraph><subparagraph id="H413E5774CFCC4B3CA57DF38F072307B5" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">identify specific actions that the Commission will take to incorporate into the training, inspection, oversight, and licensing activities, and regulations of the Commission, without compromising the mission of the Commission, the recommendations identified under subparagraph (E); and</text></subparagraph><subparagraph id="HECC8E0572547432BABBFAF594E2EFC71"><enum>(G)</enum><text display-inline="yes-display-inline">describe when the actions identified under subparagraph (F) may be implemented.</text></subparagraph></paragraph></subsection><subsection id="H77C548BF57BF44C591E0AB28DB16265E"><enum>(c)</enum><header>Office and facility space review</header><paragraph id="HEF278754E89F4C70A8BA4B97EFCC740B"><enum>(1)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall—</text><subparagraph id="H4AB38FBB264340509C04419A08B269A8"><enum>(A)</enum><text>review office and other facility space requirements of the Commission; and</text></subparagraph><subparagraph id="H013BC0AD66174BF9B17917B57CE65004"><enum>(B)</enum><text display-inline="yes-display-inline">submit to the appropriate committees of Congress a report, with recommendations, on the results of such review.</text></subparagraph></paragraph><paragraph id="H03DE59CD28A7493FBC423C7F6F79E1A2"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The report described in paragraph (1) shall include—</text><subparagraph id="H0888E1B36F0B4DEBBF216F7E33607FBD"><enum>(A)</enum><text>an examination of—</text><clause id="H0B5936380D9D4ED88B9B4F57D3945AC2"><enum>(i)</enum><text display-inline="yes-display-inline">the costs associated with the headquarters, regional offices, and technical training center of the Commission, including examination of—</text><subclause id="H87D1292DE6344421B36DD9C84FA1D284"><enum>(I)</enum><text>costs that do not support the Commission’s mission, including rent subsidies for other Federal agencies; and</text></subclause><subclause id="H4754B1BE155E45E08452B6524743CD23"><enum>(II)</enum><text>opportunities to reduce future costs through reduction in unnecessary office space, consolidation of offices, use of advanced information technology, or any other appropriate means; and</text></subclause></clause><clause id="H8AC9AA17655147A2B9B54F7AAE313C5D"><enum>(ii)</enum><text display-inline="yes-display-inline">current and anticipated office and facility requirements to efficiently accomplish the mission of the Commission; and</text></clause></subparagraph><subparagraph id="HD5FA41FADDEB48069E128AFBB4ACE94B"><enum>(B)</enum><text>recommendations to Congress, the Commission, and the General Services Administration for actions that may assist in reducing office and facility costs to licensees and taxpayers.</text></subparagraph></paragraph></subsection><subsection id="H4DAD07B53827443698CF8D0ABB428E88"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H13B801181FD748F7BB4710CD92031AA5"><enum>(1)</enum><header>Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate.</text></paragraph><paragraph id="HF6EC0DC13FC04D2581760C515E2EC4E9"><enum>(2)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></paragraph><paragraph id="H2913BE854A25492FB4EE4FE7539CB437" commented="no"><enum>(3)</enum><header>Licensee</header><text display-inline="yes-display-inline">The term <term>licensee</term> means a person that holds a license issued under section 103 or section 104 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref>; 2134).</text></paragraph></subsection></section></subtitle></title><title id="H0D5C1E9274244683B4EFABE0FA861EAF"><enum>II</enum><header>Nuclear Technology Deployment</header><section id="H8024810162AE43F7BC9567116EAAC94A"><enum>201.</enum><header>Advanced nuclear deployment</header><subsection id="H4F8B38EBF89244AC8E7F974BC3C5F50C" commented="no"><enum>(a)</enum><header>Enabling preparations for advanced nuclear reactor demonstrations on Federal sites</header><paragraph id="H67D88294A70E4A80B0DB23020A6D262F" commented="no"><enum>(1)</enum><header>In general</header><text>Section 102(b)(1)(B) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215(b)(1)(B)</external-xref>) is further amended by adding at the end the following:</text><quoted-block id="H43C9D32EAF2F41C5AD74B4B03088C4E4" style="OLC"><clause id="HDEDC3AA7CD0946A9AC62571E0DFDF23E" commented="no"><enum>(vi)</enum><text>Costs for—</text><subclause id="H9A180153F99B4231BA6AF48793B4F14E" commented="no"><enum>(I)</enum><text display-inline="yes-display-inline">activities to review and approve or disapprove an application for an early site permit (as defined in section 52.1 of title 10, Code of Federal Regulations (or any successor regulation)) to demonstrate an advanced nuclear reactor on a Department of Energy site or any site or installation that is critical national security infrastructure (as defined in section 327(d) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019); and</text></subclause><subclause id="H10CA3A9200814E5CBBF02CE4D9644E94" commented="no"><enum>(II)</enum><text>pre-application activities relating to an early site permit (as so defined) to demonstrate an advanced nuclear reactor on a Department of Energy site or any site or installation that is critical national security infrastructure (as defined in section 327(d) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019).</text></subclause></clause><after-quoted-block>. </after-quoted-block></quoted-block></paragraph><paragraph id="H9D20630745A94E3F99D065037C2A5023" commented="no"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall take effect on October 1, 2024.</text></paragraph></subsection><subsection id="H99CA236BA3234D10B46F56EBFF85B210"><enum>(b)</enum><header>Regulatory requirements for micro-reactors</header><paragraph id="H484AEF4157C54153B57096E948B3F671"><enum>(1)</enum><header>Micro-Reactor licensing</header><text>The Nuclear Regulatory Commission (in this subsection referred to as the <quote>Commission</quote>) shall—</text><subparagraph id="HC5E54E3297C34895B1DE000EF4AF085C" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">not later than 18 months after the date of enactment of this Act, develop risk-informed and performance-based strategies and guidance to license and regulate micro-reactors pursuant to section 103 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref>), including strategies and guidance for—</text><clause id="H9E7D98D3DE5B438ABAACCFAFCFF7531D" commented="no"><enum>(i)</enum><text>staffing and operations;</text></clause><clause id="HAF0AFB305F814E2EBAFC6788755465B0" commented="no"><enum>(ii)</enum><text>oversight and inspections;</text></clause><clause id="H24EAEBB213F547EB89707036C4821356" commented="no"><enum>(iii)</enum><text>safeguards and security;</text></clause><clause id="HAA30D7497192431A90CE28B55F4A0861" commented="no"><enum>(iv)</enum><text>emergency preparedness;</text></clause><clause id="H4E2F7E255D004DD6AE8CA8D68FEF7959" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">risk analysis methods, including alternatives to probabilistic risk assessments;</text></clause><clause id="H174BEB166ED04352B944FE5654C0D87F" commented="no"><enum>(vi)</enum><text display-inline="yes-display-inline">decommissioning funding assurance methods that permit the use of design- and site-specific cost estimates;</text></clause><clause id="HC454B616C27049139E92346E1AD0C672" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">the transportation of fueled micro-reactors; and</text></clause><clause id="H4F2FD43C2615424382E825C257A16908" commented="no"><enum>(viii)</enum><text>siting, including in relation to—</text><subclause id="HF8568EDABF16463E91F157D0D8543577" commented="no"><enum>(I)</enum><text>the population density criterion limit described in the policy issue paper on population-related siting considerations for advanced reactors dated May 8, 2020, and numbered SECY–20–0045;</text></subclause><subclause id="HA73F85D1AF2E4FB49B9A44B41409985E" commented="no"><enum>(II)</enum><text>licensing mobile deployment; and</text></subclause><subclause id="H3637FF9CCF4B41B78818B3FD50C7973E" commented="no"><enum>(III)</enum><text>environmental reviews; and</text></subclause></clause></subparagraph><subparagraph id="HEDB93E6509244637B9DE05336C810AC3"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 3 years after the date of enactment of this Act, implement, as appropriate, the strategies and guidance developed under subparagraph (A)—</text><clause id="HB4A93518404742608B327A56A88C89FB" commented="no"><enum>(i)</enum><text>within the existing regulatory framework;</text></clause><clause id="H964F3537E3E041B298A0A5DB73BB81CE" commented="no"><enum>(ii)</enum><text>through the technology-inclusive, regulatory framework to be established under section 103(a)(4)(A) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>); or</text></clause><clause id="H4C4B8AEE32BB40088C6D983B131A653D" commented="no"><enum>(iii)</enum><text>through a pending or new rulemaking.</text></clause></subparagraph></paragraph><paragraph id="H7F9F00A19F96467E9F38B2A72E84C96A"><enum>(2)</enum><header>Considerations</header><text display-inline="yes-display-inline">In developing and implementing strategies and guidance under paragraph (1), the Commission shall consider—</text><subparagraph id="H9E1BED34E6DA41D49D413C87C0566C2A"><enum>(A)</enum><text>the unique characteristics of micro-reactors, including characteristics relating to—</text><clause id="HFA93D761296943329493C07ECA11E53A"><enum>(i)</enum><text>physical size;</text></clause><clause id="HBCC3E3EDB9C34EEB99AFB15F908204F9"><enum>(ii)</enum><text>design simplicity; and</text></clause><clause id="H2EC148C5DCAA4890B686C32795CF03B9"><enum>(iii)</enum><text>source term;</text></clause></subparagraph><subparagraph id="H2781645BD4784E4A8963E11A2329D174"><enum>(B)</enum><text>opportunities to address redundancies and inefficiencies;</text></subparagraph><subparagraph id="H8F75F10DD0374097AAF516AD7B9E9D14"><enum>(C)</enum><text>opportunities to consolidate review phases and reduce transitions between review teams; </text></subparagraph><subparagraph id="HD3A2C15F85564890A23139E6F1515DD7"><enum>(D)</enum><text>opportunities to establish integrated review teams to ensure continuity throughout the review process; and</text></subparagraph><subparagraph id="HB2FD00D306774F1F89C7EE97CE702A13" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">other relevant considerations discussed in the policy issue paper on policy and licensing considerations related to micro-reactors dated October 6, 2020, and numbered SECY–20–0093.</text></subparagraph></paragraph><paragraph id="HB7A98431E2D24433A6DA2621F6E71CB5"><enum>(3)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Commission shall consult with—</text><subparagraph id="HDDD10A289A0C420787740C70B3E6D84D"><enum>(A)</enum><text>the Secretary of Energy;</text></subparagraph><subparagraph id="HE84FCB4B447E4745BC2528FFF95A67B0"><enum>(B)</enum><text>the heads of other Federal agencies, as appropriate;</text></subparagraph><subparagraph id="H7C4E2566204548F3AFBF97224F5EF3B7"><enum>(C)</enum><text>micro-reactor technology developers; and</text></subparagraph><subparagraph id="HD836EFA9333341F5BB4D3B7913419032"><enum>(D)</enum><text>other stakeholders.</text></subparagraph></paragraph></subsection><subsection id="HF79EAB5178964C409B4D73CE0A37238A"><enum>(c)</enum><header>Expedited subsequent combined licenses</header><paragraph id="HEBEB4EA0503E4A328521A66DE5CD55E2" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In accordance with this subsection, the Nuclear Regulatory Commission (referred to in this subsection as the <quote>Commission</quote>) shall establish and carry out an expedited procedure for issuing a combined license pursuant to section 185 b. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2235">42 U.S.C. 2235</external-xref>).</text></paragraph><paragraph id="HA6C8963560EE43EF89A4BA80949C2074" commented="no"><enum>(2)</enum><header>Qualifications</header><text display-inline="yes-display-inline">To qualify for the expedited procedure under paragraph (1), an applicant—</text><subparagraph id="H2F2E5D95C97340769D91D4A71EE27BE1" commented="no"><enum>(A)</enum><text>shall submit a combined license application for a new nuclear reactor based off a previously licensed design;</text></subparagraph><subparagraph id="HB37BA93B32C24FCC85FB2AED0BBC933D" commented="no"><enum>(B)</enum><text>shall propose to construct the new nuclear reactor on or adjacent to a site on which a nuclear reactor already operates or previously operated; and</text></subparagraph><subparagraph id="HD4F0C1FC47B04108A3F0AC91B13B3A92" commented="no"><enum>(C)</enum><text>may not be subject to an order of the Commission to suspend or revoke a license under section 2.202 of title 10, Code of Federal Regulations (or any successor regulation).</text></subparagraph></paragraph><paragraph id="HDC8136F852504DFCB36AA5EC78C37AAF" commented="no"><enum>(3)</enum><header>Expedited procedure</header><text display-inline="yes-display-inline">With respect to a combined license for which the applicant has satisfied the requirements described in paragraph (2), the Commission shall, to the maximum extent practicable—</text><subparagraph id="HB9561659988647A1824EAB471C89F161" commented="no"><enum>(A)</enum><text>not later than 1 year after the application is accepted for docketing, issue a draft environmental impact statement;</text></subparagraph><subparagraph id="H0A24528CC66842D5BC4D1B420C070C00" commented="no"><enum>(B)</enum><text>not later than 18 months after the application is accepted for docketing—</text><clause id="H46CBF54E25F6494AAE21964A56A881E1" commented="no"><enum>(i)</enum><text>complete the technical review process; and</text></clause><clause id="H5309A7DBD49B43DB973AB2781D7E7D55" commented="no"><enum>(ii)</enum><text>issue a safety evaluation report and final environmental impact statement;</text></clause></subparagraph><subparagraph id="H40006827A88B4211A5675269F173E6D3" commented="no"><enum>(C)</enum><text>not later than 2 years after the application is accepted for docketing, complete any necessary public licensing hearings and related processes; and</text></subparagraph><subparagraph id="H6C22920E502E44B38762B487B202ADF1" commented="no"><enum>(D)</enum><text>not later than 25 months after the application is accepted for docketing, make a final decision on whether to issue the combined license.</text></subparagraph></paragraph><paragraph id="H26656EC35A9E415A931643DD3B911D22" commented="no"><enum>(4)</enum><header>Performance and reporting</header><subparagraph id="HD58FD208EE3F43FBACC4072B79EED08E" commented="no"><enum>(A)</enum><header>Delays in issuance</header><text display-inline="yes-display-inline">Not later than 30 days after the applicable deadline, the Executive Director for Operations of the Commission shall inform the Commission of any failure to meet a deadline under paragraph (3).</text></subparagraph><subparagraph id="HAB854BD4B9D14A29A7BC4F1A130FB58C" commented="no"><enum>(B)</enum><header>Delays in issuance exceeding 90 days</header><text display-inline="yes-display-inline">If any deadline under paragraph (3) is not met by the date that is 90 days after the applicable date required under such paragraph, the Commission shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Energy and Commerce of the House of Representatives a report describing the delay, including a detailed explanation accounting for the delay and a plan for completion of the applicable action.</text></subparagraph></paragraph></subsection><subsection id="HBA146E1F8F2743108284605B4462A722"><enum>(d)</enum><header>Pilot program for nuclear power purchase agreements</header><paragraph id="H9AE42734268D4A869908643C672CD64A"><enum>(1)</enum><header>In general</header><text>Subtitle B of title VI of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 782) is amended by adding at the end the following:</text><quoted-block id="HB5A97C8CF1804624AF6D621599D02488" style="OLC"><section id="H9EFB2C6B0C6D4BAABE13E2F3A11B99F6"><enum>639A.</enum><header>Long-term nuclear power purchase agreement pilot program</header><subsection id="H00715744F4024544AC96FA9BD8B5E63F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary may establish a pilot program under which the Secretary may enter into at least one long-term power purchase agreement for power generated by a commercial nuclear reactor with respect to which an initial operating license is issued by the Nuclear Regulatory Commission after January 1, 2024.</text></subsection><subsection id="H89786CDC3F9041A597C0BD6CCBBA552F" commented="no"><enum>(b)</enum><header>Consultation</header><text>In establishing a pilot program under this section, the Secretary shall consult with the heads of other Federal departments and agencies that may benefit from purchasing nuclear power for a period of longer than 10 years, including the Secretary of Defense.</text></subsection><subsection id="H03F90923A8BD45B18A7416AD99F7D02A"><enum>(c)</enum><header>Period of agreement</header><text>Notwithstanding any other provision of law, an agreement entered into pursuant to this section to purchase power from a commercial nuclear reactor shall be made for a period of at least 10 years and not more than 40 years.</text></subsection><subsection id="H43F659873D084F6BAFF5866C8A126225"><enum>(d)</enum><header>Priority</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall prioritize entering into long-term power purchase agreements for power generated by first-of-a-kind or early deployment commercial nuclear reactors that will provide reliable and resilient power—</text><paragraph id="H6CF421C9E1084E1D98AB4286535B09E4"><enum>(1)</enum><text>to high-value assets for national security purposes; or</text></paragraph><paragraph id="H946FE97A76AE4E029C9556CD471F4551"><enum>(2)</enum><text>for other purposes that the Secretary determines are in the national interest, including for remote off-grid scenarios or grid-connected scenarios that provide capabilities commonly known as <quote>islanding power capabilities</quote> during an emergency.</text></paragraph></subsection><subsection id="H64A80F9BDD274A8D9CD754A43D30803B"><enum>(e)</enum><header>Rates</header><text>A long-term power purchase agreement entered into under this section may not be at a rate that is higher than the average market rate, unless the agreement is for power generated by a commercial nuclear reactor described in subsection (d).</text></subsection><subsection id="H9E5B6029C48E4780BDC1E289F123A0EE"><enum>(f)</enum><header>Advanced funding</header><text display-inline="yes-display-inline">The Secretary—</text><paragraph id="H5E6302B3608B463791BECB3E281D54FE"><enum>(1)</enum><text display-inline="yes-display-inline">may not enter into any power purchase agreement under this section unless funds are specifically provided for such purposes in advance in appropriations Acts enacted after the date of enactment of this section; and</text></paragraph><paragraph id="H5D87B6150DF645A6933C5615078318C5"><enum>(2)</enum><text>may only enter into such a power purchase agreement if the full extent of anticipated costs stemming from such agreement is recorded as an obligation up front and in full at the time such agreement is made.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4214F2F6734F42C8B4ABD9C41B614AE3"><enum>(2)</enum><header>Table of contents</header><text>The table of contents of the Energy Policy Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/58">Public Law 109–58</external-xref>; 119 Stat. 594) is amended by inserting after the item relating to section 639 the following:</text><quoted-block id="H61CE99D508904F0AA65F997477FBA10B" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 639A. Long-term nuclear power purchase agreement pilot program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H00B7E831EFE9489D90E4C82B0EE3B34A"><enum>202.</enum><header>Global nuclear cooperation</header><subsection id="H3EAA570933A548CCB0B138FD6E2F4ADB"><enum>(a)</enum><header>Global nuclear energy assessment study</header><paragraph id="H0883051B1F51492CB594D7AE8D8C3F69" display-inline="no-display-inline"><enum>(1)</enum><header>Study required</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Energy, in consultation with the Secretary of State, the Secretary of Commerce, the Administrator of the Environmental Protection Agency, and the Commission, shall conduct a study on the global status of—</text><subparagraph id="H6454B6565AA3471BBDAF9057B768C556"><enum>(A)</enum><text>the civilian nuclear energy industry; and</text></subparagraph><subparagraph id="H2B35B5F6566441B4AB94DFC753F26D66"><enum>(B)</enum><text display-inline="yes-display-inline">the supply chains of the civilian nuclear energy industry.</text></subparagraph></paragraph><paragraph id="HFA5A8EF3FB77431CBFB4447A30F9E877"><enum>(2)</enum><header>Contents</header><text display-inline="yes-display-inline">The study conducted under paragraph (1) shall include—</text><subparagraph id="H53E922CB380E43FD99A5756812339A1C"><enum>(A)</enum><text>information on the status of the civilian nuclear energy industry, the long-term risks to such industry, and the basis for such risks;</text></subparagraph><subparagraph id="H63CA0B8129794E6786CF93C12F791741"><enum>(B)</enum><text display-inline="yes-display-inline">information on how the use of the civilian nuclear energy industry, relative to other types of energy industries, can reduce the emission of criteria pollutants and carbon dioxide;</text></subparagraph><subparagraph id="H9DC27F7731064B81AC5C8E816F29EF69"><enum>(C)</enum><text display-inline="yes-display-inline">information on the role the United States civilian nuclear energy industry plays in United States foreign policy;</text></subparagraph><subparagraph id="H81B1126D1AED468EA83DF297DCEE12B8"><enum>(D)</enum><text display-inline="yes-display-inline">information on the importance of the United States civilian nuclear energy industry to countries that are allied to the United States;</text></subparagraph><subparagraph id="H55BB84B3C9864346A6D476DEB47B1CF9" commented="no"><enum>(E)</enum><text display-inline="yes-display-inline">information on how the United States may collaborate with such countries in developing, deploying, and investing in nuclear technology;</text></subparagraph><subparagraph id="HE7356FA58CB94DB19AEC28E362F9698B"><enum>(F)</enum><text display-inline="yes-display-inline">information on how foreign countries use nuclear energy when crafting and implementing their own foreign policy, including such use by foreign countries that are strategic competitors;</text></subparagraph><subparagraph id="H9FF5A778376C47A0987816DEACF26EC9"><enum>(G)</enum><text>an evaluation of how nuclear nonproliferation and security efforts and nuclear energy safety are affected by the involvement of the United States in—</text><clause id="HD91E6E251F334B78BC1E6AA9ACB72A8A"><enum>(i)</enum><text>international markets; and</text></clause><clause id="HE8A8EE8F31824B19A0BB28572BA88318"><enum>(ii)</enum><text>setting civilian nuclear energy industry standards;</text></clause></subparagraph><subparagraph id="HFAE64B0824854846B51115F3E0C844A8"><enum>(H)</enum><text display-inline="yes-display-inline">an evaluation of how industries in the United States, other than the civilian nuclear energy industry, benefit from the generation of electricity by nuclear power plants;</text></subparagraph><subparagraph id="H10150E7A22C847E9B3EF8914CF399333"><enum>(I)</enum><text>information on utilities and companies in the United States that are involved in the civilian nuclear energy supply chain, including, with respect to such utilities and companies—</text><clause id="HC6A1AF9EEBED4BD5B5C1E79A1B20992C"><enum>(i)</enum><text>financial challenges;</text></clause><clause id="H11FAC46F518741F39274356E8691AC5B"><enum>(ii)</enum><text display-inline="yes-display-inline">nuclear liability issues;</text></clause><clause id="H8D2E60CB2E5F43C38E5C8F1408381B94"><enum>(iii)</enum><text>foreign strategic competition; and</text></clause><clause id="HE737C58B39E04C0EA02D82BD16AE8FB1"><enum>(iv)</enum><text>risks to continued operation; and</text></clause></subparagraph><subparagraph id="HC69F596696484682AE2ABAA69A54E96F"><enum>(J)</enum><text>recommendations for how the United States may—</text><clause id="H2E7127BCD6A4470C84A42913FF97C53A"><enum>(i)</enum><text>develop a national strategy to increase the role nuclear energy plays in diplomacy and strategic energy policy;</text></clause><clause id="H7523B605BF8D433CADF8656D56B2CE39" commented="no"><enum>(ii)</enum><text>develop a strategy to mitigate foreign competitor’s utilization of their civilian nuclear energy industries in diplomacy;</text></clause><clause id="H07F5013B11B9484FB10D18ADED510F1A"><enum>(iii)</enum><text>align its nuclear energy policy with national security objectives; and</text></clause><clause id="H40FDDC0BF2F54F89A67A1ABAB2C2D833"><enum>(iv)</enum><text>remove regulatory barriers to the development of the United States civilian nuclear energy supply chain.</text></clause></subparagraph></paragraph><paragraph id="HC33F465D47D4480280CB55CDD2D6AC6D"><enum>(3)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 6 months after the study is conducted under paragraph (1), the Secretary of Energy shall submit to the appropriate committees of Congress a report, including a classified annex as necessary, on the results of such study.</text></paragraph></subsection><subsection id="H8AF3281D7F0444C4B8310D6B9C0FCD50" commented="no"><enum>(b)</enum><header>Program to train and share expertise</header><paragraph id="H2B78DB23A4574F2AA65B193E6913E6E4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Energy, in consultation with the Secretary of State and the Commission, shall develop and carry out a program under which the Secretary of Energy shall train foreign nuclear energy experts and standardize practices.</text></paragraph><paragraph id="H534E958EEF494895881F56B76F67A442"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">In carrying out the program developed under paragraph (1), the Secretary of Energy shall—</text><subparagraph id="H211C0F2183AE43DD8B2580E35ACF1F1D" commented="no"><enum>(A)</enum><text>issue guidance for best safety practices in the global civilian nuclear energy industry based on practices established in the United States;</text></subparagraph><subparagraph id="H48C12D8C04A04774BE18F8FE7C8FD4F1"><enum>(B)</enum><text display-inline="yes-display-inline">train foreign nuclear energy experts on the operation and safety and security practices used by the United States civilian nuclear energy industry;</text></subparagraph><subparagraph id="HD3BCFB58792747F8A584105635EB350F"><enum>(C)</enum><text>review global supply chain risks for foreign civilian nuclear energy industries;</text></subparagraph><subparagraph id="H90636E48BA324DAB8437D339B6A2AFC4"><enum>(D)</enum><text>identify weaknesses and concerns found in foreign civilian nuclear energy industries; and</text></subparagraph><subparagraph id="HBFAFB2A62F2246158DB5B38E35854A3F"><enum>(E)</enum><text>establish partnerships with foreign countries that have developed or are developing civilian nuclear energy industries.</text></subparagraph></paragraph><paragraph id="H558F0A560E11470B9D83D21722EBBB18" commented="no"><enum>(3)</enum><header>Foreign nuclear energy expert</header><text display-inline="yes-display-inline">In this subsection, the term <term>foreign nuclear energy expert</term> does not include a person who is from a country—</text><subparagraph id="H2ED181E054EF4D79AB52F2379C7FE75D" commented="no"><enum>(A)</enum><text>in which intellectual property theft is legal;</text></subparagraph><subparagraph id="HF646ECE7EFD649E7AA9735A41F1E6DF1" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">that takes actions to undermine the civilian nuclear energy industry or other critical industries of the United States; or</text></subparagraph><subparagraph id="H87D1D312AC1D4C9397A08BF6FD76DC03"><enum>(C)</enum><text display-inline="yes-display-inline">which the Secretary of Energy determines is inimical to the interest of the United States.</text></subparagraph></paragraph></subsection><subsection id="H43E4EE4C294940A1A62C181BC84FA061"><enum>(c)</enum><header>International nuclear reactor export and innovation activities</header><paragraph id="H37B80ED8BC724DBDBC71BAB2185B3BD5" display-inline="no-display-inline"><enum>(1)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Commission shall—</text><subparagraph id="H9CAD2E7214E34984A518FBDDE4A2E3AD" display-inline="no-display-inline"><enum>(A)</enum><text>coordinate all work of the Commission relating to—</text><clause id="HA1FBAC4B9D774F3AA74AB88BADECBBBD"><enum>(i)</enum><text display-inline="yes-display-inline">issuing a license for the import or export of a nuclear reactor under section 103 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref>); and</text></clause><clause id="HFD4D96A2C4B547598C34E5FBF62F34C7"><enum>(ii)</enum><text>international regulatory cooperation and assistance relating to nuclear reactors; and</text></clause></subparagraph><subparagraph id="HC1A73A20049A4B1DADE1C6C0A61EF0D2"><enum>(B)</enum><text>support—</text><clause id="HF2705798618F41F2B90960DE7550D8CD"><enum>(i)</enum><text>the consideration of international technical standards to assist the design, licensing, and construction of advanced nuclear systems;</text></clause><clause id="H5351D206938946F89D178DB74F53E7CB"><enum>(ii)</enum><text>efforts to help build competent nuclear regulatory organizations and legal frameworks in foreign countries that are seeking to develop civilian nuclear energy industries; and</text></clause><clause id="HC23CC1F2BE3D449C9D29AD4ED061CBB3"><enum>(iii)</enum><text display-inline="yes-display-inline">exchange programs and training provided in coordination with the Secretary of State to foreign countries relating to civilian nuclear energy industry regulation and oversight to improve nuclear technology licensing.</text></clause></subparagraph></paragraph><paragraph id="HC532D14E19284F3EAD9DFBE83667D38B" commented="no"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In supporting exchange programs and training under paragraph (1)(B)(iii), the Commission shall consult with—</text><subparagraph id="H9782C0FFE2E1467A81428A3F93C7A450" commented="no"><enum>(A)</enum><text>the Secretary of Energy;</text></subparagraph><subparagraph id="H4C6FF4612CB7471188C9CFC6AB8CA7C5"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of State;</text></subparagraph><subparagraph id="H95C29EDB5BB246F7B7C983EFDE618198" commented="no"><enum>(C)</enum><text>the National Laboratories;</text></subparagraph><subparagraph id="HE03F7814CFC94F36A7D975137BD0AD44" commented="no"><enum>(D)</enum><text>the private sector; and</text></subparagraph><subparagraph id="HB63C18808FB548C09061143629D33871" commented="no"><enum>(E)</enum><text>institutions of higher education.</text></subparagraph></paragraph><paragraph id="H323E891342114D14BF2ABAB816E70199"><enum>(3)</enum><header>Nuclear Reactor Export and Innovation Branch</header><text display-inline="yes-display-inline">The Commission may establish within the Office of International Programs of the Commission a branch, to be known as the <quote>International Nuclear Reactor Export and Innovation Branch</quote>, to carry out the nuclear reactor export and innovation activities described in paragraph (1) as the Commission determines appropriate.</text></paragraph><paragraph id="H418E58C0BAB744D0BA43F1ACE4387FD6"><enum>(4)</enum><header>Exclusion of international activities from the fee base</header><subparagraph id="H9607643305A3426089CFE828F488D770"><enum>(A)</enum><header>In general</header><text>Section 102 of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2215">42 U.S.C. 2215</external-xref>) is amended—</text><clause id="HA3EF82A8CF9C42F58093898323D04316" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2634B9ACBB934EF286C4A3196C06A6D6"><paragraph id="HE3805AFA779147CFB85185D7A453B411" commented="no"><enum>(4)</enum><header>International nuclear reactor export and innovation activities</header><text display-inline="yes-display-inline">The Commission shall identify in the annual budget justification international nuclear reactor export and innovation activities described in section 202(c)(1) of the <short-title>Atomic Energy Advancement Act</short-title>. </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H456E0ACFB96A4A8EB3BC09D88F77CEC6" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(B), as amended by the preceding provisions of this Act, by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF2782643219E4D38BABD90EBA5BAAAA4"><clause id="HBB3F45C5532742E7A0677C3ACB9543B2" commented="no"><enum>(vii)</enum><text display-inline="yes-display-inline">Costs for international nuclear reactor export and innovation activities described in section 202(c)(1) of the <short-title>Atomic Energy Advancement Act</short-title>.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H955ABD7755C84E068BAFE593C0869EEB"><enum>(B)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subparagraph (A) shall take effect on October 1, 2024.</text></subparagraph></paragraph></subsection><subsection id="H77DA1DB9D2A24E55B51C5BC724F2E25D" commented="no"><enum>(d)</enum><header>Denial of certain domestic licenses for national security purposes</header><paragraph id="H10A9FAA20DA1492D9200FCAD14DA2DE0" commented="no"><enum>(1)</enum><header>Definition of covered fuel</header><text>In this subsection, the term <term>covered fuel</term> means enriched uranium that is fabricated into fuel assemblies for nuclear reactors by an entity that—</text><subparagraph id="H71F5F3C884664EBAB279793385599D3D" commented="no"><enum>(A)</enum><text>is owned or controlled by the Government of the Russian Federation or the Government of the People’s Republic of China; or</text></subparagraph><subparagraph id="H70363626E06A42A89DC212DD38544419" commented="no"><enum>(B)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, the Russian Federation or the People’s Republic of China.</text></subparagraph></paragraph><paragraph id="HF7DEC27CD5DF49C890414CBD9A3F8293" commented="no"><enum>(2)</enum><header>Prohibition on unlicensed possession or ownership of covered fuel</header><text>Unless specifically authorized by the Commission in a license issued under section 53 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2073">42 U.S.C. 2073</external-xref>), no person subject to the jurisdiction of the Commission may possess or own covered fuel.</text></paragraph><paragraph id="HEE6B278F8E614F60BA49ED207D57535B" commented="no"><enum>(3)</enum><header>License To possess or own covered fuel</header><subparagraph id="HE2B2DA5ACBE1421AB431A308AD6A4A90" commented="no"><enum>(A)</enum><header>Consultation required prior to issuance</header><text>The Commission shall not issue a license to possess or own covered fuel under section 53 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2073">42 U.S.C. 2073</external-xref>) unless the Commission has first consulted with the Secretary of Energy and the Secretary of State before issuing the license.</text></subparagraph><subparagraph id="H04903859256D4CFE8614834B90E64F34" commented="no"><enum>(B)</enum><header>Prohibition on issuance of license</header><clause id="H234D7D2DAB6A4CA0A7C5CA4894AB016A" commented="no"><enum>(i)</enum><header>In general</header><text>Subject to clause (iii), a license to possess or own covered fuel shall not be issued if the Secretary of Energy and the Secretary of State make the determination described in clause (ii).</text></clause><clause id="H60F7D6912A6140C5B657325603866C36" commented="no"><enum>(ii)</enum><header>Determination</header><subclause id="HA3AAC16A3BCA4054B09E2558A3E59E05" commented="no"><enum>(I)</enum><header>In general</header><text>The determination referred to in clause (i) is a determination that possession or ownership, as applicable, of covered fuel poses a threat to the national security of the United States that adversely impacts the physical and economic security of the United States.</text></subclause><subclause id="HC99A5ECDC42B46A9A32D3D43007ACFB5" commented="no"><enum>(II)</enum><header>Joint determination</header><text display-inline="yes-display-inline">A determination described in subclause (I) shall be jointly made by the Secretary of Energy and the Secretary of State.</text></subclause><subclause id="HA7EFDC0984FF4BD7BF44B407EE3BA57E" commented="no"><enum>(III)</enum><header>Timeline</header><item id="HDCC286DECF094DF2955BDDE040B77A17" commented="no"><enum>(aa)</enum><header>Notice of application</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Commission receives an application for a license to possess or own covered fuel, the Commission shall notify the Secretary of Energy and the Secretary of State of the application. </text></item><item id="H5B960BEDDA804CCFA435CA80141F7874" commented="no"><enum>(bb)</enum><header>Determination</header><text display-inline="yes-display-inline">The Secretary of Energy and the Secretary of State shall have a period of 180 days, beginning on the date on which the Commission notifies the Secretary of Energy and the Secretary of State under item (aa) of an application for a license to possess or own covered fuel, in which to make the determination described in subclause (I).</text></item><item id="H870DE91E07934443A6A19EFACCA5A255" commented="no"><enum>(cc)</enum><header>Commission notification</header><text display-inline="yes-display-inline">On making the determination described in subclause (I), the Secretary of Energy and the Secretary of State shall immediately notify the Commission. </text></item><item id="H8D7EAD0BF7854712B185315CD8708FF0" commented="no"><enum>(dd)</enum><header>Congressional notification</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Secretary of Energy and the Secretary of State notify the Commission under item (cc), the Commission shall notify the appropriate committees of Congress of the determination.</text></item><item id="H6D376BC4BF7D44C8B8AC6F3464FC1673" commented="no" display-inline="no-display-inline"><enum>(ee)</enum><header>Public notice</header><text>Not later than 15 days after the date on which the Commission notifies Congress under item (dd) of a determination made under subclause (I), the Commission shall make that determination publicly available. </text></item></subclause></clause><clause id="HF7688DD11D7F485C805C4ABDFE49A012" commented="no"><enum>(iii)</enum><header>Effect of no determination</header><text display-inline="yes-display-inline">The prohibition described in clause (i) shall not apply if the Secretary of Energy and the Secretary of State do not make the determination described in clause (ii) by the date described in subclause (III)(bb) of that clause.</text></clause></subparagraph></paragraph></subsection><subsection id="H3D373EB3E42C4392A300BB9A48300FF6"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HF6BA6BF0970F48A59087909700AEBA3F" commented="no"><enum>(1)</enum><header>Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means each of the following:</text><subparagraph id="HEAB40F2F2E7B41DB8184AFAA5D4A9300" commented="no"><enum>(A)</enum><text>The Committee on Energy and Commerce of the House of Representatives.</text></subparagraph><subparagraph id="H83A7FD293D7B4E9A899DF8A58B6B5169" commented="no"><enum>(B)</enum><text>The Committee on Foreign Affairs of the House of Representatives.</text></subparagraph><subparagraph id="H41F8969B22D248D0828790D5D62CEDE1"><enum>(C)</enum><text display-inline="yes-display-inline">The Committee on Environment and Public Works of the Senate.</text></subparagraph><subparagraph id="HBCBCF2AA3E334C3D8DC580AF254D6084" commented="no"><enum>(D)</enum><text>The Committee on Energy and Natural Resources of the Senate.</text></subparagraph><subparagraph id="H9513FC7E7BF54AE7981DD466D3084A6D" commented="no"><enum>(E)</enum><text>The Committee on Foreign Relations of the Senate.</text></subparagraph></paragraph><paragraph id="H75D56CCC4035431AB7521C93C8C4FEC2"><enum>(2)</enum><header>Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Nuclear Regulatory Commission.</text></paragraph></subsection></section><section id="H3090A5653EB44931937C5C1FA4EA36AA"><enum>203.</enum><header>American nuclear competitiveness</header><subsection id="H1003C3F64A7C4EC8B429D54363FFEDD4" commented="no"><enum>(a)</enum><header>Process for review and amendment of part 810 generally authorized destinations</header><paragraph id="HE9303206A3D24AE0B6D68FF817B5DFF9" commented="no"><enum>(1)</enum><header>Identification and evaluation of factors</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary of Energy, with the concurrence of the Secretary of State, shall identify and evaluate factors, other than agreements for cooperation entered into in accordance with section 123 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2153">42 U.S.C. 2153</external-xref>), that may be used to determine a country’s generally authorized destination status under part 810 of title 10, Code of Federal Regulations, and to list such country as a generally authorized destination in Appendix A to part 810 of title 10, Code of Federal Regulations. </text></paragraph><paragraph id="H0186B3013C1A49EE88290EB613ACD2E0" commented="no"><enum>(2)</enum><header>Process update</header><text display-inline="yes-display-inline">The Secretary of Energy shall review and, as appropriate, update the Department of Energy’s process for determining a country’s generally authorized destination status under part 810 of title 10, Code of Federal Regulations, and for listing such country as a generally authorized destination in Appendix A to part 810 of title 10, Code of Federal Regulations, taking into consideration, and, as appropriate, incorporating factors identified and evaluated under paragraph (1).</text></paragraph><paragraph id="H37AE6294FA824579876DB36F44210F47" commented="no"><enum>(3)</enum><header>Revisions to list</header><text display-inline="yes-display-inline">Not later than one year after the date of enactment of this Act, and at least once every 5 years thereafter, the Secretary of Energy shall, in accordance with any process updated pursuant to this subsection, review the list in Appendix A to part 810 of title 10, Code of Federal Regulations, and amend such list as appropriate. </text></paragraph></subsection><subsection id="H4FFEEFC1139A4A1DA702946B9B65BD9E" commented="no"><enum>(b)</enum><header>Licensing domestic nuclear projects in which United States allies invest</header><paragraph id="HECE2A52B113241D09822863161F44AAB" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The prohibitions against issuing certain licenses for utilization facilities to certain aliens, corporations, and other entities described in the second sentence of section 103 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>) and the second sentence of section 104 d. of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2134">42 U.S.C. 2134(d)</external-xref>) shall not apply to an entity described in paragraph (2) of this subsection if the Nuclear Regulatory Commission determines that issuance of the applicable license to that entity is not inimical to—</text><subparagraph id="H5B68B20D52AB4796A06CA102D1D58A13" commented="no"><enum>(A)</enum><text>the common defense and security; or</text></subparagraph><subparagraph id="HF7D8D8CEFB9A434A84A72DEC2CB664F0" commented="no"><enum>(B)</enum><text>the health and safety of the public.</text></subparagraph></paragraph><paragraph id="HC8F7BAC175CE493CB31D9A3CD5011D41" commented="no"><enum>(2)</enum><header>Entities described</header><subparagraph id="HE5B3AC278BF145B0B8F6BB91B0E494C5" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">An entity referred to in paragraph (1) is an alien, corporation, or other entity that is owned, controlled, or dominated by—</text><clause id="H21FC6C172A86495DB9579B12D31ACC80" commented="no"><enum>(i)</enum><text>the government of—</text><subclause id="H3448F740314D4C368655A4366C0FFF7B" commented="no"><enum>(I)</enum><text>a country, other than a country described in subparagraph (B), that is a member of the Organization for Economic Co-operation and Development on the date of enactment of this Act; or</text></subclause><subclause id="H82DBBDC6A9DD4DB7ACCBA02130F0E159" commented="no"><enum>(II)</enum><text>the Republic of India;</text></subclause></clause><clause id="H77B98E070BE64409B1ECA95EEE71C952" commented="no"><enum>(ii)</enum><text>a corporation that is incorporated in a country described in subclause (I) or (II) of clause (i); or</text></clause><clause id="HD041C4FFA05047739D5A15E3F14D6D1B" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">an alien who is a citizen or national of a country described in subclause (I) or (II) of clause (i).</text></clause></subparagraph><subparagraph id="H456E0DC1D354453DAD125F69D4CF9AED" commented="no"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">A country described in this subparagraph is a country—</text><clause id="H57D32CE8DB4046CBA2C464AA1FD366C3" commented="no"><enum>(i)</enum><text>any department, agency, or instrumentality of the government of which, on the date of enactment of this Act, is subject to sanctions under section 231 of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9525">22 U.S.C. 9525</external-xref>); or</text></clause><clause id="H5C37232B4998478E9988B6DFDB94FDE2" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">any citizen, national, or entity of which, as of the date of enactment of this Act, is included on the List of Specially Designated Nationals and Blocked Persons maintained by the Office of Foreign Assets Control of the Department of the Treasury pursuant to sanctions imposed under section 231 of the Countering America’s Adversaries Through Sanctions Act (<external-xref legal-doc="usc" parsable-cite="usc/22/9525">22 U.S.C. 9525</external-xref>). </text></clause></subparagraph></paragraph><paragraph id="H8E889FCAE10E43D5947F11F8E9C595AB" commented="no"><enum>(3)</enum><header>Technical amendment</header><text>Section 103 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>) is amended, in the second sentence, by striking <quote>any any</quote> and inserting <quote>any</quote>.</text></paragraph><paragraph id="HC4BFB5BF0FC84995880F7CC2C23243A2" commented="no"><enum>(4)</enum><header>Savings clause</header><text>Nothing in this subsection affects the requirements of section 721 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4565">50 U.S.C. 4565</external-xref>).</text></paragraph></subsection><subsection id="H4F573504679849C29825F377A9678EAF"><enum>(c)</enum><header>Licensing considerations relating to use of nuclear energy for nonelectric applications</header><paragraph id="H46CBE3E709E74BEFB80C603386110D98"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Nuclear Regulatory Commission (in this subsection referred to as the <quote>Commission</quote>) shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report addressing any unique licensing issues or requirements relating to—</text><subparagraph id="HD05618BD11CB4C77A88366687007D101"><enum>(A)</enum><text>the flexible operation of advanced nuclear reactors, such as ramping power output and switching between electricity generation and nonelectric applications;</text></subparagraph><subparagraph id="H4A51C475FA2A4323809A5576EB4EA9D9"><enum>(B)</enum><text>the use of advanced nuclear reactors exclusively for nonelectric applications; and</text></subparagraph><subparagraph id="H4194E9C369AC4B8DAA3CC283C844286C"><enum>(C)</enum><text>the collocation of advanced nuclear reactors with industrial plants or other facilities.</text></subparagraph></paragraph><paragraph id="H68ECBDD8D257470BBEF407697CB820DD"><enum>(2)</enum><header>Stakeholder input</header><text display-inline="yes-display-inline">In developing the report under paragraph (1), the Commission shall seek input from—</text><subparagraph id="H970C62140D1D4361AD39B03D1EE61F6F"><enum>(A)</enum><text>the Secretary of Energy;</text></subparagraph><subparagraph id="H4DE4AFAEBC0D4FD7879EE75579761897"><enum>(B)</enum><text>the nuclear energy industry;</text></subparagraph><subparagraph id="H3A742E83D2DF4E1BA402910B60324B43"><enum>(C)</enum><text>technology developers;</text></subparagraph><subparagraph id="H64FE60600D3E44EDB841AA196131A189"><enum>(D)</enum><text>the industrial, chemical, and medical sectors;</text></subparagraph><subparagraph id="H4EA8AC9153694121904E3BE21D5A616D"><enum>(E)</enum><text>nongovernmental organizations; and</text></subparagraph><subparagraph id="H3B0FD46B05F14D89B0A4EE95DA1FB6B3"><enum>(F)</enum><text>other public stakeholders.</text></subparagraph></paragraph><paragraph id="HCE0C77B92D2B47429A344A87D01E499E"><enum>(3)</enum><header>Contents</header><text display-inline="yes-display-inline">The report under paragraph (1) shall describe—</text><subparagraph id="H172E9607B1F844C381D3D5CC09FFAB88"><enum>(A)</enum><text display-inline="yes-display-inline">any unique licensing issues or requirements relating to the matters described in subparagraphs (A) through (C) of paragraph (1), including, with respect to the nonelectric applications referred to in subparagraphs (A) and (B) of that paragraph, any licensing issues or requirements relating to the use of nuclear energy—</text><clause id="H10F867727CD64AC8B464524EF0FEE8E1"><enum>(i)</enum><text>for hydrogen or other liquid and gaseous fuel or chemical production;</text></clause><clause id="H14E6B8CF29E24A02BB73B4F3A52D068C"><enum>(ii)</enum><text display-inline="yes-display-inline">for water desalination and wastewater treatment;</text></clause><clause id="H408B0A1566A848ED9141F4D6FAA39049"><enum>(iii)</enum><text display-inline="yes-display-inline">for heat used in industrial processes;</text></clause><clause id="H61E97B29D5174238B0AA5CAFD72081C5"><enum>(iv)</enum><text display-inline="yes-display-inline">for district heating;</text></clause><clause id="H7E001A5E968249E0BA7A8C51B24A6859" commented="no"><enum>(v)</enum><text>in relation to energy storage;</text></clause><clause id="H46A898230E7E455E9D8F1118D0411A3F"><enum>(vi)</enum><text display-inline="yes-display-inline">for industrial or medical isotope production; and</text></clause><clause id="HF0C32149825D4E09855519537C1D3638"><enum>(vii)</enum><text>other applications, as identified by the Commission;</text></clause></subparagraph><subparagraph id="HB4D9B681330040B5B39122BCE2C1BCBF"><enum>(B)</enum><text>options for addressing such issues or requirements—</text><clause id="H308B67EDD7CF40C49D0CA15C0105B827"><enum>(i)</enum><text>within the existing regulatory framework;</text></clause><clause id="HF25E24D39E64465B9AD278DE334CBDE9"><enum>(ii)</enum><text>through the technology-inclusive, regulatory framework to be established under section 103(a)(4)(A) of the Nuclear Energy Innovation and Modernization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/115/439">Public Law 115–439</external-xref>); or</text></clause><clause id="HF29E79B862FA4D4EBA53BCCE9BDA447F" commented="no"><enum>(iii)</enum><text>through a new rulemaking;</text></clause></subparagraph><subparagraph id="H11452B005CD143DFB9BC5B3ED588C3B0"><enum>(C)</enum><text>the extent to which Commission action is needed to implement any matter described in the report; and</text></subparagraph><subparagraph id="H4F161552F2564BF0961520DDAEA5EAB2"><enum>(d)</enum><header>Report on advanced methods of manufacturing and construction for nuclear energy projects</header><paragraph id="H7A228B1B58864233834ACA4C972BCB5E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Nuclear Regulatory Commission (in this subsection referred to as the <quote>Commission</quote>) shall submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a report on advanced methods of manufacturing and construction for nuclear energy projects.</text></paragraph><paragraph id="H58AD1BC632304B7BB6B84F5F582ECD8D"><enum>(2)</enum><header>Stakeholder input</header><text display-inline="yes-display-inline">In developing the report under paragraph (1), the Commission shall seek input from—</text><subparagraph id="H8339A7115DE94F49BD16DC84C5EEC764"><enum>(A)</enum><text>the Secretary of Energy;</text></subparagraph><subparagraph id="H9C2B1AD7CB9041AD9A86D499C5A5C6FE"><enum>(B)</enum><text>the nuclear energy industry;</text></subparagraph><subparagraph id="HC47A091E75D8450498F4C5D1805E2728"><enum>(C)</enum><text>the National Laboratories;</text></subparagraph><subparagraph id="HC12E32E141DB45439BAACB33427BB131"><enum>(D)</enum><text>institutions of higher education;</text></subparagraph><subparagraph id="H5545E2DFD9D14F55A74E20073582A8F1" commented="no"><enum>(E)</enum><text>nuclear and manufacturing technology developers;</text></subparagraph><subparagraph id="H2417B821A8194D61A1709B76E03C3E0B"><enum>(F)</enum><text>the manufacturing and construction industries;</text></subparagraph><subparagraph id="HF4D490018F5746B1891020A0D980A054"><enum>(G)</enum><text>standards development organizations;</text></subparagraph><subparagraph id="H2DDBBDC0FE8549ED88FF5974D1777FD4"><enum>(H)</enum><text>labor unions;</text></subparagraph><subparagraph id="HC83A4E5FA9C84B39B8586229BFA74154"><enum>(I)</enum><text>nongovernmental organizations; and</text></subparagraph><subparagraph id="H49377008DFEC435EB99D30ACC36F3BA5"><enum>(J)</enum><text>other public stakeholders.</text></subparagraph></paragraph><paragraph id="H89E753A93CF7485DBB3FEAF297F89542" commented="no"><enum>(3)</enum><header>Contents</header><subparagraph id="H49D300EC00804D22B94AD11173578C40" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The report under paragraph (1) shall—</text><clause id="HDBA24D05227C41E3A5BFCF8E3D9F3F74" commented="no"><enum>(i)</enum><text>examine any unique licensing issues or requirements relating to the use, for nuclear energy projects, of—</text><subclause id="HA56BAE5D42B54961A6F0C437A1A41EF0" commented="no"><enum>(I)</enum><text>advanced manufacturing techniques; and</text></subclause><subclause id="H0377816A3496476CAF2952B1C5AF9E3D" commented="no"><enum>(II)</enum><text>advanced construction techniques;</text></subclause></clause><clause display-inline="yes-display-inline">the requirements for nuclear-grade components in manufacturing and construction for nuclear energy projects;</text></subclause><subclause id="H7DE96B9BFFD04A2C9058662EEB7C66DB" commented="no"><enum>(II)</enum><text>opportunities to use standard materials, parts, or components in manufacturing and construction for nuclear energy applications; and</text></subclause><subclause id="H4157275E04014E889816D0D0BE815787" commented="no"><enum>(III)</enum><text>opportunities to use standard materials that are in compliance with existing codes and standards to provide acceptable approaches to support or encapsulate new materials that do not yet have applicable codes or standards; </text></subclause></clause><clause id="H2C52B1BBAA314333BA50D0C5492977B8" commented="no"><enum>(iii)</enum><text>identify safety aspects of advanced manufacturing processes and advanced construction techniques that are not addressed by existing codes and standards, so that generic guidance for nuclear energy projects may be updated or created as necessary by the Commission; </text></clause><clause id="HB81275F898EF4EB5B16E4BD4BDE70C32" commented="no"><enum>(iv)</enum><text>identify options for addressing the issues, requirements, and opportunities examined under clauses (i) and (ii)—</text><subclause id="HD1C27BADD2914BBDBE7A50B50C10DE5C" commented="no"><enum>(I)</enum><text>within the existing regulatory framework; or</text></subclause><subclause id="H1E518CE85BE04F85B0CD9983576BE6E8" commented="no"><enum>(II)</enum><text>through a new rulemaking; and</text></subclause></clause><clause id="H57200DC2EBC74C0DAFE5236FD9D156FE" commented="no"><enum>(v)</enum><text>describe the extent to which Commission action is needed to implement any matter described in the report.</text></clause></subparagraph><subparagraph
